All in favor, 4-0. NEW BUSINESS 225 Main Street North Food Truck Parking Mitigation Zoning Administrator/Assistant Planner Olson -Williams stated that with the permission of property owner Frank Fabio, Emilio Candia of El Coronel has applied for a permit to operate a food vending truck that would be parked in the parking lot at 225 North Main Street (Maple Island Brewery). The Planning Commission has approved the required seasonal outdoor sales license. Parking mitigation is also required. He added that currently, Mr. Fabio is paying for 18 spaces of mitigation and this would increase it to 19 spaces. Commissioner Hopfe noted the potential for many more food truck requests especially after Chestnut Street closes. Chairwoman Pelletier suggested the City consider capping the number of food trucks allowed before there are too many more requests. The rest of the Commission agreed. Motion by Commissioner Johnson, seconded by Commissioner Lettner, to require mitigation of one additional parking space for 225 Main Street North. All in favor, 4-0. Resolution 2017-96, By -Laws Motion by Commissioner Hopfe, seconded by Commissioner Lettner, to adopt Resolution 2017- 096, a resolution amending Resolution 2009-95, establishing Downtown Parking Commission and By -Laws. Mead states that the show did not provide a parking attendant as promised, and the Co -Op had to use their own staff to direct car show attendees from parking in Lot 8a. Lot 8b has not been used for the car show in the past, but was included this year with Mr. Stone's support. Mr. Stone has now withdrawn his support, and it would be consistent with past practice to no longer allow Lot 8b to be used for this event. eo Item 4.01 i11wati, THE BIRTHPLACE OF MINNESOTA TO: Downtown Parking Commission FROM: Bill Turnblad, Community Development Director DATE: February 9, 2017 RE: Cruisin' on the Croix - Special Event Parking: Revision INTRO Last month Frank Fabio came before the Parking Commission requesting approval of the use of Municipal Parking Lots 4, 5, 9,10 and 11 for Cruisin' on the Croix. Fifteen event dates were desired, the Commission recommended approval of only four of those dates. The City Council heard the Special Event Permit request at their February 7th meeting and agreed with the Commission, that fifteen dates were too many. They approved eight dates beginning June 7th and occurring every other Wednesday through September 6th. However, the Council tabled the question of which municipal parking lots could be used for the event. They were concerned about using Lot 10 again this year, because they received complaints about the general public not being able to use the public lane that connects Mulberry with Laurel Street, and which runs right through Lot 10. In place of Lot 10, Mr Fabio suggested using Lot 8b. Tabling the question of which parking lots would be allowed allowed time for city staff to talk with the manager of River Market Co-op to determine whether he supported the use of Lot 8b. LOT 8B Planning staff spoke with both the River Market Co-op manager, Mead Stone, and with Frank Fabio about use of lot 8b for the eight event dates. Mr. Stone supported the idea, since Mr. Fabio agreed to have a person stationed at the entrance to the lot to keep car show folks out of the River Market lot. This arrangement was used for Hockey Day Minnesota and Mr. Stone was satisfied with it. Parking Lot Reservations So, the lots being requested to be reserved under this revised scenario now include Lots 4, 5, 8b, 9 and 11. This is a total of 186 spaces (an increase over the 159 previously seen by the Parking Commission). The reservation fee of $3 per space per day would be, over the course of eight event dates, a total of $4,464 for 159 spaces ($558/ event date). SPECIAL EVENTS Cruisin' on the Croix - revision Community Development Director Turnblad explained that at its February 7 meeting, the City Council approved 8 dates for the Cruisin' on the Croix car show, beginning June 7 and occurring every other Wednesday through September 6. Commissioner Hopfe pointed out that the car show takes over more than half the downtown spaces on Wednesdays. Frank Fabio, Cruisin' on the Croix organizer, stated he usually runs out of space, so all the requested lots are needed. He feels that Wednesdays are not usually busy downtown, the event generates business and is very popular. Downtown Parking Commission February 16, 2017 Commissioner Glynn pointed out that part of the problem is that the lots have to be blocked off all day. Chairwoman Pelletier said she would like Mr. Fabio to figure out how to keep the lots open during the day, maybe using signs. Mr. Fabio responded that if he could close the lots later in the day, he would, but it's hard to make sure there are no vehicles in the lots by the time the car show starts. Parking Enforcement Officer Pasket said he has not had any complaints about lots being closed off. He added that if a vehicle remains in a lot beyond the stated time, for instance if there is a sign stating the lot must be vacated at a certain hour, he would try to contact the owner. Chairwoman Pelletier suggested the Commission approve the lot reservations now, and later maybe someone will come up with a good solution about how to leave the lots open later in the day. Motion by Chairwoman Pelletier, seconded by Commissioner Anderson, to recommend that the Council approve the use of Lots 4, 5, 9 and 8b for 8 event dates starting June 7 and occurring every other week, with a fee of $3 per space per event date, which would be $3,384. All in favor, 6-0. CONTINUED BUSINESS North Main Hotel - revision Community Development Director Turnblad stated that since the parking mitigation plan for the North Main Street hotel project was approved in December 2016, soils were found to be so poor on the western portion of the proposed site that it is not feasible to construct a parking structure. Therefore, the developer is proposing to eliminate the parking structure and the office building, and to replace both with a 62-space surface parking lot. Currently there are 8 spaces in the city -owned gravel lot plus 17 spaces in the paved area that was constructed under a lease with Arcola Development. Including these 25 public parking spaces, which would be lost by use of the city -owned property to construct the surface lot, a total of 108 parking spaces are required by the hotel project (100 spaces in the off season). Mr. Turnblad explained there would be a 46-space shortage in the summer and a 38-space shortage in the off season. The developer is requesting that those shortages would be mitigated by use of the public parking system at $10 per space per month. He said that according to the developer, hotel guests would mainly use the parking spaces after hours, so the current daytime parkers (Rivertown Commons and Arcola Development) would still be able to use those spaces during the day. Mr. Turnblad recognized that the City is getting close to maxing out can be mitigated. He provided data on parking mitigation totals for the entire downtown system. During the warm season, 16% of the total spots are assigned to mitigation. He said the Commission will discuss this with the Council during the March 7 work session. The proposed venue includes City Lots 5, 9 and 11 and North Lowell Park (north of the gazebo). (See the attached map.) The event is planned to be held on Saturday and Sunday, October 7-8, with setup occurring all day on Friday, October 6th. Clean up will occur Sunday evening. The celebration is planned as a two-part party. The first part, called "Cruisin' to Closure", would take place on the actual closing date, which is Wednesday, August 2, 2017. The second part would be a street polka party and would take place on Saturday, August 12, 2017. Cruisin' to Closure August 2nd would mark the actual closing of the Stillwater Lift Bridge. Sometime between 6 PM and midnight MnDOT plans to permanently close the bridge to traffic by placing barriers on both bridge approaches. The event organizers are still working out details, but the intent of the gathering would be to wait around to witness the actual placement of the barriers and therefore the closing of an era. Festivities would include Cruisin' on the Croix (normally scheduled day for this car show), a Summer Tuesdays presence, a bridge information tent, and a gathering of folks with lawn chairs in the park on either side of the bridge concourse. Street Polka Party On Saturday, August 12th a street dance would take place on Chestnut Street. The closed street would be the dance floor and the band stage would be on the bridge concourse. The dance would occur from 5 PM to 10 PM'. South of the "dance floor" would be the beer garden, vending and porta-potties. As seen on the site plan on the next page, 16 parking spaces in Lot 2 would need to be reserved, as would all of Lots 3 and 4. Lot 4 will be parking for staff, first responders, vendors and the band. PARKING SPACE RESERVATIONS Cruisin' to Closure - On August 2nd, the north 16 spaces of Lot 2 will be reserved for VIP parking, a bridge information booth, and a booth that will sell non-alcoholic beverages. This part of the lot would be barricaded in the morning. Tear down and clean up would occur the same night. If a private entity were organizing the event, the cost of these 16 reserved spaces would be $144 ($9/space/day). 1 Though from 6:00 to 6:30 PM the band will need to take a break to accommodate the wedding ceremony that will take place in the riverside gazebo. Bridge Closing Party July 19, 2017 Page 2 Street Polka Party - For the August 12th street dance the north 16 spaces in Lot 2 would be reserved for the beer garden tent. It would be set up on Friday and taken down on Sunday. In addition, all of the 33 spaces in Lot 3 would be reserved for vendors on Saturday. Lot 4's 29 spaces would be parking for EMS and various event staff (band, vendors, etc.) on Saturday. Site Plan If a private entity were organizing the event, the cost of the reserved spaces would be: a) $432 for Lot 2 ($9/space/day - Fri -Sun) b) $87 for Lot 4 ($3/space/day - Saturday) c) $99 for Lot 3 ($3/space/day - Saturday) d) $51 for Water Street's 17 on -street spaces ($3/space/day - Saturday) The total reservation cost for the Street Polka Party would be $669. For both the polka party and the bridge closing event, the total cost of parking space reservations would normally be $813. He requested four event drop-off spaces on 2"d Street and four event parking spaces on Commercial Avenue. (See Exhibit B) The Parking Commission and City Council only approved two drop off spaces on 2' Street, which would be available to anyone on a first -come -first - served basis. The City also approved the curb cut on Commercial Street to stay in place, which would allow caterers to park temporarily on the sidewalk as they dropped off food. (See attached meeting minutes, Exhibit C, for details.) Parking has been a challenge for the event center for several reasons. One is that drop-off only for catering does not work well, since the caterers have to be present at the center for extended periods of time. Another challenge is that motorists tend to park in the drop-off zone and at the two drop-off spaces on 2nd Street. The consequences of the challenges are parking tickets and blocked access. The event center's solution to the blocked access has been to privately post no -parking signs at the commercial curb cut and to paint the curbs yellow at both locations. Both of these solutions cause concerns for parking enforcement. Mr. Sather has removed the existing loading dock, which will enable the City to complete the Commercial Street pedestrian improvements. Mr. Turnblad added that in each instance where the Council has previously approved this sort of license arrangement, it has cut in half the yearly fee for the reserved parking spaces. Mr. Sather informed the Commission that the event center is scheduled for an early June opening. He further explained he would like to install pedestrian ramps in the curb area of the former loading dock, that would slope up to the doors. He emphasized the caterers need to unload a lot of things, and added that it is costing $5-15,000 to remove the loading dock and rebuild the concrete needed. Chairwoman Pelletier said she felt uncomfortable with the cost of removing the loading dock being a negotiating item, but she feels it is fair to leave the area as offloading area until the City reconstructs the sidewalk. Council Representative Junker acknowledged that consideration is needed to get trucks into the event center, but that the City plan for extension of the pedestrian walkway appears to almost close the block off entirely to parking. He feels something should be done to enable loading and unloading for the event center. Community Development Director Turnblad said perhaps some type of sidewalk could be used that would be colored differently to indicate it is still a loading area. Commissioner Hopfe noted the Commission has denied a number of other business owners who wanted to reserve public parking spaces. Chairwoman Pelletier said she would be open to two 15-minute loading spaces, but is opposed to losing any more public parking. Commissioner Hopfe acknowledged the enforcement of 15-minute spaces is difficult especially on weekends. Parking Enforcement Officer Pasket noted the City has denied other business owners who asked for private parking, because it opens a can of worms. He is not opposed to designating a loading/unloading space but feels putting 15-minute spots on Second Street will not work. Sather Event Venue Page 5 Council Representative Junker emphasized the City is eager to get the pedestrian plaza connection. Community Development Director Turnblad said the plaza development is perhaps three to five years in the future. The development would include 66 rooms, a full service restaurant and a two level parking facility. The Downtown Parking Commission already considered the parking mitigation plan for this project. However, the plans have changed and the Commission must review the project again. PROPOSAL DETAILS In 2016 the project included a 64 room hotel, an office building and a three level parking structure. The 120 space three level parking structure had two accesses on Mulberry Street and one on Second Street. The Mulberry Street access points, each to a separate level, were very close to each other and caused considerable concern to the Mills on Main residents. The plan has changed substantially since then. The hotel itself is essentially the same with 66 rooms and a restaurant, though the coffee shop has been eliminated. But, major changes have occurred for the rest of the project site. The office building has been deleted and the parking facility completely redesigned. The current 101 space parking facility now has two levels. The lower level has one access, which is on Mulberry Street. This level is exclusively for use by hotel and restaurant guests. The second level has its access from Second Street and is a public parking deck. This version of the parking facility was presented to the City Council and found acceptable to them and the neighbors. The Crosby Page 2 PARKING ANALYSIS The number of parking spaces required for this project is now 107 during the high -season and 104 during the off-season when the restaurant patio is closed. The hotel and restaurant require 76 parking spaces during the summer. The other 31 spaces are a replacement of the spaces in Municipal Parking Lots 13 and 14, which would be redeveloped as part of this project. Details of the parking requirements are found below. OPERATION PLAN FOR PARKING FACILITY Elements of the operation plan are: 1) The Crosby would own the ground level parking. 2) The City would own the parking deck. 3) Ground level parking would be exclusively for The Crosby. 4) The parking deck would be for public parking. 5) The Crosby would manage and maintain the public parking deck, and would be allowed to charge local market rates for the public parking. 6) If there are spaces available on the public parking deck after 5 PM and on weekends, guests of the restaurant could park on the deck, but not overnight. 7) If there are spaces available on the public parking deck after 5 PM and on weekends, up to 10 guests of the hotel could park overnight. 8) The City's current monthly lease with Arcola Development for 17 spaces in Municipal Lot 13 would be honored by The Crosby and would be provided on the public deck. This would allow employees in the Arcola Building to park on the deck during office hours. Lease payments would go to The Crosby instead of the City. 9) Reservation of up to 10 spaces (hourly and/or 24/7) for Rivertown Commons use on the public parking deck would be accommodated at local market rates. MITIGATION OPTIONS The shortage of 3 spaces during the off-season and 6 during the high season could be mitigated in one of several ways. The Crosby Page 3 1) The Crosby could pay the parking mitigation fee, which currently is $10 per space per month for use of the public parking system. This has become the normal method of mitigating deficits when the number of spaces is fairly small, such as in this case. 2) An outright variance could be granted to waive the responsibility for mitigating the space deficit. This option has not been used in the last ten or twelve years. 3) The Crosby could make an arrangement with a nearby property owner to provide the deficit parking spaces. This option is used occasionally when there are nearby private parking facilities. Perhaps an agreement with the commercial parking garage owned by Mills on Main could be reached with its owners. Since the Mills on Main has an obligation to open their commercial parking garage to the public after business hours, there may be a willingness to work with The Crosby to provide their overflow parking. STAFF RECOMMENDATION Staff finds the parking facility operations plan to be reasonable, and recommends either option one or three for parking mitigation. If option three is decided upon, the overflow parking agreement will have to be fully executed, and a copy submitted to the City prior to issuance of a certificate of occupancy for the hotel. COMMENTS Costing estimates provided by a potential vendor: Base costs $2,100/port/year (annualized cost of initial investment over 7 year estimated useful life) Dual port free standing station (level 2) $7,500 Installation (if properly rated electricity nearby) $7,500 "Franchise fee" ($280/port/year) $560/yr for station $3,920 Maintenance costs (electrician, etc) $10,500 Total for 7 years $29,420 Electricity costs - Guesstimate of cost: $1/hr for level two charge EV Charging fee to customer: $3 for a two hour charge ($2.00 for electricity; $1.00 for base costs') Base cost revenue estimated to be generated $1,825/port/year Assumptions • 18 hour charging day • 2 hours per typical customer stay • 9 maximum total charges per day • 5 actual charges per day year round • 1,825 charges per year (365 x 5) • $1,825 of base costs recovered at rate of $1.00 per charge 1 Requires 2,100 charges per port per year over each of seven years to break even. If the charging station is located in a pay lot, there should also be a $3 or $5 fee for the space, depending upon which pay lot it would be located in. Charging Stations Page 2 Per the vendor's estimates, if electric rates stay pretty steady, and if we have the proper electrical infrastructure close to the proposed station, and if all assumptions are relatively close to reality, then the base costs would only be about $275 more than projected base revenue2. However, in Stillwater's market today, the vendor's assumption that there will be 5 charges (an average of 10 hours of charging time) at both ports each and every day of the year, seems a bit optimistic. COURSE OF ACTION If the Parking Commission finds that economic development, public good will and environmental values gained by making charging stations available downtown is worth underwriting perhaps a large portion of the station's costs, then direct staff to look into possible sites for the station. Staff would also look into the availability of properly rated electricity. There is currently no cap in place and no mechanism for imposing a limit on the number of permits issued. The stipulation that food trucks be sited on private property indirectly restricts the number of trucks permitted, given the limited availability of private parking space Downtown. Creating a formal restriction on the number of food truck permits issued would be a policy decision that the City Council would have to make.
