order at 7 p m Approval of minutes Mr Tomten, seconded by Mr Miller, moved approval of the minutes of Apnl 3, 2000, all in favor Case No DR/00-10 Design review of addition at Ascension Episcopal Church, 214 N Third St Jim Chnstopherson, representing Ascension Church Present for the discussion were Jim Chnstopherson and Bob Zimmerman representing the architectural firm Bentz/Thompson/Rietow They noted they have met with city engineenng staff regarding drainage issues With the exception of the north side, the existing footpnnt of the buildings will not be changed a great deal Existing bnck/stone will be matched as closely as possible, window glazing will be done to match the existing coloration in the pansh hall, and roof pitches will remain the same There was a question about the location of the transformer/condensing umt and the trash enclosure The transformer/condensing umt will be placed at the west end of the church building and be screened by landscaping The existing trash enclosure will be utilized Mr Kimbrel asked about extenor lighting Mr Zimmerman noted a site plan with cuts of lighting types was included in the packet, some existing wall sconces will be utilized Mr Johnson noted that conditions of approval No 2 and No 8 were redundant Mr Johnson moved approval as conditioned, eliminated condition of approval No 8 and changing condition of approval No 2 to read, "All hghtmg shall be directed away from the street and adjacent properties Light sources shall be shielded from direct view and protected from damage by vehicles " Mr Kimbrel seconded the motion Ms Diem asked if the architects had met with building officials regarding spnnkhng requirements, Mr Zimmerman responded in the affirmative and said the spnnkhng requirements will not affect the architecture Motion of approval passed unanimously Case No DR/00-09 Design review of extenor signage for Wells Fargo Bank at 2000 Northwestern Ave Robert Sherlock — Signart Co Inc representing Wells Fargo • • • Mr Sherlock was present He said there will not be any new signs, faces will be replaced on the existing signs He also noted the existing marquee signage will be eliminated, the structure will Hentage Preservation Commission May 1, 2000 remain, but it will be non -illuminated Also some existing signs that currently are illuminated will be non -illuminated when the new sign faces are installed The ATM signage will be addressed in a separate request Mr Johnson noted that the original proposal had the corporate stagecoach logo on the directional signs and that a revised proposal has been submitted removing the corporate logo Mr Tomten moved approval as condition, reiterating that corporate logos are not allowed and will not be used on information/directional signage Mr Miller seconded the motion Mr Johnson suggested adding for the record that the marquee signage is being removed, Mr Tomten noted that signage is an allowed use and therefore isn't an issue regarding a possible grandfathenng of use Motion of approval passed unanimously Case No DR/00-19 Design review of a boat ticket office south of the Main Street parking lot Mark Balay, representing Andiamo Enterpnses Mr Balay explaining the location of the site The request is for a 25x50' structure of galvanized siding in keeping with the industnal look in the area, he said, with wood trim soffit Lights would be placed at the front entrance only The request is for two signs, one flush mounted above the entrance and other mounted vertically off the roof on the west elevation Colors would be red with a dark gray or bronze background, Mr Balay said he would return with final colors for the signage and the building tnm/framing Ms Fitzgerald noted that just one sign is allowed Mr Kimbrel asked about landscaping Mr Balay said that except for the area nght in front of the entrance, there will be gravel the rest of the way to the end of the property, there will be some shrubs and plantings Mr Balay also noted the DOT owns the property from the highway to the proposed site Mr Johnson asked about lighting Mr Balay said he would like to use pedestnan lights similar to the NSP lights, and he said the existing NSP pole fights on the property will likely remain Mr Johnson said he would like to see the floodlights removed from the utility poles, Ms Fitzgerald will check to see if that is possible Mr Eastwood expressed a concern about the use of the galvanized siding Later in the discussion, Mr Tomten noted the design guidelines call for new construction to be of matenals compatible with surrounding structures, and Mr Miller pointed out there are other buildings m the downtown constructed of the corrugated siding Mr Tomten said he would be more concerned if the proposal was to use vinyl siding • • s Hentage Preservation Commission May 1, 2000 Mr Miller asked about the number of parking spaces Mr Balay said a vanance will be required for parking as the property where parking will be located is leased from the railroad, unofficially, he said, the site can accommodate about 45 cars Mr Lieberman, seconded by Mr Johnson, moved approval as conditioned Motion passed unanimously Case No SUP/DR/00-28 Design review of four -unit housing structure located on Olive Street between Second Street and Third Street Donald and Marianne Nolde, applicants Present for the discussion were Donald and Mananne Nolde and architect Jerry Runk It «as noted that height is not an issue The building is about 10 feet under the maximum allowable 50 foot building height The only vanance required is for construction of residential units in the downtown business distnct Mr Runk bnefly reviewed design plans and provided samples of bnck/rock-face concrete block and cloth awnings Most of the discussion centered on ways to improve the pedestnan scale appearance of the building Suggestions included the introduction of some bnck by the garage doors and the use of a bnck pilaster at the west end to terminate with a brick corner post at the other end Mr Lieberman summed up the discussion by saying he thought it is important to provide residential housing in the downtown area Mr Kimbrel moved to approve as conditioned with the applicant to provide a bnck pilaster on the west corner and landscaping if possible Mr Johnson seconded the motion, motion passed unanimously Other items • Presentation of draft Hersey Staples & Co architectural survey by Don Empson Mr Empson said the narrative is pretty much done and is on schedule, a final draft should be completed m a month or two Members expressed appreciation of the readability of the document Mr Kimbrel noted that #20 is missing from the descnption of the Bird's Eye View Map Mr Johnson asked if in addition to listing homes by date, it might also be possible to list the homes by streets • HPC annual awards Ms Fitzgerald noted the awards were to be presented at the May 2 City Council meeting Mr Lieberman was to attend the meeting for the presentations • Ms Diem provided elevations of the addition/renovation project at St Michael's Catholic Church Mr Johnson said he thought the HPC should review the project Ms Fitzgerald said she will check with Mr Russell on that issue • Mr Johnson raised an issue regarding a wall pack mounted by the doors at the new ice sheet at the Recreation Center • • • Hentage Works Facility and Park with Shared Parking PUD/01-29 Discussion The application is a PUD permit for the development of a 15-acre site, into a public works facility and park A tributary to Brown's Creek runs along the southern boundary of the site Approximately 1/3 of the 15-acres is wetland and not developed Residential uses in Spnng Creek Subdivision to the south and a residence directly to the west, boarder the site A parcel owned by Stillwater Township dedicated for park use, is located along Boutwell Road directly east of the development site Boutwell Road provides site access off of Manning Avenue, a pnmary artenal road (See attached site map) Dunng summer/fall 2000, a site study was conducted by the City to evaluate the feasibility of the site for a public works facility Neighborhood meetings were held The Planning Commission, Joint Board and City Council participated in the feasibility study The site analysis map provides a visual review of site and surrounding area conditions and a context for site development After a detailed site analysis including a wetland delineation and natural resource inventory, a site plan was developed for the Public Works Facility/neighborhood park (See site plan map) Table 1 lists the vanous components to the site plan with square footage With minor adjustments for public comments and space needs, the proposal before the Planning Commission is the same as the one resulting from the 2000 study Areas of special concern are site access, parking, outside storage buffer/screening and relationship to park use (The site and building design is reminiscent of a rural farmstead ) Dnveway access to the site is provided in two locations off of Boutwell Shared facility/park use is shown to the east while the west access is for service only The Public Works buildmg is positioned to the front of the lot to block views of the work area and take advantage of the southern exposure The garage doors open to the mtenor of the site An outside storage area is positioned to the South of the main buildmg area The storage area is screened by landscaping, a nursery and fencing A salt storage building is shown in the courtyard area of the main public works building A ball field is located east of the Public Works site, shared parking is provided A possible community • • • meeting room in the Public Works Facility uses the shared parking lots Storm water infiltration areas separate the development site from the Spring Creek wetland area A review of the project with the new Public Works Facility ordinances indicate lot area, setback, lot coverage and height limits are met The master plan does not include detail on storm water management, site lighting, mechanical equipment location, landscape plan detail and park improvements To accomplish the park improvements, cooperation with Stillwater Township may be necessary The areas not covered by the plan can be addressed by condition of approval and additional review by the Planning Commission when the details are available In addition to Planning Commission review, the project requires separate design review Recommendation Approval Funding The development is consistent with the revised comprehensive plan and PWFD zoning requirements Conditions of Approval 1 A lighting plan shall be submitted showing fixture design, locations, and illumination No light source shall be visible from an off site location 2 A grading/drainage/erosion control plan shall be submitted for review by the City Engineer and Brown's Creek Watershed Distnct 3 Any site or park signage shall be low profile and consistent with the rural character of the area 4 A detailed landscape plan showing plant type, size and planting spacing shall be provided for City approval before a 2001 concept There also has been discussion of roof -top storage to control runoff rates The hope is to have more definitive specs and plans by July Mr Wallis stated plans have been presented to the Heritage Preservation Commission, and he has no problems with the 21 conditions of approval Mr Hultman asked about the proposed shoebox style lighting and asked if the applicant might consider some more histoncally appropriate style, Mr Wallis noted they will be returning to the HPC regarding light fixture styles, and he stated they are trying to use a lot of histoncally appropnate matenals Mr Wallis briefly reviewed the retail space use, and noted that the HPC has recommended that the Main Street elevation be made more pedestnan friendly, the applicant will be working with the HPC on that concept Mr Middleton asked how the proposal fits into the Riverway regulations Mr Russell noted Riverway regulations do not apply to the plan, only the Flood Plain and Central Business Distnct regulations are applicable Ron Anderson, 216 W Orleans St , commented on the proposed underground parking and suggested that the applicant might need some infrastructure to keep hydrostatic pressure at a minimum Bobbi Brohard, 919 S Fourth St , asked about the length of the building The building will be 240' across the front elevation Linda Amrein, 307 E Laurel, asked about the cost of the units and spoke about affordable housing needs Mr Wallis noted that is an issue and the applicant is looking at granting sources Ms Amrein also asked about the height, Mr Wallis explained the building needs to be at the maximum allowable height, 50', to make the project work Mr Wald moved to give concept approval as conditioned, with the applicant to work with staff in refining design plans Mrs Bealka seconded the motion, motion passed unanunously Case No CPA/01-01 A Comprehensive Plan amendment changing land use designation of 15 acres of land south of Boutwell Road and west of Boutwell Cemetery from Single Family to Public Facility City of Stillwater, applicant Mr Russell stated the site has been purchased for a public works facility The zonmg district sets the performance standards, such as noise levels, landscaping and other requirements Ron Anderson, 216 W Orleans St , asked who would pay for the road improvements Mr Russell noted the street has been annexed to the city and is a potential State Aid Street, also he said improvements are slated in conjunction with the Settler's Glen development Mr Russell said he was not sure of the exact formula regarding the cost shanng of Development approval for development of portions of a 15- acre site into a 40,000 square foot public works facility with outdoor storage City of Stillwater, applicant City Engineer Klayton Eckles introduced the presentation by noting that the City has been looking for a site for a public works facility since 1994 The architectural firm workmg on the plans and specifications for the facility has received input from neighbors The site will also include some park space, and the building design includes space for neighborhood meetings Wayne Branum of SALA Architects reviewed the site/building plans which reflect the rural character of the neighborhood Mr Gag, seconded by Mr Wald, moved approval as conditioned, motion passed unanimously Public Hearing on Minnesota Department of Transportation TH 36 Corridor Management Plan Present for the discussion were Doug Fisher, deputy director of the Washington County Transportation Department, Scott McBnde, consultant with SEH, and Linda Heath of MnDOT Mr McBride reviewed the plan vision and implementation process The vision includes a goal of an average speed of 55 mph through the comdor He stated there are two preliminary plans for the Stillwater area Plan A, eliminating the Oakgreen/Greeley access, Plan B, leaving the 3 existing traffic signals should a new bndge not be constructed Ms Heath reviewed the shared strategies, asking Stillwater to participate m the comdor management team, asking that the management plan be incorporated into the City's Comprehensive Plan and asking that the City adopt a resolution recognizing the significance of the interregional highway comdor 9 o )DR-1bl - ZZ ORDINANCE NO 909 • • AN ORDINANCE AMENDING THE CITY CODE BY ADDING CHAPTER 31 SECTION 21-2 PUBLIC WORKS FACILITY The City Council of the City of Stillwater does ordain 1 AMENDING Chapter 31 of the City Code entitled Zoning is amended as follows a) Chapter 31-1, subd 10 is amended by adding a new paragraph (16) that will read as follows "(16) PWFD Public Works Facility District" b) A new zoning text is enacted as 31-1, subd 21 2 that will read as follows "Subd 21 1 Public Works Facility The PWFD, Public Works Facility Distnct is regulated as follows ,, (1) Purpose The purpose of the PWFD is to provide a district for Public Works Facility uses (2) Planned Unit Development Permit Required No building, structure, land or premises in the PWFD may be used and no building or structure may be constructed except those granted a Planned Unit Development, ("PUD"), permit (3) Uses Permitted with a PUD Permit a Public Work Facility including office and meeting space b Any other use or service establishment determined by the planning commission to be of the same general character as the above use and will not impair the present or future character of the adjacent properties (4) Height and Area Regulations The maximum height of buildings or structures and minimum dimensions of lots and yard setbacks in the PWFD are as follows a Maximum height of all structures 45 feet b Minimum setbacks i All building or structures must be set back a minimum of 50 feet from any public right-of-way ii All buildings must be set back a minimum of 30 feet from any property line other than the street nght-of-ways in. vanances to allow redevelopment of the property at 501 North Main Street 1 A vanance to allow a 5-foot front yard setback where 15 feet is required, 2 A vanance to allow a 10 5-foot rear yard setback where 20 feet us required, 3 A variance to provide 76 on -site parking stalls where 92 are required, and 4 A vanance to allow a four-story building that is 53 feet high at the roofline and 62 8 feet high at the top of the parapet where the ordinance limits building height to 50 feet The variances are required to redevelop this small, polluted former gas station site With a redevelopment site, it is difficult to meet current ordinance standards, as the property was subdivided under a different set of standards than exists today Approval of the requested vanances provides an opportunity for redevelopment of a site that is known to be polluted by a former gas station Vanances would be required for any redevelopment of the site, due to the site constraints, but we have tned to minimize the extent and impact of the four requested vanances The requested vanances meet the three vanance standards as follows 1 A hardship peculiar to the property, not created by any act of the owner, exists Personal, family or financial difficulties, loss of prospective profits and neighbonng violations are not hardships justifying a vanance The requested vanances are required to eliminate the unique hardships caused by the floodplain issues, shallow lot depth, relatively small commercial lot, poor soils and contaminated soils located on this property The proposed variances are required in order to allow redevelopment of the site This shallow parcel is only 138 deep on the north side of the property We have tned to minimize the need for vanances, but vanances are required in order to redevelop the lot The additional 18 feet of MnDOT property adjacent to the Main Street (T H 95) nght-of-way appears to part of this property, therefore, the reduced front yard setback would not be noticeable from the adjacent properties The rear yard setback is required for the exit stairway on the rear of the building and would be separated from adjacent properties by the railroad nght-of-way and 62 8 feet to the top of the'building parapet The hardship is caused by the Zoning Ordinance, which has both a maximum number of building stones and a maximum building height While our building would be only four stones, the total building height is slightly more than the ordinance standard because of the building code requirements, mechanical equipment design requirements and the requirements of today's consumer The size of the lot, the floodplain requirements and the ordinance requirements create hardships that limit the developer's ability to provide parking in compliance with ordinance standards One of the challenges of developing in histonc communities, like Stillwater, is that the lots were platted prior to the nse of the Amencan automobile Consequently, the lot was platted without regard to the need for auto parking The poor soils and floodplain restnctions prohibit the developer from providing underground parking and the size of the site limits the amount of surface parking that can be accommodated The ordinance requires 58 parking spaces for the residential portion of the building and 34 spaces for the retail portion of the property We are proposing to provide a total of 76 parking spaces on this site, which we believe is adequate for the mix of uses The residents would have 39 indoor parking spaces available for the 29 condominium units and shared use of the surface parking The 34 surface parking spaces would generally be available for the retail users dunng the day, while many of the condominium owners are away from home The demand for retail parking spaces will be less in the evening when the condominium residents and guest will create a higher parking demand 2 A variance is necessary for the preservation and enjoyment of substantial property nghts, and, if granted would not constitute a special privilege not enjoyed by neighbors The setback and building vanances are required to allow the property owner to develop this property in a manner that is consistent with the City zoning map and the surrounding development The vanances would allow redevelopment of this currently underutilized site The parking vanance would allow the developer to improve the property consistent with other development in downtown Stillwater Given that the existing lot is small, it difficult to provide an economically viable project and provide the
