called the meeting to order at 7 p m Approval of minutes Mr Lieberman, seconded by Mr Johnson, moved approval of the minutes of March 10, 2004, as submitted Motion passed unanimously Case No DR/04-09a Design review of Building III, Terra Spnngs at 640 N Main St Mathew Bnnza, representing applicant Brian Sweeney introduced Greg Kinney of Pope & Associates, architects, and Donald Kasbohm, developer Mr Lieberman stated for the record that he had met with the developer earlier in the week to share some concerns Mr Kasbohm briefly gave a history of his company Mr Kinney reviewed the building elevations A tower element will be reminiscent of the prison hospital tower Mr Kinney also provided samples of building matenals Matenals will be the same as those used in other Terra Springs buildings, but of slightly different colors Mr Kasbohm noted that Building III is the largest building in the development, but it will not appear so massive from the street because two other buildings encroach on the viewshed It was noted that initially, the building was to be six stories high with 70 units, the present plans call for a four-story building with 47 units Mr Kinney also briefly reviewed lighting plans, which will be the same package as the other buildings, and landscaping plans There will be no rooftop mechanicals Mr Johnson noted that Building III is not centered on the site's central plaza He questioned whether the asymmetry will be more obvious when construction is complete Mr Johnson asked Mr Kasbohm to discuss that issue with the other building developers Mr Johnson moved approval with the 19 conditions, deleting condition of approval No 2 as it is repeated in condition No 15, with the additional conditions that the developer/architect discuss the symmetry issue with the othcr developers and that the developer look at the building garage door openings in relation to the building tower Mr Eastwood seconded the motion Mr Peterson asked that archeologists be present during site preparation, Mr Sweeney said that would be done Motion to approve as conditioned passed unanimously 1 City of Stillwater Heritage Preservation Commission April 8, 2004 Case No DR/04-15 Design review of exterior signage for Neu Designs at 1754 Market Dr Mike Krasky, Sign -a -Rama, representing the applicant The applicant was present Ms Fitzgerald said the proposed sign is within the allowable square footage for building space The sign will be mounted at the same height as the other signs on the building Mr Lieberman moved approval as conditioned Mr Peterson seconded the motion, motion passed unanimously Case No DR/04-16 Design review of extenor balconies at the Joseph Wolf buildings at 402 S Main St Steve Bremer, applicant Mr Bremer was present He explained the request is due to discussions with several potential buyers who indicated an interest in having a small deck Mr Johnson expressed a concern that taking the sill out and cutting stone down would change the appearance of the building, especially on the north elevation Mr Bremer said he would only add a deck if the tenant so desired, and he said no permanent damage would be done if a deck were added to a unit — it could be removed in the future Mr Peterson moved approval as conditioned Mr Eastwood seconded the motion Mr Johnson suggested allowing a maximum of five decks to be installed and only as a purchaser desires Mr Peterson accepted that as an amendment to the motion Mr Lieberman spoke in favor of allowing Mr Bremer to add decks as necessary to market the units Mr Bremer stated he would like to put one deck on the north elevation to see how it will look Mr Johnson withdrew his amendment Original motion to approve as conditioned passed unanimously Case No DR/04-17 Design review of Tasteful Thymes at 1709 S Greeley St Donna Tarras, applicant Ms Tarras was present She said her business will be shanng the building space with Hoffman Refrigeration She will occupy the northeastern portion of the space The existing wall sign from her downtown location will be placed above the door, it was suggested that downht, gooseneck fixtures be used for lighting Ms Tarras said there likely will also be a monument sign on Greeley Street, which she would share with the other tenant Mr Johnson moved approval as conditioned, allowing one wall sign with two gooseneck, downht lighting fixtures, with the applicant to return with the other tenant if a monument sign if requested at a later date Mr Peterson seconded the motion, motion passed unanimously Case No DR/04-18 This case was tabled Case No DR/04-19 Design review of temporary structure for the sale of fireworks in Cub parking lot at 1801 Market Drive Enc Robbins, applicant 2 City of Stillwater Hentage Pieservation Commission Apnl 8, 2004 The applicant was not present Ms Fitzgerald noted that there was only one problem with the use last year, and that was with extra signage Mr Lieberman moved approval with the condition that only one sign is allowed, with the size and location to be review by staff Mr Eastwood seconded the motion, motion passed unanimously Case No DR/04-20 This case was tabled Case No DR/04-21 Design review of extenor modifications at 106 S Main St Chris Moen, CCM Builders, representing the applicant Mr Moen said the intent is to bnng back the original windows Some of the wood will be removed from the front Also a portion of the granite will be removed from the front to return to the original concrete Awnings are proposed for the windows, and Mr Moen provided color samples Signage will be in the windows Mr Johnson asked if anything was planned for the windows on the north elevation Mr Moen agreed that it would be good to restore those windows to the original at some point in the future Mr Johnson moved approval as conditioned, with the awnings to be a 1 1 pitch, and allowing replacement of windows on the north elevation to match the east elevation, if the applicant decides to proceed Mr Peterson seconded the motion, motion passed unanimously Case No DR/04-22 Design review of signage for a second floor business, Artrageous, at 321 S Main St Jackie Parks, applicant Ms Parks was present She said the requested projecting signs will not be lighted She said she is not sure of the signage colors Mr Johnson moved approval as conditioned, changing condition No 4 to indicate that if the signage is to be lighted, the applicant must return to the HPC, and adding a sixth condition that colors be presented to staff for review and approval Mr Peterson seconded the motion, motion passed unanimously Case No DR/04-24 Design review of self -storage facility on Industrial Boulevard between Highway 36 and Curve Crest Boulevard Steven Gaffney, applicant Mr Gaffney was present He noted that he had appeared before the HPC previously His proposal is the same, but is for a new site, a site purchased from DiaSonn The proposal is for a 72 square -foot monument sign that will meet the 15' setback requirement There will be two downlit wall pack units on one of the buildings, the remainder will be downlit shoebox fixtures There will be no trash enclosure One building might be heated 3 i City of Stillwater Hentage Preservation Commission Apnl 8, 2004 Mr Johnson moved approval as conditioned, eliminating conditions No 11 and 12, changing the wording of condition No 18 to indicate that the applicant shall submit catalog clips of proposed lighting fixture to Mr Fitzgerald for approval, and adding a condition that a non -lighted 12x6' monument sign is approved, with lettering style and colors to be submitted to Ms Fitzgerald for review and approval Mr East Nood seconded the motion, motion passed unanimously Case No DR/04-23 Design review of an addition to Eckberg Law Office at 1835 Northwestern Ave Michael Diem, representing the applicant Representing the applicant was Frank Stanton of Archnet The addition will be located in the rear of the building and not visible from the street elevation The addition will have the same roof line and matenals as the existing structure Additional parking will be located in the rear There will be no new signage Mr Eastwood moved approval as conditioned, eliminating conditions No 9, 16 and 18 Mr Peterson seconded the motion, motion passed unanimously Other items Ms Fitzgerald briefly reviewed the revised plans for the new park to be located on the former Gordon Iron site Ms Fitzgerald also provided a copy of an agreement with the Minnesota Department of Transportation for lift bndge interpretive monuments to be placed in Lowell Park The annual Preservation Awards will be presented at the May 4 City Council meeting Mr Lieberman will be on hand for the presentation Mr Johnson asked about the status of the Depot restaurant signage Ms Fitzgerald said she would be contacting the business owner again in an effort to get them in compliance Mr Lieberman bnefly reviewed the status of the new bndge discussions He said a scoping document is circulating and there is some basis for believing the vanous stakeholders can reach consensus Mr Johnson, seconded representing Lakeview Hospital Type of Application Design Review Project Descnptaon Design review of Landscape Plan for the Parking Ramp area Discussion The applicant presented the landscape and lighting plans at the 2/2/04 HPC meeting After some discussion, it was decided that the landscape plan should include landscaping the ponding areas The decision to vote on the project was postponed until the plans were complete Mr Dufresne will present the plans at the meeting Recommendation Approval as conditioned Conditions of Approval 1 All revisions to the approved plan shall be reviewed and approved by the Heritage Preservation Commission Attachments- Application Form/Minutes from 2/2/04 HPC Mtg/Landscape plan for ponding areas City of Stillwater Hentage Preservation Commission February 2, 2004 long way toward crating a mixed use feel, that of a neighborhood commercial center, and downplaying the stnp development treatment The applicant and Nathaniel Shea, architect, were present Mr Shea reviewed revised plans which, he said, attempt to create a New England type village He reviewed elevations and floor plans, building materials, and possible sign locations, along with lettenng style He noted that signage has been eliminated from the second -floor office spaces and consolidated in a sign over one of the entnes to the second floor The back of trash enclosures will be utilized for signage and the previously proposed monument sign has been eliminated He said the proposed landscaping plan is unchanged except for the use of a different vanety of conifer to screen the parking area, as recommended by staff The parking lot lighting will use the same cut-off fixtures as used by the adjacent bank Gooseneck lighting will be used for the signage There was a bnef discussion of the detailing of the gable ends of the roof Most of the roof will be flat to provide screening for mechanicals Mr Peterson, seconded by Mr Eastwood, moved approval as conditioned Mr Johnson suggested it be noted details regarding the sign plan will come back to the HPC for approval, and Mr East -wood said it should be noted the monument sign has been removed Motion for approval passed 4-0, with Mr Tomten abstaining Case No DR/04-09 Design review of Phase II of Terra Springs, 640 North Main St Matthew Bnnza, representing the applicant Mr Bnnza reviewed plans for the 36-unit, 22,076 square -foot condominium complex The building incorporates the adaptive reuse of a portion of the existing masonry wall on site Other exterior materials include brick that is similar in color and texture to the histonc masonry, along with fiber cement board lap siding, corrugated metal siding and asphalt shingles The landscape and lighting plans are a continuation of that proposed for the entire Terra Spnngs development Bnck pavers will be used in walkways around the building and interpretive trail Also reviewed were lighting plans All mechanical units will be in the basement, as will the trash receptacles Mr Peterson moved approval as conditioned Mr Eastwood seconded the motion, motion passed unanimously Case No DR/04-10 Design review of landscape plan and lighting plan for Lakeview Hospital's parking ramp at 1104 and 1112 Everett St St Jeffrey Robertson, applicant 4 / City of Stillwater Hentage Preservation Commission February 2, 2004 Dick Dufresne of Walker Parking Consultants was present representing the applicant He reviewed the proposed lighting fixtures and placement Ms Fitzgerald had reviewed the landscaping plan Mr Johnson moved approval as conditioned, specifying that shoebox, down lit fixtures, PROFORMER-XL with flat lenses be approved at locations AA Mr Peterson seconded the motion Mr Lieberman asked about the retaining wall and landscaping proposed for the Greeley Street elevation and said he was not prepared to vote for approval absent those details Mr Dufresne said the applicant will develop those detailed plans when the impact of construction of the holding pond is known Mr Johnson agreed that he was interested in the plans for the ponding area Mr Lieberman moved to continue the case until the applicant provides complete plans for the Greeley Street elevation and the new pond It was decided to continue approval of both the landscaping and lighting plans to the March meeting Mr East ood seconded the motion to continue, motion passed unanimously Other items ® Bndge update Mr Lieberman provided a brief update on badge -related issues Demolition of the lift bridge is off the table, he said SHPO favors future use of the lift bridge as a limited local traffic roadway or as a bike/pedestrian way Several members spoke in favor of keeping the lift bndge open to traffic Mr Lieberman also noted that the no -build alternative has been removed from the table for consideration o News rack policy Ms Fitzgerald gave an update on the recently approved policy Mr Johnson suggested that item C-1 should be clanfied to include the boundanes of the Histonc Distnct, as well as F-2 to enumerate the total number of boxes allowed Mr Johnson also questioned why it was necessary to designate the use of black iron boxes Mr Lieberman said he thought the measure should be an ordinance rather than a policy o Members were asked to be thinking about the Preservation Awards to be presented in May o Mr Lieberman noted for the record that the Bed and Breakfast Discussion The applicant is requesting design review of an amendment to one of the conditions of approval that was presented at the 2/12/04 Planning Commission meeting (Zoning Permit attached) This item will go to the Planning Commission on May 10, 2004 for the amendment approval The condition of approval the applicant is refernng to is Condition 16 The condition states 16 All extemal lighting must be maintained at the lowest wattage feasible and extinguished at 9 00 p m The two (2) lights on the front porch of the B & B, as well as the lamppost Tight at the front steps of the B & B may remain on Due to a complaint from a neighbor and concern for the safety of the guests, the applicants are revising their lighting plan The new plan eliminates the three tall Victorian -style post lamps The lights proposed are eight, downlit low -voltage fixtures that would light the paved walkway from the parking area to the front entrance of the Inn Plantings around the light fixtures will partially obscure them (A copy of the fixture is attached) Additionally, the approved plan called for two lights on the grapery structure The grapery is between the parking and the Inn This has been a concern to the neighbor The applicants have reduced the number to one The light will be concealed within the roof There will also be four pathway fights for the handicapped - accessible room in the carnage house They will be on a notion detector sensor In close proximity to the sidewalk, inside the grapery, is a fountain It is lit with a low voltage Tight bulb It helps Tight the sidewalk in that area If it is not used, another Tight fixture will be needed for the walkway There is a light on the east side of the carnage house, used by the guests and the innkeeper, who resides on the first floor of the carnage house This light is out of view of the neighbor It also provides adequate light for the parking area Recommendation Approval as conditioned Conditions of APPROVAL OF REVISED LIGHTING PLAN FOR RIVERTOWN INN APPROVAL OF THE PAINT COLORS FOR THE CARRIAGE HOUSE DATE Apnl 23, 2004 1 Condition 16 of Rivertown Inn's Special Use Permit Please refer to the attached memo directed to the Stillwater Planning Commission dated April 23, 2004 for an explanation of our request to alter this condition to read as follows All external fighting will be maintained at the lowest possible wattage feasible to allow guests safe access from the parking area, sidewalk to the front entrance of the Inn Additionally, approved fighting may remain on to adequately light parking area, walkway and carriage house entrance 2 Revised Lighting Plan We are asking the HPC to approve our revised lighting plan, attached hereto Please refer to the attached memo directed to the Stillwater Planning Commission, dated Apnl 23, 2004, which outlines the reasons for this request 3 Carnage House Paint Color We are requesting approval for the paint colors on the carnage house After considering the massing of the carnage house we are suggesting a more traditional 19th century theme for this building We would like to change the exterior appearance by amending the colors to suit the paint guidelines of urban architects of the 19' century We are requesting permission to paint the body of the building classic burgundy (current accent trim color of the Rivertown Inn) Paint the trim antique white Window sashes and eave moldings black forest green Accents to be sage green and Anjou pear to highlight Victorian details The paint scheme will reinforce the fact that this served as a utility building in the 19th century and is in keeping with the spent of the restoration of the property We have also given the adjacent neighbor (referred to in Apnl 23 document to Planning Commission) the opportunity to select their preference of color for the west facing wall to maintain the aesthetics of their garden, if they would prefer Additional updates to the project The sidewalk and landscaping project is to begin on or about May 1 The previously approved HPC plan calls for the replacement of all existing sidewalks In addition, we are removing the existing patio area on the south side of the carnage house to increase the green space and allow for planting additional trees to increase buffenng between the Inn and adjacent residences Previously approved signage will be installed about June 1 to allow us to permanently remove the old sign which has served as a temporary solution The roof of the carnage house, which is in dire need of replacement, should begin as soon as all necessary arrangements can be made to accomplish the task Painting continues, and the new Agatha Chnstie Suite is scheduled to open in late May, despite many delays FROM RIVERTOWN INN BED AND BREAKFAST TO CITY OF STILLWATER PLANNING COMMISSION Julie and Jeff Anderson EDWARD C HAWKSFORD Designer RE CONDITION 16 OF SPECIAL USE PERMIT for RIVERTOWN INN REVISED LIGHTING PLAN FOR RIVERTOWN INN DATE Apnl 23, 2004 Condition 16 of the Rivertown Inn Special Use Permit currently states as follows All external lighting must be maintained at the lowest wattage feasible and be extinguished at 9pm The two lights on the front porch of the B &B, as well as the light at the front steps to the B & B may remain on Due to a neighbor complaint, as well as our concern for the safety our guests, we are proposing a revised lighting plan, in addition to a modification of the above Condition 16 of our Special Use Permit Rivertown Inn previously presented the Planning Commission with a lighting plan It was approved as presented Our lighting is due to be installed in May, 2004 Since the approval of the onginal plan the City has received numerous complaints from the aforementioned neighbor about the number of existing lights, the location of those fights, the length of time the lights are left on, and the intensity of the lights In an effort to accommodate this neighbor, we are proposing an alternative lighting plan The new plan eliminates three tall Victorian -style post lamps in favor of a down -light low -voltage system consisting of eight small lights, which will exclusively light the paved sidewalk from the parking area to the front entrance of the Inn Plantings around this low -voltage system will partially obscure it A photocopy of the lights is attached, as well as a copy of the proposed plan This approach to lighting the sidewalk is much less intrusive than the post lights may have been Additionally, the previous plan featured two lights on the grapery structure (The grapery is a structure between the parking area and the inn) As this has been another source of concern for our neighbor, we have reduced the number of lights on this structure to one This light is concealed within the ceiling of the structure New to this plan, but entirely out of view from the neighbor, are four pathway lights for the handicapped -accessible room m the carriage house These are on a motion -detector sensor City of Stillwater Planning Commission April 23, 2004 Page 2 REGARDING CONDITION 16 OF THE SPECIAL USE PERMIT We feel that it is unsafe and unreasonable, if not a violation of law, to extinguish path lighting, carnage house access and parking area lighting by 9pm, when we know that guests frequently are using all of these areas for access If it is not a violation of law, it is extremely negligent, and if the city were to not allow lighting in areas of access, we would expect indemnification from them As responsible business owners we must provide a properly lit access for our guests from their car to the front entrance of the mn, at all times of the day or night Guests of our inn typically arrive mid -afternoon, and come and go downtown to shop or have dinner Dnving into a dark parking area and walking a dark or poorly illuminated winding sidewalk approximately 80 feet long upon their return is clearly unsafe Our insurance Garner requires all walkways at the inn be "adequately illuminated " In close proximity to the sidewalk, immediately inside the grapery, is a large fountain It is currently illuminated with the lowest available bulb This low light on this structure provides light around the entrance to the sidewalk, and is incorporated into our lighting plan as a safety light, eliminating the need for a low voltage light in that space If we do not light the fountain, another light will be needed m its place The light on the east side of the carnage house is out of view of our neighbor This light illuminates this entrance for our guests to the two guest rooms inside, as well as the residence of our innkeeper, Lisa Lothson, who resides on the first floor of the carnage house This single light provides adequate exterior lighting for the parking area, our innkeeper, and our guests In conclusion, Rivertown Inn respectfully requests the approval of the attached revised lighting plan which we believe gives genuine compromise on this issue Out of consideration and respect for our neighbors, as well as the safety of our guests, we believe it is the best solution Additionally we request the wording of condition 16 to read as follows All external lighting will be maintained at the lowest wattage feasible to allow guests safe access from the parking area to the front entrance of the Inn Additionally, approved
