01:29:20 Mike R: Our street (Edgewood) has been dug up many times to repair
water main breaks. Have all of the original waterlines been replaced? If not, isn't
there a chance that the street will be dug up again in the near future to repair
future breaks?
01:31:18 Mark: Yes to what Tony said about speeds. And many folks do not
stop at 4‐way stop signs at Interlachen and Maryknoll.
01:36:22 Galaxy S10e: With so many people out walking, more so than ever,
there should be more sidewalks. Walking on Maryknoll with a stroller feels very
dangerous with the kind of traffic on it since the intersection opened at 12.
01:49:08 JACK RIDER: Very pleased that Reabar's presentation included fixing
those sidewalks that are raised up 2‐3 inches on Maryknoll near Bayberry, making it
dangerous to walkers, esp seniors.

road to get to our house from Manning to Mid Oaks Ave N. It's one of the reasons

residents are the speeders. You have no way of knowing that.

Maryknoll Drive
•Constructed in 1969.
•Existing pavement section ranges between 4”-5.5” asphalt and about
7” gravel.
•The street is constructed to 32 feet wide, has concrete curb & gutter,
and storm sewer system.
•In 1996 the portion north of Interlachen Dr. was improved by milling
and onsite cold recycling rehabilitation process.
•Propose to remove existing curb and gutter and reclaim asphalt and
regrade for at least 6 inches of base.
•Install concrete curb and gutter and 4 inches of asphalt.
•Repair and replace catch basins and sanitary manholes where needed.
•Extra storm sewer pipes and catch basins would be added from the
intersection with Interlachen Dr. to the existing storm sewer on
Maryknoll Dr.
•Repair damaged sidewalk.
•Upgrade Pedestrian ramps to ADA standards.
Street Reconstruction
Mid Oak Avenue North
•Constructed in 1974.
•The street was seal coated in 1999.
•Existing street is 24 feet rural section with ditches on both
sides and no curb and gutter. Soil boring shows 6” of
asphalt pavement and no gravel.
•Propose reclaim asphalt and use for base and add 4 inches
of asphalt.
•Clean and repair ditches on both sides.
•The low area in the street would be raised ½ foot to avoid
flooding during high rain events.
Partial Reconstruction
Eagle Ridge Trail Area.
•Constructed between 1981 and 1985.
•In 2008 these streets were seal coated.
•Streets have concrete curb and gutter, and storm sewer.
•Pavement section consists of 4” gravel and 3”-4.5” asphalt.
•Propose reclaim full pavement section and regrade for base
and add 4” of pavement.
•Repair damaged curb and gutter.
•Remove and replace existing undersized catch basin inlets
with larger ones.
•Repair sanitary sewer manholes as needed.

storm sewer, and sidewalk on some of the streets.
•Pavement section consist of 6” gravel and 4” asphalt.
•Propose mill top 1.5” of pavement and overlay with new
1.5” of pavement.
•Repair curbs, sidewalks, catch basins and manholes.
•Upgrade pedestrian ramps to ADA standards.
•Construct 8 feet wide trail on west side of Autumn Way as
part of Safe Route to School Program.

storm sewer, and 8 ft. trail along Creekside Crossing and
Eagle Ridge Trail.

1.5” of pavement.
•Repair curbs, catch basins and manholes.
•Upgrade pedestrian ramps to ADA standards.

Dear Mr. McCarty:
The Metropolitan Airports Commission (MAC) invites the City of Stillwater to participate as a member of a
newly formed Lake Elmo Airport Advisory Commission (“Commission”). This Commission will support the
ongoing efforts to engage the stakeholders of the Lake Elmo Airport community.
This Commission will provide an open and balanced forum for strengthening relationships between MAC,
airport users, stakeholders and the community. The proposed membership consists of representatives from
surrounding cities, townships, Washington County, airport businesses, pilots and the Experimental Aircraft
Association. The role of the Committee will be to participate in discussions about matters concerning the
Lake Elmo Airport as well as share information with their respective communities about the Airport. The first
meeting is anticipated to held during the second quarter of 2021, with quarterly meetings the remainder of
the year. If necessary, virtual meetings will be held due to the health pandemic to be consistent with
Governor Walz's directives. Attached are two documents providing more information about the Commission:
1)proposed draft bylaws; and 2) draft annual work plan.
We invite the City of Stillwater to appoint a primary representative and an alternate to serve on this

Lily Lake Association Strategic Visioning
Mike Lyner, president of the Lily Lake Association, shared a pr oposal to form a vision for the
future use of Lily Lake and surrounding land, and recreate Lily Lake’s past significance as a
city-wide amenity. He requested the City’s formal blessing to continue with the process.
Councilmember Collins commended the Association for the work that has occurred so far.
Councilmember Polehna also voiced support for the initiative. He would not support
opening up the beach again, but would support making the shore more accessible.
Mayor Kozlowski recalled the unfortunate incidents that happened in regard to amoeba that
was in the lake, and resulting litigation that forced the City to consider the closing of the
beach. He would like to reconsider opening the beach and especially would like to know the
legalities and science behind the closure of the beach.
Mr. Lyner stated he would not want to completely dismiss opening the beach again, but
would like to move ahead with a vision for the lake’s future so visitors may still enjoy the
lake. The group is thinking of renaming the association because it is not a homeowner’s
association for shoreline owners – it is a group of friends who really care about the lake.
Commissioner Junker applauded the Association for its hard work. He would love to see Lily
Lake again become a focal point of Stillwater and open the beach for swimming and
activities.
Mayor Kozlowski suggested that a representative from the Association attend the Parks
Commission meetings.

Councilmember Polehna suggested assigning Councilmember Collins as Council
representative on the group, adding that City staff will need to look at their workload in
respect to staff time required.
Mr. Lyner pointed out that those with strong feelings about certain ideas are encouraged to
discuss them in order to reach consensus.
Barb Bickford, Bickford Collaboration LLC, added that the process is called convergent
facilitation, which is designed to encourage everyone to keep working on ideas and refining
them.
Councilmember Odebrecht applauded the effort and stated he is e xcited to see where it goes.
Council consensus was to move forward and direct the group to work with the Parks
Commission.
Planning Division Work Plan 2021-2024
Community Development Director Turnblad explained that COVID-19 slowed the Planning
Department’s 2020 work plan, but progress was made on many projects. 2021 projects may
experience some delays, as a new Community Development Director comes when he retires
in June. He presented an overview of completed projects, projects in process, and 2021
projects, and encouraged the Council to provide feedback.
Sign Ordinance Discussion
Mr. Turnblad next explained that the sign regulations found in the Zoning Chapter of the
City Code are in need of revision for several reasons. First, US Supreme Court cases over the
years have refined first amendment free speech law as it applies to signage and those
refinements need to be reflected in the sign regulations. Second, institutional signage has
largely been ignored by the City Code and needs to be addressed. And third, digital signage
has been requested by a few businesses. Staff has re-organized the sign code so it flows more
logically and is more understandable. The Planning Commission held a public hearing on
the proposed ordinance amendment on February 26 and recommended approval. However
on December 15, 2020, a City Council vote to approve the first reading of the amended
ordinance failed. There appeared to be support to: 1) update the Code to reflect current law;
2) create consistency in institutional sign standards; and 3) add a table showing what
signage is allowed in each zoning district. What could not gain consensus was whether or
where digital signage should be allowed. Staff requests the Council discuss digital signage
and give staff direction on whether digital signage should be allowed, and if so, where.
Mayor Kozlowski suggested the ordinance could distinguish between text-only digital signs
versus those with images.
Mr. Turnblad replied the ordinance could have a separate category for scrolling text only.
However, the industry is moving away from that, toward fully programmable digital media.
Mayor Kozlowski stated the main problem seems to be addressing signage for multi-tenant
properties that have limited physical sign space. He wondered if it makes sense to look at
allowing for a larger sign area throughout the commercial business district, and allowing
digital signage to comprise 50% for multi-tenant buildings and 25% for other businesses.
Mr. Turnblad replied that could be done as long as like properties are treated similarly.

Mayor Kozlowski stated what was frustrating with the last sign ordinance is that there was
no alternative route if technology changes. He asked if there is a way to allow for variances
in the future so that when technology changes, the City need not rewrite the ordinance; and
Mr. Turnblad responded that the ordinance can be changed as needed without doing a
massive overhaul. Typically, variances may only be applied to measurable things, not
something that is subjective.
City Attorney Land clarified that if someone wants to make a sign bigger than the ordinance
allows, they may always apply for a variance. They may also improve, replace or repair an
existing sign without applying to the City, they just cannot expand the signage.
Councilmember Junker commented he would like to explore expanding digital signage
particularly on the Highway 36 corridor and on multi-tenant buildings. Valley Ridge Mall
initially brought this issue up eight years ago.
Mayor Kozlowski asked if the Council would be open to allowing 50% digital signage on
multi-tenant buildings throughout the business commercial district and 25% for the rest.
Councilmember Junker stated multi-tenant needs to be defined.
Councilmember Odebrecht stated he finds a lot of digital signage to be ugly and distracting
especially for drivers. He is concerned that if the ordinance is not carefully crafted, anybody
who wants to improve an existing sign may make it digital.
Ms. Land explained that for legal nonconforming uses, i.e. billboard signs, they can be
repaired, replaced or improved, including making it digital, but not expanded. For legal
conforming signs, the City can put parameters around what can be done and where they
may be placed in that district. If there is nothing on the book s about digital signage, as it now
stands, a sign owner may go ahead and say it is an improvement. Once it is on the books,
then they have to follow the rules.
Councilmember Collins remarked that he too dislikes digital signs and views them as
billboards. They are not appropriate in Stillwater.
Councilmember Polehna stated he is nervous about having giant billboards on the highway.
But he also knows that Valley Ridge Mall needs something to indicate the businesses.
Councilmember Junker noted that the sign at Valley Ridge Mall has only 3-4 banner spots to
accommodate 25-30 tenants. The Mall is trying to give a little more visibility to some of the
multi-tenant spaces, but is not asking for a gigantic digital sign.
Mr. Turnblad pointed out that the absolute max size that the digital portion of the sign can
be is 50 square feet or 50% of the total freestanding monument sign. A freestanding
monument sign may be no larger than 100 square feet.
Mayor Kozlowski stated that in the expanded area, digital could be capped at 25% of
available signage. Only a limited number of businesses would apply for it. The main problem
the Council is trying to solve is Valley Ridge Mall. He would like to reach out to the whole
group of tenants at Valley Ridge Mall and get their input to ask if this would solve their
problem. He also would like to allow the sign at the Rec Center to be turned back on.
Councilmember Odebrecht empathized with the businesses and added that Acapulco has
done a lot for the community. First and foremost is protecting the beauty of the City.

Mr. Turnblad agreed to bring back a slightly revised version with digital signage language
as discussed. Mayor Kozlowski will check with Valley Ridge Mall to ask if this solves their
problem. The amendment will then be scheduled for a public hearing.
STAFF REPORTS
Public Works Director Sanders stated that discussions with the Dock Café about the
Riverbank Restoration and Riverwalk project will result in moving the trail back to its
original location closer to the river. It is hoped the project may still be done by March 2022.
Because of some of the constrictions on the project, the tree removals will be done by March
15. He reported that the Lowell Park restrooms are now heated and open until 8 p.m. every
day. Jason Grode, the new Parks Superintendent, will begin February 22.
Fire Chief Glaser informed the Council that personnel rescued a deer out of South Twin Lake.
There was a chemical incident at Stillwater Mills necessitating evacuation. There were no
injuries. Fire Department COVID vaccines are complete. There are three new paid on-call
firefighters with more coming soon to replace retiring personnel.
City Clerk Wolf stated Boards and Commissions training took place on January 28.
City Attorney Land noted the upcoming Council Training session February 4.
City Administrator McCarty reported that staff has met with Curling Center representatives
and will bring back a formal proposal for the Council to review in another month. The City
Hall boiler replacement project is half done. An Economic Development analysis is being
done by Dr. Craig Waldren to be presented to the Council in April. The Ameresco Energy
Project has begun and bids are going out to local lending institutions.
Library Director Troendle stated that telescope kits are now available for check-out. A
community survey is being conducted regarding the library’s event wing.

NEW BUSINESS
Washington County’s State Funding Support Request for CSAH 5/Brown’s Creek Trail
Connection Project
City Administrator McCarty reported that Washington County is seeking $3 million in state
funding to construct a trailhead and trail connections from County State Aid Highway
(CSAH) 5 (Stonebridge Trail) to the Browns Creek State Trail. The total cost of the
improvements is estimated to be $7 million. It is expected that the County and City will
provide $4 million, with the remaining $3 million from state funds.
Mayor Kozlowski thanked Commissioner Kriesel and Washington County staff for their
collaboration.
Washington County Commissioner Kriesel emphasized the importance of the project, which
is one of the County’s top legislative requests. He also voiced appreciation for City support
in the Manning Avenue interchange funding request.
Motion by Councilmember Polehna, seconded by Councilmember Junker, to adopt Resolution
2021‐022, Resolution Supporting Washington County State Funding Request for CSAH 5 and
Browns Creek Trail Connection Project. All in favor.
2021 Street Improvement Project Feasibility Report
Assistant Public Works Director Abdullah presented the feasibility report. There are 4.66
miles of streets proposed for improvements: 3.4 miles of mill and overlay, 0.51 miles of
partial pavement reconstruction, and 0.75 miles of full pavement reconstruction. The total
estimated cost is $2,137,189. Funding will be through assessments and permanent
improvement bonds. A few properties were appraised at random to compare the estimated
assessment to the appraised benefit. Since the project is cost-effective and feasible from an
engineering standpoint, it is recommended that Council accept the feasibility report and
order a public hearing to be held on February 16, 2021. Construction would occur May-
October 2021.

Resolution 2021‐023, Resolution Receiving Report and Calling Hearing on 2021 Street Project

Tax Abatement/TIF Committee for Lakeview Hospital Development
Community Development Director Turnblad stated that a Tax Abatement Committee was
formed for the purposes of conducting background work and formulating a
recommendation for the Central Commons tax abatement request. Subsequently, the need
has arisen for consideration of tax abatement and/or TIF aspects of the Lakeview Hospital
development site. The Council is asked to consider extending the responsibilities of the
committee to include review and recommendations for the Lakeview Hospital site.
Council consensus was that the Tax Abatement Committee’s responsibilities should include
review and recommendations for the Lakeview Hospital site.

Covid-19 Refund of Liquor License Fees
City Clerk Wolf reminded the Council that in May 2020, the Council provided a partial refund
of fees to businesses with an on-sale liquor license, due to the closure of businesses as a
result of the COVID-19 Pandemic. In November 2020, businesses were once again required
to close due to the Pandemic and on-sale liquor businesses were unable to fully use their
liquor license from November 21 through January 11, 2021 (a total of 7 weeks). Refunding
either one month or two months of liquor license fees is proposed.
Motion by Councilmember Collins, seconded by Councilmember Odebrecht, to approve the
refund of two months of liquor license fees. All in favor.
Accounting Specialist Position Change Request
Finance Director Provos explained that the Accounting Specialist position does Utility
Billing and is a back-up for the Payroll and Accounts Payable functions within the Finance
Department. Both functions are experiencing increases due to Water Department
integration. With the current vacancy in the Assistant Finance Director position, the
Accounting Specialist position will perform some of those job duties until the vacancy is
filled. This position will also assist with the integration of the Water Department billing into
the City’s utility billing software. Therefore the 0.75 FTE Accounting Specialist is being
requested to change to a 1.0 FTE Accounting Specialist as of February 7, 2021. The
additional 2021 position cost (1.0 FTE) would be $17,536.

Staff recommends approval contingent upon the satisfactory investigation, inspections, and

Health and Environment and Minnesota Alcohol Gambling Enforcement Division (AGED).
It should be noted that AGED approval is the last approval required before staff issues the
license to the establishment.

and for an additional trash container according to the 2021 fee schedule.

STILLWATER FARMER’S MARKET
2021 AGREEMENT
THIS AGREEMENT made this 16th day of February 2021 between the CITY OF STILLWATER,
Washington County, Minnesota (“City”) and STILLWATER FARMER’S MARKET ASSOCIATION, c/o Beverly
Friendt, its President, 3503 Long Lake Road E, Pine Springs, MN 55115 (“Farmer’s Market”).
1. Location. The City of Stillwater has authorized the Farmer’s Market to use the parking lot located
on the corner of Third and Pine Street for the purpose of conducting a farmer’s market where
vendors will offer agricultural goods and related merchandise for sale to the public. Substantial
changes in the layout/format/duration of the Event will not be made by the Organizer at any time
without advanced notice to the City.
2. Dates and Hours of Event. Operations are limited as follows:
a. Saturdays, June 12 through October 30 of the year 2021
b. Set-up begins at 6:30 a.m.
c. Event Time: 7:30 a.m. – 12:00 p.m. (Noon)
d. Clean-up finished by 12:30 p.m.
3. Insurance, Hold Harmless, and Indemnity. Organizer agrees to indemnify and hold harmless the
City with regard to any claims, causes of action or demands that might be brought against the City
arising out of the events authorized by this Agreement; and further, Organizer agrees to provide to
the City evidence of insurance coverage of at least the amount of the maximum liability of the city
as set forth from time to time in Minnesota Statutes Section §466.04, covering claims that might
be brought against them that arise out of the events authorized by this Agreement and to name the
City as an additional insured on their policy “as their interest may appear” by no later than three
(3) weeks before the event.
4. Signs. Market signage must be approved by the Community Development Director including the
size and location of signs and banners.
5. Parking Lots. Organizer is aware and will inform all vendors and event participants that staking
into the asphalt, etc. is not allowed (any damage repair will be paid for by the organizer).
6. Portable Toilets/Trash Container. The City will provide a toilet for use of vendors and patrons
throughout the period of their use. The portable toilet will be located in the upper parking lot on
Fourth Street. The Farmer’s Market shall reimburse the City for an extra trash container and one–
third (1/3) of the seasonal costs of the portable restroom, which is due three (3) weeks before the
start of the events.
7. Term. The term of this Agreement will be for one year unless terminated earlier by the City on
public safety grounds.
8. The Application for the Event as submitted by the Organizer is considered part of this Contract
and any representations of the Organizer or conditions imposed by the City are restated as if fully
set forth in this Agreement.

BACKGROUND
The City of Stillwater and LELS Local 257 Police Patrol Officers have concluded negotiations for a successor
labor agreement for 2021 and 2022 and the LELS Local 257 Police Patrol Officers membership has voted to
approve the agreement. Changes in the contract language include:
• Contract Duration -2 year agreement, January 1, 2021 through December 31, 2022
• Wages -General Wage Increase: 2.0% increase effective January 1, 2021; 2.0% increase effective
January 1, 2022
• Health Insurance -Employer contribution to $1,246.86 per month per member toward group health
insurance effective January 1, 2021, and increase employer contribution to $1,261.86 per month per
member toward group health insurance effective January 1, 2022
• Vacation-On an annual basis, employees may voluntarily elect to cash-out up to 40 hours of vacation.
The written election is irrevocable in nature and must be made on or before December 15 in the calendar
year prior to the cash-out taking place
• Field Training Officer: Employees assigned by the employer as a Field Training Officer will be paid an
additional 1.5 hours of pay at the regular rate of pay for each 12-hour shift worked as an FTO and 1.0
hour of pay at the regular rate of pay for each 8-hour shift worked as an FTO. This provision replaces
all previous agreements regarding FTO compensation. The new provision averages $3,360 in annual
additional FTO wages compared to previous compensation time earned and allocated.

RECOMMENDATION
The proposed Labor Agreement between the City of Stillwater and LELS Local 257 Police Patrol Officers is
consistent with direction from City Council for labor negotiations. LELS Local 257 Police Patrol Officers
membership has approved the 2021-2022 labor agreement. Increased contract costs are included in the proposed
2021 budget. Therefore, staff recommends adoption of the resolution entitled "Approving the 2021-2022 Labor

DISCUSSION
The public hearing for the 2021 Street Improvement Project is scheduled for Tuesday, February
16th at 7:00 pm. Attached is a copy of the feasibility report, the public hearing notice sent to the

RECOMMENDATION
It is recommended that Council hold the required public hearing. If desired, Council should pass
a resolution ordering the improvement and directing the engineer to prepare plans and
specifications. It should be noted that the resolution to order the improvement requires a 4;5ths

INTRODUCTION
In October of 2020, Council authorized a feasibility study for the 2021 Street Improvement Project.
The streets selected in the study are based on the condition of the road that gave a condition index to
guide us on the type of work that should be performed. Streets included in this study for 2021 include:

Lane, and 72nd Street N were initially included in the study but were removed from the
project because of budget restrictions and will be considered in 2022.
In all, there are 4.66 miles of streets proposed for improvements, 3.4 miles of mill and overlay, 0.51
miles of partial pavement reconstruction, and 0.75 miles of full pavement reconstruction.
EXISTING CONDITIONS:
Eagle Ridge Trail Area
This area includes Eagle Ridge Circle, Eagle Ridge Court, Eagle Ridge Crescent, Lecuyer
Drive, Lecuyer Circle, Lecuyer Court, and Thorene Place; these streets were constructed
between 1981 and 1985. The streets were constructed 32 feet wide, with 3 inches of
bituminous, 4 inches of gravel base, concrete curb and gutter, and storm sewer systems. The
City seal coated these streets in 2008 and did some preventative maintenance pothole
repairs. Alligator cracking and deep potholes exist on these street sections today. Soil
borings show pavement thickness in the range of 3 to 4.5 inches and about 4 inches of
gravel. The Water Department has indicated that there are no problems with the water mains
nor the services. Public works staff televised sewer and storm sewer systems, no significant
repairs are needed.
Maryknoll Drive
This road was constructed in 1969 and is 32 feet wide with a concrete curb and gutter. The
storm sewer system was built with the street but not adequate to handle the storm runoff.
The section from Interlachen Drive to Bayberry was improved in 1996 by milling and onsite
cold recycling rehabilitation process. No improvements were made to the section south of
Interlachen Drive. Alligator cracking and pothole patches exist on the street, and large
portions of the concrete curb and gutter are damaged. Soil borings show that the pavement
thickness is in the range of 3 inches and about 8 inches of gravel. The Water Department has
indicated that there are no problems with the water mains nor the services. City staff
televised the sewer system, and no significant repairs are needed.
Mid Oaks Avenue North
City records show this road was constructed in 1974 and was seal coated in 1999. The road
is built to 24 feet wide with no curb and gutter and has ditches on both sides. Soil borings
show about 6 inches of pavement and no gravel. The road is in bad condition, with alligator
cracking and pothole patches. The ditches are in good shape; however, they need cleaning in
some areas.
Interlachen and Croixwood area
The study area includes Bayberry Avenue (Maryknoll Drive S to Haw Thorn Lane),
Interlachen Drive (Bayberry Avenue to 72nd Street N), Pineridge Lane, Northland Avenue
(Interlachen Drive to Hawthorne Lane), Edgewood Avenue, Edgewood Court, Fairlawn
Drive, Tamarack Court, Interlachen Court, Cottonwood Court, Autumn Way, and
Nightingale Boulevard. These streets were constructed in the early 1970s. In the mid-1990s,
the City did 1.5 inches of mill and overlay on these streets, Interlachen Drive east of
Maryknoll Drive was constructed in 1997. These streets are 32 feet wide, with 4 inches of
pavement, 6 inches of gravel base, concrete curb and gutter, a storm sewer network, and a
sidewalk on one or both sides of some streets. Some storm sewer inlets are small and
undersized to handle the amount of storm runoff in the streets. Some sections of the
sidewalk and curb, and gutter are damaged. These streets are structurally in good condition,
but the pavement surface has cracks and needs pothole repairs.
Creekside Crossing area
The study area includes Creekside Crossing, Creekside Circle, Creekside Court, and Eagle
Ridge Trail (Creekside Crossing to Neal Avenue). The streets in this area were constructed
in 1998, and they are 32 feet wide with 4 inches of pavement and 6 inches of gravel base.
The streets are constructed with concrete curb and gutter, storm, and sanitary sewer systems.
There is cracking at the pavement's surface with potholes. The base is structurally sound
however, some portions of the curb & gutter are damaged, and the trail has several potholes
and cracks that need repair.
PROPOSED PROJECT:
Street Reconstruction
Maryknoll Drive would have the existing curb and gutter removed and the bituminous
reclaimed by mixing with the current base course to create a new base course for the street;
The Street would be tested for any bad spots. New concrete curb and gutter will be installed;
Eagle the road would have two layers of pavement, a 2.5-inch base course, and a 1.5-inch
wear course. Deteriorated catch basins, sidewalk sections, and manholes would be repaired
or replaced, and all sidewalks would have pedestrian ramps added at the street intersections
to meet ADA requirements. Extra storm sewer pipes and catch basins would be added from
the intersection of Maryknoll Drive and Interlachen Drive to connect to the existing storm
sewer system on Maryknoll Drive.
Mid Oaks Avenue North would have the existing pavement reclaimed, graded to be used as
a new, 6-inch base course for the road. The road would have 4-inches of pavement laid in
two layers; a 2.5-inch base course and a 1.5-inch wear course. The ditches along the road
would be cleaned and reseeded if necessary.
Partial Reconstruction
Eagle Ridge Cir., Eagle Ridge Ct., Eagle Ridge Crescent, Lecuyer Dr., Lecuyer Cir., Lecuyer
Ct., and Thorene Pl would have the full section of pavement reclaimed. The base would be
regraded, compacted, and tested for weak spots. The street would be repaved with 4 inches of
bituminous. Bad sections of curb and gutter would be replaced along with all intersection
pedestrian ramps to meet ADA requirements.
Mill and Overlay
Bayberry Avenue (Maryknoll Drive N to Hawthorn Lane), Interlachen Way (Bayberry Ave
to Interlachen Drive), Interlachen Drive ( Interlachen Way to 72nd Street N), Northland
Avenue (Interlachen Drive to Hawthorne Lane), Pineridge Lane, Edgewood Avenue,
Edgewood Court, Fairlawn Drive, Eagle Ridge Trail (Creekside Crossing to Neal Avenue),
Creekside Crossing, Creekside Circle, Creekside Court, Autumn Way, Nightingale
Boulevard, Tamarack Court, Interlachen Court, Walnut Creek Drive, and Cottonwood Court
would have the top 1.5-inches of bituminous surface milled and overlaid with 1.5-inches of
bituminous. Bad sections of curb and gutter and sidewalks would be replaced along with all
intersection pedestrian ramps to meet ADA requirements.
PROJECT COST AND FINANCING:
The project's total estimated cost is $2,137,189. This estimate includes design, surveying,
inspection, administration, and contingencies. The project's funding is through two sources;
assessments and permanent improvement bonds.
Pavement reconstruction
According to the City Assessment Policy, street reconstruction projects are assessed 70% to
the benefitting property owner and 30% from City funds. The properties are assessed by the
unit method. Corner lots are assessed 1/2 unit per side improved.
Maryknoll Drive
The estimated cost to construct Maryknoll Drive is $538,000. The estimated assessment amount
for these units is $8,967 per unit. The appraised benefit value to these properties is $9,000.
Mid Oak Avenue North
The estimated cost to construct Mid Oak North is $146,459. The estimated assessment amount
for these units is $9,320 per unit, the appraised benefit value to these properties is $10,000.
Partial Reconstruction
These Streets include Eagle Ridge Cir., Eagle Ridge Ct., Eagle Ridge Crescent, Lecuyer Dr.,
Lecuyer Cir., Lecuyer Ct., and Thorene Pl., the estimated cost to partially reconstruct these
streets is $469,179. Properties are assessed at 70% and by the unit method. The estimated
assessment amount for these units is $5,971 per unit; the appraised benefit value to these
properties is $6,000.
Mill and Overlay
According to the City Assessment Policy, mill and overlay projects are assessed 80% to the
benefitting property owner and 20% from City funds. Mill and overlay streets are split into
two groups;
1. Streets with sidewalk this includes Interlachen Way (Bayberry Ave to Interlachen
Drive), Interlachen Drive (Interlachen Way to Maryknoll Drive), and Northland
Avenue (Interlachen Drive to Hawthorne Lane), the estimated cost of these streets is
$184,514. The estimated assessment amount is $3,012 per unit.
2. Streets without sidewalk This includes Interlachen Drive (Maryknoll Drive to 72nd
Street), Bayberry Avenue (Maryknoll Drive N to Hawthorn Lane), Pineridge Lane,
Edgewood Avenue, Edgewood Court, Fairlawn Drive, Eagle Ridge Trail (Creekside
Crossing to Neal Avenue), Creekside Crossing, Creekside Circle, Creekside Court,
Autumn Way, Nightingale Boulevard, Tamarack Court, Interlachen Court, Walnut
Creek Drive, Cottonwood Court, the estimated cost of these streets is $789,936. The
estimated assessment amount is $2,231 per unit; the appraised benefit value to these
properties is $3,000.
The City hired Nagell Appraisal & Consulting to appraise few properties chosen at random to
compare the estimated assessment to the appraised benefit to the properties included in this study
area.

The feasibility study for the 2021 Street Improvement Project was presented and
approved at the February 2nct , City Council meeting. You are being notified since your
property is included in the project. This is to inform you that the public hearing for the
project will be held on Tuesday, February 16, 2021 at 7:00 pm. You may join the
meeting by logging on to www .zoomgov .com/join or by calling 1-646-828-7666 and
entering meeting id number: 161 843 8759.
An official notice for the public hearing meeting is enclosed. The public hearing is your
opportunity to voice your comments prior to Council making a final decision on whether
to proceed with this project. You may participate by attending and voicing your
comments or by sending a letter to the Council prior to the meeting .
A copy of the feasibility report is enclosed and updates on the project will be available on
the City website on the Engineering Department 's 'Construction Projects' page . There is
also a link where you can register to receive email updates throughout the project.

Notice is hereby given that the City Council of Stillwater, Washington County, Minnesota, will
meet via Zoom at 7:00 p.m. or as soon as possible thereafter, on Tuesday February 16, 2021, to
consider street and utility improvements. Public may participate in the public hearing by logging
into www.zoomgov.com/join or calling 1-646-828-7666 and entering meeting id number: 161
843 8759.
The area proposed to be assessed for such improvement is properties abutting;
Eagle Ridge Circle, Eagle Ridge Court, Eagle Ridge Crescent, Lecuyer Drive, Lecuyer Circle,
Lecuyer Court, Thorene Place, Maryknoll Drive, Mid Oak Avenue North, Bayberry Avenue
(Maryknoll Drive S to Hawthorne Lane), Interlachen Drive (Bayberry Avenue to 72nd Street N),
Pineridge Lane, Northland Avenue (Interlachen Drive to Hawthorne Lane), Edgewood Avenue,
Edgewood Court, Fairlawn Drive, Tamarack Court, Interlachen Court, Cottonwood Court,
Autumn Way, Nightingale Boulevard, Creekside Crossing, Creekside Circle, Creekside Court,
and Eagle Ridge Trail (Creekside Crossing to Neal Avenue).
The estimated cost of the improvements is $2,137,189.00. A reasonable estimate of the impact of
the assessment will be available during the hearing. Such persons as desire to be heard with
reference to the proposed improvement will be heard at this meeting.

SUBJECT: City Code Updates on Assessment Deferrals and Tobacco Sales
On September 15, 2020, City Council adopted a resolution authorizing deferral of special
assessments for senior citizens, disabled or military persons. Since the resolution was
adopted into policy, Stillwater City Code Chapter 56-2 Deferral of Special Assessments for
Senior Citizens, should be repealed as it is no longer current nor necessary.
Also on April 7, 2020 City Council amended Stillwater City Code Section 41-2 Licensing of
Tobacco Sales; Possession and Use. This amendment was done in accordance with the
Federal Food, Drug and Cosmetic Act, raising the minimum age of the sale of any tobacco
product, including cigarettes, cigars and e-cigarette products from 18 to 21 years. Since then,
the Minnesota State Statues revised the penalties on licensees and increased the fine amounts
as well as some minor language regarding compliance checks. Stillwater City
Code should reflect these changes.
Therefore, in an effort to maintain current city code, I am requesting the above two city
code sections be enacted upon.
ACTION REQUIRED:
If Council concurs with staff’s recommendation, council needs to pass a motion approving the
first reading of ordinances repealing City Code Section 56-2 Deferral of Special Assessments
for Senior Citizens and amending City Code Section 41-2 Licensing of Tobacco Sales;

the entire ordinance is available without cost at the office of the City Clerk, the following
summary is approved by the City Council and shall be published in lieu of publishing the
entire ordinance:
In an effort to remove unnecessary ordinances from the City Code, this ordinance
repeals the deferral of special assessments for senior citizens.
SECTION 4. EFFECTIVE DATE. This Ordinance shall be in full force and effect from
and after its passage and publication according to law.

AN ORDINANCE AMENDING STILLWATER CITY CODE SECTION 41‐2
LICENSING OF TOBACCO SALES; POSSESSION AND USE
The City Council of Stillwater, Washington County, Minnesota, does ordain:
SECTION 1. AMENDING. Section 41-2, Subd. 13 (1) of the Stillwater City Code to
hereafter read as follows:
Subd. 10. Compliance checks and inspections. All licensed premises must be open to
inspection by the local law enforcement or other authorized city official during regular
business hours. From time to time, but at least once per year, the city must conduct
compliance checks by engaging persons between the ages of 18 17 and 21 years, to enter
the licensed premise to attempt to purchase tobacco, tobacco products, or tobacco related
devices. Compliance checks using persons under the age of 18 shall obtain parent or
guardian consent. Persons used for the purpose of compliance checks must be supervised
by designated law enforcement officers or other designated city personnel. Persons used
for compliance checks are not guilty of the unlawful purchase or attempted purchase, nor
the unlawful possession of tobacco, tobacco products, or tobacco related devices when the
items are obtained or attempted to be obtained as a part of the compliance check. No
person used in compliance checks may attempt to use a false identification
misrepresenting the person's age, and all persons lawfully engaged in a compliance check
may answer all questions about the person's age asked by the licensee or his or her
employee and shall produce any identification, if any exists, for which he or she is asked.
Nothing in this section prohibits compliance checks authorized by state or federal laws for
educational, research or training purposes, or required for the enforcement of a particular
state or federal law.
SECTION 2. AMENDING. Section 41-2, Subd. 13 (1) of the Stillwater City Code to
hereafter read as follows:
Subd. 13. Penalties.
(1) Licensees. Any licensee found to have violated this section, or whose employee
violates this section, must be charged an administrative fine of $75.00 300.00
for a first violation of this section; $200.00 600.00 for a second offense at the
same licensed premises within a 24 36 month period; and $250.001,000.00 for
a third or subsequent offense at the same location within a 24 36 month period
of the first violation. In addition, after the third offense, the license must be
revokedUpon the third violation, the license will be suspended for at least 7 days
and may be revoked pursuant to a hearing in subd. 12. Funds received by the
city as administrative fines must be kept in a separate fund to offset expenses

associated with the tobacco enforcement program except that no part of these
funds may be used to pay expenses associated with an administrative hearing
officer.
SECTION 3. SAVING. In all other way the Stillwater City Code shall remain in full

SUBJECT: St. Croix Riverbank Stabilization and Riverwalk - Tree Removal Bids
Project 2016-06
DISCUSSION
Proposed construction of the St. Croix Riverbank Stabilization and Riverwalk Project is planned
for later this year. With the presence of the endangered species, tree removals, in the project area
would have to be completed either before March 15 or after November 1. In order to have the
project completed by March 2022, tree removal now is important to meet that goal. Trees, from
south of the Dock to the Shoddy Mill buildings and the near the two overlooks would be
removed.
Staff solicited six contractors to perform the work, with five of those contractor’s submitting
bids. Helke’s Tree Service submitted the low bid in the amount of $53,075.
RECOMMENDATION
Staff recommend that bids for tree removal for the St. Croix Riverbank Stabilization and
Riverwalk be approved and award the work and enter to an agreement with Helke’s Tree in the
amount of $53,075.
ACTION REQUIRED
If Council agrees with the recommendation, they should pass a motion Awarding the Tree
Removal Work and Enter into an Agreement with Helke’s Tree Service for the St. Croix
Riverbank Stabilization and Riverwalk Project (Project 2016-06).
