David Middleton, Paul Teske and Darwin Wald Absent Chairperson Gerald Fontaine and Terry Zoller Staff Present Steve Russell, Community Development Director Call to Order_ The meeting was called to order by Vice -Chairperson Russ Hultman at 7 p,m, Approval of the Minutes of February 12, 2001 The Motion to accept the minutes of the meeting from February 12, 2001 was made by Mr Gag Ms Bealka seconded the motion Heanng no comment, a vote was taken and all were in favor of accepting the minutes from February 12 Case No V/01-04 A vanance is request for a front yard setback (30 feet required, 0 feet requested) on the north side and 20'7" requested on the east side for the construction of a deck and to rebuild an existing garage and an addition above the garage with a front porch at 518 Dubuque Street in the RB, Two Family Residential Distnct Mr and Mrs Dannka Zizich were present and addressed the Commission Discussion Mr Dannka explained that there was a drainage problem that needed to be fixed Mr Dannka explained that the new construction is the same size as what is being replaced Mr Russell was consulted regarding measurement from the nght of way Mr Russell said that an individual could get as close as 20 feet to the nght of way although 30 feet is recommended Mr Middleton questioned the size of the porch and how it relates to the house It was determined that a six foot not eight foot porch seemed more reasonable Mr Ranum said that he would be more comfortable with a compromise on the size of the porch with a restnction to no larger than 6 5 feet MOTION Mr Ranum made a motion that There be two vanances granted within the recommended conditions 1 That there be at least two feet from property line at all sites and not within two feet of nght of way 2 That the porch be limited to 6 5 feet 3 That other conditions of staff are met as listed Mr Gag seconded the motion Heanng no discussion from the public, a vote was taken All were in favor • • • Planning Commission City of Stillwater Monday, March 12, 2001 Case No SUB/01-05 A preliminary plat for a 23-lot subdivision located at 1035 St Croix Avenue West (Amundson Place) in the RA, One Family Residential District David Newman, The Bancor Group Inc , applicant The following items brought numerous comments from the neighbors of the proposed project It was the intent of the builders/developers 1 To build a concept of single family residential units Some of the units share dnveways 2 Two of the lots are existing There would be 19 new lots 3 The pnce is $350,000 to $500,00 Perhaps as high as $lmillion per unit 4 That the villas are designed for the "empty nesters" in concept 5 That there is a strong "homeowners association" 6 That there will be a dedicated "pond and wetland park" with a trail system referred to as "Outlot B" consisting of four acres available to the residents, public and school Mr Mark Putman and an engineer for the developers explained drainage and landscape Mr Neuman explained that the Parks Board had requested the trail system to be located on one side of the new street connecting Amundson Dnve to West St Croix Avenue Mr Neuman explained two options that he believed would enhance the trail system by creating a loop with a center walkway trail through the pond There was much discussion as to the two trail proposals The matenal of wood chips was discussed at length, as it is believed that a paved trail system would be better than a trail made of part wood chips and part paved trail Commission member Dave Middleton presented a wntten letter to the Planning Commission from Mr and Mrs Myers of 960 Amundson Dnve Much discussion centered on the following mentioned by the Myers 1 Environmental impact on the wet lands 2 The movement of earth on Blocks 1, 2, 3 will destroy some very active and valuable wet lands 3 Drainage would appear to be a real problem After grading 75 percent of the drainage would drain to Amundsen Dnve which would overwhelm present storm sewers 4 Site data shows lot density to be 1 9 per acre This figure includes all wetlands and outlots Actual average lot size is approximately 1/4 acre not 'V2 acre as the site data shows Many residents expressed concerns for the following matters The widening of West St Croix Avenue to a 20-foot paved surface The cul de sac that would be made at the end of St Croix Avenue for a turn around There was a question of access from one home renter who questioned his dnveway having access 2 • • • Planning Commission City of Stillwater Monday, March 12, 2001 Site grading and drainage for the houses fronting on Amundson Dnve much flooding in the past was a issue with many residents as they talked about flooded basements, flooded streets and flooded back yards and holes that fill with water dunng a storm The Engineer for the Developers talked at length about the proposed storm sewers that are proposed and how there is a new ecological treatment available that is a new method of handling run-off It was mentioned that the City Engineer must be satisfied with the proposed drainage sewer system being proposed A property owner, was concerned over his property's setback and expressed concern if there was going to be a setback closer than 20 feet A property owner was concerned about speeding on the road and another about parking, as there is no room for parking around any public park proposed There was a concern for small children walking to school on Amundsen Drive One resident was afraid of losing his property because of utilities and road widening After much discussion from the residents and the Planning Commission with the Developers a motion was made MOTION Mr Middleton made a motion that the Planning commission approved the proposed development with the following conditions 1 That in the conditions of approval that numbers four shall read that the drainage/grading plan shall be revised to meet the City Engineers requirements 2 That number six is deleted 3 That number 5 be revised to state a paved trail only 4 That a number 10 be added to state that lot 10 have a 20 sideyard setback and that lot five have a 45 yard setback Under these changes Mr Middleton moved for acceptance of the development design Mr Ranum seconded the motion With no other comments, a vote was taken Ayes Mr Hultman, Mr Ranum, Ms Bealka, Mr Middleton, Mr Teske, Mr Walk Nays Mr Gag Case No SUP/01-06 A special use permit for office space in a nonconforming building at 215 North William Street in the RB, Two Family Residential Distnct Garry Gilberg, applicant The Special Use Permit is for a prospective tenant, Family Means services That would occupy 2400 square feet of the 5000 square foot building There are conditions of approval There will be no signage (There can be something on the door or front door) 3 • • • Planning Commission City of Stillwater Monday, March 12, 2001 MOTION A motion was made to approve the Special Use Permit with conditions by Mr Walk and seconded by Ms Bealka With no discussion A vote was taken All in favor Case No V/01-07 A vanance to the side yard setback (5 feet required, 0 feet requested) and to the rear yard setback (5 feet required, 0 feet requested) for the replacement of an existing garage at 817 West Mulberry Street in the RB, Two Family Residential Distnct Curtis Hudak, applicant Mr Hudak's neighbor was present to request that a survey be done to show the lot line Mr Hudak complained at the cost of the survey and the question of the neighbor's driveway possibly projecting onto Mr Hudak's property Mr Hudak said that he was not moving closer to his neighbor's property but to the east Mr Hudak said he is replacing the garage he has already The neighbor questioned the question of a new structure demanding new standards Mr Hudak said that the garage will be 24 by 34 The project descnption was revised from the agenda and a variance to the side yard setback (5 feet required, 2 feet requested) and to the rear setback (feet required, 4 feet requested) for the replacement of the existing garage MOTION A motion was made by Mr Middleton that the vanance be allowed with the conditions listed that includes that the City Engineer and building official approve the building plans and that the setbacks be approved at 2 feet to the side yard setback and 4 feet to the rear setback The motion was seconded by Mr Ranum A vote was taken All in favor Case No SUB/01-08 A subdivision of the rental townhouse lots located on Brewers Lane, Lots 1-8, Block 1 and Lots 17-24, Block 1 and Lots 1-6, Block 2, Long Lake Drive, Lots 1-8, Block 3 and Saddle Court, Lots 7-12, Block 2 and Lots 13-18, Block 2 Long Lake Villas Limited, Tim Nolde, applicant The applicant has requested withdrawal of the application due to additional construction requirements for individual lot subdivision It is recommended that there be acceptance of the request for withdrawal All were in favor of withdrawal of request Final PUD Review Review of final plans for single family residences and townhomes for Settler's Glen project Bill Richards of Omn Thompson Homes was present The final PUD review included landscape and features mailboxes and bus shelters The School District has been consulted regarding the placement of bus shelters The number of shelters will be determined and placed as deemed necessary and reasonable according to the proposed plan The lots are to have three trees per lot However some may have one as the three per lot refers to average The tree lines and streets will "flow" so that the development is not all in a straight line There will be a reduced version of the monument identifying Settler's Glen 4 • • Planning Commission City of Stillwater Monday, March 12, 2001 It was established that the "overall concept" is there for review and house plans were provided for the Planning Commission The rest of the plan is "Concept" said Mr Richards The pnce may be in the $250,000 range to $350,000 and possible $500,000 More of the homes have three car garages instead of two There were many discussions on the landscaping Mr Middleton felt very strongly about seeing that the homes had full sod sot that all the homes would be "finished" with the lawn in The discussion followed with "certificates for cost of sod" and "time limits" to complete the lawn The City can escrow for the sod in an escrow blanket Mr Ranum asked if it was necessary to have a covenant at this time for sod The possibility of a provision for the homeowners associationyroviding a plan for landscaping was discussed It was discussed that the Planners must approve the elevations MOTION A motion was made by Mr Middleton that approval of the final PUD review for Settler's Glen project be approved with the conditions and an amendment that the developers give a certificate for the total yard of each property to cover sod Mr Gag seconded the motion A vote was taken All were in favor
