1. This is the day and ti~ for the Public Hearing to consider a
Variance request to the front yard setback require..nts (20
ft. requested, 30 ft. required) for the construction of eight
single fa.ily ho..s on the north side of Van Tassel Dr. and
the east side of Meal Ave., Lots 1-8, Oak Glen 13th Addition
in the RA, Single pa.ily Residential Dist., David Johnson,
Applicant. Case Mo. V/91-39.
Motice of the hearing was published in the Courier on
Auqust 15, 1991 and ..i1ed to affected property owners.
Mr. Russell explained that the reason for the request is
because of a high perched water table. Planning Co..ission
Chair..n Pontaine stated thet the Co..ission approved the
request with three conditions. Condition Mo. 1 states that
Lots 1 and 3 shall have front and corner sideyard setbacks of
thirty feet. The applicant, David Johnson, requested that
Lots 1 and 3 be allowed the variance also. The variance will
be used only if it is deter.ined to be necessary after
digging beC)ins.

Bodlovick to approve the variance request with two conditions,
and eli.inate Condition No. 1 requiring Lots 1 and 3 to have 30-
