Mr Lieberman called the meeting to order at 7 p m He noted the upcoming retirement of Ms
Fitzgerald and expressed the Commission s thanks for her outstanding work with the City and
the HPC He also introduced and welcomed Council Representative Harycki and Interim
Community Development Director/Planner Lockyear
Approval of minutes Mr Nelson noted his name was spelled incorrectly Mr Johnson,
seconded by Mr Eastwood, moved approval of the minutes of Dec 5 2005 with the correction
to the spelling of Mr Nelson s name Motion passed unanimously
Case No DR/05-56 Design review of sign package for Liberty West at 105 New England Place
Continued from the Dec 5, 2005 HPC meeting
Ms Fitzgerald noted that the building had been sold just a few days prior to the meeting and the
representative of the sign company was ill and unable to attend the meeting On a motion from
the chair it was agreed to have Mr Tomten who had worked with the applicants following the
Dec 5 discussion present the revised proposal with the understanding that Mr Tomten would
not participate in the Commission discussion/action
Mr Tomten said he had met at the site with the owner sign people and two tenants to discuss
the HPC s recommendations/possible changes He said it was agreed to make the focus of the
signage Liberty Village/Office Lofts as suggested and to use the same font as used on the gas
station/bank signage Office Loft entrances would be more clearly identified with projecting
signage or sign above the door(s) The style/theme for the second -floor tenant signage will be
considered individually and on a case -by -case basis Mr Tomten clarified that the rectangular
spaces indicated on plans for future tenants did not mean future tenants would be limited to
such spaces rather just to indicate the amount of space available for future signage Mr
Johnson asked if there would be additional lights Mr Tomten said if there was a request for
additional lighting it would have to come back before the HPC Responding to a question by Mr
Johnson Mr Tomten said he thought the revised plans were OK and a step in the right
direction
Mr Johnson moved to approve the request as revised, with the condition that there be no
changes in the lighting on the building Mr Eastwood seconded the motion Motion passed 7-0,
Mr Tomten did not cast a vote
Case No DR/06-01 Design review of an exterior sign for Expressions Hair Design at 406 S
Third St Amy Kroening, applicant
Ms Kroening said her proposed signage is similar to the existing sign and will be placed in
basically the same location but will be perpendicularly oriented Color samples were shown Mr

Eastwood seconded by Mr Peterson moved approval as conditioned Mr Johnson clarified
that the signage will not be lit Motion to approve as conditioned passed unanimously
Case No DR/06-02 Design review of a pylon sign with reader board for Lake Elmo Bank at
1903 S Greeley St Mike Johnson representing the applicant
Mike Johnson was present Mr Lieberman stated the HPC was not in favor of reader boards
and expressed his opinion that the community is becoming cluttered with commercial language
Ms Fitzgerald said the request would go before the Planning Commission on Jan 9 for
consideration of a variance Ms Fitzgerald noted that reader boards such as the one
requested are not allowed by ordinance reader board signage is limited to time and
temperature Mike Johnson spoke of other reader boards in the community, it was noted that
with the exception of one those were grandfathered-in Mr Lieberman pointed out that
according to the City s ordinance the HPC can't approve anything other than signage indicating
time and temperature Commission Member Johnson said the Commission takes the ordinance
as written and can t deviate from the ordinance the only action the HPC can take he said is to
deny the request Jeff Johnson seconded by Mr Lieberman moved to deny the request based
on City ordinance Motion passed unanimously
Case No DR/06-03 Design review of an addition of a fuel center and drive-thru pharmacy for
Cub Foods at 1801 Market Drive Craig Mevissen representing Cub Foods
Most of the discussion centered on plans for the fuel center Members expressed a concern that
the proposed fuel center does not reflect any of the details of the primary structure Mr Tomten
noted that one of the guidelines for the Business Park and the Cub/Target PUD is that buildings
be consistent in materials style and detailing and suggested that the design of the fuel center
doesn t meet that guideline Mr Tomten provided some suggestions such as the use of some
masonry material which would help make the connection between the structures Mr Johnson
pointed to the Quik Trip station in the Liberty development as a good example of what the
Commission was suggesting for design details Mr Johnson suggested that the proposal was
not consistent with what should be the image of SuperValu s flag ship store, he said the design
should provide a look of permanence rather than something on the outskirts of the parking lot
There also were questions raised about lighting Mr Mevissen said the sign itself will not be lit
Mr Tomten noted that canopy lighting must be recessed Mr Johnson asked about parking, Mr
Mevissen said even with the proposed fuel center the amount of parking is over the required
number of spaces
Regarding the drive-thru pharmacy Mr Mevissen explained the proposal is for a small drive -up
window with sign above and canopy the same as the front canopy The sign will be internally lit,
Mr Mevissen said he thought there would also be some lighting under the canopy
Mr Johnson moved to approve the pharmacy drive-thru with the condition that lighting be
limited to a downlit fixture for the canopy only with a clip of the lighting to be provided to staff
and to deny the fuel center request Mr Lieberman suggested continuing the fuel center
pending design revisions Mr Johnson agreed to change the motion to approve the pharmacy
dnve-thru as conditioned and continue the fuel center request pending revisions to be more
consistent with the PUD Mr Eastwood seconded the motion, motion passed unanimously

Case No DR/05-55 Design review of signage for Hoffman Heating and Cooling 1709 S
Greeley St Dennis Doerr applicant
Present representing the applicant was Corey Halverson Mr Johnson stated the Commission's
previous concern was with the starkness of the white background Mr Halverson said that
concern could be addressed by dropping the wattage or placing some type of luminescent
paneling behind the lettering Mr Johnson suggested perhaps some shade of blue might be
appropriate Mr Johnson moved to approve the signage with the condition that the signage is
centered on the building and some type of blue colored translucent panel is placed behind the
signage with the additional condition that the final plan be reviewed by staff before installation
Mr Peterson seconded the motion motion passed unanimously
Other items
At Mr Zahren s request there was a general discussion about reader boards and how a
particular reader board was installed if such signage is against the ordinance Mr Lieberman
noted that all applicants have the right to appeal Commissions decisions to the Council, and he
spoke to procedures of enforcement There was a question about a mechanism for follow-up to
determine if plans approved by the HPC are actually what is finally constructed Mr Johnson
noted that the HPC is not an enforcement tool that is a staff function Ms Fitzgerald said staff
now signs off on all plans according to how the plans were approved by the HPC Mr
Eastwood suggested the HPC should have design review of all commercial projects in the City,
Mr Johnson suggested it would be wise to get the infill design guidelines approved before
taking on review of all commercial projects
A copy of the Chamber s Historic District Committee s response to the recently approved
revised Design Manual for the Historic Downtown District was included in the agenda packet
Two concerns were highlighted in the response Ms Fitzgerald said a color pallet appropriate to
the Victorian tradition was being prepared to address the concern related to color guidelines
The concern regarding height and proportion of new buildings she said is currently being
addressed by the Planning Commission which is considering a revision to the height guidelines
Mr Zahren said the Historic District Committee would like an HPC member to attend one of its
meetings to discuss the guidelines and said he thought that would be a good move on the
HPC s part Mr Lieberman and Mr Tomten agreed to attend the Historic District Committee s
Jan 12 meeting
Ms Fitzgerald distributed a draft copy of a proposed outdoor lighting ordinance and asked
members to review the draft for discussion at the February meeting
Mr Johnson seconded by Mr Eastwood moved to adjourn at 8 25 p m

Demolition of Residence at 209 N Third Street
Background
The applicant is required to request a demolition permit from the city to raze this single
family residence since it is more than fifty years old This property is in a dilapidated
condition is not listed on the National Histonc Register The applicant appears to have
the means necessary to carry out the demolition and to restore the site to open space
until such time as a need anses for its use
Recommendation Staff has reviewed this site and is of the opinion that it would be in
the best interest of the community to remove this home from the residential inventory and
that the request for a demolition permit be granted subject to

SUBJECT 209 3`d Street House Demolition Request
As per the demolition ordinance I am required to perform a structural evaluation of any
building over 50 years old that has been submitted to the Planning Department for
demolition
An assessment of the home was done from the extenor only, making it difficult to
determine structural condition The home is full of homeowner's contents/debns and
would be of no benefit to go inside since I would not be able to see the condition of the
walls and floors The amount of possessions/debris and the number of years it has been
there would most likely affect the condition of the structure such as possible rotting,
rodents, overloading of concentrated loads with heavy items, etc Although the home
appears to be in poor shape, it does not appear to be condemnable from the exterior
However, the interior condition of the home and the amount of debris throughout the
house may bnng about a different opinion

Gentlemen
Attached is a Demolition Request for the property at 209 N 3'd St Ascension Episcopal Church is in the
process of purchasing this building The church's purpose is to demolish the building and to maintain
the lot as open space until such time as the church should need the property for usage that is within the
parameters tor which it is zoned (Public administrative offices distnct)
The property is owned and occupied by Anne Berrisford She is an older woman with impaired eyesight
and heanng The property is in poor condition and because of the amount of clutter in the home, very
difficult to view It is because of this that some of the requests for this permit are difficult to manage It
is also because of this that both Susan Fitzgerald and Cindy Shills have seen the building with me
Based on the definitions in Subd 2, the house for which a demolition permit is being sought is of
Potential Historic Significance since it is more than 50 years old It is not Historically Significant since it
is not "any building or structure or portion of a building or structure on the National Histonc Register, a
designated local landmark or a contnbuting structure or building in a designated national register
histonc district "

4 The building is a single faintly home The property has been viewed by Cindy Shilts and Susan
Fitzgerald The pioperty has many code violations, asbestos, and unused oil tank, a failed roof
5 The property would be economically difficult to restore The cost of cleaning it and bringing it to
code and making it a home, plus the cost of purchase, would exceed the market value of
replacing it with a new home
6 The church's future plans for the property are unknown at this time We are a rapidly growing
church situated on a very restncted space We have remodeled our space, but are restncted as to
office, classroom, and meeting space This property could allow us future alternatives We also
house Head Start, which is held in a restncted space
7 Any future plans will, of course, be within the scope of the existing zoning (PA) and within the
guidelines of the comprehensive plan
8 Given the condition of the property, we would ask for a permit to demolish
9 We have not advertised for sale as we do not own the property at this time We could do that
once we are in title and at that point if it could be sold to be moved, that would be to our benefit

Background
The applicant has requested a design review for a proposal for construction of a building
housing 32 condo units along with parking for the existing Water Street Inn hotel and the
proposed residential units The property is located to the floodplain and as such will need
to be carefully planned so as to ensure that the City of Stillwater adheres to the standards
of flood protection for all building along the St Croix River The proposal appears to
partially encompass an area that is not at this time under the control of the applicant The
proposal also appears to indicate construction over an existing city storm -sewer easement
and the utilities in E Myrtle Street It should also be noted that the attached plans indicate
a one way traffic movement on E Myrtle Street In addition, the attached Ietter of intent
indicates that a height vanance will be needed as well as noting some changes to the
existing hotel operations At this time no information addressmg any of the
aforementioned concerns has been submitted to the City of Stillwater
Recommendation Staff has reviewed this application and is of the opimon that it is
premature to review the site plan as there are too many unknowns that may affect any
design direction decided upon by the Hentage Preservation Commission Staff
recommends that the Commission reject tlus application as being premature Further, that
the Commission direct the applicant to resolve the aforementioned stated concerns before
resubmitting the site for design review If the Commission decides to review the design,
any direction should be conditioned on resolving all of the aforementioned concerns

Protect Narrative/ Letter of intent
Located at the foot of the historic lift bridge the Water Street Inn is proposing a 32 unit condominium
project along with a hotel lobby relocation and underground parking
The new construction will occur on the existing patio north of the 1994 hotel addition and on the north
parking lot A 67 stall below grade ramp accessed from Water Street will serve the 32 units above Surface
parking of 54 stalls will serve the 40 room hotel The residential floors begin approximately 11 feet above
the surface parking Three floors of residential along with the on grade parking bung the overall height to
48 feet
The concept is U shaped with a single loaded hall at the west side allowing most units views of the St
Croix River The units will partially enclosed a plaza at the first residential level The facade will reflect
local materials and proportions
The parking level will be detailed with arches of sandstone or sim►lar material The residential levels are of
brick with historic scale windows and detailing
A bridge over Myrtle Street connects the north and south portions This bridge occurs on the third level
allowing a framed vista to the pavilion from Myrtle Street
One outstanding feature of this project is the restoration of the Union Depot Tower at its original location
The Depot was razed in 1960 leaving behind only the foundations and the weathervane (which is now
mounted on a residential garage on the north side of Stillwater) Drawings done bv the railroad survey of
1919 will be used to accurately recreate the image of the former landmark The tower (at 68 feet) will
require a height variance to the current code of 50 feet
In addition to the new housing the hotel will relocate the lobby to the north end adjacent to the parkins
The former lobby will be connected to dining space for the restaurant
One final consideration is the pending discussion of a land swap first proposed bv City Council some time
ago The north 48 feet ot the parking lot will be traded for 17 feet of former railroad right ot way along the
eastern boundary of the site This trade will allow for as city park extension that may connect with
parklands on the exiting city parking lot north of Oasis Market This would be permanent open space
allowing an additional view corridor from Main Street to the river The trade also allows tor a traditional
parking layout of two way traffic and 90 degrees stalls
Meetings with Army Corp of Engineers indicated a willingness to work together on a flood wall or levy
design at the eastern edge

additional color renderings of the elevations included in this packet

Design of new Residence at 217 W St Croix Avenue East
Background
The applicant is proposing to build a new home on a parcel that was the result of a lot
split The Parcel is substandard by a few feet and a vanance to the lot size was granted by
the city on October 18, 2005 The site plan attached indicates that the proposed home
would meet the setback and height requirements of the code however the lot coverage of
34% does not meet the current requirements of no more than 30% coverage Once the
Conservation Design Guidelines are approved by the city this project would qualify and
the first reading of the ordinance for this change will be before the Council on February
seventh No visuals have been supplied regarding the final design for the extenor of the
home but it appears that the owner will use vertical boards and battens
Recommendation The commission has two choices Deny the proposal as not meeting
the current code or it may wish to approve this design with the caveat that no building
permit be issued until the new Conservation Design Guidelines are approved and in force

The scope of the work shall include A SINGLE FAMILY HOUSE and the demolition of the
existing garage and its removal from the site, as covered in the Prelmmary Drawings, dated
January, 2006 and The Contractor shall provide all necessary labor, materials and equipment
to complete all demolition, site work, concrete, carpentry, plumbing, heating, electrical,

In order to protect as much of the existing landscape as possible the owner and contractor are
to walk the site and agree what area is to be accessible to heavy equipment This area is to be
marked with snow fencing or flagging by the contractor and shall be respected by all
subcontractors
The Contractor is to verify the location of all gas, sewer, electric, and water lines before
trenching or excavating All utilities are to run underground
All exterior dimensions are from the face of concrete walls to exterior Face of sheathing All

All work shall comply with the state and local codes, ordinances and standards, and shall be

Contractor shall provide liability and property damage insurance and workmen's
