Wald, seconded by Mrs Bealka, moved approval of the minutes of Sept 10, 2001, as presented, motion passed unanimously Case No SUP/01-43 A special use permit for a martial arts/dance school with once office at 215 N Williams St in the RB, Two Family Residential Distnct Sara Gilberg, applicant (Continued from Sept 10) Present were Ms Gilberg and Timothy Quarberg, the potential tenant Mr Quarberg explained his plans for the space and his philosophical view of martial arts Ms Gilberg stated she and her family live in the neighborhood and have tned to be careful in choosing the nght tenant Gary Stares, the property owner immediately adjacent to the building, asked if the city had inspected for parking spaces Mr Russell stated that according to the city ordinance, the proposed use requires 17 parking spaces, which can be accommodated in the parking lot Mr Starns shows photos of a yellow no -parking space that had been painted black He also raised a question about a garage door that had been installed Jana Vaughn, 722 Mulberry St , spoke on behalf of the Gilbergs She stated the neighborhood had improved since the Gilbergs purchased the property She noted they had put a lot of work and effort into the building and had gone to great lengths to find a tenant appropnate to the neighborhood Mary Starns said there are not 28 spaces in the parking lot She also stated the proposal will result in constant turmoil, parking and traffic problems and noise Mr Ranum asked if the garage door was part of the ongmal plans submitted by the Gilbergs Mr Russell said plans show a door at that location, but it doesn't look like a garage door Mr Ranum expressed a concern about the garage's impact on neighbors Mr Zoller stated the proposed use would have less of an impact on neighbors than other possible use He moved approval as conditioned, noting there was no reason not to approve the request Mrs Bealka seconded the motion Mr Hultman suggested adding a condition that the yellow no- • 8 a m and 4 p m Monday through Fnday, that delivery vehicles not block the roadway or dnveway and that the garage door remain closed except when vehicles are entenng or exiting the garage Mr Ranum suggested adding a condition that signage be installed indicating delivery vehicles are allowed only between 8 a m and 4 p m Mr Ranum, seconded by Mrs Bealka, moved the amendments to the ongmal motion Mr Zoller stated the amendments were acceptable to him Mr Ranum seconded the amended motion Amended motion passed unanimously Case No V/01-49 A variance to the front yard setback (30 feet required, 5 feet request) for construction of an addition to an existing garage at 115 N Hamet St in the RB, Two Family Residential Distnct Mark Balay, representing John and Madeline Macindoe, applicant Mr Balay was present and reviewed drawings of the proposed addition He noted that with the addition, basically a garden shed structure, the garage will be under the 1,000 feet allowable for accessory structures Mr Ranum asked if the eaves on the new structure overhang the wall of the existing garage, and if they do, if it would be possible to change that in the plans Mr Balay said that change was acceptable Mr Zoller, seconded by Mr Wald, moved approval as conditioned, with the additional condition that no part of the new structure extend west of the existing building line Motion passed unanimously Case No V/01-50 A modification to approved plans including a special use permit, variance and design review for the St Croix Boat and Packet Co ticket office, south of the Main Street parking lot in the CBD, Central Business Distnct Mark Balay, representing St Croix Boat and Packet Co , applicant Mr Balay reviewed the requested changes to the onginal SUP The pnmary issue of discussion was the request for vehicular access to the upper plateau near the ticket office The onginal plans called for four parking spaces, and the request is to make that area available for drop-off for handicapped persons only Mr Balay said his client had no problem with staffs' recommendation that buses not be allowed to use the dnveway for drop-off Members' pnmary concern was one of safety due to cars backing up after dropping persons off Mr Ranum suggested the possibility of eliminating one or two of the parking spaces so cars could loop around, rather than having to back up There also was a suggestions to have the drop- off at the existing curb cut Mr Russell noted that with plans for development of the Aiple property, the goals is to keep as much congestion as possible off the pedestnan pathway planned for the Aiple property It was noted that the Downtown Parking Commission currently is undertaking a study of the use of Main Street for additional parking • • • City of Stillwater Planning Commission October 8, 2001 After considerable discussion, Mr Ranum moved to approved the realigned pedestnan walkway, to limit the number of parking spaces in the upper plateau area to one and to temporanly close the ingress/egress to the site at the south end of the south city parking lot subject to further study by city staff with more recommendations to be made at the November meeting Mr Gag seconded the motion, motion passed unanimously Case No V/01-41 A vanance to the rear yard setback (25 feet required, 0 feet requested) for construction of a single family residence at 1511 N Main St in the RB, Two Family Residential Distnct and Bluffland/Shoreland Distnct John Hoeschler representing Elayne Aiple, applicant (Continued from Sept 10, 2001, meeting) Present were Mr Hoeschler and Jack Moms, the potential buyer Mr Moms expressed his interest in constructing a single-family residence on the parcel in question He noted that with the 100-foot setback required from the nver and the 25-foot setback from the railroad tracks, he would be left with just 20 feet on which to construct a residence Mr Hoeschler suggested the question is what the city wants the ultimate use of the property to be He said the Manna has expressed interest in the property, as have potential developers of the Temtonal Pnson site to provide nver access for condo owners He said there is pressure on the property and some type of development will occur He suggested that a single-family residence would be the least intrusive use Mr Zoller said his personal preference would be for the property to be in public use He noted that a goal of the city has been to get the Temtonal Prison site back on the tax rolls, and he would look favorably on a use of the Aiple property that might encourage development of the pnson site Mr Teske also spoke in favor of putting the pnson site back on the tax rolls, and of providing nver access to more people than a single-family residence would Mr Russell noted the city had not received any response from the DNR on the proposal due to the state employees' stnke Mr Hoeschler also stated he thought the DNR would prefer a single- family residence as least intrusive He also noted that a single-family residence likely would generate more taxes than a homeowners' association use would Bruce Ahlers, 110 Lakeside Dr , who owns property to the north of the Aiple property, spoke in favor of the single-family use He said he was opposed to the increased traffic other uses might bnng Mr Ranum said the parcel is developable, even without the requested vanance Mr Ranum, seconded by Mr Teske, moved to deny the vanance Mr Zoller, seconded by Mrs Bealka, moved to amend the motion to grant a 10-foot vanance from the rear setback Motion on the required) and height limit (50 feet required, 53 feet proposed) Background This case was reviewed by the Heritage Preservation Commission on June 4, 2001, and by the Planning Commission on June 11, 2001 It was conceptually approved subject to several conditions The Commission directed the staff to work with the applicant to refine the plans, including the engineering, landscape and flood protection plans Discussion The Special Use Permit has not been issued yet Residences of all classifications are permitted in the Central Business District Minimum front yard setback in this area is 15 feet The original plan (5/25/01) showed the building setback the required 15 feet Since that date, information has been obtained the shows MnDot has an additional 18 feet of property right-of-way, reducing the front yard setback to 5 feet The rear yard setback is required for an exit stairway on the back of the building The property angles to the west at the termination of the stairway, creating a need for the variance The proposed building is four stories high, permitted in this zoning district, the design of the building results in a total building height of 53 feet and 62 8 feet to the top of the building parapet, (50 feet required) The building height had to be adjusted after the grading plan was completed to accommodate the floodplain requirements Floodplain requirements and size of the lot create hardships that limit the number of parking spaces provided Poor soils and floodplain restrictions prohibit underground parking and the size of the site prevents the amount of surface • parking required The ordinance requires 58 parking spaces for the residential area of the building and 34 spaces for the retail portion of the property The applicant is showing 76 parking spaces on the site The residents would have 39 indoor parking spaces for the 29 condominium units and shared use of the surface parking The 34 surface parking spaces would be available for retail users during the day One of the conditions of approvals at the June 4, 2001 Heritage Preservation Commission meeting was that the lighting fixtures of the parking lot be the same as other downtown lot lighting, and the boulevard lighting will eventually continue with the same fixtures used south of the project They also rejected the proposed use of up lighting on the building columns, stating that the building lighting should primarily be confined to the first floor retail Recommendation Approval as conditioned Conditions of Approval 1 All utilities shall be completely screened from public view 2 Final Landscape Plan to be approved by the Planning Department 3 All landscaping shall be installed before utility release or final project inspection No project shall be phased unless approval is granted by the Planning Commission 4 The surface parking spaces shall be signed for "commercial space customer use" when the commercial use is in operation 5 Continuous concrete curbing shall be installed to separate parking areas from landscape areas 6 Handicapped parking spaces and signage, in compliance with State requirements, shall be shown on building permit plans and installed before final inspection of the project 7 The street address of the building shall be displayed in a location conspicuous from the public street 8 The trash enclosure shall be made of a sturdy solid masonry material, with trash receptacles screened from view and compatible with the color and materials of the project and a detail provided to the Planning Department 9 All trees required to remain on site, as indicated on the plans, shall be protected by fencing or other necessary measures shall be taken to prevent damage during construction activity 10 No roof equipment shall be visible to the general public 11 All gutters, downspouts, flashings, etc shall be painted to match the color of the adjacent surface 12 Construction projects shall conform to the City's Noise ordinance Construction during the dry season shall mitigate excess dust problems 13 A sign permit shall be required for all project signs 14 Grading and drainage plan to be approved by City Engineer before building permits are former gas station Vanances would be required for any redevelopment of the site, due to the site constraints, but we have tned to minimize the extent and impact of the four requested vanances The requested vanances meet the three vanance standards as follows 1 A hardship peculiar to the property, not created by any act of the owner, exists Personal, family or financial difficulties, loss of prospective profits and neighboring violations are not hardships justifying a vanance The requested vanances are required to eliminate the unique hardships caused by the floodplain issues, shallow lot depth, relatively small commercial lot, poor soils and contaminated soils located on this property The proposed vanances are required in order to allow redevelopment of the site This shallow parcel is only 138 deep on the north side of the property We have tried to minimize the need for vanances, but vanances are required in order to redevelop the lot The additional 18 feet of MnDOT property adjacent to the Main Street (T H 95) nght-of-way appears to part of this property, therefore, the reduced front yard setback would not be noticeable from the adjacent properties The rear yard setback is required for the exit stairway on the rear of the building and would be separated from adjacent properties by the railroad nght-of-way and, therefore, would not be noticeable from surrounding in histonc communities, like Stillwater, is that the lots were platted pnor to the nse of the Amencan automobile Consequently, the lot was platted without regard to the need for auto parking The poor soils and floodplain restnctions prohibit the developer from providing underground parking and the size of the site limits the amount of surface parking that can be accommodated The ordinance requires 58 parking spaces for the residential portion of the building and 34 spaces for the retail portion of the property We are proposing to provide a total of 76 parking spaces on this site, which we believe is adequate for the mix of uses The residents would have 39 indoor parking spaces available for the 29 condominium units and shared use of the surface parking The 34 surface parking spaces would generally be available for the retail users dunng the day, while many of the condominium owners are away from home The demand for retail parking spaces will be less in the evening when the condominium residents and guest will create a higher parking demand 2 A vanance is necessary for the preservation and enjoyment of substantial property nghts, and, if granted would not constitute a special pnvilege not enjoyed by neighbors The setback and building vanances are required to allow the property owner to develop this property in a manner that is consistent with the City zoning map and the surrounding development The vanances would allow redevelopment of this currently underutilized site The parking vanance would allow the developer to improve the property consistent with other development in downtown Stillwater Given that the existing lot is small, it difficult to provide an economically viable project and provide the number of parking stalls generally required by the meeting, the Planning Commission approved modifications to the Andiamo ticket office site plan with direction to staff and the applicants representative to propose a specific design for the south end of the Main Street Parking Lot adjacent to the Andiamo office Since that meeting, I have met with Mark Balay to come up with a design A graphic of the design will be presented at meeting time The substance of the design is to • widen the parking lot entrance and move the curb line of the lot further to the south (this may require repositioning the Stillwater entrance sign) • providing a raised curb or island separation the drop off area from the parking lot access dnve (this may eliminate one or two parking spaces) • constructing a sidewalk connecting the drop off area to the boat access walkway • provide one or two handicapped spaces next to the drop off • eliminating handicapped spaces from the office site With this proposal, there would be no vehicular access from the south end of the parking lotto the nverfront A bus drop off would be supported by the City and proposed for TH 95 Main Street (this may require some street widening and sidewalk construction) A plan showing these Mn/DOT Project Manager, T H 36 Partnership Study DATE October 31, 2001 SUBJECT T H 36 Partnership Study Background One of the central issues left unresolved by Mn/DOT's May, 2000 T H 36 Corridor Management Plan was what the intersections on T H 36 between T H 5 and TH 95 should be like in the future to better fit with local plans and business needs, accommodate future traffic (through - traffic AND local travel), improve safety, and provide better connections for pedestrians and bicyclists The T H 36 Corridor Management Plan had evaluated two "hybrid" alternatives that adjusted frontage roads and that contemplated removal of one signal, but these scenarios were focused on managing the state highway and did not attempt to analyze local traffic implications That much -needed work will be completed as a cooperative effort between Mn/DOT, the cities of Oak Park Heights and Stillwater, and Washington County It is that additional, locally -oriented analysis that is now being started through the T H 36 Partnership Study At the Stillwater City Council's meeting of July 17, 2001, the Council adopted a resolution pledging the City's participation in and support for the T H 36 Partnership Study — a planning process that is geared toward providing " needed facts to fully evaluate plan alternatives in developing a consensus vision for the T H 36 corridor " At the Council's meeting of October 16, 2001, participation in the study was again endorsed Purpose of the Partnership Study The T H 36 Partnership Study anticipates that there will be a need, at some point in the future, to eliminate signals at the T H 36 intersections of Norel/Washington, Oakgreen/Greeley, and at Osgood The Study's purpose is to analyze various configurations of grade -separated or at -grade intersections and, determine which options best meet local as well as highway needs, both long- term and as interim measures Partnership Study Status and Approach SRF Consulting Group, the consultant who conducted the Downtown Stillwater Traffic Operations Study, has been selected for the T H 36 Partnership Study A scope of services has been developed by staff from Stillwater, Oak Park Heights, Washington County, and Mn/DOT that emphases identification of local impacts of alternative intersection or interchange configurations for the three T H 36 intersections between T H 5 and T H 95 (A
