Variance for construction of eight foot fence (six feet required) approximately six inches from the property line (one ft required) at 1206 North Second Street in the RB Residential Duplex District Carol Ulrick, property owner, presented the request She stated that the property will be surveyed before the fence can be erected because of a dispute with her neighbor to the north regarding the property line The Commission felt that in this case, the six inch variance is 3ustified because of the narrow property between the driveway and the north property line Motion by Don Valsvik, seconded by Rob Hamlin, to approve Case No V/88-31, with the fence to be built following the survey of the property Motion carried 5-3 Glenna Bealka, Mark Ehlenz, and Gerald Fontaine opposed, primarily for the eight -foot height Case No V/88-32 - Variance to construct an attached garage with • a two foot setback from side property line and approximately six feet from neighbor's residence (five feet from sideyard and fifteen feet from neighbor's residence required) at 319 W St Croix Avenue in the RB Duplex Residential District 1 Stillwater Planning Commission June 13, 1988 Connie Ludowese, property owner, presented the request She has obtained written approval from the adjacent neighbors to the west and also the neighbor across the street The Commission discussed the close proximity of the garage to the neighboring home on the west Chairman Fontaine was concerned that the slope of the roof of the proposed garage would cause runoff into the neighbor's driveway It was not known whether the neighbor was aware of the potential problem before giving written consent It was suggested to the applicant that the rear of the house would be a preferable location for the garage Mr Russell stated that this would be considered a hardship because of the slope of the rear yard Motion by Nancy Putz, seconded by Rob Hamlin to deny the variance request Motion to deny carried 4-3, Mark Ehlenz abstained, Glenna Bealka, Jean Jacobson, and Don Valsvik opposed Case No. SV/88-34 - Request to vacate a 110 ft section of East Willow Street just west of North Second Street (not improved) • Robert Troyer, owner of the property to the west of the right-of- way, presented the request He plans to use the vacated area • eventually for driveway access to the land Comments have been requested from the Water Department, NSP, and the City Engineer All have stated that they see no problem with granting the request If the property to the rear is developed sometime in the future, an easement would be required Mr Troyer stated that he would have no problem in granting the City an easement Motion by Dan Valsvik, seconded by Jean Jacobson to approve Case No SV/88-34 Motion carried 8-0 Case No SUP/88-36 - Special Use Permit for a sign program for Lakeview Memorial Hospital , 919 W Anderson Street, and St Croix Valley Clinic, 921 South Greeley Street Ray Roemmich, an employee of Suburban Lighting, presented the request for the placement of directional signs for the hospital and clinic The main concern is for emergency victims trying to locate the emergency entrance to the hospital The Commission agreed that there is a need for a well -directed and well -lighted emergency entrance, but felt that an excessive number of signs is being requested and that too many of the signs are lighted In response to the Chairman's request for comments from the • audience, Jane Stillman of Realty World Pauley & Johnson stated that she has a house listed on Greeley Street, and is concerned with the size and height of the signs, and with illumination of the signs Fritz Ulrich, 822 West Anderson, stated that the 2 stillwitcr Plinninq Cuitutii-E-io n June 13, 1988 existing signs would be adequate if some btanches were trimmed During discussion, the Commission amended the application as follows Sign A, to be located on the Northeast corner of West Anderson and Greeley Streets It will be internally illuminated, limited to six feet in height rather than 10 feet, and will give emergency directions only Sign B and the sign on the building will be allowed as requested Sign C will be eliminated The City will trim trees around existing signs Motion by Don Valsvik, seconded by Judy Curtis to approve the request for a Special Use Permit as amended, and with four conditions of approval Motion carried 8-0 Case No V/88-37 - Variance request to maintain existing 63 sq ft structure located on the property line (five ft setback required) at 823 West Anderson Street Neil Hanssen, owner of the property, presented the application The variance request is for location of a two level storage shed and playhouse on rear and side property lines which was built a year ago He stated that his neighbors did not obDect to the location of the structure until he recently listed his house for sale Greg Johnson, representing the property owner to the south, stated that the neighbors were not asked for approval of the location of the structure before it was built Motion by Judy Curtis, seconded by Jean Jacobson, to deny the variance request Motion carried 6-2, with Rob Hamlin and Nancy Putz opposed Case No. PUD/88-29 - PUD Concept Plan for a 3 5 acre parcel to be used for commercial development and a 10 6 acre parcel for a 106 unit, three story apartment building on 61st Street at the future Frontage Road access road Al Hoffineyer, architect, presented the application and explained to the Commission that he was not present at last month's meeting because notice of the meeting was not received until the day after the meeting The Commission discussed with the applicant their concerns regarding the density of the pro)ect Density allowed is 8 7 units per acre, the pro3ect asks for 9 88 units per acre The applicant stated that the number of units is necessary to support • the amenities, and to maintain the quality and low rent of the building Commissioner Judy Curtis stated that the Commission spent eight months working to rezone this area, and she could not justify 3 Stillwater Planning Commission June 13, 1988 rezoning for density approval for this project Nancy Putz stated that the Commission is willing to compromise, but feels the developer is not Motion by Judy Curtis, seconded by Jean Jacobson to deny approval of Case No PUD/88-29 Motion to deny carried 8-0 The Commission emphasized that their denial was based on the high density and height of the project, and the fact that the area was recently rezoned OTHER BUSINESS Sign Ordinance - Assistant Planner Ann Pung-Terwedo met with the Commission to review the remaining sections of the new Sign Ordinance The Commission agreed to hold a Public Hearing on the Sign Ordinance, and to provide Suburban Lighting Company with a copy of the ordinance and request their feedback Motion by Mark Ehlenz, seconded by Rob Hamlin to adjourn the meeting at 10 10 p m Motion carried Submitted by Shelly Schaubach Recording Secretary • • 4 PLANNING APPLICATION REVIEW FORM CASE NO SUP/88-39 Planning Commission Meeting July 11, 1988 Project Location 2807 Woodridge Lane Comprehensive Plan District Single Family Zoning District RA Applicant's Name Steven and Kathleen Palmer Type of Application Special Use Permit Project Description A Special Use Permit to conduct a computer software and computer supplies business out of a residential home Discussion The request is for a Special Use Permit to conduct a part-time business for the reselling of computer software and computer supplies The business would basically be conducted by phone sales and ordering as a result of ads placed in local newspapers The Palmers have stated the product would be delivered by the normal mail process, federal express or UPS Mr Palmer added that he will be delivering the products to the customer's home so no additional traffic or parking will be created by the business except for the deliveries Mr Palmer works full-time out of his home so the business will be conducted on a part-time basis at his convenience He is also the only person that will conduct the business CONDITIONS OF APPROVAL 1 The business will not create customer traffic or parking in front of the home 2 Any complaints about the business will cause revocation of the Special Use Permit 3 No signage allowed RECOMMENDATION FINDINGS Determination of request The proposed use will not be injurious to the neighborhood or otherwise detrimental to the public welfare ATTACHMENTS . non -accessory sign erected for the purpose of advertising a product, event, person, or subject not entirely related to the premises on which said sign is located Building Identification Any sign that identifies that building itself rather than a business within the building Business Sign A sign that directs attention to a business or profession or to a commodity, service or entertainment sold or offered upon the premises, where such sign is • C� J directly involved in the sale or rental of the property or announcing • the purpose for which it is being offered Signs must be removed within then (10) days after sale or rental of property 7 Rummage Sale Signs Sign advertising a rummage sale not exceeding four (4) square feet located on private property which conform to the applicable provisions of this Title and are removed at the termination of the sale 8 One name plate sign for each dwelling not exceeding two (2) square feet in area per surface No signs shall be so constructed as to have more than two (2) surfaces 9 One name plate for each dwelling group of six (6) or more units Such sign shall not exceed six (6) square feet in area per surface No sign shall be constructed to have more than two (2) surfaces 10 Real Estate Development Project Signs For the purpose of selling or promoting a development project of three (3) to twenty five (25) acres, one sign not to exceed one hundred (100) square feet of advertising surface may be erected on the project site For projects of twenty six (26) through fifty (50) acres, one or two (2) signs not to exceed two hundred (200) aggregate square feet of advertising surface may be erected For projects over fifty one (51) acres, one, two (2) or three (3) signs not to exceed three hundred (300) aggregate square feet of advertising surface may be erected No dimension shall exceed twenty five feet (251) exclusive of supporting structures Such sign shall not remain after ninety five percent (95%) of the project is developed The permit for such signs must be renewed annually by the City Council, shall be bordered with a decorative material compatible with the surrounding area If such signs are lighted, they shall be illuminated only during those hours when business is in operation or when the model homes or other development are open for conducting business Real estate development signs are allowed in all zoning districts by permit — r 11 Temporary Sign A sign placed on a lot, parcel or building from a period not to exceed thirty (30) days out of any twelve (12) month p� period 12 Automobile Service Station Signs Automobile service stations are allowed one (1) wall sign and one (1) ground sign subject to the following conditions Wall Signs There shall be no more than one (1) wall sign for each principal building The gross surface area of the wall sign shall be one (1) square foot for each foot of lineal building frontage Ground Signs There shall be no more than one (1) ground sign for each principal building A ground sign may be located in any required yard but shall not extend over any lot line within fifteen (15) feet of any point of vehicular access or twenty five (25) feet for illuminated signs A ground sign shall not project higher than twenty (20) feet as measured from grade • Service Bay and Island Identification Signs Service bay and island identification signs providing direction or instruction to persons • using the facility but containing no advertising material of any kind B Prohibited Signs The following signs are prdhibited in all zoning districts 1 Any sign which obstructs the vision of drivers or pedestrians or detracts from the visibility of any official traffic control device 2 Any sign which contains or imitates an official traffic sign or signal, except for private, on -premise directional signs 3 Off -premise advertising signs except as regulated herein 4 Any sign which moves or rotates including electronic reader board signs, except time and temperature information signs and barber poles 5 No sign shall display any moving parts, be illuminated with any flashing or intermittent lights, or shall be animated, except time and temperature information All displays shall be shielded to prevent any light to be directed at oncoming traffic in such brilliance as to impair the vision of any driver No device shall be illuminated in such a manner as to interfere with or obscure an official traffic sign or signal This includes indoor signs which are visible from public streets 6 Roof signs 7 Any sign which contains or consists of banners, pennants, ribbons, streamers, string of light bulbs, spinners or similar devices, except where used for noncommercial speech 8 Portable signs including but not limited to signs with wheels removed, attached temporarily or permanently to the ground, structure or other signs, mounted on a vehicle for advertising purposes, parked and visible from the public right-of-way, except signs identifying the related business when the vehicle is being used in the normal day to day operations of that business, hot-air or gas -filled balloons or semi truck umbrellas used for advertising 9 Signs painted directly on building walls 10 Illuminated signs or spotlights giving off an intermittent or rotating beam existing as a collection or concentration of rays of light 11 Revolving beacons, beamed lights or similar devices 12 Signs supported by a guy wire 13 No sign shall be erected, placed or maintained by any person on rocks, fences or trees 14 No sign shall be erected which will interfere with any electric light, power, telephone or telegraph wires or the supports thereof 15 Graphic design signs PERMITTED SIGNS IN RESIDENTIAL DISTRICTS 1 Address signs 2 Professional name plates not exceeding one square foot in area 3 Memorial signs or tablets, names of buildings, and the date of erection when cut into a masonry surface or when constructed of bronze or other incombustible material 4 Political signs as regulated 5 Individual property sale, lease or rental as regulated 6 Bulletin boards not over thirty two (32) square feet located only on the premises of public, charitable or religious institutions PERMITTED SIGNS BY A SIGN PERMIT IN CA DISTRICT For all uses, only the following signs are hereby permitted with a sign permit A(�Jj All commercial, office, and industrial signs in a CA District are �• subject to the following conditions One sign per lot, parcel, building, or business is permitted A Wall Signs (1) Number There shall be not more than one (1) wall sign for each principal building except that where the building abuts two (2) or more streets, additional such signs, one (1) oriented to each abutting street, shall be permitted (2) Area The total signage shall have an aggregate area not exceeding one (1) square foot for each foot of such building face parallel or substantially parallel to a street lot line (a) Consists only of individual, outlined alphabetic, numeric, and/or symbolic characters without background except that provided by the building surface to which the sign was attached (3) Location A wall sign shall not project more than sixteen (16) inches from the wall to which the sign is to be affixed (4) Height A wall sign shall not project higher than the parapet line of the wall to which the sign is to be affixed or fifteen (15) feet as measured from the base of the building wall to which the sign is affixed, whichever is lower Wall signs above this height shall require a Special Use Permit 0 (5) Special Conditions Where a principal building is devoted to PERMITTED SIGNS BY A SIGN PERMIT IN ALL IP DISTRICTS All commercial, office and industrial signs in all IP Districts are subject to —� the following conditions One (1) sign per lot, building, parcel, or business is permitted A Wall Signs (1) Number There shall not be more than one (1) wall sign for each building except where the building abuts two (2) or more streets, additional such signs, one (1) oriented to each abutting street shall be permitted (2) Area The gross surface area of a wall sign shall not exceed ten 2 one (1) foot for each building, parallel, or substantially �__— -';> parallel, to the building lot line (3) Location A wall sign may be located on the outermost wall of any principal building but shall not project more than sixteen (16) inches from the wall to which the sign is to be affixed The location and arrangement of all wall signs shall be subject to the review and approval of the Director of Building (4) Height A wall sign shall not project higher than the parapet line of the wall to which the sign is be be affixed or twenty (20) feet as measured from the base of the building wall to which the sign is to be affixed, whichever is lower (5) Special Conditions Where a principal building is devoted to two S (2) or more permitted uses, the operator of each such use may install a wall sign upon his/her proportionate share of the building wall to which the sign is to be affixed A sign plan must be submitted for the entire building with the following requirements a The toal gross signage for the entire building shall not exceed one (1) square foot for each foot of such building face parallel, or substantially parallel, to a street lot line b The locations, sizes, types and elevations of all signs c All signs shall be visually consitent in design, color and scale B Ground Signs (1) Number There shall not be more than one (1) ground sign for each principal building (2) Area The gross surface area of a ground sign shall not exceed one hundred (100) square feet for each exposed face nor exceed an aggregate gross surface area of two hundred (200) square feet (3) Location A ground sign may be located in any required yard but shall not extend over any lot line or within fifteen (15) feet of any point of vehicular access from any zoning lot to a public roadway (4) Height A ground sign shall not project higher than fifteen (15) feet, as measured from base of sign or grade of the nearest adjacent roadway, whichever is lower i FIRST READING 6 GRADING PERMITS A GRADING PERMITS REQUIRED 1 No person shall undertake, authorize or permit any of the following actions without first having obtained a grading permit from the city a any excavating, grading, filling or other change in the earth's topography resulting in the movement of more than 50 cubic yards of material, except in any designated Wetlands, Floodplain or Shoreland District, b any excavating, grading, filling or other change in the earth's topography in any designated Wetlands, Floodplain or Shoreland District, or c any mining operation for gravel or other materials d any changing of a natural drainage way or drainage pattern that results in increasing or intensifying the flow of surface water upon adjacent property 2 Notwithstanding the above, no grading permit shall be required for the following activities, except as required by the Minnesota State Building Code a earthwork undertaken in accordance with grading plans approved in conjunction with a site and building plan review or plat approval, or b earthwork which will result in moving less than 50 cubic yards of material, provided the work does not take place in any designated Wetlands, Floodplain or Shoreland District and does not affect local drainage patterns 3 No grading permit shall be issued for site grading without approved plans for site development or adequate provision for site protection from wind or water erosion 4 No person shall undertake, authorize or permit any excavating, grading, filling or other change in the earth's topography which violates or is not in compliance with a grading permit issued by the city, including the approved plans and all terms and conditions of the permit 5 All grading permits which would result in the moving of more than 1,000 cubic yards of material per acre of site area shall be reviewed as a conditional use permit under the standards outlined in subdivision 27 of this section, to the extent possible grading permit review will be combined with other planning permit reviews B REVIEW OF GRADING PERMITS 1 Application for a grading permit which requires review as a conditional • use shall be made to the Community Development Director on forms provided by the city and shall be accomplished by the following as required a the legal description of the property, b the fee required by Chapter 70 of the Uniform Building Code, and c evidence of ownership or an interest in the property d existing and proposed final grades utilizing two foot contour intervals, e a survey showing the location and elevation of all roads, utilities and structures which may be impacted by the proposal, f a tree survey showing all trees having a caliper of six inches or greater and a tree preservation plan, g a landscaping and site restoration plan, h a development concept plan indicating how the recontoured parcel may be developed in a manner consistent with this ordinance and the comprehensive plan, i a drainage plan which includes any engineering work for stormwater retention which may be necessary, j an erosion control plan indicating the type and location of erosion control measures to be used, k a traffic analysis showing how the materials will be removed from or delivered to the site, and 1 such other information as may be required by the city m schedule of building construction phasing on permit site C ADMINISTRATIVE REVIEW OF GRADING PERMITS a Grading plans which would result in the move of more than 50 but less than 1,000 cubic yards of material per acre may be approved by the Community Development Director The applicant shall submit the required items from B above b Upon receipt of a completed application, the Community Development Director shall review the application within ten working days and shall notify the applicant of the decision by mail The Community Development Director may impose such modifications and conditions as may be necessary to protect the public interest Bonding may be required in any amount sufficient to ensure site restoration should the applicant default on his or her responsibilities D GRADING PERMIT STANDARDS Grading permits shall be issued only for grading plans which comply with the following a The plans shall maximize the preservation of trees on the property and utilize the trees to the maximum extent possible to screen the grading from adjacent property J b The plan shall utilize landscaping to restore site aesthetics, minimize the visual impact of the work, screen the grading from adjacent property and enhance the property's development potential All areas altered because of grading activity shall, at a minimum, be restored with seed and disced mulch or sod within two weeks after the completion of the activity The city may approve an extension of this deadline if appropriate, but in no case shall site restoration be delayed beyond October 1, c The plan shall not result in sites which are unsatisfactory for development of permitted uses The development potential of a site may be adversely impacted by such matters as unsuitable finished grades, poor soil stability, unsatisfactory drainage or exposure to deleterious influences such as highway frontages for residential property, d The plan shall provide for the removal of any significant amounts of organic material or construction debris from the site, e In instances where an existing natural or created buffer will be impacted by grading or filling operations, site restoration shall be completed in a manner which resembles, to the extent possible, the original vegetative and topography state of the property, when deemed appropriate by the city, f The plan shall protect designated wetlands, floodplains, shorelands, public waters and other natural features to the maximum extent possible, • 9 The plan shall provide for adequate drainage, stormwater retention and erosion control measures, h The plan shall provide for traffic movements to and from the site which do not have significant adverse affects on roads, intersections or development in the area Streets surrounding the site shall be swept as needed to remove any debris which may accumulate due to these activities, i The plan shall include a schedule of activities which limits the duration of off -site disruptions and impacts, j The plan must also be approved, where required, by appropriate watershed districts, the United States Army Corps of Engineers, the Minnesota Department of Natural Resources and any other government agency which has jurisdiction, k The plan shall be accomplished by a bond sufficient to insure compliance with the approved permit and adequate site restoration The amount of the bond shall be based upon the size of the site, sensitivity of its surroundings, extent of grading, amount of material moved, necessary site restoration and potential impacts upon public facilities, including damage to public roadways and property, and 1 The plan shall comply with the Minnesota State Building Code and all other applicable statutes or ordinances
