Dev. Director Ann Pung-Terwedo, Planner Absent: Rob Hamlin and Duane Elliott Chairman Fontaine called the meeting to order. APPROVAL OF MINL.TES Chairman Fontaine made the following correction to the minutes of March 9: Page 3, first paragrah, last sentence should read: "Gary Funke stated that he would like to see the issue tabled and the two Planning Commissions talk it out." Motion by Darwin Wald to approve the minutes of March 9, 1992, as corrected. Seconded by Gary Funke. All in favor. PUBLIC HEARINGS 1. Case No. SUP/92--10 - A Special Use Permit to conduct a sign production and sales outlet in the east half of a steel building (old Windsurfing Shop) at 501 North Main Street. Daniel Nelson presented the application. He stated that most of the production of the signs will be done in Ham Lake, and this location would be used for the most part as a sales outlet. Chairman Fontaine asked if flammable materials would be used or stored there. Mr. Nelson stated that very few flammable materials are used. Not more than four gallons of paint would be stored there. He compared that to what a person might store in his garage. He stated that the location is not built for production. Mr. Nelson is aware of the two conditions of approval and is in agreement. He stated that the sign plan has been mailed. Gary Funke made a motion to approve the Special Use Permit with the two conditions as recommended and a third condition: The Fire Department shall inspect and approve the storage of toxic or flammable materials. Seconded by Darwin Wald. All in favor. 2. Case No. SUP/92-11 - A Special Use Permit to conduct a professional theatre along with the service of food and beverages at 324 South Main Street (Grand Garage). The applicant was not present and the Commission continued with the next case. i Planninq Commission Minutes April 13, 1992 3. Case No. 9.UB/92 12 - A minor subdivision of a 14.96 acre lot into two lots of 4.28 acres and 10.68 acres of Outlot B on the northwest corner of Curve Crest Boulevard and Northwestern Avenue in the Business Park Industrial District. Ned Windmiller, owner of the property, presented the request. He stated that the 15 acre lot is owned by a partnership, and they now have a buyer (Stillwater Clinic) for one parcel of 4.2 acres. The Commission could find no problem with the request. Motion by Gene Bealka to approve the Subdivision request. Seconded by Gary Funke. All in favor. 2. QaaQ Ng, SUPZ92-11 (Continued) - Two audience members asked if the Commission would be discussing this case this evening, as that was the reason for their attendance at the meeting. They asked if the theatre would be requesting a liquor license. Ann Pung-Terwedo stated that the applicants are requesting only to serve dessert and coffee. They also questioned if Esteban's liquor license could be transferred to another establishment. Gary Funke stated that Esteban's license is to remain with the Grand Garage building. 4. Case No. S[JB/92-13 - A Special Use Permit to sell popcorn and pop from a 1926 Model T Ford Truck at 401 South Main Street in the Central Business District. Mark A. Petterson presented the application. He stated that the truck will be parked in the same spot as the previous popcorn wagon. He has verbal permission from the property owner, but will also get written permission. His hours will be approximately noon to sundown seven days a week. The truck will be left at the location overnight. He is aware of the six conditions. Motion by Gary Funky to approve the Special Use Permit with six conditions. Darwin Wald seconded. All in favor. 5. Qaa.f No, SUP/899-2t- - Annual review of Special Use Permit and report on 1992 Rivertown Trolley activities. Robert Raleigh, owner, was present. He stated that he will be in the same location as last year, but will add a new route to his tour. His first tour is a 45 minute history of Stillwater; the second tour will highlight other homes. Gene Bealka stated that Mr. Raleigh is a great ambassador for Stillwater. The trolley goes to the State Fair every year and is good advertisement for Stillwater. The Commission members agreed that the trolley has been beneficial to Stillwater. Motion by Don Valsvik to approve the Special Use Permit annual review. Seconded by Darwin Wald. All in favor. E Planning Commission Minutes April 13, 1992 Several of the Commission members asked if the annual review has to be continued. Steve Russell stated that it is necessary because the ticket booth is a temporary structure. Mr. Raleigh asked if the condition requiring the booth to be removed by December 1, 1992, could be changed. Mr. Russell stated that requirement is necessary because of the flood plain regulations. 2. Ca e Na. SUP 92-11 Continued - The applicant did not arrive and the Commission discussed the case because it is on the agenda for the April 21 City Council meeting. The Planning Commission's past procedure has been to tabl"e'an item if the applicant is not present for the discussion. Ann Pung-Terwedo stated that the theatre is scheduled to open on April 23. The Fire Department and Building Inspector have made their inspections and limited the capacity to 49 people. The guests will be given maps with designated parking areas. Glenna Bealka made a motion to approve the Special Use Permit. There was no second. It was noted that the City made an extra effort to get an early City Council date in order to accommodate this applicant. It was also suggested that if the Planning Commission does not stand by its policy of expecting applicants to attend the meeting, then in the future possibly none of the applicants will show up. Chairman Fontaine stated that he will be unable to attend the Council meeting on April 21. Don Valsvik stated that it would be appropriate for a Planning Commission member to attend and tell the City Council that the applicant did not come to the meeting and the Planning Commission therefore took no action. Motion by Gary Funke to continue Commission meeting in May. Gene 6-0-1 (Glenna Bealka abstained). OTHER this case to the next Planning Bealka seconded. Motion carried 6. Steve Russell stated that the Planning Commission could recommend that the City Council direct further study of the zoning amendments. BACKGROUND: On April 21, 1992 the City Council gave Mr. Halverson, owner of the Grand Garage Theatre, a thirty day temporary permit to conduct his business. The Planning Commission is receiving this case as a continuation from their last meeting. PLANNING APPLICATION REVIEW CASE NO. SUP/92-11 Planning Commission Meeting: April 13, 1992 Project Location: 324 South Main Street (Grand Garage) Comprehensive District: Central Business District Zoning District: CBD Applicant's Name: Robert M. Halverson Type of Application: Special Use Permit. PROJECT DESCRIPTION A Special Use Permit to conduct a professional theatre with the service of coffee and dessert. DISCUSSION The request is to conduct a professional theatre in the Grand Garage. The space is located in the rear of the structure (formerly the Bath Store). The Fire Chief and Building Official have reviewed the space. They have concluded the maximum occupancy load for the space is 49 occupants based on the existing conditions. Additional persons in this sapce would require alterations to the exits. The applicant has agreed to keep the space at 49 persons. The parking demand based on occupants is 13 parking spaces. Parking is very limited in the area. The closest parking lot is the Brick Alley lot and the Second Street lot. CONDITIONS OF APPROVAL: The applicant shall submit all health and building inspection reports for the service of food. 2. The maximum occupancy load according to the Fire Chief and Building Official is 49 occupants. This shall be maintained at all times. 3. Exterior signage for the use shall be incorporated into the overall signage plan for the building and shall be reviewed by the Design Review Committee. RECOMMENDATION: Approval. FINDINGS: The theatre use will not be injurious to the neighborhood or otherwise detrimental to the public welfare and will be in harmony with the general purpose of the Zoning Ordinance. DISCUSSION: The request is to move a 2,000 square foot residence to a 22,400 square foot vacant lot (lots 6, 7, 8 and 9, Block 9, Sabin's Addition). As a part of the project, a 2,000 square foot addition would be constructed on the east side of the moved residence. In making a building permit recommendation to the City Council, the Planning Commission should consider the following items: - Compliance of the building and use with zoning and land use regulations. - Conformance of the moved building with the existing or future pattern of development in the neighborhood to which the building is being moved. - Consistency of the moved building's age, bulk, architectural style and quality of construction with the buildings in the neighborhood. The use proposed is single family residential consistent with zoning use requirements. A variance is being requested for the corner sideyard setback to save a tree and to fit in with the topography of the site. (See Case V/92-22.) The site where the building is being moved to is large, 22,400 square feet. The moved residence, with addition, is also large, about 4,000 square feet. The addition to the building will be to the rear of the site (east). At meeting time, a representation of the design of the addition will be presented. Included in the Moving Permit application are pictures of the residence being moved and adjacent structures. The neighborhood structures and moved building look in good condition. All were built pre-1900. The addition to the moved residence should be compatible with the existing residence design and the entire residence painted to improve the appearance of the appearance of the structure. Page 2, Hope House of St. Croix Valley Site Plan considerations: The lots across Cherry Street to the north are unbuildable lots due to a ravine. East of the applicant's lots on Cherry Street is one home. Cherry Street deadends beyond the lot in the ravine. Only this one single-family home uses Cherry Street as a driveway. On the south side of the lots the land slopes upward to a ridge. At the top of the ridge is a fence line and the back yards of two homes on Linden Street. There are several mature trees on the lot which the applicant would like to save, in particular a 48" red oak along Everett and several 20" to 30" boxelders on the north, west, and south ends of the lots. The site plan calls for a 40' setback from Everett to save the red oak and a 20' setback on the south side yard to save the ridge of trees. As a result, the face of the house is setback 30' from Cherry Street but the porches along the south side of the house will be setback only 24' from Cherry. The site plan also calls for bringing the driveway to the house along Cherry Street in order to save the red oak. It will lead to a tuck under garage for two or three cars. Above the garage an addition will be built for four additional bedrooms to the rear of the house. The original house will face Everett Street with a front walkway. Reasons for variance requests: 1) Applicant requests a variance from the 30' side yard setback requirement along Cherry Street to a 24' foot setback. This lot is a corner lot for which 30' setbacks are required from both Everett Street and Cherry Street. Only a 10 foot setback is required from the south lot line. A variance of six feet would allow applicant to retain much of the southern hillside and the trees on top. The resulting 24' setback from Cherry Street would be adequate for public safety, because the traffic on Cherry will be so light since it will serve only two homes. 2) Applicant requests a variance to pave Cherry Street twelve feet (121) wide without gutters and curbs in order to use Cherry Street to acess applicant's driveway off of Cherry Street. Applicant could be required to pave Cherry Street 24' wide with curbs and gutters to accomodate the use of Cherry Street by itself and the existing home. The Applicant could put in its driveway from Everett Street to avoid the expense of paving Cherry Street, but realizes it is in the public interest to use Cherry in order to save the red oak. The other homeowner on Cherry has requested that Cherry Street be paved 12' wide with no curbs or gutters to preserve the rural aesthetics of the area. This approach is consistent with neighborhood attitudes toward protecting the natural beauty of the ravine north of Cherry. Applicant will instruct its visitors to park on Everett by the front walkway to avoid unduly stressing Cherry Street. Page 3, Hope House of St. Croix Valley Building suitability to neighborhood: The home abutting the western boundary of the site is 417 W Cherry Street. It was built in 1873, has 818 square foot foundation size (SF/FS), is 11-2 stories, and is of old farmhouse/victorian architectural style of average quality. The home abutting the southern boundary of the site is 616 W. Linden Street. It was built in 1898, has 816 SF/FS, is 12 stories, and is also of old farmhouse/victorian architectural style of average quality. The home to be moved to the site is currently located at 218 W. Pine Street. It was built in 1880, has 1280 SF/FS, and is also of victorian style but of a slightly better than average quality. This home is well -suited to the neighborhood, becau3e it is of similar age and victorian style. The quality is better than the existing homes, because of its larger size and porch. The home will not seem inappropriate to the area due to its larger size, because it will be on a lot twice the size of the other homes. DISCUSSION: T}ie request is to locate the moved residence to the 22,400 square foot lot. As shown on the site plan, the residential structure will be set back 40 feet from Everett Street, 25 feet from the south property boundary and over 50 feet from the rear property boundary. The reason for locating the structure 24 feet r from Cherry Street is because of site topography and tree locations. The proposed site plan will preserve all large trees on the site. Cherry Street is an unimproved City right-of-way. Currently, it is used for access to a residence east of the site. The proposal is to pave a 12 foot driveway on the right-of-way to provide access to a new tuck -under garage for the moved residence. Water and sewer service will be provided off Everett Street. It is unlikely Cherry Street will be improved in the future because land in the area is already developed or constrained by steep slopes and unlikely to develop. Because there are no other structures along Cherry Street that will be affected by the 24 foot setback and sidewalk, traffic will not be a problem with the driveway and parking design. There are no functional reasons for requiring having a 30 foot setback. The siting of the structure will protect trees and minimize the grading disruption of the site. CONDITIONS OF APPROVAL: 1. A 12 foot driveway off Everett Street shall be paved to the garage. 2. The entire house shall be newly painted. 3. The sideyard setback to Cherry Street shall be a minimum of 20 feet and to the south property line 25 feet. 4. There are several street trees located on the site and a clinic sign located on the corner of Panama and Orleans Streets. It is recommended that a compact hedge be planted between the east parking lot and Panama Avenue and along the west parking lot to screen view of the cars from the surrounding area. Current design review requirements call for the trash containers to be concealed by a structure compatible with the color and appearance of the building. FINDING: The proposed use is less intense than the existing medical office use and based on the Conditions of Approval will improve the appearance of the site. CASE NO. V/92-18 Planning Commission Meeting: May 11, 1992 Project Location: 14490 Dellwood Road Comprehensive Plan District: Residential Zoning District: Single Family Residential/Bluffland/Shoreland Applicant's Name: Dennis Evavold and Gail Englund Type of Application: Variance PROJECT DESCRIPTION: The request is to construct a single family residence on slopes of greater than 12%. DISCUSSION: In-1991 this 6.33 acre lot was created (Case No. SUB/91-17). At that time development on slopes greater than 12% was a potential concern. This request is to construct a single family residence that is located partially on slopes greater than 12%. The City Bluffland/Shoreland Ordinance does not permit development on sloped area greater than 12%. One reason for the regulation is to protect views from the river. Because of topograhy, the building site cannot be seen from the river. Another reason for regulating development on sloped land is to reduce erosion during construction and after development. A condition of approval requires the applicant to prepare an erosion control plan/drainage plan and for it to be approved by the Community Development Director before building permits are issued. The applicant would also like to fill two man-made holes next to the building site and raw repair the driveway cut. These improvements would protect the site from further erosion and return it to a more natural condition. Only trees in the building envelope will be removed so the site will be minimally disturbed. A soils report regarding an on -site septic system was provided with the subdivision and a site for the on -site sewer system located. Any on -site sewer system will have to meet the PCA requirements and not be located on slopes of greater than 12%. According to the Bluffland/Shoreland Ordinance in considering a variance, the following factors shall be considered. 1. Preserving the scenic and recreational resources of the St. Croix Riverway, especially in regard to the view from and use of the river, 2. The maintenance of safe and healthful conditions, 3. The prevention and control of water pollution, including sedimentation, 4. The location of the site with respect to floodways, slopes and blufflines. 5_ The erosion potential of the site based on degree and direction of slope, soil type and vegetative cover, 6. The scenic and recreational resources of St. Croix would be preserved because the site is not visible from the river and no recreation resources are located in the area. 2. As conditioned, based on project approval, water quality will be preserved and erosion minimized. 4. The site is not in a floodway or a bluffline - a portion of the site is in slopes of greater than 12%. 5. As conditioned, site erosion will be minimized. 6. The site is within an urban area, City of Stillwater, one house on 6.3 acres will be minimally impact the habitat. 7. Currently access is adequately provided to the site. 8. CROIX AND BROWN'S CREEK WATERSHED MANAGEMENT PLANS Whereas, by resolutions in 1984, the City of Stillwater entered into Joint Powers Agreements to create and participate in the Middle St. Croix and Brown's Creek Water Management Organizations; and Whereas, a portion of the City is located within the Middle St. Croix Watershed and Brown's Creek Watershed Management areas, and the City Council of the City of Stillwater has made appointments for representation on these Watershed Management Organization Boards; and Whereas, the City Council of the City of Stillwater finds that each Watershed Management Organization services that portion of the City lying within the respective watershed boundaries and that each organization has prepared a Watershed Management Plan to administer its duties within its jurisdiction. Attest: city clerk Mayor GOALS OBJECTIVES AND POLICIES AND MANAGEMENT PLAN FOR THE CITY OF STILLWATER WATER MANAGEMENT 1.GOALS, OBJECTIVES AND POLICIES This outline contains the goals, objectives and policies for the management of the water resources within the City of Stillwater. They provide the basis for our management and implementation strategies which have been prepared to be consistent with the goals, objectives, and policies contained in the surface water management plans of the Browns Creek Water Management Organization (MSCRWMO) and the Middle St. Croix River Water Management Organization (BCWMO). GOAL STATEMENT OBJECTIVE NO. 1: WATER QUANTITY MANAGEMENT The City of Stillwater shall, to i:he greatest extent possible, minimize public expenditures used to control excessive runoff rates and volumes. Pollution problems will be minimized by reducing excessive rates of flow as well as to protect downtstream areas from hazards related to excessive volumes of runoff. Our predominant concern is to eliminate the transport of sediment and nutrients caused by increased rates and volumes as a result of changes in land use. This objective can be broken down into the following policy areas: POLICY 1A: The City shall be responsible for the correction of flooding and excessive flows and volumes for waters of local importance. POLICY 1B: All new platted developments shall require no increase in the rate of runoff by providing additional storage on -site or through construction of a retention area to serve this and other areas to accomplish the "no increase" policy. POLICY 1C: For those areas of the watershed not having natural or storm sewer outlets, all new platted developments shall not result in an increase in the annual volume of surface water discharge from the areas of the development. This "no volume" increase shall be accomplished by minimizing impervious surfaces, water retention systems, and other means of reducing the volume of runoff. POLICY 1D: No fill, drainage, construction or discharge shall be allowed which would reduce or eliminate the retention, storage, or treatment capability of a wetland contained in the Water Resource Inventory of the DNR Protected Waters map, or the USFWS Wetland Inventory without at least 100% compensation through construction of retention storage or treatment systems. This must also be consistent with the interim program of the Wetland Conservation Act of 1991. 1 POLICY 1E: Stormwater management improvements on stormsewers and culverts shall be designed for the ten year frequency storm event with overflow paths and ponds being designed for the critical duration one hundred year frequency. OBJECTIVE NO. 2: WATER QUALITY The City plans to improve and protect water quality within its boundaries to the maximum extent practicable. Point and non -point sources of pollution to all lakes and streams, when identified, shall be reduced or eliminated through the application of Best Management Practices (BMP's). Both sewered and unsewered areas shall be maintained so that sanitary sewer systems and on -site septic systems are in good working order and do not contribute to surface or groundwater pollution in accordance with the standards of the MPCA and Washington County. Wetlands will be protected and utilized for the treatment of Stormwater runoff. POLICY 2A: The City of Stillwater will seek to correct all sources of water pollution within its jurisdiction through the application of best management practices (BMP's) as contained in Agriculture and Water Quality, Best Management Practices for MInnesota; Forestry and Water Quality, Best Management Practices for Minnesota: and Protecting Water Quality in Urban Areas, Best Management Practices for Minnesota. These are MPCA publications. The Washington County Soil and Water Conservation District will provide technical assistance and recommendations. POLICY 2B: The City shall continue to enforce the PCA regulations for septic systems. POLICY 2C: The City of Stillwater shall protect all wetlands within its jurisdiction and shall require compensation consistent with Policy 1D for wetlands filled, drained or otherwise destroyed. POLICY 2D: The City shall encourage the use of wetlands for beneficial purposes including the treatment of runoff to reduce water quality impacts to the areas lakes, streams and ponds. POLICY 2E: Whenever practical, new and existing stormsewers shall be routed to detention, storage, treatment systems or wetlands before discharging to lakes and streams. POLICY 2F: The City shall install, maintain, and inspect sanitary sewer facilities within its jurisdiction, where feasible, to reduce to the maximum extent any discharge to surface or groundwater of any untreated sewage. POLICY 2G: The City shall test lakes with water quality problems. If treatment is needed, the City shall take steps to improve the water quality. 2 OBJECTIVE NO. 3: FLOODING, EROSION AND SEDIMENTATION The City of Stillwater shall prevent flooding and erosion from surface runoff within its jurisdiction by requiring the establishment of 100 year flood elevations on the areas ponds, lakes and streams, and controlling erosion and sedimentation. POLICY 3A: The City will continue to enforce the City Floodplain regulations. POLICY 3B: For any development located adjacent to lakes, ponds or wetlands with no natural outlet or adjacent to a watercourse, the developer shall determine the 100-year flood elevation for those lakes, ponds, wetlands or watercourses. The City strongly encourages the use of Soil Conservation Service Hydrologic methods for making these determinations. POLICY 3C: Erosion control plans that prevent excessive erosion shall be required for development activities disturbing greater than 10,000 square feet of land. POLICY 3D: Excessive soil loss on any lands within the City shall not be allowed beyond the maximum soil loss tolerances specified in the Field Office Technical Guide of the USDA Soil Conservation Service. POLICY 3E: The CityofStillwater shall adopt a soil erosion regulation for construction sites consistent with Minnesota Statutes, 1986, Chapter 40.19-40.28, Excessive Soil Loss. POLICY 3F: The City of Stillwater shall adopt the uniform soil, erosion and sediment control planning and practice standards of the Soil Conservation Service and the Minnesota Board of Water and Soil Resources. OBJECTIVE NO. 4: GROUNDWATER The purpose of this objective is to ensure high quality drinking water sources for the citizens of the area now and for the future. POLICY4A: Well_ placement, abandonment, and water supplies shall be done in accordance with Minnesota Department of Health regulations by licensed contractors or licenses municipal employees. POLICY 4B: No actions shall be authorized which will adversely affect the quality of groundwater serving as a supply to domestic sources within the City limits. POLICY 4C: Placement of on -site septic systems shall conform to the Minnesota Pollution Control Agency regulations. Permits for all new septic system installations shall be issued and inspected by the City building inspector. 3 POLICY 4D: Fliere shall be no discharge of pollutants to the groundwater through injection, seepage or infiltration which would materially degrade groundwater resources. Sources of pollutants shall be handled in a manner that prohibits their introduction into groundwater. These pollutants shall include, but are not limited to: 1. Liquids capable of polluting groundwater such as oil, gasoline, acids, bases, solvents, and other chemicals. 2. Manure, fertilizer, pesticides or herbicides. 3. Sewage.* 4. Solid or hazardous waste. 5. Salt and salt -sand mixtures storage. * This provision shall not be construed as a prohibition on the use of properly designed and operated septic systems. POLICY 4E: A11 storage of materials capable of polluting groundwater shall be done in accordance with applicable State rules. OBJECTIVE NO. 5: RECREATION AND FISH AND WILDLIFE MANAGEMENT The City of Stillwater shall preserve and protect to the extent possible fish and wildlife habitat, and recreation and open space areas. The wetlands within the City serve as natural habitat for a wide variety of species important to the ecological balance of the area. Protection will be afforded to all these areas consistent with the policies of this plan, and policies of the Browns Creek and Middle River Water Management Organizations and Watershed Districts that have jurisdiction in our City, to protect water -related resources. This objective is broken down into the following policy areas. POLICY 5A: All wetlands shall be protected consistent with Policy 1D. POLICY 5B: The City shall seek to apply a multi -use management approach to water resources considering the benefits of all activities including fish and wildlife, recreation and open space. POLICY 5C: The City shall seek to improve fish and wildlife areas, recreation, and open space facilities in conjunction with the Minnesota Department of Natural Resources, Washington County, and Water Management Organizations. OBJECTIVE NO. 6: REGULATION The goal of the City of Stillwater to develop and adopt specific land -use regulations which will ensure the protection of waters as described in the Browns Creek WMO, and Middle St. Croix River WMO. The administration of these regulations will be carried out by the City of Stillwater. POLICY 6A: The City shall be responsible for administering and enforcing the required land -use regulations. 4 POLICY 6B: The City Community Development Department shall maintain a copy of the BCWMO, MSCRWMO surface water management plans. POLICY 6C: The City shall maintain a copy of the DNR Protected Waters Map and will amend its zoning ordinance to state that any land disturbing activities including drainage, affecting a DNR protected water or wetland, require the proposer to secure a permit from the DNR before work can commence. POLICY 6D: The City shall maintain a copy of the USFWS National Wetlands Inventory Map and will amend its zoning ordinance to state that any proposed filling or development in areas identified as wetland on this map may require a permit from the US Army Corp of Engineers, and will notify the regulation branch of the Corps of Engineers St. Paul District of any development proposals affecting these wetland areas. 5 2. MANAGEMENT PLAN This section is designed to establish the role of the City in the control and management of surface waters within its jurisdiction. The following sections - Water Management Classification System, Land -Use regulations, Compliance, Monitoring and Data Collection, Improvement Projects and Maintenance Programs - comprise the basic management program the City of Stillwater will follow. A. WATER MANAGEMENT CLASSIFICATION SYSTEM The water management classification system separates waters of the City into three classifications: waters of regional, district and local importance. The reason for a division of waters within the City is to provide for a logical method of planning and management responsibilities, and for the assignment of cost for improvement projects. Waters of regional importance within the City are waters considered highly valuable from a recreational and public use standpoint. Funding for projects within these waters should be assessed watershed -wide or from other funding sources such as federal, state, region, or county. Waters of district importance are waters which will be controlled and managed by the BCWMO and MRWMO. Funds for project waters within this classification should be considered on a tributary basis. Waters of local importance are waters not tributary to waters of regional or district importance or relatively small ponds and wetlands. Funding for projects on these waters should be primarily from local funding sources. 1. Regional Waters - Waters which have importance not only to the City but to�areas outside of the City as well; for a variety of uses, with the main emphasis being recreation. These watersheds are to be broken down separately for capital improvement projects and assessed separately. a. St. Croix River b. Brown's Creek 2. District Waters Waters that drain directly to a lake or river of regional importance or drain directly to one of the water bodies listed below and any wetlands covered under Minnesota Department of Natural Resources Protected Waters and Wetlands; and land -locked wetlands greater than ten acres in size. a. Perennial and intermittent streams that cross civic boundaries within MSCWMO. b. All perennial and intermittent streams which are tributary to Brown's Creek. 3. LAND USE REGULATIONS The transition from goals, objectives and policies to one regulations is necessary because it is through land -use regulations that the City of Stillwater can control and manage activities that affect surface waters. Listed below are those land -use regulations that the City will adopt and enforce to achieve its goals, objectives and policies. This referral system is to insure that projects are referred to either the Brown's Creek Water Management Organization or the Middle River Water Management Organization for their review and comment as required by the water management classification system and the proposed land use regulation. This referral system should make the following determinations: 1. Does the proposed project or land use activity affect any inventoried properties of the MSCWMO or BCWMO? 2. The appropriate water management classification. 3. The need for review and comment by the MSCWMO or BCWMO. 4. The next meeting of the MSCWMO or BCWMO. Upon receipt of a project referral, the MSCWMO or BCWMO will make all necessary investigations and/or consult with the Washington County Soil and Water Conservation District for comments and recommendations regarding the proposed activity. Either the MSCWMO and BCWMO will then respond back to the City of Stillwater with its comments and which land use regulations apply and will need to be enforced. * Attached are the referral forms for the Brown's Creek and Middle St. Croix Water Management Organizations. 7 D. MONITORING AND DATA COLLECTION On an annual basis, the City of Stillwater will submit an informal progress report to each WMO and WD within its boundaries to inform them of the status of plan implementation, current water problems, potential future problems, plan amendments and the overall performance of our efforts. At this time, the City does not plan on implementing any long term water quality monitoring programs of its own; however, local residents have shown concern about the water quality of Lily Lake and McKusick Lake. These lakes shall be tested for water quality. If treatment is needed, the City shall take steps to improve the quality through water treatment and regulation.
