CITY HALL: 216 NORTH FOURTH STILLWATER, MINNESOTA 55082 PHONE: 612-439-6121 RESOLUTION NO. 92-249 ESTABLISHING DOWNTOWN PARKING COMMISSION AND BYLAWS A. PURPOSE The Downtown Parking Commission is established to oversee the development and implementation of the Downtown parking plan. This includes planning for long range parking lot improvements and day-to-day regulation of public parking spaces. B. COMPOSITION AND SIZE OF COMMISSION There is hereby established a City of Stillwater Downtown Parking Commission hereinafter referred to as the "Commission" which shall consist of seven (7) voting members to be appointed by the Mayor, with the advice and consent of the City Council. The Public Works Director, or his designee, the Chief of Police, or his designee, and the Community Development Director shall be ex-officio and non -voting members of the Commission. All voting members shall be residents of the City of Stillwater. Of the seven (7) Commission members, five (5) shall be Downtown business or property owners, and two (2) shall be City of Stillwater residents interested in Downtown parking. Commission members shall serve for two year terms. The initial appointments to the Commission shall be made for the following terms; (1) year term, (2) Commissioners, (2) year term, (3) Commissioners, and (3) year term, (2) Commissioners. Any Commissioner that misses two consecutive meetings without notice to the Chairman shall be removed from the Commission. C. ORGANIZATION A Chairman and Vice Chairman shall be elected annually by a majority vote Of Commissioners present at the first meeting of the calendar year. During the absence of the Chairman, the Vice Chairman shall exercise and perform the duties of the Chairman. D. DUTIES AND POWERS The Downtown Parking Commission is advisory to the City Council. It shall have have no authority other than that expressly given to it by this resolution. 1 1. The Commission shall make recommendations to the City Council regarding the development of a long term Downtown Parking Plan and day-to-day management of Downtown public parking. 2. The Commission shall seek and obtain public comments on parking improvement projects and changes to parking regulations that may affect businesses, property owners, customers and residents of the community at large. 3. The Commission shall explore -options for making Downtown parking financially self sufficient by setting permit fees and fine rates and exploring methods of financing the construction of new and maintenance of existing parking facilities. 4. The Commission shall exercise such other functions with respect to Downtown parking improvements as requested by the City Council. 5. The Commission shall present to the City Council a yearly report of Commission accomplishments and activities. E. DUTIES OF CHAIRMAN The Chairman shall set the agenda for Commission meetings with assistance of Staff, appoint special subcommittees of the full Commission and represent the full Commission when recommendations are made to the City Council. F. STAFFING The Community Development Department, with the assistance of the Public Safety Department and Public Works Department, shall provide technical and administrative assistance to the Commission. G. MEETING 1. All meetings of the Commission shall be open meetings to which the public and press shall be admitted. 2 2. Notice of the meeting shall be given as determined by the Commission. 3. The Parking Commission shall meet as needed as determined by the Commission. 4. Special work sessions or subcommittee meetings shall be scheduled by the full Commission at regular meetings to study and prepare recommendations regarding Commission parking matters. H. QUORUM A quorum shall consist of four (4) members of the seven (7) Commission members. No action shall be taken by the Commission without a quorum. I. VOTE All action shall be taken by voice vote. Tie votes with one or more Committee members absent shall continue the item to the next regular meeting. Tie votes with all members present shall defeat the motion. J. REVISION OF BYLAWS The Bylaws may be recommended by the Commission for approval of the City Council. Note: All approvals are by majority unless none are required by statute. Staff was directed by Council to prepare bylaws for the establishment of a Downtown Parking Commission. The attached bylaws were developed by Staff with input from the Parking Task Force members, Karl Ranum and Paul Simonet. As provided by the bylaws, the Downtown Parking Commission consists of seven members. City Staff, including Public Works, Police and Planning, will provide assistance to the Commission dependent on issues. RECOMMENDATION: Approval o��laws (resolution) and advertise for interest in membership on the Committee. Task Force members, Ranum and Simonet, are residents of the City and Downtown business people interested in membership on the Committee. PURPOSE In order to help facilitate the improvement of the Downtown through the implementation of the Downtown Plan, a Downtown Plan Action Committee is established. The Committee shall abide by the terms and conditions as described below. B. COMPOSITION AND SIZE The Committee shall have nine members, comprised of one member each from the Planning Commission and Heritage Preservation Commission, two Council members and five members of the community representing Downtown property or business owners, representatives of financial institutions, past members of the Downtown Plan Steering Committee and other residents interested in improving the Downtown. The Committee shall be appointed for a two year term beginning January 1989. All members shall be appointed by the City Council. C. ORGANIZATION A Chairman and Vice -Chairman shall be elected annually from among the committee members at the first meeting of January to serve at the pleasure of the committee. During the absence of the Chairman, the Vice -Chairman shall exercise and perform all the duties of the Chairman. D. DUTIES AND POWERS 1. The Downtown Plan Action Committee shall make recommendation to the City Council regarding implementation of the Downtown Plan consistent with the goals, objectives, guidelines, policies, plans and programs contained in the plan. 2. The Downtown Plan Action Committee shall prepare an annual work program report for Downtown improvements, including a multi -year capital improvement program and financing plan. The report shall include a description of previous years activities. The report should be presented to the Council in October of each year. 3. The Downtown Plan Action Committee shall exercise such functions with respect to Downtown improvements as directed by the City Council. C. The Downtown Plan Action Committee shall seek and obtain public comments on improvement projects that affect business, property owners and the community at large. 5. If any committee members should be absent for three consecutive regular meetings of the Downtown Plan Action Committee without excuse, he/she shall relinquish his/her seat in the Commission. The design provided 27 parking stalls which includes 1 handicap stall. The parking area added for the Rivertown Commons building is designed for 8 stalls. As you recall, at the Council meeting, the discussion was whether to designate the Lowell Inn lot for permit parking or two hour parking. After discussions with Mr. Russell on Wednesday, the Parking Task Force had discussed these two options with all the businesses in the area and the conclusion was that the parking lot should be permit parking only. Consequently, we have prepared a chaxige order to submit to the parking lot contractor to install the signage required for permit parking. In the next two weeks signage will be completed and streets and parking lots marked. In order to enforce the parking regulations, the Parking Ordinance will have to be amended to reflect the parking designations. Attached to this report is the final, signed and marked designations for the Downtown area. (This does not include lots outside of the Downtown Improvement Project area.) The City Council should review these descriptions one final time before the Parking Ordinance is revised. It is suggested that the Council set a workshop for July 14 to meet with the Parking Task Force, SEH, and City Staff to review the parking designations one final time. Glen Van Wormer in the attached memo of June 4, 1992, identified some parking issues that need further consideration; ie loading zones, handicapped spaces, a Parking Commission for parking management and curb marking. The net result was a considerable amount of signing in place, some of which could have been removed. A goal of the downtown plan was to reduce the number of signs. The construction plans for the downtown improvements were to removal of many others. include replacement most of the signs which were necessary and Simultaneously with the downtown planning came a change from parking meters to signed time restrictions. The rather quick removal of parking meters necessitated a quick installation of time limit signs, resulting in over --signing in some locations. Part of this was due to installing signs on existing posts or Poles, or onto remaining parking meter posts. The subsequent removal of the parking meter posts further modified sign placements. The permanent signing was to be coordinated with revisions t❑ parkins. Combinations Of two hour, four hour, and 30-minute zones were to be used for public parking with special areas for permits, handicapped, or loading zones. Signing concepts were reviewed by the Downtown Planning Committee. Later the details were reviewed by the Downtown Action Committee. During this time, a number of physical changes to signs were made through the efforts of some concerned citizens. Unfortunately, records of most of the changes that were made are not available. The final plans that were part of the contract were reviewed by the Downtown Committees, Parking Committee, City staff, and many individuals. The final layout reflected a group Effort towards the best signing. Construction started and removed many of the signs that were in place. With ~Jsome delays and the early snowfall, many signs were not inplace in the fall of 1991. During the entire process, the City has had numerous requests for actions regarding parking, designations, and especially signing. The City and the contractor have made a number of changes, most of which have been documented. Unfortunately, the signing which is physically in place is not complete compared to plans. This has resulted in criticism of the signing layout and request for modifications. Despite the Council's intent to make no more changes to the signing until construction is complete, there is continued pressure to do so. There is also concern that there is no legal Council action for many of the restricted spaces. The changes by plan were to have Council action. The changes that were made by the concerned citizens have no record and therefore, many of the them are probably not legal in terms of their specific restrictions. One of the biggest handicaps in understanding the signing in the downtown area is the lack of pavement markings. These were not l�, bF. Requests have been made for more signing or for larger signs which is contrary to the initial action of the Committees to reduce the number of signs and to minimize their size. The combination of marked parking stalls and signing in the construction contract should result in a system which is clearly understood by most motorists. To help clarify many of the problems which are occurring in the downtown, we would like to propose the following actions: 1. The Council and City staff continue with the policy they adopted that there be no more changes made to the signing plans until the final pavement markings and signs have been installed. Steve Russell June 4, 1992 Page #3 2. The City Council review the attached parking list which identifies two hour, four hour, 30-minute, handicapped, permit, and loading zones. This is what will be reflected in the signing which is currently part of the plan, modified slightly for modifications made during the construction process. This does not restrict the Council from taking further action to modify signing, but at least will provide legal action necessary for proper enforcement. 3. The City should develop a definition and a policy for 6A, 1.g zc'nes- it iy aPPaxent -c:La'c many people would like to have loading zones for the convenience of themselves and their customers. The same building owners and occupants would also like to maximize parking for customers in the downtown. There is conflict when loading zones have restricted uses and businesses are complaining about lack of adequate parking. 4. The Council should also review its present signing of handicapped spaces on the City streets. We have a concern relative to the use of a prime parking space for handicap use when all City lots have handicapped spaces which currently are under utilized. our biggest concern is that a handicapped stall is generally 12 feet in width in a parking lot compared to the normal 8-1/2 or 9 feet for a regular stall. The 12 feet of width is not available in on -street Parking spaces meaning that any extra width needed by the handicapped motorists will come from the through lane. This obviously sets up a safety concern which should be addressed. 5. For the long term, the City should look at setting up a Parking Commission. We have worked in several communities wi.Lra s�tch a exists. The Commission would be advisory to the Council and would be set up similar to Planning Commissions, Charter Commissions or other specifically authorized groups. Changes in parking and parking signs should have review by this Commission. Membership could be made up from downtown business people, City staff members, citizen members, or a Council person. The benefit of such a organization would be to provide continuity of thought and action and to formalize a process which currently has many very interested and concerned People lobbying many different ways to try to get a specific modification or installation done. The Council would not give up any of its authority, but would receive input from a specific authorized group. This absence of a loading zone for the entire block of Main Street not only creates a problem for customers who purchase large items that cannot be carried to their cars, but also is just as severe a problem when the need to unload items for one's business arises. Every business has to unload boxes or furniture at one time or another. any ofe businesses have no access to the alley or if they do, it is an hinsufficient access so there is no alternative. This creates a hardship in our ability to conduct business. With the omission of several parking spots on Main Street one would think a compromise with all parties concerned could be reached in providing a short term loading zone pbrhaps in the middle of the block so as to service the entire block.
