Memorandum
To Planning Commission
From Steve Russell, Community Development Director
Date 6-7-01
Subject Planned Unit Development Review for 40,000 sq/ft Public Works Facility and Park
with Shared Parking PUD/01-29
Discussion
The application is a PUD permit for the development of a 15-acre site, into a public works
facility and park
A tributary to Brown's Creek runs along the southern boundary of the site Approximately 1/3
of the 15-acres is wetland and not developed Residential uses in Spnng Creek Subdivision to
the south and a residence directly to the west, boarder the site A parcel owned by Stillwater
Township dedicated for park use, is located along Boutwell Road directly east of the
development site
Boutwell Road provides site access off of Manning Avenue, a pnmary artenal road (See
attached site map)
Dunng summer/fall 2000, a site study was conducted by the City to evaluate the feasibility of the
site for a public works facility Neighborhood meetings were held The Planning Commission,
Joint Board and City Council participated in the feasibility study
The site analysis map provides a visual review of site and surrounding area conditions and a
context for site development After a detailed site analysis including a wetland delineation and
natural resource inventory, a site plan was developed for the Public Works Facility/neighborhood
park (See site plan map) Table 1 lists the vanous components to the site plan with square
footage
With minor adjustments for public comments and space needs, the proposal before the Planning
Commission is the same as the one resulting from the 2000 study Areas of special concern are
site access, parking, outside storage buffer/screening and relationship to park use (The site and
building design is reminiscent of a rural farmstead )
Dnveway access to the site is provided in two locations off of Boutwell Shared facility/park use
is shown to the east while the west access is for service only The Public Works buildmg is
positioned to the front of the lot to block views of the work area and take advantage of the
southern exposure The garage doors open to the mtenor of the site An outside storage area is
positioned to the South of the main buildmg area The storage area is screened by landscaping, a
nursery and fencing
A salt storage building is shown in the courtyard area of the main public works building A ball
field is located east of the Public Works site, shared parking is provided A possible community

areas separate the development site from the Spring Creek wetland area
A review of the project with the new Public Works Facility ordinances indicate lot area, setback,
lot coverage and height limits are met The master plan does not include detail on storm water
management, site lighting, mechanical equipment location, landscape plan detail and park
improvements To accomplish the park improvements, cooperation with Stillwater Township
may be necessary The areas not covered by the plan can be addressed by condition of approval
and additional review by the Planning Commission when the details are available
In addition to Planning Commission review, the project requires separate design review

CASE NO V/DR/01-52
Hentage Preservation Date November 5, 2001
Project Location 501 North Main Street
Comprehensive Plan Distnct Central Business District
Zoning Distnct CBD
Applicant's Name Jeff Wallis
Type of Application Design Review
Project Descnption Design review of revised plans for retail/residential
budding
Discussion
The proposed plan is similar to the plan submitted earlier this year The
applicant has enclosed a letter that summarizes the changes between the current
plan and the plan that was submitted on May 25, 2001 To quote the letter, the
changes are as follows
1 A topographic and boundary survey has been completed by Landform and is included
in this submission
2 We have completed the title work for the property and found that the total property
area is 1 31 acres, not 1 45 acres as ongmaily noted The title work identified that an 18-
foot wide stnp of land adjacent to Main Street is actually owned by MnDOT and is not
part of the subject property as was onginally assumed
3 The proposed front yard setback has been reduced from 18 feet to 5 0 feet A
vanance is requested for this reduced front yard setback
4 The proposed rear yard setback has been reduced from 20 feet to 10 5 feet for a
small comer of the building and the patio exit stairway A vanance is requested for this
reduced rear yard setback
5 The budding was shifted north approximately 15 feet to accommodate additional
parking on the south
6 The building height has increased from four stones and 50 feet in height to four
stones and 53 feet in height to the roofline and 62 8 feet to the top of the parapet A
vanance is requested for the increased budding height
7 Mechanical units have been relocated to the roof and will be screened

8 The amount of retail space within the building increased from 5,106 square feet to
approximately 6,700 square feet
9 The number of condominium units was conceptually planned for 29-32 units in the
onginal submittal, we have now shown a total of 29 condominium units
10 The number of enclosed parking stalls has decreased from 59 stalls to 42 stalls This
continues to exceed the City requirement that 29 stalls be enclosed
11 The number of surface parking spaces has increased from 24 stalls to 34 stalls This
was accomplished by double -loading the parking area
12 The total number of on -site parking spaces has decreased from 83 stalls to 76 stalls
A vanance is requested to allow 76 stalls on -site where the ordinance requires 92
stalls for the proposed mix of uses
13 A grading and drainage plan has been prepared and is included in this submittal
14 We are proposing to raise the elevation of the building pad to allow the finished floor
elevation to be at 994 5, which is above the 1 00-year flood elevation
15 A NURP pond was added in the northeast comer of the property in compliance with
City, state and federal requirements This was not shown on the previous submittal
16 The grading plan shows that the building pad will be elevated above the 1 00-year
flood plain elevation This would comply with the flood protection ordinance
17 The landscaping plan has been revised to address issues raised by the Planning
Commission
18 The lighting plan has been revised
19 A sign plan has been prepared
20 We have eliminated one curb cut onto Main Street (T H 95) as requested by
MnDOT
21 The garage door has been eliminated from the front elevation as a result of
MnDOT's requirement that one of the existing curb cuts be removed
22 The property area has been reduced, therefore, the green space area has
decreased from 37 percent to 26 percent of the lot area
23 A utility plan has been prepared and has been included in this submittal
24 Building floor plans have been prepared and are included in this submittal
25 The building elevations have been revised

26 A new exit stairway is proposed from the first floor patio on the garage roof at the
rear of the building Secunty to the patio will be provided by an access keycard
system on the security door
27 Several building structural changes were made as additional information was
received and plans were refined
28 The use of EFIS has been limited on the building elevation as suggested by the
City at the previous submittal
29 We are continuing to work with staff to ensure compliance with the City's flood
protection plan At this time we are proposing to construct a floodwall east of the
proposed building for flood protection
30 We have added pedestnan connections from Main Street as recommended by
the Historic Preservation Commission and the Planning Commission
31 We have included a connection from the parking lot to the eastern edge of our
property to provide a connection to the future City trail planned for the railroad

Variance Narrative
We are requesting approval of the fofowing four vanances to allow
redevelopment of the property at 501 North Main Street
1 A vanance to allow a 5-foot front yard setback where 15 feet is required,
2 A vanance to allow a 10 5-foot rear yard setback where 20 feet us required,
3 A variance to provide 76 on -site parking stalls where 92 are required, and
4 A vanance to allow a four-story building that is 53 feet high at the roofline and
62 8 feet high at the top of the parapet where the ordinance limits building
height to 50 feet
The variances are required to redevelop this small, polluted former gas station
site With a redevelopment site, it is difficult to meet current ordinance
standards, as the property was subdivided under a different set of standards
than exists today Approval of the requested vanances provides an opportunity
for redevelopment of a site that is known to be polluted by a former gas station
Vanances would be required for any redevelopment of the site, due to the site
constraints, but we have tned to minimize the extent and impact of the four
requested vanances
The requested vanances meet the three vanance standards as follows
1 A hardship peculiar to the property, not created by any act of the owner,
exists Personal, family or financial difficulties, loss of prospective profits
and neighbonng violations are not hardships justifying a vanance
The requested vanances are required to eliminate the unique hardships
caused by the floodplain issues, shallow lot depth, relatively small
commercial lot, poor soils and contaminated soils located on this property
The proposed variances are required in order to allow redevelopment of the
site
This shallow parcel is only 138 deep on the north side of the property We
have tned to minimize the need for vanances, but vanances are required in
order to redevelop the lot The additional 18 feet of MnDOT property
adjacent to the Main Street (T H 95) nght-of-way appears to part of this
property, therefore, the reduced front yard setback would not be noticeable
from the adjacent properties The rear yard setback is required for the exit
stairway on the rear of the building and would be separated from adjacent
properties by the railroad nght-of-way and, therefore, would not be
noticeable from surrounding properties

Re 501 North Main Street
October 26 2001
Although the proposed budding is only four stones high, as permitted in the
Zoning Ordinance, the design of the building results in a total building height
of 53 feet and 62 8 feet to the top of the'building parapet The hardship is
caused by the Zoning Ordinance, which has both a maximum number of
building stones and a maximum building height While our building would
be only four stones, the total building height is slightly more than the
ordinance standard because of the building code requirements, mechanical
equipment design requirements and the requirements of today's consumer
The size of the lot, the floodplain requirements and the ordinance
requirements create hardships that limit the developer's ability to provide
parking in compliance with ordinance standards One of the challenges of
developing in histonc communities, like Stillwater, is that the lots were
platted prior to the nse of the Amencan automobile Consequently, the lot
was platted without regard to the need for auto parking The poor soils and
floodplain restnctions prohibit the developer from providing underground
parking and the size of the site limits the amount of surface parking that can
be accommodated The ordinance requires 58 parking spaces for the
residential portion of the building and 34 spaces for the retail portion of the
property We are proposing to provide a total of 76 parking spaces on this
site, which we believe is adequate for the mix of uses The residents would
have 39 indoor parking spaces available for the 29 condominium units and
shared use of the surface parking The 34 surface parking spaces would
generally be available for the retail users dunng the day, while many of the
condominium owners are away from home The demand for retail parking
spaces will be less in the evening when the condominium residents and
guest will create a higher parking demand
2 A variance is necessary for the preservation and enjoyment of substantial
property nghts, and, if granted would not constitute a special privilege not
enjoyed by neighbors
The setback and building vanances are required to allow the property owner
to develop this property in a manner that is consistent with the City zoning
map and the surrounding development The vanances would allow
redevelopment of this currently underutilized site
The parking vanance would allow the developer to improve the property
consistent with other development in downtown Stillwater Given that the
existing lot is small, it difficult to provide an economically viable project and
provide the number of parking stalls generally required by the zoning
ordinance However, we have provided a mix of uses that would be
complementary and would allow shared parking

3 The authonzng of the variance will not be of substantial detriment to
adjacent property and will not materially impair the purpose and intent of this
section or the publ►c interest nor adversely affect the comprehensive plan
The requested vanances would not be a detnment to the adjacent property,
nor would they matenally impair the purpose or intent of the Zoning
Ordinance or other city policies and requirements Furthermore,
redevelopment of the property would allow attractive reuse of a currently
underutilized property The proposed mix of retail and residential uses
would improve the appearance of the property and would be an
Improvement for this area of Stillwater The requested vanances would not
be immediately recognizable to a passerby, but the improvement to the
property would be an asset to the neighborhood and the City of Stillwater at -
large Furthermore, the vanances would not negatively affect adjacent
properties, because Main Street (TH 95) separates the subject property from
the properties on the west and the abandoned railroad property separates
the subject properties from the Dock Cafe and the St Croix River

Suite # 200 Minneapolis, Minnesota 55426
Developer Don and Marianne Nolde
311 South 3rd Street
Stillwater, Minnesota
(651) 439 2645
Site The site is an existing lot located on the South side of Olive Street between 2nd and 3rd
Streets The site is owned by the developer and at the present time is undeveloped
Proposed Development The proposed project is a 4 unit, 3 story, residential structure with
8 enclosed parking spaces The housing units consist of 1, two -bedroom townhouse style unit, and 3,
two bedroom single level units Enclosed parking is provided in a semi underground parking garage
located below the housing units (This is a change from 3 townhouse style units and 1 single level
unit)
Zoning The site is presently zoned CBD A conditional use permit was previously applied
for and granted by the Planning Commission on May 8th ,2000
Variance Required The building foot print and location on site is basically the same as presented to
and approved by the Planning Commission on May 8th of 2000 As the plan has developed and the
market for single level units rather than two level units has been recognized, the need for an escape
stair from the third floor unit and exterior deck space for upper level units have been identified The
variance requested is to allow the construction of an exterior exit stairway and two elevated decks on
the east side of the building over the roof deck of the basement parking garage Neither the deck nor
stairway eliminate any green space and are located on the side of the building adjacent to the Qwest
commercial property
