Motion by Mark Ehlenz, seconded by Judy Curtis to approve the

Steve Russell presented the application and explained that the
property owners petitioned for annexation of 2 7 acres of land
The township does not oppose the annexation
Motion by Mark Ehlenz, seconded by Glenna Bealka to adopt the
resolution approving Case No CPA/89-4 Roll call was taken,
motion carried 5-0
Case No ZAM/89-44 - Zoning Ordinance Text Amendment to zone a
2 7 acre pircrl of lane RA Single Rimily Residential City of
Stillwater, Applicant
Steve Russell presented the application The 2 7 acres discussed
in the previous case (CPA/89-4) should be zoned single family
residential to be consistent with the e%isting character of the
area and development compatible with the land
Motion by Judy Curtis, seconded by Mark Ehlenz to adopt the
resolution approving Case No ZAM/89 -44 Roll call was taken,
motion carried 5-0
• Case No. SUB/89-73 - A minor subdivision of a 2 7 acre parcel
into three lots of 34,100, 43,090, and 34,100 square feet at 8031

Motion by Nancy Putz, seconded by Judy Curtis to approve Case No
SUB/89-73 Motion carried 5-0
Case No V/89-74 - A variance to the Sign ordinance setback

Richard C Ernst presented the application He explained that
tenants on the upper level need exposure to drive -by traffic
There are currently eight tenants upstairs with space for another

wants the business names on the boulevard sign, staff suggested
putting the business names on a sign on the building There is
also a problem with the sign extending onto county right-of-way
The applicant and the Commission agreed to table the request The
• applicant will redesign the sign for reviewal at the next
meeting
Motion by Nancy Putz, seconded by Mark Ehlenz to table Case No
V/89-74 until the December 11 Planning Commission meeting Motion
carried 5-0
Case No V/89-75 - Variance to the frontyard setback requirement
(twelve feet proposed, thirty feet required) for the construction
of a home with an attached garage at 900 North Broadway in the RB
Two Family Residential District
Larry Lappi presented the application He stated that this is the
most practical location to build on this property because of the
topography of the lot
Glen Goggin, owner of the lot directly north of the property,
stated that allowing this home to be built 18 feet closer to the
street will hurt the value of his property
Judy Curtis stated that she feels there is a definite hardship
because of the topography of the lot
Motion by Nancy Putz, seconded by Mark Ehlenz to approve Case No
V/89-75 with two conditions as stated Motion carried 5-0

TYPE OF APPLICATION: Variance
PROJECT DESCRIPTION:
Variance to the Sign Ordinance for placement of 10 foot tall, 112 square foot
(141x8') sign with no front setback (fifteen foot setback requirement, maximum
sign size 100 square feet).
DISCUSSION:
The request is to construct a ten foot tall, fourteen foot wide by eight foot
high ground mounted free standing sign next to the parking lot in front of the
Greeley Square Development. The applicant would like to place the sign
directly in front of the parking lot perpendicular to the parking lot. This
would result in the sign overhanging the property line by approximately four
feet. The Greeley Street right-of-way is owned by Washington County Public
Works. In discussions of this application, they indicated that private
advertising signs are not allowed on or over the right-of-way.
The sign size is very large for this type of sign, fourteen foot wide by eight
feet tall, and it is unusual to have office tenants located on such a sign. It
is recommended that the sign be used only for identifying the Shopping Center,
Greeley Square and address and that a directory of second floor office uses be
located on the building next to the entryway to the offices. It is not
practical or desirable to have all building office users identified on the
commercial center sign. The Greeley Square Center sign could then be sized
more appropriately for this purpose, four feet by ten feet. At this size the
sign would fit within the developments property.
RECOMMENDATION:
Denial or continuance of request for redesign consistent with Staff comments.

PROJECT DESCRIPTION
A Special Use Permit to convert a first floor meat market into a bar and
conversion of a third floor bar into banquet facilities
DISCUSSION
The request is to relocate Brine's Bar, located on the third floor, to a first
floor location in the same building The existing bar will then be used as a
banquet facility This request requires a Special Use Permit for this type of
use in Downtown Stillwater due to the limited space for parking The block
that Brine's is located has the highest demand for parking in Downtown
Stillwater
The proposal for the new bar on the first floor consists of seating for 110
customers along with areas for darts and a pool table The bar will offer
quick, over-the-counter foods served by the bartender
The banquet facilities on the third floor will be used for special functions
such as meetings, large group gatherings, and small weddings The seating for
this facility is 125 patrons The present lunch room on the second floor seats
110 customers The total customers for the three floors is 345 15-20
employees may be working if all uses are functioning to capacity Parking
required for the whole Brine's complex is 71 according to the Parking
Ordinance If course, this requirement cannot be met due to their location in
Downtown Stillwater

1 All employees shall park in employee designated lots

The request is to vacate the whole portion of Linden Street between North Main
Street and the Burlington Northern Railroad right-of-way This street is not
shown on the present map of Stillwater and may have been vacated sometime
during the past one hundred and forty five years However, the Myron Shepard's
Perfected Plat of Stillwater, as shown, does have this street platted There
is nothing of City record that states a street vacation was ever granted on
this section of Linden Street In order to clear the title on the property,
the Desch's are requesting this street vacation
RECOMMENDATION Approval for the street vacation
FINDINGS
The proposed street vacation is consistent with the Land Use Plan

Portion of Linden Street together with our check in the amount of
$100 00 for the filing fee As we have discussed previously,
most of the maps for the City of Stillwater do not show this
portion of Linden Street, or in the alternative show it as
vacated, except for the Myron Shepard's Perfected Plat of
Stillwater In view of that discrepancy and because there is
nothing of record showing the vacation of Linden Street, my
clients who are the owners of Parcel 1 shown on the attached
sketch have petitioned for this vacation Also, in order to
solve this cloud on the title for property to the east, Barry
Stack has prepared the description so that we are vacating all
that part of Linden Street lying easterly of the west line of the
property owned by Mark and Gloria Desch If you have any

PROJECT DESCRIPTION
Special Use Permit request and use determination for office/warehouse building
with 1,850 square feet of retail space in the IP-I District
DISCUSSION
The application is to construct a 12,720 square foot commercial building witn
3,350 square feet of office use, 4,020 square feet of meat processing
(manufacturing use), 3,500 square feet of warehouse use and 1,850 square feet
of retail use
• The building as proposed would have three leaseholders Leasehold "A" is for a
meat processing and sales use with 1,850 square feet of retail sales space
Leasehold "B" is for 2,500 square feet of office/warehouse and Leasehold "C"
for 4,000 square feet of office/warehouse The parking requirement for the
building is 37 spaces Forty spaces are provided
A use determination must be made to allow the retail use in the IP-I District
The proposed 1,850 square feet of retail space represents 15% of the leaseable
building floor use and 30% of leaseholder "A" floor space The majority of the
building use is a permitted use and the 15% retail use is incidental to the
manufacturing use The product sold will be manufactured on site
The site plan for Phase I construction includes a landscape and drainage plan
The landscape plans show street trees along Curve Crest and Washington Avenue
with a bermed planted area in the boulevard to screen the parking area
A trash enclosure is shown to the rear of the building
The East elevation of the building show the building materials as rockface
concrete block with accent trim and aluminum windows The project meets the
setback, height and lot coverage requirements
RECOMMENDATION Approval
CONDITIONS OF APPROVAL
1 A coordinated sign program for the building shall be submitted and
approved before any sign permits are issued
2 The trash enclosure shall be constructed of a sturdy masonary material
similar to the materials and colors of the building
3 The driveway access off of Curve Crest Blvd shall be closed and moved
to the West as shown on the plan when Curve Crest is improved
4 All mechanical equipment shall be located to the rear or located on the
roof of the structure and screened
5 Landscaping improvements shall be in or security provided before
building occupancy
6 A maximum of 1,850 square feet of building may be used for retail sales
incidental to products manufactured on sites
7 Comments from the City Engineer shall be incorporated into final
construction plans
8 Drainage and access easements shall be provided between the two most
Southerly lots

The follow-ng is a description of the use intended for Leasehold "A', sheet PA-1
(attached)
Brine's will be manufacturing meat products for distribution to outside retail facilities
This portion of the leasehold, plus the office support area, occupies 70% of the total
square footage of leasehold "A', the other 30% will consist oT retail (on site
distribution)
We feel adequate parkirg has been provided on the proposed site plar PA-1
Tem, Crary corner access at the S E corner is provided to the site now and would be
shi led west as Curve Crest Boulevard is extended
Considering the amount of retail existing on Washington Avenue and the proposed
retail to the west on Curve Crest, we feel this corner is a natural for low impact retail as
described here in
it s also our understanding that in the future, Curve Crest Boulevard could become a
fairly heavily traveled thoroughfare We feel it is important to develop this corner
properly with an attractive inviting building design The introduction of Brine's at this
corner would provide this opportunity
