CITY OF STILLWATER
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION APPROVING
CONDITIONAL USE PERMITS
FOR HY-VEE STORE AND HY-VEE C-STORE IN
CENTRAL COMMONS ADDITION
CASE NO. 2020-10
WHEREAS,Mark Lambert, Central Commons,LLC has submitted an application
for approval of:
1) Conditional Use Permit for Hy-Vee pharmacy drive-thru and grocery pick-up
located on Lot 3, Block 2,Central Commons Addition;and
2) Conditional Use Permit for C-Store fuel sales and coffee shop drive-thru located
on Lot 1, Block 1,Central Commons Addition;and
WHEREAS,on April 22, 2020 the Planning Commission for the City of Stillwater
held a public hearing on the Conditional Use Permits and upon hearing testimony from the
public voted 6-1 to recommend approval to the City Council with conditions; and
WHEREAS, on August 4, 2020 the City Council held a public hearing on the
requests and found them to be substantially consistent with City development standards,
the Stillwater Comprehensive Plan and the Comprehensive Plans of all surrounding
jurisdictions.
NOW,THEREFORE, BE IT RESOLVED, that the City Council of the City
of Stillwater hereby approves the Conditional Use Permits with the following
conditions:
1. The site shall be developed in substantial conformance with the plans on file
with the Community Development Department,including those below,
except as may be modified by the conditions herein:
• Preferred Preliminary Plat Plan Sheet PP02 date 7/13/20
• Preferred Site Plan Plan Sheet SPO1 date 7/13/20
• Preferred Grading Plan Plan Sheet GD01 date 7/13/20
• Wetland Fill/Buffer Plan Plan Sheet C401 date 4/15/20
• Phase 1 Erosion Control Plan Plan Sheet C402 date 4/15/20
• Post Construct Groundcover Plan Sheet L100 date 4/15/20
• Preferred Overall Landscape Plan Plan Sheet L101 date 7/13/20
• Apartment elevation by Doran dated 2/27/20
• C-Store exterior elevations Plan Sheet A6.0
• Food store exterior elevations Plan Sheets A6.0&A6.01
• Apartment floor plans dated 4/15/20
2. Approval of the Conditional Use Permit is conditioned upon approval from
the Metropolitan Council of the requisite Comprehensive Plan Amendment.
3. All civil engineering plans must be found satisfactory to the City Engineer,or
revised to his satisfaction prior to commencement of any earth work.
4. All required permits from MnDOT and Washington County must be issued,
and copies submitted to the City,prior to commencing any earth work.
5. The HMU,Highway Mixed Use Zoning District ordinance must be adopted
by the City Council with substantially similar content to that found in the
pre-annexation agreement or Conditional Use Permit may have to be
reviewed again by the City Council.
6. An administrative law judge for the Municipal Board must approve the
annexation petition before the Conditional Use Permit becomes effective.
7. The Conditional Use Permit shall not become effective until the Final Plat
and Final PUD plans are approved by the City Council for Phase 1 of Central
Commons.
8. The Planning Commission must review the sign plan together with the Final
PUD and final plans,and the City Council must make a decision on signage
prior to issuance of sign permits or installation of any signs.
