at 7 p m Mr Wald, seconded by Mr Junker, moved to approve the minute of May 12, 2003, motion passed unanimously Case No V/03-49 A vanance to the sign regulations (one allowed, two requested) at 1200 W Frontage Road in the BP-C, Business Park Commercial Distnct, Koppy Motors, applicant William Minder represented the applicant He stated the request for two signs was to "even the playing field" with competition He showed photos and noted other nearby businesses have two signs Mr Russell pointed out that a free standing sign of up to 100 square feet is allowed in the BP-C distnct The applicant stated he was told the allowable signage was much smaller, and he has already spent considerable money in having a sign constructed If he had been told a 100 square foot sign was allowable, he would have Invested in a larger sign Mr Middleton noted the Commission had a similar request last month which was denied due to the concern regarding proliferation of signage Mr Middleton, seconded by Mr Wald, moved to deny the request, motion passed unanimously The applicant asked whether he could have an additional sign on the side of the building, as the building is located on a corner lot Mr Russell said he believed that was allowable The applicant was told to work with staff Case No V/03-50 A vanance to the front yard fence height regulations (42" allowed, 60" proposed) at 828 W Willard St in the RB, Two Family Residential Distnct Joe Thompson, applicant Mr Thompson said the existing fence is in disrepair He owns a dog that can clear 40" and would like to have the fence the same height around the penmeter of the yard He stated the fence wold be brought in 8 feet, so as not to have to remove four large pine trees 1 City of Stillwater Planning Commission June 9, 2003 Mr Ranum suggested there are alternatives to a 60" fence and moved to deny the request Mr Teske seconded the motion Motion passed 6-2, with Mr Middleton and Mr Turnquist opposed Case No V/03-51 A vanance to the side yard setback (10 feet required, 5 feet requested) for construction of an addition above an existing garage at 504 W St Croix Ave in the RB, Two Family Residential Distnct David P Ponath, applicant David and Ann Ponath were present They suggested that the addition will be an improvement to the home The footpnnt of the existing structure will not be expanded Neighbors, Jerome Petroski, 418 W St Croix, and Thomas Loome, North William Street, both spoke in favor of the plans Mr Middleton, seconded by Mr Turnquist, moved to approve the variance as conditioned, motion passed unanimously Case No V/03-53 A vanance to the street side yard setback (30 feet required, 11' 10" requested) for construction of a two -car attached garage at 1101 S Fourth St in the RB, Two Family Residential Distnct Michael and Jennifer Peltier, applicants Mr and Mrs Peltier were present and noted their house is already non -complaint with setbacks Mrs Peltier said they are Just trying to work with the lot in order to have a two -car garage A concern was expressed that a car parked in front of the proposed garage would extend onto the sidewalk Mr Teske noted that in the previous case, the requested vanance did not expand the footpnnt of the existing structure He suggested that in the long run, the proposal would be detnmental Mr Ranum agreed that he was not comfortable with the extent of proposed improvements on the lot Mr Junker asked the applicants whether a smaller garage might work Mr Middleton said he would have no problem if the garage was smaller Mr Hultman noted that if the garage was reduced to 22' deep, a car parked in front would not extend over the sidewalk Mr Ranum, seconded by Mr Teske, moved to deny the request, motion passed unanimously Case No SUP/03-54 A special use permit for outdoor sales for 10 days at 1801 Market Dnve (Cub Foods parking lot) in the BP-C, Business Park Commercial Distnct Enc Robbins, applicant Mr Robbins, TNT Fireworks, said the request is for the outdoor sale of Minnesota legalized fireworks Two non -profits will conduct the sales, North Central Bible College of Minneapolis 2 City of Stillwater Planning Commission June 9, 2003 and Redeeming Love Church of Maplewood TNT is also the in-store provider of fireworks for Cub He said he had met with the Fire Chief regarding the request Mr Junker, seconded by Mr Wald, moved -season porch and deck at 1311 N Third St in the RB, Two Family Residential Distnct Tom and Linda Furst, applicants Linda Furst was present She said they would like to have a rear exit to the house, and the yard is on an incline She said a similar vanance was granted to a neighbor She noted they had a deck before that had to be npped down Mr Middleton, seconded by Mr Peroceschi, moved approval Motion passed 6-2, with Mr Ranum and Mr Wald voting no Case No SUB-F/03-56 Preliminary and final plat approval for a 7-lot subdivision including two outlots at 608 N Main St in the CBD, Central Business Distnct Terra Spnngs, LLC, applicant A representative of the developer bnefly outlined the proposal The two outlots will belong to the City There also will be dedicated open space in the intenor of the development for public access The complex will include five buildings A resident of 1002 N First St expressed a concern about the height of "building 5," which he said might block his nver view The developer's representative said Terra Spnngs will be back with building details at a later date, all view comdors will be examined in that process, he said Mr Turnquist noted the request is similar to what was presented to the Commission in prior presentations and moved approval as conditioned Mr Middleton seconded the motion Motion passed 7-1, with Mr Ranum voting no Case No ZAM/03-03 A zoning map amendment to rezone 10 lots located along 62nd Street North from AP, Agricultural Preservation, to LR, Lakeshore Residential Kevin and Roxanne Shoeberg, applicants Case No SUB/03-61 A subdivision of a 3 03 acre lot into four lots at 12730 62nd St N in the LR, Lakeshore Residential Distnct Kevin and Roxanne Shoeberg, applicants Mr Shoeberg was present He pointed out that when the property in the area was annexed to the City, it was zoned AP by "default " None of the lots in the area meet the AP designation He said when he bought his property in 1989, it was essentially ghost platted The rezoning, he said, will make the property conforming He said he bought the property knowing the City was going to 3 City of Stillwater Planning Commission June 9, 2003 annex the area, and that it wold be zoned residential He further stated that the rezoning is consistent with the City's Comprehensive Plan and does not breech any agreement with the Township Richard That portion of 62"d Street is currently an 18-foot road that connects with the path on the west side of Long Lake If the subdivision is allowed, he said it would increase traffic by 33 percent, and the developer could petition the City to upgrade the street He noted that none of the lots, other than his, has lakeshore access He further noted that the request only benefits a few property owners, and that piecemeal subdivisions will charge the character of the neighborhood Mr Huelsmann also read letters from Patnck A Tynen and Jean M Tynen, 12677 62"d St N , and Perry Furgala, 12525 62nd St N , stating their opposition to the rezoning and subdivision A resident of 2872 Long Lake Dr asked about the possibility of assessments due to the extension of sewer services and the possibility of increased taxes A resident of 2885 Nightingale Court asked about water runoff Lisa and Enc Wahlin, 12563 62"d St , stated their opposition and noted the request only benefits the farthest lot The resident of 12727 62"d St expressed opposition to being mcluded in the lakeshore designation Also speaking in opposition to the proposal were the resident of 12601 62"d St and Kurt Zaspel, 12811 62"d St N Kay Sterling, 3200 Staloch, expressed a concern about the additional hard surfaces and the affect on Long Lake Mr Junker asked whether all 10 lots on 62"d Street had to be included Mr Russell responded that spot zoning is a bad practice According to the Comprehensive Plan, large lot residential/lakeshore residential parcels are 20,000 square feet Mr Wald moved to approve ZAM/03-03, motion existing 22 x 24 garage is only 8' from the property line and the dnveway extension is on city property The proposal is to construct a new garage of the same size farther from the home and farther present She stated the existing steps must be removed Currently, water runs behind the steps and into her basement The overhang will extend no farther than the existing steps and will be aligned with the neighbor's house, the neighbor has no objections to the plan, she said Mr Ranum, seconded by Mr Teske, moved approval as conditioned, motion passed unanimously Case No V/03-59 A vanance to the front yard setback (20 feet required, 11 feet requested) and to the side yard setback (6 feet required, 5' 6" requested) for construction of a front porch at 522 W Oak St in the RB, Two Family Residential Distnct Mark Balay, applicant, representing Karl Diekman Mr Balay and Mr Diekman were present The proposal is to remove an existing covered stoop and replace it with a porch that replicates, as much as possible, an original attached porch shown in old plat maps The new porch will extend 1 foot farther in the front yard and six inches into the side yard Mr Teske, seconded by Mr He told the Commission the existing handicapped access ramp does not meet code The proposed wrap -around porch will return the front steps to the front door and maintain handicapped access Also, the proposal will provide for a pull -in drop off spot Mr Ranum, seconded by Mr Middleton, moved approval as conditioned, motion passed unanimously Case No SUP/03-62 The case was continued until the July meeting Other business There was a bnef discussion of a rezoning request, Case No ZAM/03-02, the Commission heard at the May meeting The request was denied by the Commission The applicant appealed the decision, and the City Council has referred the matter back to the Commission Mr Russell suggested the Commission should be lookmg at the Comprehensive Plan and the long-term ramifications for rezoning the entire area It was decided to bring the matter, and staff report, back to the Commission for discussion at the July meeting Mr Teske stated he would like information regarding how many of story, taking up 144 sq ft of yard The reason for the larger size is the need for storage of tools for my livelihood, as I am self employed It would also be used for the traditional reasons that yard and garden sheds are built for The old shed that is presently on the property, is falling apart, and never did have a good footing, which allows it to sink into the soil It has a footprint of approxunately 196 sq ft If/ I am not allowed the variance, the old shed may get rebuilt, as I need the space I of course would tear down the old shed, with your allowance of the new shed The appearance of the structure I believe to be in kecpmg with many older sheds that one can still see around Stillwater, that are m fact two story, and much larger m size I think it is also far more attractive than other neighbors temporary structures I have measured the distance to what I believe is the property line, and believe it to be at least five feet The building as placed is ten feet two sign at a residence that has a Type I Home Business Permit The proposed sign would have a blue background with the words "Wendy Woods" in black and "Photography" in white The Type I Home Occupation does not allow for exterior signage Type III Home Occupation does allow for a 2' x 2' exterior sign The applicant lives in the RB Zoning District, where Type III Home Occupations are permitted with a special use permit (see attached Home Business Ordinance) A special use permit will require a public hearing It is staff's opinion there is no hardship in which to grant a variance and suggests the commission grant a Type III Home Occupation permit Recommendation Denial of a variance Approval of a special use permit for a Home Occupation Type III Conditions of Approval Should the Commission grant the special use permit for a Home Occupation Type III, staff suggests the following conditions of approval 1 No outside storage or display of products, equipment or merchandise is permitted 2 Any retail sales must be accessory or incidental to the primary residential use 3 Infrequent hobby, craft or art sales are permitted twice per year for not more than six (6) days per calendar year 4 Any sign must be unlighted and smaller than two (2) square feet 5 Customers are permitted by appointment only 6 Not more than twenty percent (20%) of the total gross floor area of the dwelling unit may be used for the Home Occupation for four hundred (400) square feet, whichever is less 7 No activity or equipment may be used that creates noise, vibration, glare, fumes, odor, or electric or television interference is permitted if it is detectable by adjacent neighbors 8 Business hours are limited from 7 a m to 8 p m 9 Off-street parking must be provided for customers 10 No more traffic is allowed other than in a normal residential area 11 No more than one (1) nonresident employee is allowed 12 Type III Home Occupations are subject to review upon complaints from the neighborhood If regional transit service, including Metro Transit, Metropolitan regional routes and suburban transit systems New Council charts a different course BY PETER BELL Having been on the job for about five months, I m often asked what is my specific vision and goals for the Council, and, more generally, the region I m always tempted to respond with a Met Council version of the Hippocratic Oath and say "First, do no harm The organizing principle behind the Council is efficiency To provide regional services and to integrate planning and delivery of those services It s a conservative ideal that should serve the region well as we prepare to accommodate nearly a million more people in the next 30 years With a growing population, and more people making more trips over longer distances, I am committed to a multi -modal approach to congestion, an approach that involves roads and transit This includes bringing the Hiawatha line into service on time and within budget, operating that service as efficiently as possible I also support high-speed express buses on dedicated busways and construction of additional freeway lanes, perhaps underwritten by a congestion -pricing model similar to a proposal by U S Rep Mark Kennedy In addition, the Council is working with the U of M to develop cutting -edge technology to facilitate more effective use of shoulder lanes by buses, and we arc implementing new systems that will enable us to collect fares more efficiently and revamp our routes to provide better customer service The Council must discharge its responsibilities in a fiscally responsible manner To that end, we are doing our share to address the states $4 2 billion budget deficit We are making tough, but necessary choices — reducing some transit service, raising some bus fares and we ve had to eliminate more than 200 positions In addition, the Council will reduce its property tax levy A second area of focus is customer service, with local units of government among our key customers Local elected officials are our partners and our success depends, in large part, on our relationships with those partners This Council has already demonstrated a willingness to work closely with local governments to resolve differences Another customcr service issue has to do with the Livable Communities program Historic illy, the core cities and first -ring suburbs have received the lions share of grant funding — about 85 percent since 1996 In April, the Council voted to target more of those dollars to outer -ring suburbs and rural growth centers This change in the distribution plan should result in a more equitable allocation of these highly sought Metropolitan Council Chair Peter Bell after resources Finally, the Council will refocus its efforts on core services that the Legislature has specifically directed us to undertake —Metro Transit, Metro Mobility and wastewater treatment, for example Those services encompass the vast majority of our employees and our budget, and provide tangible benefits We will focus on delivering those services efficiently and effectively At the same time, we will ferret out functions that may exceed the bounds of our core mission Regional planning is another core service The new Council is taking a fresh look at Blueprint 2030, the overarching regional planning document the previous Council adopted in its final days In fact, this Council has already determined the document should be a flexible "framework' around which our systems plans can be developed, rather than a more rigid "blueprint' which dictates how things will be done Again, this change reflects the new Council s heightened level of respect for local control and autonomy These changes clearly indicate that this Council brings a new attitude to regional governance and will chart a somewhat different course However, we all know "the proof is in the pudding," and I am eager and excited about the opportunity to give the region a taste of the biennium Light rail The state and Hennepin County each will pay $6 7 million a year to operate LRT The Council will solicit operating proposals from private vendors and Metro Transit High -Occupancy toll lanes Mn/DOT can charge single -occupant vehicles to use the lanes on I-394 and I-35W Northwest Corridor busway The Council receives $1 million to keep working on the busway Northstar commuter rail Mn/DOT and the Northstar Corridor Development Authority will continue studying its feasibility between Minneapolis and St Cloud I-35W bus rapid transit Mn/DOT will study its feasibility between downtown Minneapolis and Lakeville Regional parks Council receives $3 3 million for the biennium for parks acquisition development and rehabilitation Council will match this with $2 2 million For operations and maintenance the Council receives $7 4 million for the 10 implementing agencies each year Council levies The Livable Communities program levy stays at $8 3 million each year The
