APPROVAL OF MINUTES Minutes of June 8, 1987 with corrections as noted - Gerald Fontaine called the meeting to order. Dean Miller reported. PUBLIC HEARINGS: Case No. V/87-29 - Variance to the front setback requirements for construction of addition to an existing restaurant,_ Burger King, at 14430 60th Street North in the Industrial Park Commercial IP-C District. Jerry Sisk, Applicant. Kent Carlson, representing the Applicant, presented the plan. He said the nine foot greenhouse addition would add 25 seats to the restaurant capacity. He said they are adding it to change the look of the building. The patio outside seating would not be extended. The Commission considered the request. They felt the location of the existing building was a hardship and limited other locations for the addition. Motion by Rob Hamlin, seconded by Dean Miller. Approved 7-0. Case No. V/87-30 - Variance to the front and side yard setback requirements for construction of canopy over existing gas pumps at 1101 North Owens Street in the General Commercial CA District. Ed Bird, Food n Fuel, Applicant. Ed Bird presented the plans. He said the canopy would protect the customers. Mike Dorendorf, who lives at 1114 North Owens and owns property at 1106 and 1108 North Owens, across from Food N Fuel, said the canopy is not as much concern as lighting. The Commission shared Mr. Dorendorf's concern for lighting and conditioned the approval accordingly. Motion by Rob Hamlin, seconded by Dean Miller and approved 7-0 with Condition. Condition: The lighting under the canopy shall be recessed with the light lens not extending below the fixture and no additional canopy or site lighting. 1 Case No. V/87-31 - Request for modification to approved building sign requiring a variance to the Sign Ordinance located at 1060 Curve Crest Blvd. in the Industrial Park Industrial District. Ronald Schoenborn, Applicant. Ron Schoenborn presented the plans. He indicated the nameplate sign would be located one foot from the property line and be lighted from the ground. The Commission discussed the lighting variance. They were concerned for the lighted sign being so close to the street. Nancy Putz made the motion, Dean Miller seconded, with condition that the sign not be lit. Approved 7-0. Case No. V/87-33 - Variance request to Sign Ordinance requirement for construction of 240 square foot billboard at Woodland Lakes Project Site along Highway 36 in the Industrial Park Industrial IP-I District. Robert Scott Company, Applicant. The Commission reviewed the sign variance request for Woodland Lakes Center. No one represented the applicant. The Commission felt the larger sign was appropriate to the large 70 acre site with the stipulation that the sign be removed by January 1, 1989. Mark Ehlenz made the motion, Jean Jacobson seconded. Approved 7-0 with removal condition. Case No. ZAM/87-1 - Zoning Ordinance Amendment changing the zoning of approximately seventeen acres running West along 60th Street North (Frontage Road) from Zantigo's Restaurant to South Greeley, including Country Kitchen, and along South Greeley not including but South from the School District Administration Building South to the Frontage Road from Industrial Park Industrial IP-I to Industrial Park Commercial IP-C. City of Stillwater, Applicant. (This amendment implements the Brick Pond/South Greeley/Forest u;iic/Frnntano Rnad Comprehensive Plan Amendment.) Case No. ZAM/87-2 - Zoning Ordinance Map Amendment changing the zoning of approximately 24 acres of land located South of Forest Hills residential area West of the Oak Park Heights boundary and North of Industrial Park Commercial land along the Frontage Road from Industrial Park Industrial IP-I to RB Duplex. City of Stillwater, Applicant. (This amendment implements the Brick Pond/South Greeley/Forest Hills/Frontage Road Comprehensive Plan Amendment.) The Commission reviewed the zoning changes. Staff indicated that the changes are consistent with the recently approved Brick Pond Area land use and public facilities plan. A letter was received from John S. McDonald, representing the Augustine Brothers, disapproving of the zoning change. No other comments from the public were received. ON ZAM/87-1 - Motion by Dean Miller, second by Nancy Putz, for approval. 7-0 approved. ZAM/87-2 - Motion by Nancy Putz, second by Jean Jacobson. Approved 7-0. The meeting adjourned at 8:15 P.M. SUP/87-34 Planning Commission Meeting: August 10, 1987 Project Location: 807 North Fourth Street Comprehensive Plan District: Multi -Family Zoning District: RB Applicant's Name: Amherst and Joy Fry Type of Application: Special Use Permit Project Description: Change of use from Antique shop to rental storage space requiring Special Use Permit. Discussion: The request is to convert the Antique Shop to rental storage space. Both uses are commercial uses and require Special Use Permits. The dry storage use would probably create less traffic and activity than the Antique Shop. The RB zoning regulations allow commercial uses that are not objectionable to the neighborhood. No off-street parking is provided now or would be provided for the storage use. Conditions of Approval: None Recommendation: Approval. Findings: The proposed change in use is compatible with the area and consistent with purposes of the RB District. Discussion• The application is to fill in an existing man made harbor and construct a new dock with nine slips. The site is located in the Bluffland/Shoreland and Flood Plain District. The Flood Plain District requires a Special Use Permit for docks in the Floodway. It does not appear that the Harbor is in the Floodway because of the silting and original construction into the riverbank. The Applicant has applied to the DNR and received a permit for the project (copy of permit and conditions of approval attached). As conditioned by the DNR, the shoreline area will be returned to a more natural state with landscaping, beach and dock. There are several other similar docks along the river in the area. Conditions of Approval The 21 provisions of DNR approval are incorporated in the City approval by reference. Recommendation; Approval. As of this date we have an existin; harbor, built 22 years ago, which contains 10 slips for boats and a beac',z for swimming on the St. Croix river. We also have 200 feet of usable boat docks in the river which we adjust accordingly to the high water level. (pictures of same on following pages.) The docks are anchored in part to an existing 50 x 22 foot slip. There are three poles which hold t.iis slip in place. Our shoreline is 114.66 feet and the river bed is sand. We purpose to fill in the existing harbor with sand and use it as a beach. Due to the yearly high water the walls of the harbor have deteriorated very badly and sand has half filled the harbor. If we continue to use the harbor we will need to have it dredged. To keep the harbor open enough to get our boats in and out we should have it dredged every year. We want to build new wood docks to replace the old ones with 9 fingers 50 feet long for- 9 slips to replace the 10 slips in the harbor. The boats of today are wider then they were 22 years ago. We would remove the 50 x 22 foot slip in the river but keep the poles to anchor our new wood docks to. The water depth at the end of our 200 feet of docks is 7 feet and the water depth at point of first slip is 5 feet. Total estimated cost of entire project is $15,000.00. It will take approx- imately 12 to 14 cubic yards of sand to fill in the harbor. Equip.'ment that will be'used will be a dump truck and a pick up truck for the sand and removal of debris. Enclosed please find pictures showing the walls of the harbor and the docks which we are using. They are on shore now which is where we keep them for the winter. Also enclosed are pictures of the high water. The high water every year has covered the entire area of our harbor and beach. We believe that by doing what we have purposed in the above letter it will eliminate any future dredging, deterioration of docks and harbor walls and be much easier to maintain. This Permit may be terminated by the Commissioner of Natural Resources at any time he deems it necessary for the conservation of water resources of the state, or in the interest of public health and welfare, or for violation of any of the provisions of this permit, unless otherwise provided in the Special Provisions. 7. Construction work authorized under this permit shall be completed on or before date specified above. Upon written request to the Commissioner by the Permittee, stating the reason therefore, an extension of time may be obtained. 8. The excavation of soil authorized herein shall not be construed to include the removal of organic matter (as indicated above) unless the area from which such organic matter is removed, is impervious, or is sealed by the application of bentonite after excavation. 9. In all cases where the doing by the permittee of anything authorized by this permit shall involve the taking, using, or damaging of any property rights or interests of any other person or persons, or of any publicly owned lands or improvements thereon or interests therein, the permittee, before proceeding therewith, shall obtain th.e written consent of all persons, agencies, or authorities concerned, and shall acquire all property, rights and interests necessary therefore. 10. This permit is permissive only. No liability shall be imposed upon or incurred by the state any of its officers, agents or employees, officially or personally, on account of the grantlh�"���fi�ii account of any damage to any person or property resulting from any act or omission of the peritt�_' of its agents, employees, or contractors relating to any matter hereunder. Clean, inorganic fill shall be compacted and sloped to match the topography of adjacent properties. 15. Dock and slips must be constructed within the bounds of the easement. 16. Docks shall beuplaced as indicated in choice two of the plans except that the entire length of dock and ramp shall not exceed 1501. 17. All wood removed from the retaining wall shall be hauled away. 18. Permittee shall obtain necessary permits from the City of Stillwater. 19. Permittee shall plant several native specie trees to blend with adjoining properties. 20. The permittee shall comply with all rules, regulations, requirements or standards of the Minnesota Pollution Control Agency and other applicable federal, state or local agencies. .21. Discussion: The application is to construct a twenty car parking lot just North of an existing parking lot for the Southill Square office Building. The lot would be used by Staff and allow visitors to the offices to park on site rather than in the street. The parking lot is situated several feet above the street. The setback requirements for a parking lot in the RCM District is 35 feet ora distance approved by the City Council. Tentatively, three evening training meetings have been scheduled for: September 24 October 8 October 29 November 14 (Saturday session),.from 9:00-3:00 p.m. _ All sessions will be held in the Northeast Metropolitan Technical Institute (916) on Century Avenue and Interstate 694. On the first evening, the topics have been established: a Metro East overview and a panel discussion on the Supreme Court's recent land use decision and implications.
