Director Bob Lockyear Absent Suzanne Block and Dave Middleton Mr Gag called the meeting to order at 7 p m Approval of minutes Mr Teske seconded by Mr Carlsen moved approval of the minutes of Jan 9 2006 Mr Junker asked that the minutes pertaining to Case No SUP/06-02 special use permit for a fuel center and drive -through pharmacy for CUB Foods, be clarified to indicate that his motion was to approve the drive -through pharmacy, as conditioned and deny the fuel center Mr Teske seconded the motion on Case No SUP/06-02 and the motion passed 8-0 Motion to approve the minutes of Jan 9 2006 as corrected passed unanimously Case No ZAT/06-03 Zoning Ordinance Text Amendment regulating building heights in the Downtown Central Business District CBD area City of Stillwater applicant Mr Lockyear explained the proposal, which provides for a four -level gradation in allowable height moving from the bluff line down to the River As proposed heights would be restricted to 4 stories 45 west of South Second, 3 stories 35 east of South Second Street to the west side of Water Street, 2 '/z stories 25 between the east side of Water Street and the Burlington Northern tracks, and 1 '/2 stories 20 from the railroad tracks to the River Mr Lockyear said the map was refined and language added clarifying how height is measured since the proposal was first considered at the Commission s January meeting Currently allowable height in the downtown district is 4 stories 50 feet Mr Meinke asked if it would be possible to simply regulate height by restricting a new structure to a height not to exceed the existing building Mr Teske asked if there currently is an exception for towers Mr Lockyear said he was unsure of any exemptions for towers but said he did not think a tower could be higher than the building it is part of Mr Gag opened the public hearing Vern Stefan 717 Sixth Ave S provided the Commission with a letter (enclosed) from Mainstream Development LLC Mr Stefan said he was concerned that the City failed to provide notification of a proposal that would affect property he owns He said he has had several meetings with City staff about a proposal to complete the final phase of the development of his property Maple Island, and was assured in those conversations that the preliminary plans were in compliance with code/ordinances Mr Stefan said the proposed height regulations would have grave' economic implications for his property/project, and said he looked forward to working with staff Mr Lockyear explained that the only legal notification requirement is that the meeting notice be published in the City s legal paper Chuck Dougherty 15330 58th St N , Oak Park Heights and owner of the Water Street Inn echoed Mr Stefan's concerns about notification He said the proposal represents a major change and suggested that the City be forthcoming about noticing downtown business owners Information is not getting out to property owners he said Mr Dougherty said he is against any 1 1lr 1 City of Stillwater Planning Commission February 13, 2006 change and said the proposed changes have an economic impact on what he can do with his property No other comments were received and the discussion was brought back to the table Mr Junker said the proposal brings sensitivity regarding the height issue and said he thought it meats further discussion Mr Junker agreed with the need to get more input such as through Council hearings Mr Menke said he would like to keep heights lower in the whole downtown area but said he thought keeping heights at existing levels could do that Mr Meinke also agreed with the need for more public hearings Mr Peroceschi called the proposal "ridiculous" and said it would restrain trade and the marketplace Mr Carlsen said he wasn t sure this revised proposal was the exact document that should be adopted but said he thought something should be done to regulate heights Mr Teske said he thought the Commission should make it clear to staff what additional information it needs such as how the proposal compares to existing structures in addition to more public input Mr Dahlquist said he would like legal issues addressed and have property owners noticed individually Mr Gag noted the height issue was one of the Commission s initiatives due to struggling with heights in the recent projects on North Main Street Mr Peroceschi questioned making this proposal a priority at a time when the City is short staffed, Mr Junker responded that staff will determine whether they are able to perform the work requested Mr Lockyear said if the Commission feels there is a need for more discussion, the Commission could scheduled a special meeting and invite property owners and Chamber representatives for example He also suggested the possibility of a field trip to other river communities so see how those communities deal with height issues Mr Junker moved to direct staff to provide more input on the concept of height sensitivity input to include public input input regarding any legal issues as well as input related to engineering/utility issues in order to keep the process moving Mr Teske seconded the motion Motion passed 6-1 with Mr Peroceschi voting no Case No V/06-03 A variance to the side yard setback (20 feet required, 4 feet requested) for construction of an addition at 724 W Hickory St in the RB Two Family Residential District Mike Cummings, applicant Mr Cummings and his contractor were present It was noted the houses in on an odd -shaped parcel The intent is for the proposed addition to have as little impact as possible they said The request is to construct a 360' addition a bedroom over an existing addition It was noted that the existing structure is closer to Myrtle Street than the addition will be The addition will extend 10 to the north from the existing structure A set of drawings was provided and reviewed by the Commission Mr Junker asked if the addition and primary structure would match in color and materials The applicant responded that the entire house will be re -sided Mr Carlsen moved approval with the condition that the addition and primary structure match in color and materials and that all storm water drainage remain on site Mr Lockyear suggested incorporating the three findings of fact as part of the motion Mr Carlsen amended his motion to include the findings of fact Mr Teske seconded the motion Motion passed unanimously 2 0 City of Stillwater Planning Commission February 13 2006 Case No SUPN/06-04 A special use permit for a 1 352 square foot expansion (26 seating) of a restaurant and variance to the parking regulations (12 required 0 proposed) at 241 S Main St in the CBD Central Business District Kevin Grube, representing Mark Hanson Marx applicant The applicant was not present Mr Lockyear reviewed the plans The applicant plans to redo the front of the building(s) and provide one door with vestibule Inside, half of the wall between the two buildings would be removed, the expansion would provide 26 additional seating and new restrooms The awning would be extended across the entire front of the building(s) and the sign centered on the building(s) Mr Lockyear said one advantage of the expansion is that the applicant will now be required to sprinkle the buildings, which include apartments above Mr Junker seconded by Mr Peroceschi moved approval as conditioned Motion passed unanimously Case No SUPN/06-05 A special use permit for expansion of restaurant use (Stone's Restaurant) with an additional 200 outdoor seating and variance to the parking regulations at 324 S Main St (Grand Garage) in the CBD Central Business District Michael Stone applicant The applicant was present, along with architect Scott Mauer and Kevin LaCasse Grand Garage Mr Stone explained the new restaurant will be an upscale casual dining place not trendy He said he believed the key to the success of his business is the outdoor dining area as proposed He said decorative pavers would be installed so the area could be used for dining May through September and still be used in the winter months for drop off/pick up purposes He said they plan to do new landscaping and provide low wattage uplighting to illuminate the landscape Mr Stone said one issue is the condition of approval regarding the provision of steps The architect explained he is unsure whether the proposed steps can be constructed without resulting in the loss of canopy trees due to the elevations involved Mr Lockyear said the concern was with providing access to the nearby parking lots but said staff would agree that the steps shouldn t be required if it means the loss of trees Mr Gag opened the public hearing Michele Plocher, who lives on Second Street said she thought the plans would spruce up the site and make the area safer She said she was concerned about lighting as well as the potential for additional noise Mr Mauer provided Ms Plocher with a brochure showing the type of landscape lighting proposed Kevin LaCasse Grand Garage expressed support for Mr Stone s plans and noted this site has been a difficult one for past businesses No other comments were received Mr Dahlquist asked about plans for outdoor music Mr Stone said the proposal is to provide piped low background music for dining and to have special events such as a jazz brunch Mr Stone said music will be of a low beat variety Ms Plocher said there is always noise in the area, including noise from skateboarders and said she would like low -beat music, but noted her neighbors might not be of the same opinion During the Commission discussion it was noted that other requests for outdoor music are conditioned according to ending time and reviewed upon complaint Mr Teske moved approval as conditioned, clarifying condition of approval No 2 to indicate that the applicant work with City staff regarding the provision of steps and that the music be allowed until midnight on Friday and Saturday nights 10 p m on weekdays with the use reviewed upon complaint and allowing the use of soft outdoor landscape lighting Mr Dahlquist seconded the motion, motion passed unanimously Other items Review of Andiamo and Gondola permits — Mr Lockyear said he was not prepared to take up this matter at this time Mr Junker updated the Commission on the Council s action regarding the CUB Foods proposal He said CUB requested to come back before the Planning Commission and HPC with revised plans for the fuel center, the pharmacy drive -through was approved At Mr Teske s request Mr Junker updated the Commission on the Council's action regarding the infill design guidelines Mr Junker said the guidelines were approved with some discussion about the proposed 2-story 27 height restriction on structures built on Tots less than 15 000 square feet Mr Teske seconded by Mr Junker moved to adjourn at 8 35 p m Respectfully submitted, Sharon Baker and ANN/06-01 Zoning Amendments, Planned Unit Development Permit, Subdivision and Annexation of for a 270 lot development on 170 2 acres of land and water located south of TH 96 and west of Neal Ave (aka Millbrook Subdivision) Background This is the review of a proposed residential development on a 170-acre parcel of land with accompanying water features located on the northern edge of Stillwater at the intersection of County State Aid Highway 15 (Manning Avenue) and State Highway 96 (Dellwood Road) The proposal is to create a new neighborhood for the city consisting of 271 residential units with supporting neighborhood features including parks, trails and access to the water The review and recommendation to approve a large subdivision to add to the community can appear to be a bit overwhelming to the Planning Commission However, given the proper perspective, you will provide an excellent check to work that has been performed by the developer and their team to meet the exacting standards of the community as well as to monitor the work completed by your professional staff Staff is providing some guidelines to help you in forming your opinion regarding this major residential addition to the City of Stillwater You should depend on your professional staff to provide the technical aspects of subdivision development They are trained to review the development for such things as lot configuration, street network, adequate provision of utilities including gas, electric, lighting, communication cable, sanitary sewer, street trees, parks and trails and natural resource and storm water protection In addition, they have been concerned regarding the design features and phasing of this project and how the city will be able to deal with this new neighborhood coming on line in Stillwater This comprehensive application includes requests for rezoning this property into three categones, CR - Cottage Residential, TR - Traditional Residential and TH - Town House In addition, the developer seeks to have a Planned Unit Development approved for a mixed use subdivision with supporting amenities A subdivision plat is also required to divide the property into lots and outlots that can be recorded to allow for sale and taxing purposes Since this property is not a part of Stillwater as yet the developer is also requestmg annexation of this property into the city Page 2 Cases No ZAM/06-01,02,& 03, PUD/06-07, SUB/06-06 and ANN/06-01 (aka Millbrook Subdivision) Your role in this complex review is to determine if the developer and staff have provided you with enough information for you to make a positive recommendation to the Mayor and City Council regarding subdivision and zoning of this property and subsequent annexation into the City of Stillwater Major questions to be answered to your satisfaction should include 1 Does the proposal conform to the community's comprehensive plan? 2 Is the timing proper for the proposed subdivision and rezoning? 3 Are all of the utilities available to serve the proposed development? 4 Is the proposed use compatible with adjacent land uses? 5 Have all of the minimum standards for this development been met? 6 Is there an adequate transportation network to serve the development 7 Will the proposed development place an undue financial burden on the city? There may be other specific issues that you wish to pursue and staff would encourage you to bring them forward at the public meeting It should be noted that in reviewing this development the city is to hold the developer to the minimum standards as are laid out in the vanous regulatory ordinances regarding residential subdivision and zoning in the city The developer may offer additional enhancements for marketing purposes but they are not obligated to provide them Recommendation Staff has spent a good deal of time in consultation with the development team and we feel confident that this proposal is npe for review by the commission The developer's final plan, as is included herein, has met all of the standards imposed by your regulations You will find attached the final review comments of staff We have reviewed these comments with the developer in a final meeting and we anticipate that all of the issues will be addressed by them at the public heanng Staff would recommend that upon satisfactory review of the proposal, the Planning Commission endorse the efforts of the developer and their team and recommend approval of the zoning, subdivision and annexation as proposed, conditioned upon meeting all of the comments included by staff in the attached memorandums (These memorandums include three from the Public Works Department, one from the Fire Department and one from To Millbrook file From Bob Lockyear, Interim Community Development Director Date February 27, 2006 Re Review of the submittal for Plan Commission review The Millbrook subdivision has been submitted for review before the Planning Commission on March 13th Overall this appears to be a credible solution for development of this land and the submitted documentation is sufficient to review and make suggestions to improve the implementation of this addition to the housing choices m the Stillwater area However, there are some issues that need to be reviewed and resolved They are as follows 1 Phasing — A plan must be submitted that indicates the phasing program for grading, trail construction, wall construction, utilities installation, road construction, park land preparation and the order in which the lot areas will be marketed It is recommended that the active parks be graded and seeded and trails be installed as phase one of the lot development 2 Park preparation — All work on the active park areas shall be reviewed and approved prior to any grading The active parks shall be graded to no more than a 2% gradient and shall have at least 5 inches of topsoil on the surface pnor to seeding Seed mix and mulch cover will need to be approved by the Public works Department pnor to application This should be resolved pnor to any grading of the site 3 Access to Brown's Creek — Previous discussion with Steve Russell indicates that there have been suggestions to provide a larger access to the Brown's creek area open space area from the main entrance road in the development The current proposed access is narrow and not inviting It would be less intimidating to have a large open area that invites people to walk into the brown's creek open space area If this area is expanded the development would have a better visual and pedestrian access and would facilitate easier use by the homes to the north Lot 149 could be eliminated to accommodate this improvement to the open space use 4 Trail Surfacing — All trails must be surfaced with a bituminous surface that is sufficient to handle maintenance vehicles The one exception will be the trail along the south side of Twin Lake from the bndge to the edge of the development This will need to be a gravel surface that is sufficient to handle maintenance vehicles There should be a subsurface bamer to retain the gravel on the trail 5 Bridges — Construction details on bridges and board walks need to be delineated It is recommended that all bndges be able to handle maintenance traffic or have alternative access points to allow for maintenance vehicles 6 Walls — Wall construction should be done outside of the wetland buffer unless a vanance is granted for said work This will avoid conflict with the watershed MEMORANDUM TO Jay Liberacki FROM Klayton Eckles, Director of Public Works DATE February 21, 2006 SUBJECT Millbrook Comments Page PP1 1 Park Dedication — The city park outlot indicates 8 83 acres of dedicated parks Measurements indicate something closer to 7 8 acres of park space Also at least 75 acres of the dedicated park space is wetland and ponds 2 The exception lot at the NW corner does not show both parcels 3 Additional discussion needs to take place regarding ownership of various outlots including the homeowners association outlots and city outlots Also discussion regarding public trail access corridors between lots, and utility easements Wherever trails and easements are located the City desires to have outlots preferably owned by the homeowners association but encumbered by drainage, utility, open space and trail easements 4 Along lots 1-13, the area that is outside the building envelope on the north side of these properties should include a significant trail easement to accommodate a future trail along Hwy 96 5 City outlot I can be accessed from outlot H An additional outlot needs to be added on the western end of outlot I to provide access to both ends 6 The access between lots 94, 95 and 96 should be improved to provide better public trail access Page PP2 1 Show both exception parcels to the west as well as ownership 2 Along lots 167-172, a significant area must be reserved for a wetland mitigation site The project should modify the grading plan to accommodate the wetland mitigation site as well as provide for rough grading for this mitigation site Page GP4 1 GP4 shows significant buffer impacts along 54, 55 as well as lots 114-116 and 117- 123 Much of this impact can be reduced by modifying the proposed lot grading or house styles or the use of retaining walls 2 There are significant trees located along 114-116 By reevaluating the grading plan in this area a large stand of trees could be saved 3 Grading plans shows major retaining walls constructed along lots 114, 115 and 121- 124 These retaining walls in some instances are within 10 feet of the wetland The proposed retaining walls should be moved off of the public space onto the private parcels to eliminate the need for public maintenance Generally these retaining walls appear to be for the purpose of creating flat areas on Tots 4 Outlot H City Park The grading on the City Park shows grades of up to 10% on the eastern area and a good portion of the western area has steep slopes Modification should be made to the overall grading plan to improve the quality of space provided in this park Page GP5 1 Comment regarding the wetland shown in the City Park along the edge of the buffer area for this wetland a small drainage swale could be added to capture water and treat it prior to discharging it into the wetland 2 In general the trail system shown on the plans along the back areas near the creek and the lake doesn't appear to take into account existing trees or the nature of the slopes in the area Additional work needs to be done on the trail design 3 Road H exiting the north end of the plat will extend onto a property outside of the scope of the project A ghost platting of this parcel should be presented at 60 scale to demonstrate that the road location provides adequate development opportunity MEMORANDUM To Bob Lockyear, Intenm Community Development project of Millbrook on February 21, 2006 1 Roundabout Design a The tuner diameter should be increased to 50 feet and add a 10 foot truck apron around the circumference b The dnving width of the circle should be narrowed to 16 feet c Crosswalk should be added at each entrance to the roundabout d The splitter islands should be increased in length to 2 car lengths from the yield point e Exit widths should be checked to see if they accommodate a WB-50 turmng radius f Speed vehicle paths should be provided for the revised design 2 Traffic Wedge a The alignment of the street and the medians do not appear to provide any traffic calming benefits consider having the street "bubble" more at the median b The location of the median at Sta 5+ 00 may be in conflict with dnveway access on the south side of the street c Taper lengths do not meet MMUTCD standards d Eliminate the crosswalk at Sta 13+00 3 Storm water and Ponds a Provide Emergency overflow information on all ponds and street City of Stillwater from Katharine D Widm, Ph D Forestry Consultant Plant Health Associates, Inc 651-436-8811 kdwidin(aicomcast net 3/6/06 As requested, I have reviewed the plans for the proposed Millbrook Development on Hwy 96 in Stillwater I also walked the site on Wed March 1 and took a look at the trees and woodland areas I have the following observations and recommendations regarding this project Trees On Site Most of the trees on site are at least second growth Many are fast-growing pioneer tree species such as boxelder, cottonwood and elm There are some areas where evergreens have been planted The highest quality woodlands are those on the south side of South Twin Lake (north -facing slope above the lake) and many of these will be protected as part of the buffer to the lake There are several nice stands of aspen and paper birch as well as some other native trees of high quality There are few large, mature oak on the site Tree Protection Ordinance & City Code Stillwater City Code states that development should not reduce canopy cover on the site by more than 35% The Engineenng Dept should calculate canopy cover reduction for this project (total acres of tree canopy on site and acres of tree canopy to be removed) Several areas of the property (lake shore and wetland buffer areas) probably fall under the Bluffland/Shoreland Ordinance and any tree removal in those areas for development would need to adhere to those regulations Code also states that understory plants and root area around trees to be preserved should not be disturbed, except for removal of invasive plants such as European buckthorn, and underplanting with desirable plant material Regarding removal of diseased trees or trees seriously damaged by storms — I saw few trees which would fit either category and saw no evidence of senous diseases, such as oak wilt, on the site City Code (Tree Protection Ord 891) also requires that trees which are removed for subdivision improvements must be replaced on the basis of 10 trees per acre of canopy removed Subdivsion Code for the City of Stillwater also requires an average of 3 street trees per lot to be planted inside the property hne and not in the boulevard, unless approved by the City Engineer Tree Protection Plan Though there is a plan which shows which trees are to be removed and which are to be saved, and there is a grading plan, there is no plan or language which descnbes how trees, which are to remain on the site, are to be protected during construction The City has a document entitled, "Tree Protection Standards" and this outlines acceptable methods for protecting trees on development sites The developer should request a copy from the Millbrook Development Report — City of Stillwater 3/06 — 2 Comm Development office if they have not yet received it Any buffer areas which are to remain undisturbed, should be fenced off from development, especially in areas where trees and shrubs near the buffer (e g Outlot A) are being removed and a lot of grading is occurring In areas where silt fencing is going in anyway, orange silt fencing may be used as tree protection fencing, rather than 5 ft orange "snow -fencing", as long as the silt fencing remains in place dunng construction Landscape Plan The proposed Preliminary Landscape Plan (dated 2/1/06) shows tree location but does not indicate yet where trees and shrubs of specific types will be planted The attached Plant List looks fine, except for the following comments "Cnmson King" is a Norway maple which is marginally hardy in Minnesota This cultivar can suffer from winter injury and dieback, as well as fungal cankers "Greenspire" linden is also not native and may have problems with stem girdling roots Any green ash should be limited in number due to the inevitable arnval in Minnesota of the emerald ash borer, a serious pest of green ash and cultivars Where are the "Siouxland" Poplar to be planted Cottonwoods grow quite large and may be a detnment near buildings and roadways The ornamental trees are fine and the crabapple cultivars are all disease -resistant Colorado and "Baker Blue" spruce should represent only a small percentage of the evergreens to be planted Colorado spruce and cultivars are not native and have problems with Rhizosphaera needlecast and Cytospora canker which limit their usefulness in the landscape Austrian pine is dense at matunty, however, it is not native and can also have problems with insects and diseases Red pine should be used in areas where a more open pine form will be acceptable The Planting Detail is good and the landscape contractor should be sure to adhere to the planting practices delineated in the Planting Detail The Landscape Architect should be on hand at time of plant delivery and installation to check that methods of plant handling, temporary storage (if necessary) and planting are such that plant stock is not damaged See "Planting Standards", City of Stillwater Any trees on site which are to be transplanted, should be in good condition and have good form Specifications regarding which trees are to be moved, the method of transplanting, size of tree spade and provisions for aftercare of transplanted trees, should be included with the Planting Detail of Landscape Plan Trees to be moved should be tagged and approved by a representative of the Comm Devel Director, such as the city Forestry Consultant Trail Along Lake A recreational trail is proposed along the south side of South Twin Lake, on or near the treed slope I would recommend that the trail stay out of the trees, if possible, to prevent damage to tree roots and loss of additional trees Also, roots of fast-growing species, such as cottonwood, elm and aspen, can cause heaving of the trail when trees are growing close to the trail surface I would also recommend that the trail stay off the slope as much as possible to lessen damage to surrounding trees dunng trail construction and also to prevent excessive soil erosion It has worked well in other developments for the forester to walk the proposed trail comdor with a representative from the city engineering dept and a rep from the development company, as well as the contractor who will be grading the trail comdor Millbrook Development Report — City of Stillwater 3/06 — 3 Planting in Development Buffer Areas I recommend that native trees and shrubs be planted in natural areas, which serve as buffers to Brown's Creek and the lake, to increase the plant diversity and improve aesthetics and wildlife habitat in those areas Native trees which could be planted in buffer areas are aspen, hackberry, American linden (basswood), bur oak, bicolor oak, red oak, paper birch, nver birch and red maple Native shrubs and small trees which could be planted in buffer areas include gray dogwood, red -twigged dogwood, black chokeberry, sumac, hazelnut, wild plum, nannyberry, pin cherry, and serviceberry It also would be nice to have some information on how the development plans to manage the natural areas on the site after development Subdivision code for the City of Stillwater does require a forest or woodland management plan for the Stillwater City Code, the Stillwater City Council (City) hereby grants to the St Croix Boat and Packet Company (Company) a Dock Permit upon the following terms and conditions 1 LOCATION The Dock may be maintained in the St Croix River approximately 150 feet south of East Nelson Street, on the parcel owned by the City and located immediately south of the Dock Cafe parcel of land 2 OTHER RULES The Company must abide by the rules and regulations and permit conditions of the Corps of Engineers of the United States Army and the Minnesota Department of Natural Resources Any charter or excursion vessels carrying passengers for hire and using docks must abide by applicable U S Coast Guard regulations 3 NO GAS PUMPS No gas pump may be located on the dock 4 NO DISCRIMINATION The Company may not discriminate against any person on the basis of race creed, national origin, sex or social status 5 WATER FRONT REGULATIONS The Company must abide by all rules and regulations and restrictions set forth in Chapter 48 11 of the Stillwater City Code relative to the waterfront 6 SPECIAL USE PERMIT The Company must abide by the conditions as set forth in the Special Use Permit (SUP/88-60) issued to Company by the Stillwater City Council, dated July 18, 2000 7 SCHEDULE OF FEES AND REPORT OF ACTIVITY Upon request of the City, the Company must submit a schedule of fees charged for the general and transient boat docking and a report summanzing the boating activity for the year The activity report must 13 TRANSIENT BOATS Transient boats are defined as vessels that use the dock as a stopover privilege on a trip that does not onginate from the dock Transient boats must be limited to dock up to not more than 24 hours per stay "Bareboat" charter vessels are considered transient boats if the origination of the trip, including loading of passengers, takes place elsewhere 14 PARKING The City reserves the right to request the Company's assistance in assunng that patrons and guests of the Company will park in a designated municipal parking lot 15 FIRES No person may build a fire in any area of the docking premises or in any vessel moored at the dock 16 OBSTRUCTIONS The City does not by granting this permit accept any responsibility for dredging the dock area or making the docking area free from obstructions or other hazards to navigation 17 STORAGE The City is not responsible for storage of the docks dunng off-season and the Company must abide by any decision of the City with regard to storage 18 RESERVATION OF RIGHTS The City reserves the nght to add to or amend these rules when needed to protect the health, safety and welfare of the City 19 RIGHT OF ENTRY The Company agrees to grant the City a right of entry upon any portion of the City property upon which the Company has constructed tenant owned improvements for the purposes of constructing Phase II and Phase III of the Stillwater Levy Wall project dunng the year 2000, subject to reimbursement to Company of any expenses associated with moving state the number of boating trips made each week and the number of passengers camed dunng the week 8 INSURANCE The Company must provide the City with Certificate of Insurance evidencing One Million/Three Million General Liability Coverage of their operation, naming the City as an additional insured under the policies as their interest may appear 9 PUMP OUT PRIVILEGES The Company must provide pump -out privileges for manne heads for any boater requesting this privilege at the same rate and fee charged to boats that are moored at the dock for a fee 10 INSPECTIONS The City reserves the right to request inspections of heads, electrical systems or other unsafe conditions on or about the dock or any vessel moored thereto 11 USAGE The moorage at the dock facilities is limited to five (5) charter and or excursion boats, one (1) floating ticket office vessel and a service boat not exceeding 26 feet in length The Company must accommodate a reasonable number of public ` walk on' passengers and Company must also accommodate a reasonable number of transient boats In no event must the number of boats or vessels exceed the moorage limitation contained in the permits issued by the U S Army Corps of Engineers and the Minnesota Department of Natural Resources 12 PERMIT FEE The annual permit fee is $ 1100 00 each for the Avalon (a 675 passenger rear wheeler), Empress Andiamo (a 500 passenger rear wheeler), Andiamo Showboat (a 150 passenger rear wheeler), Jubilee (a 150 passenger rear wheeler), the Andiamo (a 115 passenger rear wheeler moored at Sunnyside Manna), the transient boat docks and the Company owned dock for a total of $ 7,700 00 The permit shall also allow a 26-foot service boat tenant owned improvements that are lawfully due to Company under the Federal Relocation Standards Act 20 DURATION The duration of this permit is from January 1, 2000 through December 31, 2000 21 TERMINATION This permit may be Company shall work with the City on a permanent solution to restroom problems in the are of boat operation 8 The outside storage building shall be converted to a garbage container enclosure and all garbage stored within the building 9 Noise from the docks shall be held to a minimum after 10 p m 10 Excursion /charter boats moored at City docks shall not play music at docks after 10 p m 11 The use and these conditions shall be enforces by the City through issuance of its annual dock permit 12 This permit shall be reviewed annually before the dock permit for the City owned property is approved
