APPROVAL OF MINUTES
Motion by Judy Curtis, seconded by Mark Ehlenz to approve the
minutes of June 13, 1988 as submitted All in favor
PUBLIC HEARINGS
Case No. SUP/88-39 - Special Use Permit to conduct a computer
software and computer supplies business out of a residential home
located at 2807 Woodridge Lane Steven Palmer presented the
application
Mr Palmer stated that the business would be run in a manner
similar to that of an Avon representative He will be ordering
supplies for his customers and making deliveries There will be
no additional traffic or parking created at his residence except
for the delivery of products by the regular mail, federal
express, or UPS
Chairman Fontaine stated that traffic and safety are the major
concerns in approving this type of request, and those issues do
not appear to be a problem in this case Mr Palmer asked for
clarification of Condition No 2 which states Any complaints
about the business will cause revocation of the Special Use
Permit The Commission agreed to amend the condition to read

revocation of the Special Use Permit
Judy Curtis made a motion to approve the Special Use Permit with
three conditions as amended Mark Ehlenz seconded Motion carried

Case No V/88-38 - Variance to the Sign Ordinance for the
placement of signs at 1750 South Greeley Street (new Minuteman
convenience store)
Mark Ogren, Croix Oil Company, presented the request for four
illuminated signs An ID (Ground Sign), Canopy Sign parallel to
Stillwater Planning Commission
Minutes
July 11, 1988

Greeley Street, a Canopy Sign parallel to Curve Crest, and a
building sign Mr Ogren has amended the original request in
order to comply with staff recommendations The ID (Ground Sign)
will be reduced to 25 ft in height rather than the requested 37
ft 6 in The existing base will be used A variance will be
required in order to have the sign remain at its present location
As illuminated canopy signs are not allowed, the request has been
amended by removing the name "FINA" from the canopy signs,
leaving only the red and blue striping, and the lighting has been
reduced by 1/3 on each side The illuminated building sign is
within the general purpose of the Sign Ordinance
Following discussion regarding the canopy, the Commission
determined that it could not be considered a sign because only
graphics would appear, not the name of the business
Motion by Don Valsvik, seconded by Rob Hamlin to approve the
Variance request as presented, subject to conditions Motion
carried 5-0, Judy Curtis abstained
Case No V/88-40 - Variance request to construct a swimming pool
in a side yard location (rear yard required) at 1504 West Pine
Street Thomas Doe, property owner, presented the request
Assistant Planner Pung-Terwedo explained to the Commission that a
second variance would be required for the 6 ft privacy fence
requested (42 inches required for sideyard fence)
Following discussion with the applicant, the Commission
determined that the property line on the Hemlock Street side is
in question Staff has recommended a survey of the property, and
the Commission agreed Approval will be given based on the
condition that evidence of the property line be submitted prior
to the City Council public hearing
Don Valsvik made a motion to approve Case No V/88-40 subject to
two conditions 1) A detailed survey describing the exact
locations of the property lines must be submitted The drawing
attached to the application is not correct 2) Variance for 6 ft
fence Rob Hamlin seconded Motion carried 6-0
OTHER BUSINESS
Mr Fontaine reported on action taken by the City Council at the
July 5 meeting
Sign Ordinance - The Commission reviewed and discussed the
changes and additions to the new sign ordinance Ms Pung-
Terwedo stated that a public hearing on the sign ordinance will
be held next month

DISCUSSION

Program and a program evaluation be reviewed by the Planning Department
at the end of the first school year

Dear Mr Russell
This letter is to request consideration by the City of Stillwater for the issuance
of a special use permit to the Stillwater Area Schools, Independent School District
#834 for the operation of a Latch -Key program at the Oak Park Elementary School
The Board of Education for Independent School District #834 adopted a
recommendation by an administrative study committee to implement a program of before
and after -school child care effective the 1988-89 school year The committee in
their recommendation recommended that the implementation be phased in over a period
of three years Phase one implementation sites would be Oak Park, Afton/Lakeland,
Withrow and Marine Elementary Schools
The primary purpose of the Extended Day Program is to provide high quality before
and after school care for children Within this framework the program seeks to
provide an educational/recreational environment conducive to learning with a minimum
of formal structure
The program will function Monday thru Friday during the school year (September
6,1988 thru June 8 1989) Hours of operation will be as follows
a ) Before school 6 00-8 30 a m
b ) After school 2 30-6 00 p m
c ) All day care when school is not in session (6 00 a m - 6 00 p m )
d ) The program will be closed the following dates November 24, 25,
December 26 January 2, and May 29
e ) The program will not be available during the summer vacation in
1988-89
A breakfast snack and an after school snack will be served at each extended day
site
We are planning to operate out of the cafeteria at the Oak Park Elementary School

Each site will require a minimum
enrollment of twelve (12) children to
make the program self-supporting

Discussion
On July 5, 1988, the Stillwater City Council passed a new Bed and Breakfast
Ordinance This Ordinance limits Bed and Breakfast sleeping rooms to five (5)
The Rivertown Inn, owned and operated by Charles and Judith Dougherty, is
presently a nine (9) room Bed and Breakfast The Dougherty's would like to
keep this Bed and Breakfast at nine sleeping rooms even if the structure is
sold The Rivertown Inn is a large enough home to accommodate nine (9)
sleeping rooms and has adequate parking on -site
CONDITIONS OF APPROVAL
1 The Rivertown Inn will remain a nine (9) room Bed and Breakfast Any
increase in rooms will require another variance
2 If the structure is sold, new owner's may apply for a Special Use
Permit for nine (9) sleeping rooms

PROJECT DESCRIPTION
Request to construct a three stall 768 square foot garage with possible
variance to setback requirements
DISCUSSION
The application is to construct a three stall garage to park City Water
Department vehicles The site is in the Medium Density Residential RC-M
District requiring a Conditional Use Permit A sideyard variance would be
required for Alternative Plans A, B and D Four possible locations for the
garage are proposed for consideration by the Planning Commission
The Board of Water Commissioners has not made a final decision on the
preferred location and is requesting review and comment by the Commission on
the locations
The site for the garage is just west of the existing garage behind the Water
Department Office The building would be located down the hill and next to the
driveway, access off of Fourth Street Two pine trees would have to be removed
to construct the garage The garage, as proposed, would be approximately
twenty-three (23) feet tall and have an 8/12 pitched roof The building
material would be brick and asphalt shingles —to -match the existing buildings
on the site
Of the four alternatives, A, B, C and D, location B is recommended because of
access considerations and design capability with the area If alternative A
were selected, it would be difficult to match the roof line of the existing
garage and driveway access to the building would be tight Again, with
alternative C, access would be tight and the roof would be located close to
the sloped hill east of Fourth Street Plan D shows the garage located
diagonally from the property line In this area buildings are located parallel
to property lines The irregular location would be a new design element
Alternative B would provide satisfactory access to the new garage and a
screened location for outside storage

Alternative B is recommended as the preferred alternative with some
modification No variance is required for alternative B Access is from the
open area of the parking lot with no sharp turns A space south of the garage
could be used for outside storage by screening the areafrom the south and
west Two additional parking spaces would be provided for employees west of
the existing garage It is recommended the garage be moved approximately five
feet toward the existing garage (east) This would reduce the excavation into
the hill and still work Whatever alternative is selected, the design and
materials of the building should match as nearly as possible the existing
buildings
RECOMMENDATION
Consideration of alternative plans and conditions of approval

1 The building design and materials shall match the existing garage, ie
same color and texture bricks, match roofing color and material, color
of garage door shall match, roof pitch shall be the same as the

PROJECT DESCRIPTION
A variance to construct a new two car garage approximately fifteen feet from
the sideyard and property line (thirty feet required for corner lots)
DISCUSSION
The request is for a variance to construct a new -garage approximately fifteen
feet back from the property line on Grove Street The —existing garage will be
removed The reason for this request is to allow a large enough parking space
(length) for a vehicle in front of the garage Another reason for -this request
is consideration for the neighbor who uses Mr Ness's backyard as a place to
throw snow during the winter If a garage was set back thirty feet, it would
block the area in which the neighbor deposits his snow Mr Ness feels this is
important to keep this area open for his neighbor's use
CONDITIONS OF APPROVAL
1 The garage be set back at least twenty feet from the property line to
allow for adequate parking spaces
RECOMMENDATION Approval
FINDINGS
For reasons set fully in the findings, the granting of the variance is
necessary for the reasonable use of the land and buildings A variance will
accomplish such a purpose

I would like a 15 foot setback of my new garage
instead of a 30 foot setback requirement.
A 30 foot setback would obstruct the neighbors view.
A 30 foot setback would cause problems with the neighbor's
snow removal. His snow would have to be piled up against his
house or against our garage because of his long driveway.
With a 15 foot setback he could throw his snow on
our lawn as he does presently.

SUBJECT Request by George Ness for Garage Setback
at 1321 West Olive Street
I am a neighbor of George Ness and am writing to
ask that you approfe his request for a 15 foot
setback for his new garage.
The required 30 foot setback would cause me problems
with removing snow from my driveway. My driveway
runs about 50 feet along side my house. The only
place I can throw snow is on the Ness' lawn which
they permit me to do. A 15 foot setback would
permit me to continue to throw snow on their lawn.
The 30 foot setback would not give me any place to
throw my snow.
A 30 foot setback would also cause the garage to
obstruct our view out of the main viewing window on
the north side of my house. A 15 foot setback would
permit us to continue to watch each other's house for
safety and protection purposes.

PROJECT DESCRIPTION
A Special Use Permit to construct a 23,000 square foot office/warehouse on
Curve Crest Blvd and Variance to lot coverage requirements (east of Arrow
Building Center and west of the Curve Crest Building)
DISCUSSION
A warehouse in the IP-C1 District requires a Special Use Permit to evaluate
the impact of the use and design of the site on the surrounding area Other
uses in the area include Time Out Sports to the rear, Arrow_Building_Center to
the west and Curve Crest Office Complex to the east The rear of the building
is where the loading docks are located Loading and unloading will take place
in this area The vacant lot to the rear could be developed in retail or
office uses permitted in the IP-C1 District To minimize the impact of the
loading area, on the adjacent lot to the rear, a six foot solid wood fence
with street trees as shown on the front of the project, is recommended
The project meets the setback, parking and height limits for the use and
zoning district The maximum lot coverage (building and parking coverage) in
the IP-C District is 80% The proposed development covers over 90% of the site
resulting in less green area The site plan is very tight and in order to meet
the 80% requirements, the bulding size would have to be reduced
A review of the site plan by the Fire Department indicates the one-way drives
around -the building should be increased to twenty feet minimum from fourteen
feet and seventeen feet
RECOMMENDATION Approval
CONDITIONS OF APPROVAL
1 A solid wood fence and street trees similar to the front of the
building shall be provided
2 The minimum driveway clearance shall be twenty feet
3 The one-way driveway area shall be signed NO PARKING FIRE LANE

4 All mechanical equipment shall be roof mounted or located at the rear
of the building
5 Any change of building use from 4,500 square feet office and 18,500
square feet warehouse shall require Community Development Director
review

7 The trash enclosure shall be constructed of masonry material similar
in color to the building
8 All landscaping shall be installed before building occupancy
9 The final plans for building permit review shall incorporate comments
of City Engineer (attached)

Pursuant to your request, we have reviewed the grading and
drainage plan for the above referenced planning case This plan
is for CON -SPEC Corporation for a proposed building on Curve
Crest Boulevard The building will be -on Lots 1-and 2, Block 2
Kern-Pauley Addition
We find the grading plan to generally meet the City standards
The proposed grading plan does provide for drainage and storm
sewer out to Curve Crest Boulevard However, the developer is
proposing to excavate Curve Crest Boulevard and install a manhole
over the existing storm sewer Instead of excavating the street,
it would be better if he were to install the pipe behind the
existing curb and gutter on Curve Crest into an existing catch
basin located approximately 85 feet west of the proposed
driveway This will require the developer to secure an easement
for the installation and maintenance of storm sewer from the
adjoining property to the west of the proposed development We
have recalculated his drainage figures on the enclosed print that
you provided -for us We have indicated invert elevations of the
pipe and the pipe grade We have circled this information in
red The contractor could break into the back of the existing
catch basin

Variance to the twenty foot sideyard building setback requirement (fourteen
feet proposed) for the construction of an accessible walkway for the
handicapped
DISCUSSION
The request is to construct a new walkway and secondary entrance to the
Stillwater Post Office The entrance will be an addition to the building which
will be approximately fourteen feet from the sideyard property line The
walkway will be constructed within this fourteen foot setback area Normally,
additional landscaping would be needed because of the transition zone from the
CA Zoning District to the RCM Zoning District on the parcel of land to the
north However, since Trinity Lutheran Church is located next to the property,
the use is quite different from a residential structure No additional
landscaping will be required The Church is also in favor of the handicapped
access
The handicap access is very important to this facility In order to conform to
the USPS handicapped accessibility standards and the Minnesota Building Code,
this access must be constructed
RECOMMENDATION Approval
FINDINGS
For reasons set forth fully in the findings, the granting of the variance is
necessary for the reasonable use of land or buildings and that the same is the
minimum variance that will accomplish such purpose
