PROJECT DESCRIPTION
Request to construct 40 ft. by 60 ft. wood structure with 1 ft. setback in a
single family residential district.
DISCUSSION:
ne roposal is to construct a heated storage garage, 2,400 square feet, on a
13,000 square foot lot in a single family residential district. The site plan
shows the approximately 20 ft. tall structure set back 1 foot from the rear
and side property lines. The Zoning Ordinance requires a 5 ft. building set
back and limits the size of the garage to 1,000 square feet. The proposal is
for a garage more than twice as large as allowed in the residential
development regulations. The garage would be used for commercial purposes,
storage space for Stillwater Towing. Currently. Stillwater Towing is a legal
non -conforming use in the RA, Single Family Residential District. The proposed
garage would expand that use. Other uses in the area are attached and detached
single family homes to the west and north and commercial uses to the south.
RECOMMENDATION:
Denial.
FINDINGS:
The pro op sal is not consistent with the single family zoning of the site.

PROJECT DESCRIPTION:
The request is for a variance to the sideyard setback requirements.
DISCUSSION:
The request 1s to construct two additions off the front and back of an
existing residence. The residence has a Special Use Permit for an in -home
electronics repair business.
The proposal requires a variance to the sideyard setback requirement. The
additions would conform to the existing house setback, being six feet off
Alder Street on the rear (east) and three feet from the side on the west
(front). The proposal meets the rear and frontyard setback requirement. The
proposed is in the Bluffland/Shoreland District. The application meets the
Bluffland/Shoreland regulations.
RECOMMENDATION:
Approval.
FINDINGS:
1. Because of the location of the existing residence, it would not be
practical to construct the addition in another location without undue
hardship.
2. The proposal would not negatively impact the neighborhood or adjacent
uses.

The sign has a dark background with light letters. This will minimize the
spill -over lighting of the area. The proposed sign design is an
improvement to the existing sign. An extensive application package was
submitted by the applicant and is attached.
RECOMMENDATION:
Approval with condition.
FINDINGS:
The proposed sign will be more attractive and not adversely impact the
residential area to the west and north.
CONDITION OF APPROVAL:

PROPOSED SIGN FOR
1675 S. GREELEY STREET OFFICE BUILDING
Purpose: To install a new internally illuminated free-
standing directory sign, the two sides facing
north and south on Greeley Street, approximately
0.6' from the property line, 3' west of the
building, 13' from the northwest corner and 10.17'
away from the curb. The sign will be manufactured
and installed by Attracta Sign, Inc.
Reasons: The existing sign for the building, since its
original installation in 1987, has quite often
directed business traffic mistakenly to the
private road south of the building. A new sign is
needed north of the existing sign to provide
customers of resident businesses with clearer
direction to the parking lot. Correcting the
direction problem would help improve traffic flow
and safety along Greeley Street, where traffic has
increased significantly since 1987.
The proposed new sign will blend in with other
signs along Greeley Street, especially those to
the south which also have internally lighted
signage, and will be an improvement to the Greeley
business area as a whole.
Proposed Sign: Per attached sketch in Appendix A. The new net
signage area, excluding building street address,
will amount to approximately 33.25 square feet (7'
by 3.751), which is only 77% of the original net
signage space (42.75 square feet, 9' by 4.751).
Please note that the actual size may vary slightly
if modification is required to accommodate
underground cable and utility lines.
Material: Cabinet and base of paintgrip galvanized metal.
Sign faces to be 3/16" plexiglas. Graphics per
attached in Appendix A.
Colors: Cabinets to be light gray to match with the color
theme of the building. Faces to be dark emerald
green (c# 3630-126) with white text except as
required for tenants' trade names or logos.
Landscaping: There will be a 10' by 3' landscaped area around
the sign, with no shrubs or flowers over 2' tall.
The finished area should look similar to the
sample in Appendix B.
Appendices: Appendices C, D, and E show the relationship of
the proposed sign to the existing building
structure. Original blueprints (approved by the
City when the building was built) were used to
prepared the Appendices. Appendix F is a copy of
the survey of the lot and the building.

AN ORDINANCE AMENDING CHAPTER 31.01 OF THE CITY CODE BY ADDING
SUBDIVISION 26.5 (f), (g) and (h) REGARDING PARKING IN RESIDENTIAL AREAS.
The City Council of the City of Stillwater does ordain:
Section I. Amending. Section 31.01, Subd. 26.5 (f), (g) and (h) and
shall hereafter read follows:
f. Truck Parking in Residential Areas. No flat-bed truck over
7,000 G.V.W. or other truck over 10,000 G.V.W. shall be
parked on or off street in a residential zoned district
except when loading, unloading or rendering a service
unless proper storage and screening is provided as
hereinafter required.
g. Storage shall mean a condition that exists for more than
thirty (30) days and does not include lesser periods or
time when material is temporarily set aside.
h. Exterior Storage. In residential districts all materials
and equipment shall be stored within a building or fully
screened so as not to be visible from adjoining properties
and public streets, except for the following: laundry
drying and recreational equipment, construction and
landscaping materials and equipment currently being used on
the premises, off-street parking of three passenger
automobiles. Boats, unoccupied trailers and recreational
vehicles, less than 25 feet in length are permitted if
stored in the rear or side yard. Storage of more than one
commercial or industrial vehicle or article of equipment is
prohibited unless a special use permit is issued for use.
i. Screening. The screening required in (f) above shall
consist of a fence or Wall not less than-5 teet high in
order to block direct view of the storage area from the
public street and adjacent property. Landscaping may also
be required with planting of a type approved by the
Community Development Director in addition to fencing.
Section II. Saving. In all other ways the Stillwater City Code shall
remain in ful o e and effect.
Section III. Publication and Effective Date. This ordinance shall be
in full force and effect from and after its passage and publication
according to law.

Background:
The City Council discussed the Shoreland Ordinance when it
was presented for first reading. In particular, the
section of the Ordinance on Vegetation Alterations was
highly questioned as to its affects on individual
property owners and their right to open views to a lake or
water body. The Council has directed the Planning
Commission to review this section.
Discussion:
e attached Vegetation Alteration section of the
Ordinance is presented for discussion. Changes to this
section have been made by the City Attorney and Staff.

5. Height of Structures. All structurlps in residential districts, except
churches and nonresidential agricultural structures, must not exceed 35
feet in height. V
6. Shoreland Alternations. Alternations of vegetation and topography will be
regulated to prevent erosion into public waters, fix nutrients, preserve
shoreland aesthetics, preserve historic values, prevent bank slumping and
protect fish and wildlife habitat.
7. Vegetation Alternations.
a. Vegetation alteration necessary for the construction of structures and
sewage treatment systems and the construction of roads and parking
areas are exempt from the vegetation alternation standards that
follow.
b. Removal of trimming of vegetation is allowed subject to the following
standards:
1. Selective trimming of natural vegetation shall be allowed,
provided that sufficient vegetative cover remains to substantially
screen cars, dwellings and other structures and to comply with the
standard established on adjacent uses and the area is not exposed
to soil erosion.
2. No cutting or removal of trees over six inches in diameter
measured at a point two feet above ground level within the
required building setback shall be permitted unless the trees are
dead or diseased.
3. Natural vegetation shall be restored insofar as feasible after any
construction project is completed in order to retard surface
run-off and soil erosion.
4. The provisions of this section shall not apply to allowed uses
which normally require the removal of natural vegetation or to
the removal of trees, limbs or branches that are dead, diseased or
pose safety hazards.
5. Connections to Public Waters. Excavations where the intended
purpose is connection to a public water, such as boat slips,
canals, lagoons and harbors will only be allowed after the
Department of Natural Resources has approved the proposed
connection to public waters.
