Director Steve Russell Absent Robert Gag, Chairperson Mr Middleton called the meeting to order at 7 05 p in Approval of Minutes Mr Wald, seconded by Mr Turnquist, moved approval of the minutes of Nov 10, 2003 Motion passed unanimously Case No V/03-95 A variance to the sign regulations for additional canopy signage (one sign permitted) at 601 N Main St in the CBD, Central Business District Todd Weiss, applicant Continued from the November 10, 2003, meeting Peter Katsiotis was present representing the applicant He explained the request and pointed out there are other businesses, including the Freight House, that have multiple signs Roger Tomten of the Heritage Preservation Commission was present He reviewed the HPC's position on the request It was a condition of the HPC that the canopy not be backlit, and that verbiage on the sides be of a generic nature He also noted that window signage of up to 30 percent of the total space is allowable Mr Tomten said it was the HPC's suggestion that the existing monument sign be used for the Zephyr, with a sign over the door for the restaurant He further noted that the Freight House predates the ordinance and that the building has multiple frontages, thus allowing more signage Mr Ranum said he concurred with removing the lighting from the canopy area Mr Teske said the Commissions has been consistent in trying to hold to the sign ordinance Several members agreed with the suggestion to leave the existing monument sign for the Zephyr and use generic directional wording on the canopy for the restaurant Mr Teske noted it is up to the applicant to decide how to bring the signage into compliance with the ordinance He moved to deny the request Mr Turnquist seconded the motion Motion to deny passed unanimously Case No V/03-100 A variance to the front yard setback (30 feet required, 9 feet and 6'6" requested) for construction of a front porch and stoop at 807 S Fifth St in the RB, Two Family Residential District Heidi and Chris Lottsfeldt, applicants 1 City of Stillwater Planning Commission December 8, 2003 The applicants and their architect, Roger Tomten, were present Mr Tomten reviewed plans for renovating the 1870s home Plans include adding two additional bedrooms, as well as a front porch/portico He said the new porch/portico would not extend any farther than the existing house He said the materials would match the existing structure as closely as possible Mr Junker, seconded by Mr Peroceschi, moved approval as conditioned Motion passed unanimously Case No V/03-101 A variance to the front yard setback (30 feet required, 25 feet requested) and to the rear yard setback (25 feet required, 20 feet requested) for construction of a residence between 1419 and 1323 West Ramsey St (a newly created lot) located in the RA, Single Family Residential District Tom Larson, applicant Mr Larson said the request is for a 23 foot front setback and 19 foot rear setback He pointed out that the newly created lot is only 75 feet deep, with setback requirements, that would allow a home to be just 20 feet deep Mr Dahlquist and Mr Tumquist both noted that when the Planning Commission approved the subdivision creating the non -conforming lot, members knew this issue would come before them in the future Mr Ranum said he was not concerned with the rear setback, but was concerned about the crowded street frontage Mr Russell asked about breaking up the tall elevation of the proposed new residence The applicant responded that the proposed deck should accomplish that goal Mr Tumquist, seconded by Mr Teske, moved approval as conditioned Mr Peroceschi noted he did not vote for the original subdivision, Mr Russell said the staff report would be corrected to indicate that The motion for approval as conditioned passed 7-1, with Mr Peroceschi voting no Case No SUPN/03-102 A special use permit for an accessory dwelling (800 square feet allowed, 820 square feet proposed) on a 22,590 square foot lot (10,000 square feet required) with a variance to the rear yard setback (25 feet required, 6 feet requested) and to the side yard setback (10 feet required, 6 feet requested) at 418 S Holcombe St in the RB, Two Family Residential District Brian Enright, applicant Mr Enright was present He noted the proposal is to convert the second floor of an existing 542 square foot garage (not 820 as indicated in the agenda) into a play room/family room with a half bath He said nothing of the exterior of the structure would be changed He stated he had contacted neighbors, none of whom objected, seven neighbors signed a petition saying the proposal was not of concern to them 4 y City of Stillwater Planning Commission December 8, 2003 Mr Ranum said he had a concern with adding utilities that would make the space inhabitable in the future Mr Enright said that was not their intent Mr Dahlquist asked about the definition of an accessory dwelling Mr Russell said that is determined by utilities — half baths are not allowed without an accessory unit permit Mr Ranum said he was opposed to "stepping over" the accessory dwelling ordinance and noted there is no hardship involved Mr Teske and Mr Peroceschi said such requests should be dealt with on a case by case basis Mr Teske, seconded by Mr Tumquist, moved approval Motion passed 6-2, with Mr Ranum and Mr Dahlquist voting no Other Items Mr Russell reminded members of the Dec 18 workshop on the Boutwell Transportation Study Mr Russell said Croixwood residents had asked to speak at the workshop There was discussion as to how the Commission wished to handle that request It was the consensus that while the meeting was open to the public, it should not be open to unlimited comment It was suggested comments could be received in writing Mr Russell reminded members that the public comment for the scoping phase of the St Croix River crossing project was to end December 10 There was some discussion of the business impact of the Highway 36 Second Formal Request to Offer Dinners to Guests of the Rivertown Inn. A. A request to offer dinners to current guests and invited friends of the Inn who've stayed with us before and/or are friends. B. Request to offer special events featuring dinners and fundraisers and charity events not to exceed 40 guests per event. C. The events to be concluded by 9:00 p.m. D. Events are based on reservation only basis and invitation only basis and not exceed four per month. E. Previous SUP's amendments have been granted to Aurora Staples Rivertown Inn Bed and Breakfast seeking similar consideration. Explanation of request: The current SUP allows us to serve food to our guests and we have a fabulous and renown gourmet chef Patrick O'Toole who's offering fine dining and cuisine to our guests. We have had requests from guests to bring guests to dinner that are not staying. We also have an interest in having very limited, by invitation only events and word of mouth has traveled about the chef so that we want to be able to host some charity events, fundraising events and wine dinners in collaboration with our chef. requested Council approval for a New Years Eve dinner for guests and friends of guests not to exceed 10-12 additional people He stated that a review in the newspaper had some incorrect information and that their dining is not open to the public Mr Paul Lacy, neighbor of the Rivertown Inn, stated that he does not have any problem with the event on New Years Eve, however does have other issues that will be addressed at a later time Councilmember Rheinberger stated he would be in favor of this one-time event Mayor Kimble stated that the inn is not to operate as a restaurant, and there should be parking spaces located between Everett Street and Greeley Street in the RA, Single Family Residential District Case No SUP/03-88 Notice Page 5 of 11 City Council Meeting — 03-26 December 2, 2003 was published in the Stillwater Gazette and mailed to affected property owners on November 21, 2003 Community Development Director Russell explained the request for a 237-space parking facility The proposal was presented to the Planning Commission on October 13 and was denied The developers have since revised the proposal to address some of the concerns of the neighborhood The structure has been moved back to 60 feet from Everett Street, rather than the original 37 feet and there would be only one access to the structure from Everett Street Glen Van Wormer, consulting traffic engineer from SEH, presented a study of the impact on future traffic should the proposal go through Dave Middleton, representative of the Planning Commission, explained the Commission's decision to deny the request The major concern was the impact on the neighborhood Mayor Kimble opened the hearing to comments from the public Terry Hakala, representing Walker Parking Consultants, explained that his firm was retained in May of 2003 by Lakeview Hospital to study the parking situation He explained how this proposal was arrived at as the best solution to the problem He showed the design modifications and stated he believes the new design will address the concerns of the neighborhood Jeff Robertson, administrator of Lakeview Hospital, explained that the hospital is looking for a long-term solution to the parking problem Mary Soderholm, 1128 S Everett, stated that she has gone from being very angry to very sad about the proposed structure She feels their quality of life will be forever changed She spends a lot of time in her yard Once the ramp is built the noise pollution will be horrendous, the car exhaust will diminish the air quality, and they will see headlights and taillights as cars enter and exit She is also concerned about the walking path Rich Soderholm, 1128 S Everett, stated that this proposal should not be given a Special Use Permit because it is objectionable to the neighborhood, undesirable, offensive, disagreeable and does not fit the nature of the neighborhood He stated that the height is nine feet above the limit allowed by the zoning ordinance He hopes the City Council will follow the advice of the Planning Commission Tom Sherber, 1121 S Everett, stated that the hospital is a wonderful asset to the community, but requested that the Council deny the proposal There are a number of issues that have not been discussed Removal of homes piecemeal is a detriment to the neighborhood Increased traffic will be dangerous The current site is not suitable for a regional hospital Page 6 of 11 City Council Meeting — 03-26 December 2, 2003 Karen Hofstrand, 1204 S Everett, stated that the neighborhood is one of the most beautiful in Stillwater She works as a physician and understands the concerns of the hospital But the health care field is expanding and in the long term this site will not be adequate for the hospital The hospital may be there for the next ten years, but the neighborhood will be there long after that The Council should have a long-term view of the neighborhood Kathy Wilke, 803 Orleans St , spoke on behalf of the junior high students who walk to school There are no sidewalks and traffic is a concern She is also concerned about the quality of life for the neighbors Patrick Poshek, 1302 S Everett, has been an assessor for 28 years, and stated that zoning plays an important part in market value The ramp is a failure of the purpose of the zoning ordinance He is also concerned about the easement the City wants to acquire for a walking path This is private land that would be opened to the public The property owners should be reimbursed for loss of market value Marty Rossini, 1224 S Everett, asked how many people would like to look at a parking ramp in the back yard In September, the neighbors were told there would be no sidewalk Now it has appeared in the new plan It is a threat to their property and their safety He has faith that the Council will make the right decision Stuart Glaser, 1103 S Everett, stated that he echoes the comments of his neighbors His view will be looking west right into the ramp He wondered how much the ramp would actually be used This appears to be a problem only in the daytime, Monday through Friday He does not want to see the hospital move, but wondered when a facility becomes too big for its current location This is a residential area and they want to keep it that way Kathy Black, 1311 S Everett, stated her concern with no sidewalks There are a lot of children and a lot of people walking through the neighborhood Dan Rydeen, 1111 S Everett, stated the hospital is outgrowing this site and this is a long-term fix for a short-term problem Dugan Kern, 1216 S Everett, is concerned with quality of life issues He wondered how this would affect the Brick Pond water levels, pollution, and air quality He feels there are long-term consequences, which will devastate the neighborhood There are other options to explore Terry Nelson, 904 Pine Tree Trail, is an employee of Lakeview Hospital She understands the concerns of the neighbors, but wondered where employees are suppose to park The neighbors were not happy with the shuttle parking They tried parking at Lily Lake, but people did not like that either She wondered what would happen if the hospital moves Page 7 of 11 City Council Meeting — 03-26 December 2, 2003 Mark Trupper, 1303 S Everett, stated that the neighborhood is against this proposal David Wettergren, 6315 St Croix Trail N , current Chairman of the Lakeview Hospital Board, stated that the topic of parking comes up annually He is sympathetic to the neighborhood concerns, but there are always pros and cons to any issue The Board has discussed a variety of solutions to the parking problem, and the Board is unanimous in support of the current proposal He stated that the hospital is a $25 million dollar business for the community There has been a significant investment and the board wants to protect that investment Their intent is to grow with the community and to continue at the current site He wants to assure the community that the board has taken a long-range view There will have to be some incremental moves over a period of time and resolution of the parking problem is important to the future plans Peter Boosalis, 515 Broadway Ave , is a hospital employee and so is his wife He spoke on behalf of the hospital employees in support of the parking ramp Mayor Kimble closed the public hearing Mayor Kimble recessed the meeting at 9 00 p m Mayor Kimble reconvened the meeting at 9 10 p m Councilmember Rhemberger stated that he is in favor of granting the special use permit for the parking structure He feels the potential loss of the hospital is the City's second greatest problem Councilmember Kriesel agreed that it would be a tragedy if the hospital left the community Councilmember Junker stated that he appreciates the changes that were made to the plan after the Planning Commission meeting, but that it was not enough, and he cannot support the plan Councilmember Milbrandt stated that he couldn't support the plan because of some design concerns Mayor Kimble said he appreciates the long-range planning by the hospital He asked the Council to consider sending the request back to the Hospital Use for a 237 Space Parking Structure (Case No SUP/03-88) Background This special use permit request was heald by the Planning Commission at their meeting of October 13, 2003 (Staff report and minutes attached) The proposal is to construct a 237 car, two level parking facility south of the hospital and on two lots south of the existing parking lot on South Everett Street At the Commission meeting, neighborhood concern was expressed for impact of the structure on views, additional traffic on South Everett Street and possible lighting impact on neighborhood Based on neighborhood concerns expressed, the Planning Commission denied the request An appeal was filed by Lakeview Hospital on October 21, 2003, requesting the Council review The appeal describes the rational for on -site parking, parking alternatives considered by the hospital, future hospital plans and impact of the proposed parking on the Everett and Anderson Streets neighborhoods Since the October 13, 2003, Planning Commission meeting and in response to concerns expressed by the neighborhood, Lakeview Hospital has modified their plans relocating the parking structure further back from South Everett Street (37 feet original, 60 feet revised) and eliminating auto access from Everett Street directly to the parking structure The driveway access to the Everett Street parking lot would be located on Everett Street at Anderson Street only (see attached revised plan) To further address concerns expressed by residents across Everett Street from the parking facility, parking on the east side of the east drive could be eliminated and the deck extended to the west With the removal of the parking, the parking area would meet the 30 foot setback for a structure in the RA Zoning District Glen Van Wormer will be available at meeting to go over the traffic impacts of the proposal His traffic study is attached to the Planning Commission staff report Other suggested conditions of approval from the Planning Commission staff report are listed below Further, it is suggested that the City's Heritage Preservation Commission (design review) work with the neighborhood and applicant to review and approve final plans consistent with the above conditions regarding screening, landscaping and lighting, similar to when the parking lot east of Everett Street was constructed Conditions of Approval 1 Parking lighting shall have standard of 20 feet or less with light cut offs so that residential areas are not lit or cannot see the source of light 2 The south parking ramp boundary shall be heavily landscaped to minimize the visual impact from the residential area 3 The parking structure shall be designed so that the fronts of cars cannot be seen from the south and east parking ramp elevation 4 The two residential structures shall be advertised and made available for relocation 5 The drainage plans shall be coordinated with the city lake drainage improvement plans of the city and reviewed and approved by the City Engineer 6 The hospital shall participate in Everett Street and possible hospital related sidewalk improvements adjacent to the site A pedestrian trail easement shall be provided connecting Everett Street to Greeley Street 7 Access to the parking structure off of Everett Street shall be limited to traffic from the north This shall be signed and enforced by the
