Present: Councilmembers Bodlovick, Farrell, Funke, Opheim (arrived at 4:40 p.m.), and Kayor Abrahamson Absent: None Also Present: City Coordinator Kriesel City Attorney Magnuson Community Dev. Dir. Russell Finance Director Deblon Consulting Engineer Moore Recording Secretary Schaubach Press: Julie Kink, The Courier Mike Karsnik, Stillwater Gazette Others: Tom Hay, Dave Johnson, Ron Langness, Tim Schmolke DISCUSSION OF OAK GLEN FINANCING r Council met with Consulting Attorney Tom Hay, Oak Glen Developer Dave Johnson, and Bond Consultant Ron Langness to discuss new legislation which allows the City to issue bonds to finance the payment of any delinquent taxes and assessments on Oak Glen real estate. The City would then pay the delinquent taxes, penalties and interest, which would allow the developer to complete the sales of the unsold lots. The existing assessments would be cancelled and the lots would be reassessed. Mr. Langness stated that the amount that would be borrowed is approximately $527,865. (All in DISCUSSION OF VOLUME BASED FEES AND OTHER SOLID WASTE MATTERS r Mayor Abrahamson informed the Council that the City's waste hauler has requested an executive session with the City Council. City Attorney Magnuson advised that under the statute, there are no grounds for an executive session with Mr. Junker. Council directed Mr. Magnuson to contact Mr. Junker to explain the ruling to him. Council discussed Mr. Junker's contention that not all properties in the City are being billed for trash collection. Council discussed a Volume Based Fee program as proposed by the Solid Waste Committee. (Ayes - 3; Nays - 2, Councilmember Funke and Mayor Abrahamson) ITEMS RELATING TO DOWNTOWN PLAN IMPROVEMENT. L.I. 257 Motion by Councilmember Farrell, seconded by Councilmember Funke to direct Consulting Engineer Moore to prepare a letter for the Mayor's signature approving the request by Mn/DOT to close High- ways 95 and 96 with a detour on Myrtle and Owens from June 3 to 17, 1991. (All in favor) r Motion by Councilmember Funke, seconded by Councilmember Bodlovick to approve the request to delay construction on Water Street between Main and Nelson until after Lumberjack Days. (All in favor) Motion by Councilmember Funke, seconded by Councilmember Bodlovick to install fire services up to the outside wall of all buildings with the option to continue installation inside the building at the owner's expense. (All in favor) Motion by Councilmember Opheim, seconded by Councilmember Bodlovick to adopt the appropriate Resolution requesting a variance to MSA 169-104 and 169-106 for West Myrtle Street from Main Street to Third Street; and North Second Street from Chest- nut Street to Mulberry Street as they relate to Downtown Plan improvements. (Resolution No. 91-101) Ayes - Councilmembers Bodlovick, Farrell, Funke, Opheim, and Mayor Abrahamson Nays - None Motion by Councilmember Opheim, seconded by Councilmember Bodlovick to adopt the appropriate Resolution to defend and indemnify the State of Minnesota in regard to reconstruction of MSA 104 (Myrtle Street). (Resolution No. 91-102) r Ayes - Councilmembers Bodlovick, Farrell, Funke, Opheim, and Mayor Abrahamson Nays - None Motion by Councilmember Opheim, seconded by Councilmember Funke to adopt the appropriate Resolution to defend and indemnify the 2 r. stillwater City Council Minutes Special Meeting May 28, 1991 State of Minnesota in regard to reconstruction of MSA 105 (Second Street).
