Motion by Mark Ehlenz, seconded by Glenna Bealka to approve the
minutes of February 13, 1989 as submitted All in favor
PUBLIC HEARINGS
Case No SUP/89-15 - Special Use Permit for a five guest room Bed
and Breakfast located at 626 North Fourth Street in the RB Duplex
District Martha Hubbs, owner of the residence, presented the
application
There are 10 recommended conditions of approval, consistent with
the City's new Bed and Breakfast Ordinance _ The owners have
agreed to these conditions
Motion by Don Valsvik, seconded by Jean Jacobson to approve the
Special Use Permit with 10 conditions of approval Motion
carried 5-0
Case No. SUP/V/89-16 - Special Use Permit and Variance for
additional canopy signs and wall sign at 1905 South Greeley
Street, (Tom Thumb), in the IP-C Industrial Park - Industrial
District Dan Kaufman, Kaufman Sign Co , presented the
application
The request is for two lighted 36 square foot signs on the canopy
over gas pumps, to stripe the canopy with Tom Thumb trademark
colors (orange, brown and red), and to install a four foot by six
foot 24 square foot sign on the front of the building
The store will not be allowed to have its own individual pylon
sign because it is part of Greeley Square Center, which will be
erecting a pylon sign indicating all the retailers in the center
The City's new Sign Ordinance does not allow signage on the
canopies for gas stations

Motion by Mark Ehlenz, seconded by Don Valsvik to deny the wall
and canopy sign request, and to approve the colored stripes on
the canopy (no logo), along with the condition that all temporary
signs be removed from the site now and in the future unless
approved by the City Motion carried 5-0
Case No V/89-19 - Variance to use the second level of a garage
for a work shop at 222 West Cherry Street in the RCM Multi -Family
Residential District Jeffrey Palmer, owner, presented the
application
The request is to add a second story on an existing garage
The Zoning Ordinance allows one story garages of a maximum of 20
feet The applicant is requesting a 25 foot maximum height The
existing garage is excavated into a hill The second level would
be at grade level as viewed from the side or rear
Motion by Mark Ehlenz, seconded by Jean Jacobson to approve the
Variance request with a 25 foot maximum height Motion carried

Case No SUP/V/89-20 - Variance to rear and side yard setback
requirements and lot size requirements for the conversion of a
single family residence to a duplex located at 301 West Myrtle
Street in the RCM Multi -Family Residential District Patrick
Mulvehill, owner, presented the request
Mr Mulvehill stated that there are numerous multiple dwellings
in the neighborhood, and that the conversion of his residence
will enhance the looks of his property The Commission
questioned whether there was a hardship involved, Mr Mulvehill
stated that he is a psychologist in private practice and by
converting his residence to a duplex, he would be able to
increase his income by renting out half of the duplex
Members of the Commission felt that the 25 foot rear yard
setback requirement is irrelevant in this case because of the
topography and because there are no neighbors to the rear The 24
foot front yard setback is consistent with other dwellings in the
neighborhood
Motion by Don Valsvik, seconded by Mark Ehlenz to approve the SUP
and Variance request Motion carried 4-0, with Jerry Fontaine
and Jean Jacobson abstaining
Case No SUB/89-21 - Preliminary plat review to subdivide one lot
of approximately 2 7 acres into two lots of 2 07 and 63 acres in
the IP-C Industrial Park Commercial District, at 14460-14480
North 60th Street Gary Swager, GDS and Associates, presented
the application

subdivision request with three conditions of approval Motion

Case No SUP/89-22 - Special Use Permit for an electronic repair
service at 2103 Schulenberg Alley in the RB Duplex, Bluffland
Shoreland Riverway District Daniel Challeen, owner of the
residence, presented the request
Mr Challeen would utilize two rooms in his home and an outdoor
storage shed for his electronic repair business He plans to
widen his driveway to create two customer parking spaces
Motion by Jean Jacobson, seconded by Glenna Bealka to approve the
Special Use Permit with the three recommended conditions of
approval Motion carried 6-0
Review of New Park Plan - City Parks Director Blekum presented a
park plan for city property at the corner of McKusick Road and
Owens Street The plan was prepared by the Parks and Recreation
Commission and has an estimated cost of $23,175
The Planning Commission favorably reviewed the plan and suggested
that the park be lighted at night and that a buffer or fence be
installed around the parking lot
Review of Plan for Picnic Shelter in Lowell Park - Mr Blekum
presented plans to build a picnic shelter in Lowell Park similar
to Ole shelter in Pioneer Park The Commission was in favor of
the shelter, provided it was consistent with the Downtown plan
The Downtown Design Review Committee will review the plans at
their next meeting
Case No. ZAT/89-5 - Amendment to the Zoning ordinance changing
the General Commerical, CA, Zoning District regulations by
changing the CA District to Central Business District, CBD, and
changing the development regulations for the district City of
Stillwater, Applicant
Case No ZAM/89-3 - Amendment to Elle Zoning Ordinance changing
the zoning designation of land in the North Main Street area from
IA, General Light Industrial and IB, General Heavy Industrial, to
CBD, Central Business District City of Stillwater, Applicant
Steve Russell presented the applications for the City The
Commission suggested that sightly screening or landscaping be put
in place in the current industrial area until that area is
redeveloped
Motion by Don Valsvik, seconded by Mark Ehlenz to recommend
approval of ZAT/89-5 and ZAM/89-3 with appropriate screening to
be defined by the Community Development Director Motion carried

The City Traffic Engineer is preparing a parking analysis of
the proposed 7,000 square foot Billiard Hall The use would
be located in the old ConnCo shoe building (previous retail
use) No on -site parking is provided in the application
Parking is, at times, a problem in the area with inadequate
off-street parking for uses in the area
The Planning Commission should review the Staff report on
parking, hear the applicant and public testimony, and
recommend approval or denial of the use for the site Other
methods of providing additional parking in the area of the
use could also be considered

The City has received a request to locate a billiard hall in an existing
structure at 201 North Second Street Amusement and recreational uses are
permitted in the CA General Commercial District The use would include 20 pool
tables and 10 to 15 video games and lounge housed in the 7,000 square foot
of building The Zoning Ordinance requires City Council review of parking
provided for the use No parking spaces are proposed for the pool hall use
The applicant indicates that ample on -street and public lot parking exists in
the area The estimated parking requirements for the use is 40-50 spaces
Recently the City has received complaints regarding a parking shortage in the
area
It is suggested that the City Council review the request and refer it to the
City Traffic Engineer and Planning Commission for review and recommendation
RECOMMENDATION

of parking situation for the use and area

We have briefly reviewed some of the traffic impacts of the
proposed Billiard Parlor on 2nd Avenue and Commercial Street in
the downtown area Little data on our current studies exist
relative to the traffic generated by Billiard Parlor
We can estimate traffic generated by the Parlor based on the size
of the building, number of pool tables and video games, and other
potential spectator activities or facilities
Assuming approximately 20 to 25 pool tables with four players per
table and some spectators, the maximum crowd for the Billiard
area would be approximately 125 people With a mixture of
numbers of players and a lesser utilization, an average peak
period of 70 people is more reasonable Assuming the inner
activities such as video games also attract a number of patrons,
the maximum number of patrons could be as high as 170 with a more
reasonable figure of 100 Based on between 1 4 and 1 6 people
per vehicle, there would be between 60 and 100 vehicles at the
building at a particular time Obviously, a lower utilization of
tables and games would resolve in a lower number of vehicles
At lower use times, it might be assumed that less than half of
the tables are in use and all with only two players per table,
with a minimum number of spectators and video game players, there
may be as low as 25 people in the building
We estimate that the 7,000 square foot facility will generate
approximately 700 daily vehicle trips The demand for parking
will vary from only a few vehicles during the day to
approximately 70 vehicles during heavier periods

PROJECT DESCRIPTION
Request to locate a temporary four by eight foot ticket booth to sell tickets
for tours around the Stillwater area
DISCUSSION
The request is to temporarily locate a four by eight foot ticket booth along
the North side of Nelson Street just East of the Freighthouse parKing lot The
booth would be located on Freighthouse property on an old railroad bed
Tickets for tours of the Stillwater area would be sold from the booth The
tours, as proposed, would leave from Lowell Park next to Nelson Street as
described in the letter of application
The visitor tour use is complimentary to the Downtown The ticket booth design
replicates the design of the tour vehicle The booth must be removed during
the off-season because of flood plain requirements A sign is proposed but not
shown A maximum sign size of four square feet is recommended
It is recommended that the structure be setback five feet from the front and
side property lines and the area between the booth and street paved with a
hard surface for easy customer access
It is suggested the temporary structure be allowed for the summer season, then
reevaluated regarding booth location, site improvements, and trolley loading
area as part of the Downtown Plan improvements A bus loading area is proposed
for the South end area and could provide a loading location for tour buses
RECOMMENDATION Approval as conditioned
CONDITIONS
1 The ticket booth shall be located on Freighthouse property, setback
five feet from the South and East property boundaries
2 Only tickets for Stillwater area tours shall be sold from the booth
3 The temporary booth shall be removed by October 15, 1989 (This is
necessary because of the flood plain location )
4 The area between the ticket window and Water Street shall be paved and
the area around the ticket booth surfaced as approved by the Community
Development Director
5 A use permit is granted for one year, at the end of the season (October
15, 1989) the applicant shall prepare a written report describing the
tour activity and suggesting improvements to the business regarding
booth location and bus loading area This will be considered along with
City improvement plans for the South Main Street area in considering
the application for the 1990 season

We will be offering different tours in and around Stillwater
highlighting including Houlton, Wisconsin, the Old Buckhorn
sight, scenic overlook on the Wisconsin side, the old
prison in Bayport, etc 0ur tour will include some of
the more hilly streets of Stillwater and will be geared
to transportation in Stillwater when trolleys first
operated in 1889
We expect that one of our more popular tours will be
downtown Stillwater along the levy, under the Stillwater
Bridge, north through the large parking lot to the
boat docks, up Myrtle Street to North Main Street,
highlighting the Minnesota Zephyr, up Elm Street to
Wilkins, highlighting Pioneer Park, then traveling
down and highlighting such items as the Lowell Inn,
the old Post Office, traveling up South Third Street
to the old Court House, then traveling down to the
overlook and looking at downtown Stillwater, coming
back down the hilly street behind the Grand Garage,
and then back down to the Lowell Park
We will be operating irregular routes on our tour
pointing out other points of interest as time permits
or as a specific group may request We feel that by
offering some flexibility, we will be able to change
our route as traffic may demand We also feel that
this will give us an opportunity to more closely
study the best routes to develop a regular route
car connecting the upper part of Stillwater the hotels
and shopping cente_s with lower Stillwater including
Houlton, Wisconsin and Kolliner Park

We feel that the route car can become extremely effective
in helping alleviate parking problems and effectively
move the people in the valley
Enclosed find written permission of the Freight House Restaurant,
Jim Williams, manager and agent, to place a ticket booth
on the Freight House property near the entrance to the
parking lot The ticket booth will approximately be
4 feet by 8 feet and approximately 7 feet tall and
will have Rivertown Trolley tickets on it We also feel
that the ticket booth can be an effective information
source for tourists as to all the things that are happening
in and around Stillwater
Enclosed find a picture showing approximate location of the
ticket booth labelled Exhibit 1 Exhibit 2 shows a
picture in Lowell Park, which is already a bus stop
and could be used for safe loading and unloading of
passengers
Should the Planning Commission require, we will be available
to meet with them to more clearly point out and answer
any additional questions that the Commission may have
Also included is a rough sketch of the ticket booth
sight as it relates to existing buildings _We are
confident that an effective trolley system will enhance
the City of Stillwater and the St Croix valley area
and will be able to help solve some traffic problems
and to help the city grow with the adopted downtown
plan

DISCUSSION
The application is to convert an existing gas station to a taxi dispatch
office and parking area for up to three vehicles
The application site plan indicates the existing service station structure
will not change The existing sign, lights, pumps and gas tanks will be
removed No other changes are proposed
The taxi office use does not need the wide driveway aprons of a service
station It is suggested that the Churchill driveway be reduced to twenty four

The site plan shows landscaping or ground cover around the west and north
sides of the lot Fleece Flower will be planted in a three foot bed to the
front of the parking spaces, then sod with some existing vegetation to the
property line Juniper and Hackberry bushes screen the lot from Olive Street

FINDINGS
The project meets City dimensional standards for the parking lots and
the landscaping screens the lot from public view are as required by design
guidelines in the Downtown Plan

PUBLIC MEETING
The City Council has called a public meeting
for Tuesday, April 11, 1989 at 7 00 P M in
the City Hall Council Chambers to review
the first phase of Downtown improvements
and to discuss a financing program for the
improvements
First phase improvements include primarily
addressing existing problems with the utility
systems Downtown water and sewer lines
are over one hundred years old Some of the
lines are leaking and in poor condition This
is not a new problem The Metropolitan
40 Wastewater Control Commission has
previously warned the City that the I & I
(Inflow and infiltration) problem needs to be
corrected By correcting the sewer problem
and eliminating clean water flowing into the
sewer line City sewer flows should decrease
Other first phase improvements include
constructing storm sewer mains for areas
without them repairing streets and
sidewalks and bringing City parking lots up
to current development standards Most of
the phase one improvements can be
considered maintenance or replacement of
existing utilities and facilities
Second phase improvements will include
plaza development waterfront
improvements nver walkway improvements
parking structure and purchase and
improvement of Mulberry Point
To finance the $6 000 000 First Phase
improvements a financing program has been
developed that includes several funding
sources Tax Increment Bonds ($2 500 000)
Sewer Revenue Bonds ($500 000) special
sewer and parking service districts ($300 00)
reserve funds and retained earnings ($300 00)
el and special assessments ($2 000 000) Special
assessment projects represent approximately
82% of the total project costs with 40%
assessed to property owners

property tax and /or rents for businesses in

will result in a more attractive better serviced
place to shop work live and do business

Downtown Plan
Adopted
On October 24 1988 the Stillwater City
Council unanimously approved the
Downtown Plan The plan provides a guide
for future City improvements and private
development The plan includes sections on
land use transportation and parking urban
design and utility improvements It is
estimated that more than 10 million dollars
in improvements are needed in the
Downtown to maintain existing utility
systems in order to meet current standards
and to improve the image of Downtown The
plan sets the blueprint for Downtown
development and related improvements The
timing of improvements will depend on the
availability of Federal State and Local
revenues

The annual Downtown Spring Cleanup is
scheduled for May 6th The event is
sponsored by the Chamber of Commerce
Downtown Business Association and City of
Stillwater Property and business owners are
asked to cleanup their building and property
Volunteers and City crews will cleanup the
streets parks parking lots and other public
areas The event is scheduled for 9 00 A M
(meet at 8 30 A M in front of the gazebo
in Lowell Park) to 12 00 Noon with a picnic
lunch following in Lowell Park Awards will
be given to properties showing/needing the
most improvement

The Downtown Plan Steering Committee
completed its work on the Downtown Plan
with the City adoption of the plan in
October The Committee met over fifty times
between June 1987 and October 1988
including several workshops four public
hearings presentations to interested local
groups field trips and numerous
subcommittee meetings The committee

Downtown
Development
Reviewed
A five member Downtown Design Review
Committee was recently appointed by the
City Council to make sure new development
retains or is complimentary to the historic
character of Downtown Design guidelines
contained in the Downtown Plan are used
by the Committee to review new
development projects If a project is
consistent with the guidelines it is
recommended for approval to the Planning
Commission If it is not changes in the plans
will be recommended The Design Review
Committee recently reviewed the plans for
a three story office building proposed to be
constructed just north of the Maple Island
plant The Committee felt the office project
was consistent with the guidelines because of
the building height (three stories) parking
spaces provided building material (Stillwater
Brick) provision for widening Mulberry
Street site landscaping and space for
pedestrian pathway connecting to the future
river walkway The Committee also felt the
new office building would be a fine addition
to the North Main Street area Members of
the Downtown Design Review Committee

The need for a new Downtown Commercial
Zoning District was first described in the
Downtown Plan The existing zoning of the
Downtown was established in the 1960 s The
current districts allow heavy and light
industrial uses in parts of the Downtown
The new district would eliminate heavy
industrial uses but continue to allow light
office type industrial uses with Special Use
Permit review Other permitted uses would
include retail office and service uses The
new Central Business District (CBD)
establishes height limits (fifty feet or four
stories) setback and lot size requirements the
Planning Commission reviewed the new
Ordinance at their meeting of March 13 and
recommended it for City Council approval
with the addition of requiring all outside
storage areas to be screened from public
