PLANNING APPLICATION REVIEW FORM CASE NON 03-04 Planning Commission Date February 10,2003 Project Location 821 North Fourth Street Comprehensive Plan Distnct Two Family Residential Zoning District RB Applicants Name Deb Bessert representing Jessica Lange Type of Application Variance Project Description A Vanance for the construction of a two car garage in addition to an existing 600 square foot carnage house Discussion The request is for a Vanance to construct a two -car garage in addition to an existing 600 square foot carnage house The 22 foot by 24 foot garage would replace a 20 foot by 28 foot garage that was demolished a number of years ago There is an existing concrete dnveway that would of lead to the demolished garage The proposed garage would be constructed in the same location as the previous garage The applicant states that the existing carnage house located in the rear of the property would be nearly impossible to use as a garage due to access and condition of the building There is a steep hill where a driveway would access this building (see attached topography map) It is a very old building and the applicant does not want to demolish it Recommendation Approval as conditioned Conditions of Approval 1 All revisions to the approved plan shall be reviewed and approved by Community Development Director 2 The garage shall be similar to the main structure in materials, color and architecture 3 An erosion control plan shall be submitted to the City Engineer 4 The small tool shed shall be demolished 5 The carnage house shall be used for storage not human habitation Findings 1 That a hardship peculiar to the property, not created by any act of the owner, exists In this context, personnel financial difficulties, Toss of prospective profits and neighbonng violations are not hardships justifying a vanance 2 That a vanance is necessary for the preservation and enjoyment of substantial property nghts possessed by other properties in the same distnct and in the same vicinity, and that a vanance, if granted, would not constitute a special pnvilege of the recipient not enjoyed by his neighbors 3 That the authorizing of the vanance will not be of substantial detnment to adjacent property and not materially impair the purpose and intent of this title or the public interest nor adversely affect the Comprehensive Plan Attachments Pete Linder, Linder's Flower Mart Type of Application Special Use Permit Project Description A special use permit for a seasonal flower mart Discussion The request is to temporarily use a portion of the River Heights Shopping Center parking lot for a seasonal plant sales retail business The use occupies a portion of the parking lot (25-30 spaces) that is required parking for the shopping center Because the shopping center does not use all the parking, it is possible to consider the plant sales use on a seasonal basis If shopping center activity increased, the temporary plant sales would not be allowed The proposed plant sales use is different from CUB, Target or Ace Hardware seasonal outdoor plant sales in that the business does not operate the primary business at the site Recommendation. Approval Conditions of Approval 1 The Special Use Permit is for one year and must be reviewed annually for shopping center activity and parking space availability - 2 The use is approved for two months from April 15 to June 30 , Attachments: Application form package HPC Action on 3/4/02: +6-0 approval.
