Variance for the side yard and rear yard setback requirements for a garage located at 1225 South Second Street Jean Jacobson James Weber, owner, presented the application The garage has already been constructed with a four foot rear yard setback (five is required) and a three foot side yard setback (five is required) No building permit had been applied for because the owner originally planned an addition to the garage After construction began, he realized that the original structure would have to be removed and a new structure built The Commission agreed that the new structure was an improvement to the property, but that there should be some penalty imposed for failure to apply for a building permit Motion by Don Valsvik to approve the variance request with the condition that the applicant pay double building permit fee, and to make note to the City Council that there should be a substantial increase in after -the -fact permit fees in the future Seconded by Glenna Bealka Motion carried 7-0 Case No. CPA/89-1 - Preliminary and Final Plat approval to subdivide an existing 2 39 acre lot into two lots of 93 acres and 1 46 acres located at 1819 North Fourth Street Robert Troyer presented the application This request was approved in 1987, but a survey was not completed at that time 2 Stillwater Planning Commission February 13, 1989 Motion by Mark Ehlenz to approve the subdivision request with two conditions Seconded by Don Valsvik Motion carried 7-0 Case No SUP/89-12 - Variance request to the rear yard setback requirements (20 ft proposed, 30 feet required) for construction of a 13,716 sq ft retail center located at 2000 Washington Avenue in the Industrial Park Commercial District Mr R C Ernst presented the application The center would share the existing Merrill Lynch driveway The Commission expressed some concern with the entrance and exit plans, and there was discussion of alternative entrances and exits Motion by Judy Curtis to approve the variance with the five stated conditions Seconded by Mark Ehlenz Motion carried 7-0 Case No. CPA/89-3 - R 3 Avia - • • • PLANNING APPLICATION REVIEW CASE NO V/89-16 Planning Commission Meeting March 13, 1989 Project Location 1905 South Greeley Street Comprehensive Plan District Industrial Park Zoning District Industrial Park Commercial Applicant's Name Kaufman Signs Type of Application Variance Project Description Request for variance to Sign Ordinance for additional signage DISCUSSION The request is for, (1) two lighted 36 square foot signs on the canopy over gas pumps (2) to stripe the canopy with Tom Thumb trademark colors (orange, brown and red) and (3) to install a four foot by six foot 24 square foot sign on the front of the building Plans for the signs are attached A sign program was approved as a part of the Special Use Permit for the retail center A sign band with individual letter signs maximum 24 inches was allowed across the front of the building Specifically, no signage was allowed on the canopy The recently adopted Sign Ordinance does not allow signage on the canopies for gas stations A review of current business signage indicates that the two temporary signs on the building front is illegal and more than 30% of the window areas appear to be covered by signs Other convenience gas service stores have been allowed colored stripping on the canopy although they are free-standing and not a part of a center RECOMMENDATION Denial of lit wall sign and canopy signs, approval of colored canopy CONDITIONS OF APPROVAL 1 All temporary signs shall be removed from the site now and in the future unless approved by the City ATTACHMENTS - Application - Sign Plan • • • CONDITIONS OF APPROVAL CASE NO. a part of the City Comprehensive Plan Plan preparation was funded in part through the Metropolitan Council Planning Loan Program A project team including BRW (Urban Design) SEH (Utilities/Parking) and JMA (Economic) worked with City staff to prepare the Comprehensive Plan The plan stresses the importance of the City setting on the St Croix River a national scenic riverway and character of the old Main Street buildings Major elements of the plan include (1) a hierarchy of streetscape and open space treatments (2) land use and zoning changes to reflect current conditions and opportunities (3) design guidelines for new development and remodels (see examples below) (4) parking improvement program and (5) Capital Improvement Program Tax increment financing improvement districts and parking revenues are described as funding sources for the estimated $10 $15 million improvements To carry out the plan the City has recently established a Downtown Plan Action Committee to oversee plan their own a division within the American Planning Association With the creation of its new Private Practice Division APA provides planning consultants with a forum for exchange expression &
