APPROVAL OF MINUTES
Motion by Mark Ehlenz, seconded by Don Valsvik to approve the
minutes of the meeting of September 11, 1989 as submitted All in
favor
PUBLIC HEARINGS
Case No SUP/89-68 - Special Use Permit to conduct a retail craft
business in a home at 404 West Churchill Street in the RB, Two
Family Residential District
Cheryl Larson and Gretchen Anderson presented the request They
intend to produce gifts baskets and sell them at home parties
similar to Tupperware or Mary Kay The applicants understand the
three conditions of approval There were no comments from the
audience
Steve Russell reported that he received a phone call from a
neighbor wondering if approval of the request would lead to more
commercial business in the neighborhood The applicants stated
that their business would have no impact on the neighborhood
Judy Curtis stated that she saw no problem with this request, and
commended the applicants for applying for a permit since many
people operate home businesses without permits
Motion by Judy Curtis, seconded by Don Valsvik to approve the
Special Use Permit with three conditions Motion carried 7-0
Case No ZAT/89-8 - Zoning Ordinance Text Amendment for a new
comprehensive parking ordinance for the entire City of
Stillwater
Steve Russell presented the amendment for the City He requested
Planning Commission review and comment before approval by the
City Council

Motion by Don Valsvik, seconded by Mark Ehlenz to recommend for
approval to the City Council Motion carried 7-0
Case No SUB/89-69 - Preliminary Plat approval for the
subdivision of a 14 963 acre parcel (Outlot B, Parcel 3,
Stillwater Industrial Park) into seven lots on the Northeast
corner of Curve Crest Boulevard and Washington Avenue in the IP-
I, Industrial Park Industrial District Prime Site,
Incorporated, applicant
Representatives of Cedar Corp who are working with Prime Site,
presented the request The applicants are aware of the three
conditions of approval, but have not been able to contact the
developer regarding condition No 2
Steve Russell stated that the Park Dedication policy would apply
if a park fee has not yet been paid
The Commission determined that Condition No 2 should be revised
to read Lot #1 shall be combined with Lot #2 or road and
utilities extended to Lot 41, or Lot #1 will not be developed
• without road and utilities A fourth condition was added In
lieu of park fees will be paid as set forth in the Park
Dedication Policy if the developer has not yet done so
Motion by Don Valsvik to approve the Subdivision request with
four conditions Motion carried 7-0
Case No. 89-70 - Expansion and remodeling of Lily Lake School
Bill Anderson of Anderson -Dale Architects and Dan Parker of
School District 834 presented the request Steve Russell
explained that the request was added to the agenda because of the
short agenda and so that the project could be completed before
the next school year begins
Mr Parker explained that the project will expand student
capacity at Lily Lake by 180 students A new gymnasium with a
separate entrance, new mag classroom, new front entrance and some
office space will be added The present cafeteria and IMC will be
expanded
Motion by Judy Curtis, seconded by Jean Jacobson to approve the
variance and special use permit with two conditions Motion
carried 7-0
• OTHER ITEMS
Downtown Plan - The Commission reviewed the Downtown Improvement
Program meeting outline On Thursday, October 19 at 7 00 p m the
Commission will meet with the Downtown Plan Action Committee, the
Parks and Recreation Board, and the Heritage Preservation

SUBJECT COMPREHENSIVE PLAN AMENDMENT EXPANDING THE CITY BY ADDING
APPROXIMATELY 2 7 ACRES OF LAND TO THE CITY BOUNDARY (CASE NO
CPA/89-4)
BACKGROUND
The City was approached by the subject property owner to annex the 2 7 acre
property to the City The City Council reviewed their request and passed an
Ordinance as required by state law annexing the property to the City The
State Municipal Board (the state agency that reviews annexations) approved the
annexation petition
AMENDMENT DESCRIPTION
With the annexation, the City Comprehensive Plan must be amended and property
zoned for development The 2 7 acre site is located southeast of the
intersection of Walnut Creek Drive and Neal Avenue (see attached map)
Existing land use in the area is single family Oak Glen is located directly
to the north of the site The Sunset Ridge Estates is adjacent to the
property to the north and east Large lot single family development is located
along Neal Avenue in the Township City sewer and water services are available
to the site Access to the site is provided off of Neal Avenue The existing
Comprehensive Plan indicates the area for urban expansion between 1980-1985 A
single family residential use would be consistent with the existing character
of the area and development compatible with the land
RECOMMENDATION
Approval of Comprehensive Plan Amendment adding 2 7 acres to the City and
urban service area boundary and designation of land Single Family Residential

TO INCLUDE APPROXIMATELY 2 7 ACRES OF PROPERTY
EAST OF NEAL AVENUE AND SOUTH OF WALNUT CREEK DRIVE
AS AN AMENDMENT TO THE CITY COMPREHENSIVE PLAN
WHEREAS, the Metropolitan Land Planning Act of 1976 requires that amendments
to Comprehensive Plans of local governments be prepared, submitted to the
Metropolitan Council and adopted in the same manner as the original plans,
Minnesota Statutes 473 864, Subdivision 2 (1978), and
WHEREAS, the City of Stillwater has prepared a City wide Comprehensive Plan,
and more detailed area plans for part of the City, and
WHEREAS, the Planning Commission has reviewed the amendment request
considering existing City Land Use Policies, availability of public
facilities and land development capabilities, and
WHEREAS, the land use and zoning of the annexed property shall be considered
RA, Single Family Residential
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommends to the
City Council that it is in the public interest and community betterment that
the Comprehensive Plan be amended to include the 2 7 acre area in the City
• Comprehensive Plan and municipal urban service area and to designate the site

Background

into three smaller parcels One lot will be 43,090 square feet with the
existing home and the other two vacant lots will be 34,100 square feet each
The City recently annexed this property into the City of Stillwater It is
zoned RA, Single Family, therefore, all lot, depth, and width requirements for
this district are met A petition has been submitted to the City of Stillwater
• for a feasibility study extending the utilities to this property

PROJECT DESCRIPTION
Variance to the Sign Ordinance for placement of 10 foot tall, 112 square foot
(141x8') sign with no front setback (fifteen foot setback requirement, maximum
sign size 100 square feet)
DISCUSSION
The request is to construct a ten foot tall, fourteen foot wide by eight foot
high ground mounted free standing sign next to the parking lot in front of the
Greeley Square Development The applicant would like to place the sign
• directly in front of the parking lot perpendicular to the parking lot This
would result in the sign overhanging the property line by approximately four
feet The Greeley Street right-of-way is owned by Washington County Public
Works In discussions of this application, they indicated that private
advertising signs are not allowed on or over the right-of-way
The sign size is very large for this type of sign, fourteen foot wide by eight
feet tall, and it is unusual to have office tenants located on such a sign It
is recommended that the sign be used only for identifying the Shopping Center,
Greeley Square and address and that a directory of second floor office uses be
located on the building next to the entryway to the offices It is not
practical or desirable to have all building office users identified on the
commercial center sign The Greeley Square Center sign could then be sized
more appropriately for this purpose, four feet by ten feet At this size the
sign would fit within the developments property
RECOMMENDATION
Denial or continuance of request for redesign consistent with Staff comments

At this time we are requesting approval to place the
monument type identification sign for Greeley Square I
have attached a plan showing the sign design for your
approval The sign will consist of a brick base with
two (2) double faced internally lit signs installed as
shown The top sign will be for identification of
Greeley Square The lower sign will provide room for
office tenants business names As you know, we were not
allowed signs to be placed on the second level of the
building front early in the planning stages, prior to
construction Since that time, tenants moving in and
considering office space have requested the availability
of signs on the second level Because of their need we
are desigining a sign to accommedate them as well as
identify the shopping and office sign

A variance to the frontyard setback requirements (twelve feet proposed, thirty
feet required) for the construction of a single family home with an attached

The property is located off the South end of North Broadway and is bounded by
North First Street on the West, vacated Aspen Street on the North, and Elm
• Street on the South The site overlooks the old prison
The proposal is to construct a home approximately twelve feet from the front
property line on North Broadway The applicant is requesting this placement
due to the drastic change in elevation on the South end of the property The
proposed home has a ten foot sideyard setback which is the minimum required
From the Northeast corner going Southwest the elevation drops thirty five feet
before dropping to at least another fifteen feet to Elm Street If the home is
constructed at this Northeast corner, less grading will occur and less fill
will have to be brought in to construct the home The area of the proposed
home has the least grade change The adjacent home to the North of this site
is setback approximately ten feet from North Broadway
The City Council denied a request to subdivide this property into two lots on
November 1, 1988 Due to the drastic change in elevation on the Southwest
corner of the site
Sewer service is available from North First Street but it would be very
difficult to get to because of ground conditions and the slope of the land An
on -site well is required to service the lot
There is an oak tree to the South of the proposed home The applicant has
indicated he would like to leave this tree
The site plan indicates area for off-street parking outside the attached
garage facing North Broadway Also, another ten foot area to the South of the
garage will be provided

er to remove any wire conduit or other thing that burns cuts or chafes
any part of any tree whether trunk loot or branch in any street 01
parkway In case the owner of the wire shill fall after three days
written notice to t2ke adequate steps to prevent further injury
Section 16 No paving of any desciiption shall be laid of main
tained by anyone between the sidewalk and curb which shall cut oft

Section 1 That portion of Aspen Street lying between the east
line of First Street and the east line of Broadway is hereby vacated so
far as the public easement therein is concerned Provided that this
ordinance shall not be construed as affecting the private right of rndr
vrduals who have purchased property fronting on slid street to exer
rise and maintain such rights Provided further that this ordi
nance shall not be construed to affect the right of the public or the
City to use and maintain the present st'►iiway leading from the so
called Elm street to the top of the bluff immediately north and to pass
and repass from the top of said stairway to Broadway
