Amherst Fry presented the request.The Commission asked what material
would be stored on the site. The applicant said household goods and furniture.
The Commission included a condition limiting the storage to household items.
Judy Curtis made motion and Rob Hamlin seconded. Passed 6-0.
CASE NO. SUP/87-35
Vicki Bergstedt presented the application. The Commission asked which
alternative was being presented for approval. Alternative 3, the present
proposal, has been amended to meet DNR concerns. The DNR is reviewing the
proposed change. Jack Hoeschler, Attorney representing Frank Aiple, requested
that the Planning Commission set a policy that boats in the water not extend
over the property line extended into the river. Rob Hamlin asked if the slips
will be rented out to people who do not live in the Lakeview Harbor
Association. Vicki Bergstedt said the slip shall be for association members
only. The slips have to be equal size for all association members. Howard
Boever, 104 Lakeside Drive, Harbor Association member, indicated the project
would improve the appearance of the area. Steve Russell said that he received
a call from Mrs. Stratte indicating concern for the visual impact and size of
the slips.
Motion by Rob Hamlin, seconded by Don Valsvik, to approve the application
with conditions regarding consistency with DNR conditions, five foot side
property line setbacks, and boats not extending over property boundaries.
Approved 6-0.
CASE NO. SUP/87-36
Robert Hagstrom presented the application. He said that additional
parking is needed for the 14 year old project. Gerald Fontaine indicated that
the buffering is important to screen the parking area.
Motion by Don Valsvik, seconded by Rob Hamlin. Approved 6-0.
CASE NO. V/87-37
Jerry Aerts, property owner, described the project. Lee Natwick, living
at 278 Deerpath Drive, neighbor to the South, requested the setback from his
home be ten feet and from Deerpath Court twenty five feet. The Commission
agreed with the request.
Motion by Nancy Putz, second by Dean Miller. Approved 6-0 as conditioned
and recommended by Staff.
CASE NO. SUP/87-38
Special Use Permit for three bedroom Bed and Breakfast. David Belz
presented the request. Dan McDonald, a resident of East Laurel Street, asked
questions about the application. Neal Casey, 107 East Laurel Street, spoke and
asked questions about the use but did not oppose the project.
Mark Ehlenz made motion, seconded by Nancy Putz. Approved 7-0 with 13
conditions as stated in the Staff report.

Chairman Fontaine briefed the Commission on Council action July 21, 1987
and August 4, 1987 indicating the Council had gone along with Commission
recommendations except for a lighted sign on Curve Crest.
Steve Russell described the recently completed work on the Downtown Plan.
On Thursday the Downtown Plan Committee will meet and walk the downtown.
Don Valsvik and Mark Ehlenz indicated an interest in the Fall Planning
Commissioners Workshop in White Bear Lake. Steve Russell said there is money
in the budget for the cost of the workshop.

Discussion;
The application is to add an approximately 500 sq. ft. addition to an existing
facility. The addition would require the loss of six parking spaces. A new
area for six spaces is being added and driveway relocated. The design of the
addition is consistent with the existing building.
Conditions of Approval:
New curb, gutter and sidewalk shall be constructed where the old driveway was
located.
Recommendation:
Approval.
Findings:
The proposed use will not be injurious to the neighborhood and general welfare
to the community.

Variance for construction of pool in front and side yard.

The application is to construct an in ground swimming pool eight feet from the
front property line. The lot is large but constrained by vegetation, slope and
existing structures. The City Code requires all swimming pools to be located
in the rear yard. A retaining wall and fence is shown between the front
property line and the pool. The fence requires a variance because of its
height of 48 inches.
The pool location is of concern. The pool would be elevated above street grade
by constructing a retaining wall. A fence would be above the retaining wall.
This would appear as a large structure from the street. The fence and
retaining wall appear to be less than five feet from the property line as
shown on the site plan. Buildings are required to be setback thirty feet in
the RA District.
It is recommended that a minimum twenty foot property line setback be required
for the fence from the front property line. The decks would have to be
modified to accommodate the pool further back on the lot. (It is suggested a
section view of the proposal showing street level, retaining wall fence and
pool be submitted to help describe the project.)
Recommendation:
Approval with conditions.
Condition:
The front fence shall be setback a minimum of twenty feet from the front
property line.

The application is for a three room Bed and Breakfast. A previous Special Use
Permit was approved for the structure for two rooms. Since the original permit
was issued no complaints regarding the use have been received.
It is recommended that the "standard" conditions of approval be required. (An
additional parking space has been required to accommodate the extra room.)

CONDITIONS OF APPROVAL
CASE NO. 661
1. The Special Use Permit is issued to Bernard and Diane Rappa and Kenneth
and Barbara Schotl and is not transferable to successive owners.
2. The Owners of the property shall reside and operate the Bed and Breakfast.
3. Three bedrooms and six guests maximum shall be allowed at any one time
(two subject to approval).
4. A parking plan for the site shall be prepared assigning three off street
parking spaces for guest parking besides two spaces per living unit or
household. The parking spaces shall be signed and plan approved by the
Community Development Director.
5. No liquor to be sold on the premises.
6. Breakfast may be served only and only to guests of the residence.
7. The Special Use Permit shall be reviewed by the Planning Commission upon
complaint.
8. The structure shall be inspected by the Fire Marshal, Building Official
and Health Officer as required by such a use.
9. A 1' x 2' identification sign may be located on site as approved by the
Community Development Director.
10. No additional external lighting.
11. No other uses or functions such as wedding receptions or such may be held
at the location.

Bed and Breakfast facility. We are applying for a Special Use Permit
at this time to utilize three (3) rooms for said purpose. This
property (Sauntry House) was licensed for operation as a Bed and
Breakfast recently under another name and we are at this time
reapplying for slightly enlarged operating facilities.

Project Description: Variance for sign program.

A sign program for the Oasis Building and addition is being proposed. The
program requires a variance because of the number of signs and sign setback
from South Greeley Street.
The program includes a 28 ft. tall free standing sing in front along South
Greeley and signs near the three door entries to the building on the East,
North and South sides. The Sign Ordinance allows two signs and requires that
the lighted free standing sign be setback 25 ft. from the front property line.
The proposed sign is 7 ft. from the front property line and approximately 35
ft. from the curb. The sign would be a directory sign for the various uses in
the building. It is suggested, because of the location, the maximum sign
height be 25 ft. This could be done by reducing the sign face height by three
feet. A Realty World sign is over the South building entry. It is recommended
that the sign be 8 ft. by 3 ft. maximum so it fits within the accent panel.
Other 1 ft. by 2 ft. business signs are located at the three entrances to the
building. The existing signs on the front of the building will be removed to
conform to the program.
Conditions of Approval:
1. A maximum of one sign other than free standing sign shall be allowed for
each tenant.
2. The existing signs on the building shall be removed consistent with the
sign program.
3. The free standing sign shall be a maximum of 25 ft. with a 9 ft. clearance.
4. Any exception to this sign program shall require a variance permit.
Recommendation:
Approval.

The application is for a Special Use Permit to construct an aquatic/therapy
facility. The building area would total 19,800 sq. ft. including 7,600 sq. ft.
pool area, 4,000 sq. ft. pool treatment area, 3,100 sq. ft. administration
area, 1,000 sq. ft. multi purpose area and 4,100 lobby and maintenance area.
Parking for 56 vehicles is shown including 11 handicapped spaces, 1 bus space
and 2 van spaces. An additional 10 space expansion area is available if needed
to the West of the existing parking lot. Access to the site is directed off of
Curve Crest Blvd. A circular drive and covered drop off area is shown. Left
turns to the second parking area may be confusing because of the circular
drive but traffic is not expected to be heavy. A one way traffic flow into the
parking area from the first drive and out the second drive could solve the
potential problem. A future access to Outlot "B" road is marked.
The site plan meets the zoning setback requirements. The number of parking
spaces seems adequate based on the particular use and the experience of the
Courage Center at the other location. If additional parking is needed, it can
be developed on site.
The landscape plan shows a variety of Evergreens and decidious trees. Maple
trees frame the site and Evergreens and bushes screen parking and provide a
variety of plant material. Sod will cover the front part of the site that
could be seen from Curve Crest Blvd and the remainder will be seeded.
The building will be constructed of white brick, have a multi -pitched standing
seem green metal roof. Interior lighting is provided through the use of
skylights and clerestory windows. Vinyl clad windows and glass blocks detail
the building. The building design and landscape will certainly compliment the
area.
A free standing 41x24' illuminated identification sign is proposed in front of
the building. No drainage plan has been received as of this writing but it
should be available by Planning Commission time. The project is located on
three lots. They should be combined into one.
Recommendation:
Approval.

3. The trash area shall be enclosed in the building or screened using a
structure of compatible design.

Attached are 12 copies of our proposal for Courage St. Croix, an aquatic/therapy
facility to be operated by Courage Center.
As per your request, we are including a site plan showing setbacks, parking,
service etc., building sign detail, a site lighting detail and a building
description. A separate site plan includes landscaping only. We are also
including building elevations calling out materials.
We have not included a drainage plan at this time. Our civil engineers are
currently preparing a scheme based on the results of the Sept. 1 hearing on the
East Industrial Park Drainage Area. This will be included for the September 14
Planning Commission meeting.
We will expect to present the project at the September 14 Planning Commission
meeting. Please keep us informed of that meeting schedule.
