RESOLUTION 2020‐
APPROVAL OF AGREEMENT OF ASSESSMENT AND WAIVER OF NOTICE,
HEARING AND APPEAL AND ADOPTING ASSESSMENT FOR
WATER SERVICE LINE REPAIRS
WHEREAS, water repair service agreements have been executed relating to the following
addresses: 805 3rd St S; 807 3rd St S; 1101 6th Ave S; and 1209 3rd St S; and
WHEREAS,the agreement for this water repair is in default; and
WHEREAS, it is proposed to assess the costs against the property of the Owners, and the
Owners agree to pay the cost as a special assessment against their property for collection
with the real estate taxes in annual installments per year with 2.80% interest.
THEREFORE BE IT RESOLVED, by the City Council of Stillwater, Minnesota:
1. That the agreements of assessment and waiver of irregularity and appeal between
the Property Owners and the City of Stillwater is hereby approved and authorizes the
Mayor and City Clerk to sign the agreements.
2. Each tract of land therein included is hereby found to be benefited by the proposed
improvements in the amount of the assessment levied against it.
3. Such assessment shall be payable in equal annual installments extending over a
period as stated below with an interest rate of 2.80%:

4. Accrued interest from the date of the adoption of the assessment roll through
December 31, 2020 will be added with the first installment due in 2021 and be
collected as stated above on the unpaid balance for the predetermined years. At any
time thereafter,prior to November 15th of any year, Owners may pay the remaining
principal balance (in whole or part) to the City of Stillwater.
5. The clerk shall forthwith transmit a certified duplicate of this assessment to the
county auditor to be extended on the property tax lists of the county. Such
assessments shall be collected and paid over in the same manner as other municipal
taxes.

SUBJECT: 2021 Employee Group Health Insurance Opt Out Option
BACKGROUND
The City of Stillwater’s Labor Management Insurance Work Group evaluated an opt-out pilot program concept
for 2020 and found that the City may experience annual net savings in premiums paid for employee health
insurance. Annual net savings were dependent on the number of employees that chose the opt-out program. The
City Council approved the one-year pilot program, nine employees opted out of the City’s health insurance, and
net savings for 2020 were $40,716.
The estimated net savings for 2021 would be generated by individuals who may enroll into their partner’s 2021
group health insurance plan and then waive City of Stillwater coverage. The Affordable Care Act sets the potential
maximum monthly cash payment at 50 percent of the lowest cost premium plan. The lowest cost premium plan
is $634.50 per month for 2021, resulting in a maximum potential payment of $317.25; minus the employer’s cost
to provide the payment, for a net payment of $250 per month. The employees with 2021 group health coverage
through their partners would be eligible to receive from the City a proposed monthly cash payment of $250 in lieu
of the health insurance benefit offered to them by the City. In this scenario, the City would save $384.50 per
month in property tax levy cost.
The transition is not without risk to the plan:
SWWC Blue Cross Blue Shield reserves the right to re-underwrite the plan if eligible active contracts
change by more than 10% from initial proposal (equivalent is nine (9) individuals move off the plan)
Current preferred loss ratio is 80% (actual costs paid vs. premium received); losing contracts could
spread the risk among a smaller group and may make the loss ratio more difficult to meet; rate increases
could follow
RECOMMENDATION
Staff recommends that the City Council adopt the attached resolution approving for 2021 a $250 per month cash
in lieu of payment to employees who opt out of City SWWC Blue Cross Blue Shield group health insurance
coverage provided they are covered on their partner’s group health insurance plan.

APPROVING 2021 CASH IN LIEU OF OPT OUT OPTION CITY OF STILLWATER
GROUP HEALTH INSURANCE PLAN FOR BENEFITS ELIGIBLE CITY
EMPLOYEES
WHEREAS, the City of Stillwater, as an employer, offers group health insurance to its
benefits eligible employees; and
WHEREAS, the City’s Labor Management Insurance Work Group evaluated an opt-out
concept and found the City may experience annual net savings on premiums paid for employee
group health insurance by offering a $250 per month cash in lieu of payment to employees who
opt out of group health insurance provided by the City because they are enrolled in 2021 group
health insurance coverage through their partner, and
WHEREAS, the City acknowledges its support of potential annual net savings in
premiums paid for employee health insurance if employees can obtain coverage through their
partner’s group health insurance plan; and
WHEREAS, City Staff and the Insurance Work Group will evaluate the results of actual
net health insurance premium savings to the City resulting from a program offering cash in lieu of
opt out of City health insurance during the 2021 insurance open enrollment period and provide
those results to the City Council for inclusion in the final 2021 budget.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Stillwater
hereby approves a 2021 $250 per month cash in lieu of payment to employees who opt out of City
SWWC Blue Cross Blue Shield group health insurance coverage due to coverage on their partner’s
plan.

TO PROMOTE PHYSICAL AND SOCIAL DISTANCING FOR BUSINESS
ACTIVITIES DURING THE COVID-19 HEALTH PANDEMIC
WHEREAS, on March 13, 2020 Minnesota Governor Tim Walz issued Executive Order
20-01 declaring a Peace Time Emergency and Coordinating Minnesota’s Strategy to Protect
Minnesotans from COVID-19; and
WHEREAS, in response, on March 16, 2020 Mayor Kozlowski declared a Local
Emergency in recognition of the community risk posed by COVID-19; and
WHEREAS, on March 17, 2020, the City of Stillwater City Council adopted the Local
Emergency declaration and invoked the city emergency plan and authorized appropriate response
strategies to the pandemic; and
WHEREAS, on May 27, 2020 the City of Stillwater City Council adopted Resolution
2020-051 to assist businesses with the ability to reopen in a way that provides appropriate
distancing between its patrons and its employees while operating profitably and to provide
multiple, additional, or alternative customer service areas on commercial sites within the City
without the strict adherence to zoning and permit regulations; and
WHEREAS, with the inclement weather of the winter months approaching, businesses
need to continue to provide these alternative customer service areas in a safe manner that complies
with Building Code and Fire Code.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Washington County, Minnesota that:
1. Except as modified herein, Resolution 2020-051 is still in effective.
2. Section 1. b. of Resolution 2020-051 is modified as follows:
Other than an amendment to a liquor license, no zoning or conditional use permit shall
be required for any temporary structure or operation related to customer service, waiting
or dining seating areas; or on-site signage and storage; or other temporary outdoor use
is proposed to occur outside of the business establishment provided the Community
Development Department’s rules and procedures are met.
3. Section 1. C. of Resolution 2020-051 is modified as follows:
Any temporary structure or operation related to customer service, waiting or dining
seating areas on-site signage or storage; or other temporary outdoor use proposed to
occur outside of the business establishment that is otherwise prohibited Zoning Code
may be permitted subject to approval of the Community Development Department or
Council as set forth herein.
4. Resolution 2020-051 is modified by adding Section 1. g. as follows:
Any temporary structures located in the temporary outdoor use service area shall require
a building permit and the property owner/applicant shall comply with all documentation
and inspections required by the City to ensure compliance with the MN State Building
Code and Fire Code.
This Resolution is effective immediately subject to federal and state laws or orders relative to the
permissibility of business operations and shall continue until repealed by subsequent City Council
action or termination of the Local Peace Time Emergency.

BACKGROUND
Central Commons, LLC is the owner of the 35.3-acre property at the southeast quadrant of
Manning Avenue and State Highway 36. They plan to develop the property as a mixed use
Planned Unit Development (PUD) project over several phases. The first phase will be
synchronized with the construction of the new grade separated interchange at Highway 36 and
Manning Avenue. Site grading for this phase is planned to begin early next year. Within this
phase the following building construction is planned:
1. A Hy-Vee store of approximately 95,000 square feet (sf) on Lot 3, Block 2;
2. A Hy-Vee convenience store of about 4,000 sf with fuel sales and drive-through
coffee shop on Lot 1, Block 1; and
3. A market rate apartment facility with 200 units on Lot 4, Block 2.

The timing of subsequent phases of development is not yet known, but will include the two retail
lots north of Hy-Vee and Outlots A and B. The exact uses on the outlots are yet to be determined.
The Planning Commission held a public hearing and recommended approval of the Preliminary
Plat and Concept PUD in May of this year. The City Council reviewed and approved the
Preliminary and Concept PUD on August 4th.
The Final Plat and Final PUD for Phase 1 were reviewed by the Planning Commission on October
28th, when they held a public hearing and recommended conditional approval.
SPECIFIC REQUEST
The developer has submitted the following specific requests for approval:
1. Final Plat for Central Commons Addition (CPC Case 2020-40); and
2. Final Planned Unit Development (CPC Case 2020-52) for Phase 1 of Central
Commons.
ANALYSIS
Final Plat and Final PUD review consists of considering the conditions that were attached to the
Concept PUD and Preliminary Plat approval to determine if they are, or will be met.
The conditions of approval are shown below, with staff comments in italics.
1. The site shall be developed in substantial conformance with the plans on file with the
Community Development Department, including those below, except as may be
modified by the conditions herein:

The Final PUD plans for Phase 1 are in substantial conformance with the approved
preliminary/concept plans.
2. Approval of the preliminary plat, conceptual Planned Unit Development, rezoning to
HMU and Conditional Use Permits are all conditioned upon approval from the
Metropolitan Council of the requisite Comprehensive Plan Amendment.

The Metropolitan Council has scheduled consideration of the amendment for its November 18th
meeting. The Final PUD approval for this phase cannot become effective until after that. So, a
version of this condition will continue to be attached to the final PUD approval.
3. All civil engineering plans must be found satisfactory to the City Engineer, or revised
to his satisfaction prior to commencement of any earth work.
This will continue to be a condition attached to the Final PUD approval. Currently there is an
alternate sanitary sewer plan and a temporary road plan that are being considered by the
developer. The developer will need to coordinate with the City Engineer on which plans will
actually be constructed.
4. Prior to submission of final plat and final plans, design of the access point to the
apartment complex must be agreed upon by the City, County and developer.
This has been resolved and the layout is as shown in the attached site plan.
5. Prior to submission of final plat and final plans, design of the eastern access point
from the County Road must be agreed upon by the City, County and developer.
This has been resolved.
6. A Development Agreement found satisfactory to the City Attorney and City Engineer
must be fully executed prior to release of the Final Plat for each phase of development.
The Development Agreement is scheduled to be considered by the City Council on December
1st. So, this condition will continue to be attached to the Final PUD approval for Phase 1.
7. The City will extend trunk utilities from their current terminus in Curve Crest
Boulevard to the project site. Payment for these trunk extensions will be shared by all
benefiting properties, including Central Commons. Central Common’s share may be
reduced, waived or paid through a tax abatement agreement, as determined by the
City Council and detailed in the Development Agreement that will be approved
together with the Final Plat.
This condition will be attached to the Final PUD approval. An Assessment Agreement and
Tax Abatement Agreement are scheduled to be presented to the City Council for consideration
at the December 1, 2020 work session.
8. Retaining walls for the County Road project may be required to accommodate the
proposed size of parking lots in Central Commons. Therefore, if the County charges
these retaining wall costs back to the City, their cost may have to be passed through to
the developer. Central Common’s share may be reduced, waived or paid through a
tax abatement agreement, as determined by the City Council and detailed in the
Development Agreement that will be approved together with the Final Plat.
This condition still applies. It will be addressed in the Assessment Agreement and Tax
Abatement Agreement.

9. Any utility easements found necessary by the City Engineer must be executed and
filed together with the final plat for each phase of development. Prior to release of the
plats from City Hall for recording, fully executed copies of the easements must be
submitted to the City.
This condition still applies.
10. Development impact fees, including park and trail fees for each phase must be paid to
the City prior to release of the Final Plat for that phase of development, unless waived
in part or whole by the City Council.
This condition still applies. It will be addressed in the Assessment Agreement and Tax
Abatement Agreement.
11. All required permits from MnDOT must be issued, and copies submitted to the City,
prior to commencing any earth work. In addition, the final plat for Central Commons
Addition must be consistent with the right-of-way platting for the planned Hwy 36
interchange.
This will continue to be a condition attached to the Final PUD approval.
12. All required permits from Washington County must be issued, and copies submitted
to the City, prior to commencing any road work.
This will continue to be a condition attached to the Final PUD approval.
13. The HMU, Highway Mixed Use Zoning District ordinance must be adopted by the
City Council with substantially similar content to that attached to this planning report,
or the preliminary plat, concept Planned Unit Development and Conditional Use
Permits may have to be reviewed again by the City Council.
This condition has been satisfied.
14. Any mitigation measures found necessary by the City Council upon review of the
EAW must be incorporated into the final plat application materials for each phase of
development.
The City Council found no EAW mitigation measures necessary to be included in the final
PUD.
15. An administrative law judge for the Municipal Board must approve the annexation
petition before the preliminary plat, conceptual Planned Unit Development and
Conditional Use Permit approvals become effective.
This condition has been satisfied.
16. There are a few locations within the proposed project where parking stalls are
configured to have to back out into a higher volume main internal circulation roads.

Consideration should be given to identifying many of these parking stalls as employee
only parking and included in the Final Plat application materials for Phase 1.
These spaces are all in the Hy-Vee Grocery parking lot. And, Hy-Vee wants to keep them as
they are.
17. Photometric plan revisions must be made and found satisfactory to the City prior to
release of the Final Plat for each phase of development.
This condition has been satisfied.
18. Light fixture cut sheets and details for all exterior lighting fixtures must be submitted
and found satisfactory by the City Council at the time of Final Plat and Final PUD
plan review for Phase 1.
This condition has been satisfied.
19. Mechanical plans must be submitted and found satisfactory by the City Council at the
time of Final Plat and Final PUD plan review for Phase 1.
The mechanical plans have not been submitted yet. The developer has requested that these be
allowed to be submitted and approved by City staff prior to issuance of the building permits.
20. The Conditional Use Permits shall not become effective until the Final Plat and Final
PUD plans are approved by City Council for Phase 1.
This condition refers to Hy-Vee and the Hy-Vee Convenience Store. It will continue to apply.
21. The Planning Commission must review the sign plan together with the Final PUD and
make a recommendation to the City Council prior to a City Council decision on signs.
At the Planning Commission public hearing for the Concept PUD, the Commission
recommended that sign permits and any required variance requests should be submitted prior
to sign installation. The developer wanted to have this resolved with the PUD, so the Council
referred the details back to the Planning Commission for a recommendation.
Attached is a spreadsheet that gives details for each of the proposed monument, identification
and wall signs. It includes the original staff recommendation to the City Council, the
developer’s desired revision, and staff’s reconsidered recommendation. The Planning
Commission recommended adoption of the table as the set of signage standards for Central
Commons.
In general:
When installed next to County right-of-way (ROW), the standard 15’ setback is a
bit excessive since the County has required considerably more ROW width than
normally experienced. So, staff and Planning Commission concede that 10’ is a
reasonable setback along the County Road.

Maximum monument sign height is typically 20’ along Highway 36. But, given
speed and elevation challenges along this stretch of Highway 36, 35’ seems
reasonable.
Identification sign height is normally 6’. But, in order to make room for enhanced
landscaping under these signs, staff and the Planning Commission find that a 10’
height reasonable.
Staff and Planning Commission agree that extra wall signage makes sense for the
Hy-Vee grocery store, since it is a goodly distance from Hwy 36, and the building
is massive. But, on other buildings, wall signage should meet BP-C standards of 1
square foot/1 lineal foot of building front.
22. Prior to final plat and final plan submission, the developer must work with the city
engineers for Stillwater and Lake Elmo, as well as with Washington County, to come
to an acceptable design for the intersection of Linden Avenue with Manning Avenue.
The developer must also give additional design consideration to widening the right of
way south of the entrance to the apartment complex, or identify a possible alternate
public road access to the two parcels south of Central Commons.
This has apparently been resolved. The City Engineer will verify whether this is so prior to the
Council meeting.
Miscellaneous
Washington County has not designated funding for the construction of 58th Street between
Manning Avenue and St Croix Boulevard. And though the County has identified this road
segment as a high priority, it is not listed in their five-year capital plan yet. Consequently, either
the County will need to revise their capital plan and build the road, or the developer will need to
build a temporary road to give access to the project. This language is included in the
Development Agreement and the temporary road plan is included in the revised plan set.
ALTERNATIVES
A. Approval. If the City Council finds that the Final Plat and Final PUD for Phase 1 satisfies, or
will satisfy the Preliminary Plat and Concept PUD conditions, then the Council could
approve them with at least the following conditions:

recommendations included in the attached table entitled “Revised Central Commons
Signage Review – October 26, 2020”.
14. If Washington County does not build the segment of 58th Street traversing the project
prior to issuance of Certificates of Occupancy for any of the proposed buildings, then
the developer will be obligated to build a temporary road for access purposes.
15. Prior to release of the Final Plat from City offices for recording at Washington County,
the Stillwater City Engineer must approve the design for the intersection of Linden
Avenue with Manning Avenue.
B. Table If the City Council finds the development materials to be incomplete, or that there
is doubt that the conditions of approval attached to the Preliminary Plat and Concept PUD
are being satisfied, the Council could table action for additional information.
C. Denial If the City Council finds the development to be inconsistent with Concept PUD
conditions of approval, it could deny the requests.
RECOMMENDATIONS
Planning Commission
The Planning Commission unanimously recommended approval with the conditions
recommended by staff and the understanding that Condition #22 in the original staff report

2. The Final PUD for Phase 1 will not become effective, nor may the Final Plat be
released from City offices for recording with Washington County, until the
Metropolitan Council approves the requisite Comprehensive Plan Amendment.
3. All civil engineering plans must be found satisfactory to the City Engineer, or
revised to his satisfaction, prior to commencement of any earth work.
4. A Development Agreement found satisfactory to the City Council, City Attorney
and City Engineer must be fully executed prior to release of the Final Plat.
5. The City will extend trunk utilities from their current terminus in Curve Crest
Boulevard to the project site. Payment for these trunk extensions will be shared by
all benefiting properties, including Central Commons. Central Common’s share
may be reduced, waived or paid through a tax abatement and/or assessment
agreement, as determined by the City Council prior to release of the Final Plat.
6. Retaining walls for the County Road project may be required to accommodate the
proposed size of parking lots in Central Commons. Therefore, if the County charges
these retaining wall costs back to the City, their cost may have to be passed through
to the developer. Central Common’s share may be reduced, waived or paid through
a tax abatement and/or assessment agreement, as determined by the City Council
prior to release of the Final Plat.
7. Any utility easements found necessary by the City Engineer must be executed and
filed together with the final plat for each phase of development. Prior to release of
the plats from City Hall for recording, fully executed copies of the easements must
be submitted to the City.
8. Development impact fees, including park and trail fees for each phase must be paid
to the City prior to release of the Final Plat for that phase of development, unless
waived or paid through a tax abatement and/or assessment agreement, as
determined by the City Council prior to release of the Final Plat.
9. All required permits from MnDOT must be issued, and copies submitted to the City,
prior to commencing any earth work. In addition, the final plat for Central
Commons Addition must be consistent with the right-of-way platting for the
planned Hwy 36 interchange.
10. All required permits from Washington County must be issued, and copies submitted
to the City, prior to commencing any road work.
11. Mechanical plans must be submitted and found satisfactory by the Community
Development Director prior to issuance of any building permits in the project.
12. The Conditional Use Permits shall not become effective until the Final Plat and Final
PUD plans are approved by City Council for Phase 1.
13. All signs must be designed and installed in compliance with the revised staff
recommendations included in the attached table entitled “Revised Central Commons
Signage Review – October 26, 2020”.
14. If Washington County does not build the segment of 58th Street traversing the project
prior to issuance of Certificates of Occupancy for any of the proposed buildings, then
the developer will be obligated to build a temporary road for access purposes.
15. Prior to release of the Final Plat from City offices for recording at Washington
County, the Stillwater City Engineer must approve the design for the intersection of
Linden Avenue with Manning Avenue.

BACKGROUND
The City of Stillwater Police Chief retired from the position effective September 30, 2020.
The City commenced a recruitment process pursuant to the City personnel policies and procedures
to fill the position, and first interviews were held on October 15, 2020. Five top candidates were
invited to a second round of interviews on October 29, 2020. The 2nd interviews were conducted
by five groups: Police Department staff; Department Managers; Community Member group; City
Council and the City Administrator.
Based on the results of the second interviews, Brian Mueller was selected as the top candidate
for the position.
Pursuant to Article VII of the City Charter, the City Administrator recommends appointment of
Brian Mueller as the Police Chief for the City of Stillwater effective January 11, 2021.

WHEREAS, the current City Police Chief retired from the position effective
September 30, 2020; and
WHEREAS, in order to fill the vacant position, the City commenced a recruitment
process pursuant to City personnel policies and procedures to fill the position; and
WHEREAS, upon review of applications received for the position, initial interviews
were conducted with qualified candidates on October 15, 2020, and the top candidates were
invited to a second round of interviews on October 29, 2020; and
WHEREAS, based upon the results of the second interviews, and pursuant to
Article VII of the City Charter, the City Administrator recommends the appointment of Brian
Mueller as the Police Chief for the City of Stillwater, with an effective starting employment
date of January 11, 2021.
NOW THEREFORE BE IT RESOLVED that the Stillwater City Council, pursuant to
Article VII of the City Charter, and based upon the City Administrator’s recommendation,
hereby approves the appointment of Brian Mueller as Police Chief for the City of Stillwater
effective January 11, 2021.
