The Stillwater Planning Commission will meet on Monday, April 11, 1994, at 7 p.m. in the
Council Chambers of City Hall, 216 North Fourth Street.

Approval of Minutes of March 14, 1994.

1. Case No. SV/94-12. A street vacation for a 60 ft. x 150 ft. portion of South Harriet Street
between West Willard Street and West Abbot Street in the RB, Two Family Residential

2. Case No. SUB/94-13. A resubdivision of a 10 ft. x 150 ft. portion of Lot 8, Block 1,

6. Case No. SUB/94-17. Preliminary plat approval for a major subdivision of a 3.66 acre parcel
into six lots ranging in size from 13,977 square feet to 46,497 square feet. The property is
located on the Northwest corner of County Road 12 and Boutwell Road in the RA, Single
Family Residential District. Clark R. Nyberg, Applicant.
7. Case No. SUP/94-19. A special use permit to conduct a consulting business out of a
residential structure. The property is located at 620 West Pine Street in the RB, Two Family
Residential District. Alfred and Jeanne Wiger, Applicants.
8. Case No. SUP/94-20. A special use permit for the reconstruction and expansion of a 67 car
parking lot for Lily Lake School. The property is located at 2003 W. Willard Street in the
RA, Single Family Residential District. Independent School District #834, Applicant.
9. Case No. SUP/94-21. A special use permit to conduct a book publishing and distributing
company out of an existing residential structure. The property is located at 317 W. Maple
Street in the RB, Two Family Residential District. Daniel and Susan Larson, Applicants.
10. Case No. SUB/94-22. Preliminary plat for a major subdivision of a 5 acre parcel into ten
(10) lots ranging in size from 12,506 sq. ft. to 33,916 sq. ft. The property is located at 1524
West Myrtle Street in the RA, Single Family Residential District. Richard Huelsmann,

11. Case No. SUP/94-23. A special use permit to conduct a restaurant/take-out business at 224

Chairman Fontaine called the meeting to order at 7:00 p.m.
APPROVAL OF MINUTES
Motion by Glenna Bealka, seconded by Rob Hamlin to approve the minutes of January 10, 1994
as submitted. Carried.
Motion by Kirk Roetman, seconded by Rob Hamlin to approve the minutes of January 31, 1994
as submitted. Carried.
Discussion of the minutes of February 14, 1994, regarding Case SUB/94-3. Minutes were
clarified by Steve Russell. Motion by Kirk Roetman, seconded by Rob Hamlin to approve the
minutes of February 1, 1994 as submitted. Carried.
PUBLIC HEARINGS
Case No. SUB/94-9. A minor subdivision of a 20 ft. x 155 ft. parcel of property from Lot 5,
Block 1, Marvin Gardens to Lot 4, Block 1, Marvin Gardens (1100 West Sycamore Street) in the
R.A. Single Family Residential District, Mark D. and Julie Wilson, applicants.
Julie Wilson presented the case and explained that this parcel is no longer needed for access to
Lot 5 because the owners now have access off County Road 5. An easement will remain on the
property.
Motion by Rob Hamlin, seconded by Dorothy Foster to approve the Subdivision request. Carried
6-0.
Case No. SUP/94-10. A minor subdivision of a 1.3 acre lot into two lots of 17,500 sq. ft. and
39,128 sq. ft. The property is located at 1301 West Orleans Street in the R.A. Single Familiy
Residential District. Randy Noecker, applicant.
The applicant presented the case. There is one condition of approval which the applicant agrees
to.+
Motion by Kirk Roetman, seconded by Dorothy Foster to approve the subdivision request with
one condition. Carried 6-0.
Case No. V/94-11. A variance to the front yard setback requirement (30 ft. required, 6 ft.
proposed) for an addition to an existing home. The property is located at 936 Third Avenue
South in the RA, Single Family Residential District. William and Jodi Defiel, applicants.

Mr. Defiel explained his plans to add a garage and family room onto an existing home. He
stated that the addition will not be obtrusive and will fit into the neighborhood.
William Funari, 937 4th Avenue South, questioned how high and how far to the street the
addition will be. Mr. Defiel stated that the building will be an additional 20 feet closer to
Dubuque. Mr. Russell stated that 30 feet is the maximum height allowed.
Mr. Hamlin questioned why the addition will not be built on the back of the house. Mr. Defiel
stated that there is not enough room to get to the back of the property on 3rd Avenue South,
which actually does not exist. In that location, it would also block a neighbor's view. In the
proposed location, he will not obstruct anyone's view.
Duane Seaquist, 4th and Dubuque, stated that Handevidt's garage (935 5th Ave. S.) is out to the
property line, and Mr. Seaquist's garage is 10 ft. from the property line.
Jeff Anderson, neighborhood resident, stated he does not have any objection to the addition.
Motion by Rob Hamlin to deny the variance request. No second.
Motion by Glenna Bealka, seconded by Dorothy Foster to approve the variance request.
Discussion: Don Valsvik stated he would be in favor of the request provided the height of the
addition is no higher than the existing structure. Rob Hamlin stated that he feels it is too much
house too close to the property line, and a hardship does not exist because other locations are
available. Kirk Roetman stated that this addition will not change the character of the
neighborhood, and the applicant is sensitive to the neighbors views.
Motion by Don Valsvik to amend the previous motion adding one condition of approval: the
roofline shall be no higher than the roofline of the existing structure. Seconded by Glenna Bealka.
Motion carried 5-1.
Case No. SV/94-12. A street vacation of a portion of Carnelian Street between Stillwater Avenue
and St. Croix Avenue in the RB, Two Family Residential District. City of Stillwater, applicant.
Ann Pung-Terwedo explained the request to vacate a 20-foot portion of Carnelian Street.
Gerald and Gloria Shepardson, 1208 N. William, stated that they own Lot 6 which will have no
access if Carnelian is vacated.
Steve Russell stated that the Public Works Department does not feel that improving this street
would be feasible. Two lots could be developed and the owners would have to pay the costs
of improving Carnelian. Mr. Shepardson stated that they are not asking to improve the street, just
to not vacate the street.
JoAnn Lohr, owner of Lots 10, 11, and part of 12, stated that the City cannot landlock property.
Mr. Shepardson stated that the property would be useless if landlocked.
Motion by Kirk Roetman, seconded by Rob Hamlin to deny the street vacation request. Carried
6-0.

OTHER BUSINESS
Lily Lake Report
Ann Terwedo explained that the City of Stillwater contracted with the Washington County Soil
and Water Conservation District to test the water quality of Lily Lake. Tim Fredbo of WCSWCD
presented the report. Three samples were taken during the summer of 1993. Mr. Fredbo stated
that he expected the results to be worse because of the amount of rain last year, but that may
have been offset by the lack of warm weather. He recommended that water monitoring be
continued on the lake.
Jack Evert, resident on Lily Lake, noted that the weed growth has become worse. Tim
recommended a buffer strip of uncut grass along the shoreline to control runoff. He also
recommended shoreline residents use little or no phosphorus fertilizers. Chairman Fontaine
recommended education of the residents through the City newsletter, etc.
Del Peterson, resident, asked about street runoff. Tim recommended that streets be cleaned more
frequently.
Tim reported that the Met Council has a Citizens Lake Monitoring program costing $1,000.
Motion by Rob Hamlin, seconded by Kirk Roetman to recommended that the City Council
approve continued monitoring of Lily Lake and other major water bodies within the City, and to
investigate cost-effective methods of sampling. Carried 6-0.
Rivertown Trolley Annual Review
Mac Barlass presented the one-year review of the Rivertown Trolley Special Use Permit.
Motion by Don Valsvik, seconded by Glenna Bealka to approve the one-year review of the
Rivertown Trolley Special Use Permit. Carried 6-0.
The Commission directed the Parking Commission to review the request for Trolley Stop on South
Main Street in front of the Grand Garage.

Discussion
The request is to construct a 480 square foot garage in the same location as an existing garage
which doesn't meet the required setbacks. The new garage will be very visually attractive and
improve the area.
The proposed location for the new garage is appropriate for efficient vehicular access to the
property and will maintain the backyard.
Finding
The proposed meets the intent of the zoning ordinance and the granting of this variance is
necessary for the reasonable use of the land and buildings.

Project Description
A street vacation for a portion of Cedar Street between East Laurel Street and the wall of the
Territorial Prison Site.
Discussion
The proposal is to vacate a portion of Cedar Street which runs parallel with Main Street north of
Laurel Street. The street is platted across the Warden's House property. As with many streets in
Stillwater, this street was platted and never improved.
In order for the Historical Society to construct their Carriage House in the rear of the property,
the street must be vacated.
The city has no use for the platted street now or in the future.
The vacation of Cedar Street will not impact public facilities.

Discussion
The request is to adjust a lot line which presently runs through an existing garage. The property
line change will now be located across the existing carport and not the structure.
Beyond this request, a buildable lot could be defined if Lots 1 and 2 were combined. This
would require another resubdivision. Presently, the street does not extend to that lot. Any
request to build on the property will also require the property owner to request that the public
street be improved or request driveway access over the public right of way. This is not part of
this application.

Project Description
Subdivision of 3.04 acre site into 6 lots ranging in size from 13,977 square feet to 96,497 square feet.
Discussion
The site is located west of Boutwell and north of Myrtle Street (County Road 12) at the corner of
Boutwell and Myrtle Streets. The City boundary runs along the west boarder of the site. Wild Pines
third addition, a single family residential area is located across Boutwell to the east.
One residence is currently located on the heavily treed site. Pine trees cover most of the site and provide
a natural buffer from surrounding areas along with site topography sloping up from Boutwell and County
Road #5. No wetlands are located on the site.
The subdivsion preliminary plat has been referred to the City Utility Departments and Washington
County Public Works for comments regarding their areas of interest.
The subdivision design meets the City Zoning lot size and dimensional requirements. The proposed
street system meets City street right-of-way standards for a local street. The proposed subdivision
shows the lot configuration over the existing contours. No gradings, storm water management, erosion
control, landscape plans or soils analysis has been submitted as required by recently adopted
environmental protection ordinances; trees, soils, stormwater management. Conditions of approval are
listed to meet the requirements of these new regulations.
The Parks and Recreation Commission reviewed the subdivision at their meeting of March 26th and
recommend that the park dedication requirement be met with an in lieu park fee consisting of 7% of the
net improved land value.
As conditioned the preliminary plat is consistent with the Zoning Ordinance and Subdivision Ordinance.

1. A detailed grading drainage plan shall be prepared for city approval. The grading plan shall
show existing and proposed contours and the grading effect on existing trees.
2. A site landscape plan shall be presented before final plat approval showing a reforestation plan at
a rate of 10 trees per net developable acre for all areas where trees are being removed.
A soils survey shall be prepared by qualified professional before final plat approval identifying
and retroactive soils per city Restrictive Soils Ordinance and proposing mitigations required to
correct soil conditions as approved by the city building official through a restrictive soils permit.
4. A final grading erosion control plan shall be prepared and approved by the Community
Development Director before final plat approval.
The subdivision shall construct storm water management facilities necessary to manage
increased runoff resulting from the development so that the two year, ten year and 100 year
storm peak discharge rates existing before the proposed development are not exceeded.
6. Runoff shall not be discharged directly to wetlands without presettlement of the runoff.
No land disturbing or development activity shall be allowed on slopes of 18 percent or greater.
A storm water management plan shall be submitted and prepared by the Community
Development Director before final plat approval.
9. No more than 25 percent of subdivided lots shall be impervious surface.
10. Comments from the City Utilities Departments and Washington County Public Works shall be
incorporated in the final plat.
11. Site design review by the Community Development Director shall be required for development
of lots 1, 3, 4, 5, and 6 to review residential siting, grading, drainage/erosion control, and to
ensure maximum reasonable retention of existing trees.
12. A 50 foot setback is required for the exterior parameter of lot 6.

2) (SUB/94-17) The second request is to subdivide a 3.66 acre parcel
into six lets. Cash in lieu of park land would be $2,400. The Board
agreed that the amount required by the Park Dedication Policy is
inadequate in view of the value of the subdivision.
Motion by Steve Wolff, seconded by David Junker to accept the cash -in -
lieu of parkland for the subdivision request. Motion failed 3-5.
Motion by Del Peterson, seconded by Steve Joyce to request the
Community Development Director negotiate with the developer for
adequate park land for the subdivision. Motion carried 6-2.
3) The third request is the Blichfeldt subdivision on Green Twig Way
previously denied by the Parks Board. The request was approved by the
Planning Commission, then denied by City Council. The Planning
Commission will ask the Council to hear the case aoaiii.

Ann Terwedo reviewed the questionnaire sent to Board members. Short-
term goals, long-term goals, and priorities were listed. Ann will
compile the information gathered from the questionnaires and report
back at the next meeting.
New Business
Tim Thomsen reported that two parks employees were recently promoted.
Tim discussed the new ADA safety requirements for playground equipment.
He stated that so far the City is in compliance, but must have plans to
upgrade the equipment. The upgrading does not have to be done at once.

at 9:25 p.m. Carried.

_Discussion
The request is to improve, expand and reconfigure an existing gravel parking lot for Lily Lake
School. The parking lot will accommodate additional parking created by the school expansion.
The plan does not show a landscaping plan. The slope on the east property line has a natural
slope with mature vegetation. This slope should be maintained to the extent possible. There are
homes located to the south of the school property. A six-foot wooden fence should be placed
along the north property and east property lines in order to buffer the homes from the school.
There is an emergency driveway access along the north edge of the lot. This access needs to be
closed off by either a gate or appropriate signage. The driveway is not an improved public street
and should not provide school employees and parents a second access to the site.

Dear Commission Members and Concerned Citizens:
We would like to apply for a special use permit of our property. We are
starting a small, children's publishing business. The name of the company is
Kodomo Press and it is dedicated to bringing awareness of our country's and
the world's cultures to children of elementary school age through picture
books. The business would publish between one and three picture books a
year and employ only ourselves —the owners of the property.
This is not a retail company, nor does it involve contact with clients. The
only activity that would be generated at our place of business would be the
delivery of books. The delivery would come from the printer once for each
book published. As we are publishing one book in 1994, there would be one
delivery this year. In 1995, we intend to publish one or two books, so there
would be only one or two deliveries next year. The delivery truck would be
parked in our driveway or on the street for a period of no more than an hour.
The books will be stored in existing space in our basement. Outgoing books
would be delivered by us in our personal vehicles or sent through the U.S.
Postal Service or UPS. These activities would create no more than usual daily
activities of going to work and to the post office. Any meetings done with
vendors, such as printers, would be held at their place of business.
The first book being published is written and illustrated by people out of
Green Bay, WI and any meetings we have with them will be done in Green
Bay. The books we intend to publish next year are being written by ourselves,
and therefore, need no contact with anyone, other than the printer, outside
our place of business.
It is our belief that this business will not change, in any way, the lives of the
people on our street. It is our hope that we can benefit the community of
Stillwater through this business by not only publishing quality children's
books locally, but by using our knowledge in education and literature to
volunteer with schools and other community programs that work with
children.

Subdivision of a 5.02 acre parcel into 9 lots ranging in size from 12,506 to 33,915 square feet.
Discussion
The request is to subdivide a 5-acre site with an existing residence into 9 lots. The existing residence will be
located on the largest lot, 33,915 square feet. The site is located in the RA, single family residential district. A
pond separates the site from the JC Ballfield (owned by the School District). Single family residents boarder the site
to the east and north and Myrtle Street fronts the site to the south. An existing driveway provides access to the site.
This driveway will be abandoned and new street constructed providing access to the nine lots.
A portion of County Road 12 right of way is being vacated by the county and is shown as a part of the subdivision.
The subdivision plan has been referred to the city utility departments and Washington County Public Works for
review and comment. No comments have been reviewed as of this writing.
The grading plan shows the removal of a high area on the site and filing a low area (not a wetland). Many of the
circle trees on the front east portion of the site are kept. The access road end is located approximately 40 feet from
the pond. Fifty feet separation is required. No drainage management plans were submitted, but will be required
before final plat approval. The proposed plans show the stormwater is directed directly to the pond without
presettlement.
The proposed subdivision is consistent with the zoning requirements regarding lot areas and size.
Tree replanting at the rate of 10 trees per net developable acre is required as part of the final construction plans.
The proposal shows the dedication of the pond as the park dedication requirement. The pond does not qualify for
dedication. The park and recreation commission reviewed the subdivision and feel a 7 percent in lieu park fee is
appropriate for the subdivision.
Findings
As conditioned, the project is consistent with the zoning and subdivision ordinances.

The subdivision plan shall show all wetlands and the required setback for the type of wetland in
accordance with the Wetlands Conservation Ordinance.
2. A detailed grading/drainage plan shall be prepared for city approval. The grading plan shall show existing
and proposed contours and the grading effect on existing trees.
A site landscape plan shall be presented before final plat approval showing reforestation at a rate of 10
trees per net developable acre for all disturbed areas.
4. A soils survey shall be prepared by a qualified professional before final plat approval identifying any
restrictive soils per city Restrictive Soils Ordinance and proposing mitigations required to correct soil
conditions as approved by the city building official through a restrictive soils permit.
5. A final erosion control plan shall be prepared and approved by the Community Development Director
before final plat approval.
6. The subdivision shall construct storm water management facilities necessary to manage increased runoff
resulting from the development so that the two year, ten year and 100 year storm peak: discharge rates
existing before the proposed development are not exceeded.
7. Runoff shall not be discharged directly into the wetlands without presettlement of the runoff.
8. An undisturbed protective strip of natural vegetation 20 feet wide shall surround the pond.
9. No land disturbing or development activity shall be allowed on slopes of 18 percent or greater.
10. A storm water management plan shall be prepared and submitted to the Community Development Director
for approval before final plat approval.
11. Any structures including new roads shall be setback at least 50 feet from the pond, an unclassified wetland.
12. No more than 25 percent of subdivided lots shall be in impervious surface.
13. In lieu park fee shall be paid consisting of 7 % of the net improved land value before final plat approval.
14. Comments from the city utility departments and Washington County Public Works shall be addressed in
the final plat.
15. The County Road 12 right of way shown on the plat shall be vacated before final plat approval.

From our meetings we fee€ confidant that the final designs submitted at your
office today meet the parameters approved by the city for the exterior signage
at Lakeview Hospital in atillwator,
Thomas Signs has been contracted by the hospital as fabricator/installer of
the signs. We have sent revised drawings to them and they will be contacting
the city in the next few days to procure the appropriate permits.
