meeting to order at 7 p m Approval of minutes Mr Junker, seconded by Mr Middleton, moved approval of the minutes of January 12, 2004 Motion passed unanimously Case No SUP/04-03 A special use permit for a gymnastics facility at 1900 Tower Dr in the BP- 0, Business Park Office Distract Bart Roskoski, applicant The applicant and Mike Kennedy, property owner, were present Mr Junker asked whether the facility would be open on Sundays Mr Roskoski said the business will be open Sundays, except dunng the summer months The applicant said he was aware of the conditions of approval Regarding the condition for a long-term contract for off -site parking, Mr Kennedy said they are working with Hentage Pnnting to meet that condition Mr Teske, seconded by Mr Turnquist, moved approval as conditioned Motion passed unanimously Case No SUP/04-05 A special use permit for Liberty Village retail/office condos located at County Road 15 in the VC, Village Commercial Distnct Contractor Properties Developers, applicant Case No SUP-F/04-08 Final PUD approval for Liberty Village 2nd Addition combining Lots 2 and 3, Block 1, into one lot, Lot 1, Block 1, 2nd Addition located at CR15 m the VC, Village Commercial Distnct Contractor Properties Developers, applicant Present were Matt Alexander, representing the developer, and Nathamel Shea, architect Robert Kroening, 12480 72nd St , noted that Case No SUP-F/04-08 combines lots 2 and 3, rather than lots 1 and 2 as indicated on the meeting agenda Mr Kroemng expressed concerns regarding the building facade, building matenals, signage and landscaping Another member of the audience, who did not provide his name or address, asked wether there had been any study of the possible increase of traffic on 72nd Street/Interlachen 1 City of Stillwater Planning Commission February 9, 2004 Mr Shea then reviewed the design schematics in detail He reviewed the design elements intended to give the look of a New England mixed use village center He reviewed possible locations for signage, as well as the proposed font style The previously proposed monument sign has been eliminated Lighting will be the same as used at the adjacent bank The landscaping is the same as previously approved other than the use of lower level evergreens on the west side of the site He noted that the architectural review committee for the Liberty development has reviewed and approved the final documents Much of the Commission's discussion centered on parking Mr Alexander noted that there is a covenant which provides for shared parking With the spaces at the adjacent bank and gas station, as well as the park, along with the on -site spaces (57), the developer meets the required 74 spaces Mr Russell expressed a concern about the correspondence from Mondo Management indicating the possibility of a cafe restaurant with beer/wine Mr Russell said that type of usage increases parking needs A representative of the management company was present and indicated that if beer/wine is not an allowed use that would not present a problem The management company representative indicated that the possible anchor tenant is a bakery/coffee shop with a very limited menu Dunng discussion, it was noted that the ongmal PUD has retail as an allowable use Mr Dahlquist and Mr Teske suggested restnctmg to the applicant to the onginal allowable use and then letting staff and the applicant work out the definition of "retail " Mr Middleton moved approval of Case No SUP/04-05 with the 18 recommended conditions of approval, with the additional condition that the developer comply with the onginal PUD Mr Dahlquist seconded the motion, motion passed unanimously Mr Middleton, seconded by Mr Turnquist, moved approval of SUB-F/04-08 Motion passed unimously Case No PUD-F/04-06 Final PUD approval for Terra Spnngs, Building 4, a four -level, 36-unit condominium at 640 N Main St in the CBD, Central Business Distract J Buxell Architects, applicant Mr Buxell and Matt Bnnza were present Mr Buxell reviewed design plans He said initially Building 4 was three stories, now it is partially four -stones high The proposal is to preserve the eastern wall of the onginal warehouse structure, the other walls were compromised in the fire, he said There was a question about the height of the building Mr Buxell said the average height is 49' 11", just under the 50' allowable The tallest part of the building is the tower portion which is 68' to the tip of the tower 2 City of Stillwater Planning Commission February 9, 2004 Fred Bassett, 1002 N First St , said the development is destroying his view of the nver No other comments were received from the public Mr Buxell asked about condition of approval No 2 regarding the requirement to set aside four on -site parking spaces for owner parking He noted that 68 spaces are provided within the building He said if owner parking is a problem, commercial parking would be limited Mr Buxell said he would prefer to see what evolves regarding parking issues, rather than sign designated spaces at this time Regarding the condition that the central green and trails on Lot 4 be constructed before Building 4 occupancy, Mr Buxell said a portion of the green area may be used as a staging area for Building 3 construction He said he was unsure of the status of that possibility at this time Mr Middleton asked about rooftop mechanicals Mr Buxell said mechamcals would be inside the building Mr Turnquist moved approval as conditioned, changing the wording of condition No 2 to "four on -site parking spaces shall be set aside as needed for required owner parking " Mr Middleton seconded the motion, motion passed unanimously Case No V/04-07 A variance to the street side yard setback (30 feet required, 8 feet requested) for construction of a 432 square -foot, 1 %2 story addition at 1521 W Olive St in the RA, Single Family Residential Distnct Kirk Roetman, applicant Mr Roetman was present He stated the plans are to remove an existing addition and deck The new structure will not extend out any farther than the existing structure Mr Teske, seconded by Mr Junker, moved approval as conditioned Motion passed unanimously Case No SUP/04-09 A special use permit for retain/take-out area, office area, kitchen production, storage and distnbution space at 1931 Curve Crest Blvd in the BP-O, Business Park Office Distnct Tasteful Thymes Company, Donna Tarras, applicant Ms Tarras said after further explonng the two options listed in her application, she found that Option A would not be feasible She noted that most of her retail business is take-out Mr Turnquist stated he was pleased Ms Tarras is able to relocate her business in Stillwater and moved for approval as conditioned Mr Teske seconded the motion Mr Middleton said it should be clanfied that approval is for Option B Motion for approval of Option B as conditioned passed unanimously Other items 3 City of Stillwater Planning Commission February 9, 2004 Boutwell Area Transportation Study — Mr Russell referred to the memo summanzing the Commission's recommendations which will be forwarded to the City Council Mr Gag went through the 10 recommendations Most of the discussion centered on recommendation 2 Mr Middleton said he did not recall the Commission agreeing to designate Neal Avenue as a "collector" street Mr Gag also expressed a concern about that designation Joe Lux, Washington County, was present for the discussion Several Commissioners noted that by definition, every street could be called a "collector" street After discussion, it was agreed to change the wording of No 2 to Connect Neal Avenue from Bout -well Road at the existing County Road 12 at Northland Avenue Regarding recommendation No 6, improvements to and possible "calming measures" on Deerpath, Mr Turnquist noted the Commission felt Deerpath should definitely be widened and that improvement should not be dependent on state aid Regarding recommendation No 7, sidewalks on one side of Bnck Street, Mr Russell noted that is because Bnck is part of the city's trail system Mr Peroceschi introduced a proposed resolution stating that "under no circumstances should any of the `traffic calming' efforts involve restricting egress or ingress on any streets " After discussion, it was the consensus that while the "message is good," the doors should be left open for possible solutions No action was taken on the resolution Mr Dahlquist said he would like the recommendations forwarded to the City Council to include a general discussion of the Commission's goals — providing a north/south connection, for example Mr Russell said he would work with Chairman Gag in developing an introductory statement for the Council Mr Turnquist, seconded by Mr Teske, moved to approve the 10 recommendations, changing No 2 by eliminating the designation of Neal Avenue as a collector street and correcting several typos pointed out in the discussion Motion passed unanimously Downtown Streetscape Enhancement Study — Mr Russell noted the Streetscape Enhancement Study basically provides details for implementation of the Downtown Plan update Robert Lane of Lane Design Group, Mahtomedi, outlined the proposed study work plan and aspects the study will cover — retail, architecture, histonc character and landscape Mr Middleton said the current appearance of Water Street is of concern Mr Peroceschi questioned why parking lots "get the best view " Mr Russell noted that if the use of the lift bndge changes and the bndge is not open to traffic, that will present opportunities for Main Street Mr Dunker and Mr Teske both commented that a key will be the perceived value of the 4 City of Stillwater Planning & B review She said it has been a good year, with few complaints She said here has only been one complaint, that of the noise issue with Rivertown Inn She noted that, according to Washington County, none of the B & Bs have had major problems with their kitchens She also noted that the Rivertown Inn is not considered a B & B by the county because of the number of its rooms The meeting was of Stillwater on the redevelopment of this 2 5-acre parcel for the past six months The project has been reviewed by the Planning Commission and the City Council A Conditional Use Permit (CUP) and Special Use Permit were approved by the City November 18, 2003 The CUP Resolution is 2003 241 The HPC has also reviewed and approved the architectural elevation The project is now going forward with the land subdivision per City Code Section 32-1, Subdivision 4 — Platting Procedure Proiect Description Over the past year, the Project Team has reviewed existing site conditions and prepared a number of studies for the development of this project The design studies looked at numerous ways to develop a housing project on this site Ideas that were considered include row housing along North 2"d Street, the extension of a condominium building into the Second Street hill, and a continuous building footprint around the perimeter of the site with an enclosed Central Plaza Although these ideas address the concerns of the surrounding neighborhoods During the further design development, the Project Team considered many factors, including the design sensitivity to the existing neighborhood as it relates to aesthetic values, site lines, neighborhood views and existing surrounding building design and is pleased to present the current design concept which is in the best interest of the Developer, City and neighbors Our goal is to provide a project both the public and pnvate owners will be excited to have as an addition to the Main Street in Stillwater The building materials consist of Tumbled Brick, Conventional Stucco Systems, as well as metal clad divided light window with decorative moldings We are proposing to incorporate terraces into each condominium unit These terraces engage into the building facade The ornamental rails shall consist of rod iron style and be historic in nature The building facade fronting North Main Street shall step incrementally, as to replica the existing buildings downtown The buildings on North Main Street are planned to consist of retail shops accessible by steps and ramps from the street level, as well as a central lobby to access three levels of condominium units above The retail shops storefronts will be designed with recessed entries, which mimic numerous buildings downtown The proposed entrances to the retail spaces shall consist of suspended canopies and blade signs Behind these retail shops is a two level parking garage, which will include both private and public parking One level of parking is planned to be below the street level shops and is proposed to be for the residential units This level will be designed to address groundwater issues and floodplain elevation requirements A private plaza for the building's occupants is planned for the central area at the rear of the building and will be cut into the Second Street hillside The rear plaza area will have gazebos, a pool and numerous planters to create an exciting yet intimate open space for the condominium residents The retaining wall along the rear of the plaza is proposed to be the bedrock limestone rock face provided it is structurally solid This plaza will be used for numerous functions The project proposes the enhancement and paving of the existing alley to the North The Developer will be coorl'nating the improvements with the adjacent property owner Additionally, the existing house on the northwest corner of North Main Street and Mulberry is planned to be relocated to the southwest comer of the site and may be leased out as an art studio New access for the house will be off of Mulberry Street Site Planning Improvements Streetscape Improvements The proposed facade along Main Street will enhance the retail/ commercial district of Stillwater The extension of the retail district along this block will incorporate numerous doors, stairs, ramps and planters to create an exciting array of improvements There will be an 8 foot wide sidewalk along the curb line for pedestrian passage before the stairs and planters transition up to the facade The architectural facade of the building is set back from the Main Street curb line 18 to 28 feet This area will integrate raised planters, street trees, seating areas, raised platforms at the retail shop level and have an ADA accessible access All parking for the retail shops will be in the parking structure behind the shop On street parking will be encouraged as approved by the City The new Main Street facade and design of the streetscape elements will utilize the design palette already established in Downtown Stillwater The project will be a strong complement to the draw Stillwater currently experiences as a regional tourist and shopping destination Lighting Decorative lighting fixtures similar to the pedestrian level lighting along Main Street south of the project will be incorporated into the project hardscape amenities to extend the decorative, will be incorporated into the streetscape and alternated with the existing street lighting fixtures The existing light poles along North Main Street and East Mulberry Street provide lighting for the vehicular traffic, these poles will be protected during construction to maintain safe driving conditions The street light pole along Mulberry Street approximately 30 feet east of North Second Street will be relocated as part of the project to make room for the access dnve west of the main building Grading / Retaming Walls The western edge of the site is a bluff that transitions 50 feet of vertical elevation from North Second Street to North Main Street There are sections of many existing retaining walls on site and adjacent to the site along the Second Street nght of way A portion of the existing retaining wall adjacent to North Second Street recently failed and was temporanly repaired by the City A geotechnical consultant has been added to the Project Team and will be completing additional geotechnical analysis through the spring snow -melt and ground thaw period to determine the stability of the existing wall adjacent to the North Second Street sidewalk as well as limits, elevations and condition of the bedrock in the vicinity of the proposed retaining wall The project will be required to include the replacement of portions of this wall as necessary, and the installation of a permanent fence along the top of the wall for pedestrian safety As this wall is constructed, portions of the existing sidewalk may be impacted and will be replaced The current plan shows a 30 foot wall to transition from the main building's plaza level to North Second Street elevations After the additional geotechnical exploration noted above is completed, the type and limits of the proposed wall will be further defined and designed Wall options include large -diameter boulder, modular block, or bedrock cut in shear The wall is proposed as a design -build project that will be completed in conjunction with site excavation to determine the extent and condition of bedrock and structural design during the construction period Infrastructure Improvements Municipal Water There are numerous water services that serve the existing buildings on the site The applicant intends to connect to the existing o" and 8" DIP services along North Main Street According to discussion with the Water Board, the 6" service should be adequate for all domestic service for the main building The 8" DIP is proposed to serve as the main building's fire line The project team is coordinating with the State Fire Marshall's Office to determine fire flow requirements All existing service lines not mentioned above are planned to be abandoned at the curb stop In addition, the relocated 2-story building at the southwest corner of the site will be served by an existing 1" copper service currently abandoned at the property line Sanitary Sewer A number of existing sanitary sewer service leads were constructed as part of the 1991 Downtown Improvements The proposed building will utilize service stubs that were constructed as part of the 1991 improvements, specific connection locations will be identified during final design of the interior plumbing It is anticipated that the lower level garage floor drains will be discharged into a sanitary sewer stub via an internal pump All existing service lines not utilized by the proposed development will be sealed and abandoned at the property line The sanitary service for the existing St Croix Lighting building along Mulberry Street will be utilized for the relocated 2 story building at the southwest comer of the site Storm Water Drainage Runoff from the site currently drains from west to east toward the St Croix River The existing buildings on the site create a mostly impervious development just downstream of the bluff area that runs along the western boundary The proposed site will have a similar flow pattern from west to east Ponding upon the roof of the proposed main building will provide a means of detention and rate control for the proposed site that does not currently exist An underground mechanical separation system solids as detailed in the Preliminary Stormwater Management Plan As a result of the development, the rate of proposed runoff will be decreased compared to both existing and pre -development conditions, and will be of higher quality than in the existing condition The Preliminary Stormwater Management Plan details the existing and proposed storm water drainage conditions FEMA Floodplam A portion of the site currently hes within the FEMA floodplam below elevation 692 5 The site will be graded to provide fill for the portion of the site below the floodplam elevation to raise the entire property above the floodplam A Letter of Map Amendment will be obtained from FEMA to take the site out of the floodplain pnor to construction of the building Existing Groundwater Initial geotechnical investigations indicate the presence of groundwater below a portion or portions of the existing building and also weeping out of the bedrock at the rear of the site Draintile is planned for the base on the proposed retaining wall at the rear of the development to intercept and route the natural groundwater flows around the proposed building and into the City's storm sewer system A perimeter dramtile is also proposed around the lower level of the garage to carry any groundwater moving across the site around the building and mto the public storm sewer system via a sump pump As part of the building demolition activities, additional geotechnical analysis will be performed to further clarify existing limits and levels of groundwater within the limits of the proposed building At that time, more specific underground mitigation and routing of the groundwater can be considered and included in the subgrade design Measures may include over -excavation and installation of gravel / draintile pathways at appropriate locations to direct the groundwater to the east and into the public stormsewer system Floodproofing of the lower level of the garage will be specified to meet City code and 2003 and after review of the staff report, applicant and public testimony, the Planning Commission denied the request, and WHEREAS, on October 21, 2003, the applicant appealed the Planning Commission's denial and submitted a revised plan on 11-10-2003, for Council consideration with the appeal and indicated in the letter of appeal, the applicant has eliminated two levels from the original proposal, and WHEREAS, the current project is within the height limit established by the Zoning Ordinance and the parking provided is in excess of the spaces required by the Zoning Code, and WHEREAS, the plan has also been modified adding a residential finger in the rear court area which adds 14 units to help compensate for the loss of the top residential level of the structure, and WHEREAS, the project is within the flood plain and the applicant has proposed to comply with flood plain regulations by obtaining a revision of the flood plain map by elevating the building and structures to above the regulatory flood elevation of 693 5 or, in the alternative, that the structures be flood proofed to the regulatory flood protection elevation of 693 5, and WHEREAS, a traffic study prepared by Glen Van Wormer of SEH Engineering dated October 9, 2003 concluded that the project traffic can be accommodated on the existing road system, and that additional traffic generated by
