The request is to use an existing residential structure in the RB Duplex Residential District for an office use.
The structure will not be used for residential purposes. The applicant has stated that there will be one UPS
delivery per day. Three to four employees will work at the site. There is enough space in the rear yard to
accommodate parking off of Myrtle Street.
A major concern regarding use of this home exists. Myrtle Street is very busy and commercial uses along our
major thoroughfares creates additional conflicts between our residential and commercial land uses. Office uses
should remain in areas zoned for commercial areas and not impact residential areas.
A policy in the comprehensive plan is to maintain residential areas in residential use and not allow the
commercial uses to intrude in residential areas. To allow the use, commission would have to determine that the
"proposal is not objectionable to the neighborhood".

Request for a variance to the front yard setback and rear and side yard setback for addition to an
existing residence.
Discussion
The application is to connect an existing residence to an over sized garage, 2,400 sq. ft. and to
construct a side, 9 foot by 8 inches by 32 foot addition to a residence.
When a primary structure (residence) is connected to a secondary structure (garage) the garage
becomes a part of the primary structure and then needs to meet the setback requirements of the
primary structure. In this case, the oversized garage as a secondary structure is required to be
setback 5 feet from the property line. When it is connected to the residence a 25 foot rear yard
setback and 10 foot side yard setback is required. The existing garage has a 5 foot setback.
Besides the garage connection, a 9 foot, 8 inches by 32 foot addition is proposed for the north
side of the existing structure. The required setback is 30 feet. The addition would be setback 4
feet, 6 inches from South Greeley.
There are other locations on the lot where the addition could be constructed that would not
require a variance.

Design review and special use permit for a take-out pizza business along with a variance to the front yard setback
requirement (3 feet proposed, 15 feet required).
Discussion
The request is to improve the existing "old" gas station structure at 210 North Main Street. The project consists of
adding signage, replace old window openings, adding landscape areas, street furniture and a new curb cut.
The building facade shows a band around the upper portion of the building. This is not recommended since it is an
applied feature. New windows with small transom details are also shown. These add character to the building. The
windows should be clear glass and not opaque.
One 24 square foot sign is proposed, six feet in height, this sign is located approximately three feet from the property
line, 15 feet is required. The sidewalk in that area is ten feet so the sign will be setback 13 feet from the street. The
material of the sign shall be of wood or metal.
A trash location has been shown on the site plan. The receptacle should be screened in a wooded enclosure.
A new curb cut is proposed on Main Street. This will have to be approved by Mn DOT because Main Street is a state
highway. The area in front of the building can accommodate 6-7 idling cars for delivery purposes. There may be a
conflict with pick-up customer parking in this area. Two customer parking spaces are provided off Commercial Street
with four (4) parking spaces for employees. The customer parking spaces shall be signed for customers.
The Heritage Preservation Commission reviewed the proposal at their regular meeting on December 5, 1994. The
approved the plan as conditioned. The only concern of the commission is the material of the sign. Plastic or another type
of manufactured material is not appropriate in the downtown.
Findings.
The proposal meets the intent of the Downtown Guidelines and sign ordinance.

1. The new benches shall be reviewed by staff.
2. Detail plant material shall be submitted for staff review.
3. The trash receptacle shall be enclosed in a wood structured with doors.
4. The lighting style shall be reviewed by city staff.
5. The rooftop mechanical equipment shall be screened from view.
6. Written approval from Mn DOT shall be submitted to the city approving the access to Main Street.
7. The new curb cut shall met city standards.
8. The sign shall be constructed of wood or metal.

Attached for your review is a revision to the sign ordinance for the Business Park (BP) districts.
The changes tighten up the sign regulations. The bold face words have be changed from the
existing ordinance.
At meeting time, staff will go over each change with the commission.
Recommendation:
Review draft changes and set public hearing on sign ordinance amendment for planning
commission meeting of January 9, 1995.

All commercial, office and industrial signs in all Business Park (BP) Districts are
subject to the following conditions: One (1) wall, freestanding, awning or canopy
sign per business Per Street IWCAR� is permitted subject to the following
requirements:

Area. The gross surface area of a wall sign shall not exceed one
(1) square foot for each tW* (-2) feet of building, parallel,
or substantially parallel, to the front lot line.
2. Location. A wall sign shall be located on the outermost wall of
any principal building but shall not project more than sixteen (16)
inches from the wall to which the sign is to be affixed. The
location and arrangement of all wall signs shall be subject to the
review and approval of the Community Development Director.
Height. A wall sign shall not project higher than the parapet line
of the wall to which the sign is to be affixed or ItIfteft V 6)
feet as measured from the base of the building wall to which
the sign is affixed, whichever is lower.
4. Special Conditions. Where a principal building is devoted to two
(2) or more uses, the operator of each such use may install a wall
sign upon his/her proportionate share of the building wall to which
the sign is to be affixed. A sign plan must be submitted for the

a. The total gross signage for the entire building shall not
exceed one (1) square foot for each two (2) fe0t of
such building face parallel, or substantially parallel, to a
street lot line or a minimum of twenty-five (25) square feet
per business.

sign shall not exceed thirty (30) pet -cent of the gross
surface area of the awning, canopy or marquee to which such sign
is to be affixed.
2. Location. A sign may be affixed to or located upon any awning,
canopy or marquee.
3. Height. An awning, canopy or marquee sign shall not project
higher than the top of the awning, canopy or marquee to which
such sign is to be affixed.
d. Multi -tenant Master Si n Pro rare. A building Master Sign Program
shall be required (for multi -tenant commercial buildings) besides the
individual tenant and occupant signs. A building master identification
sign may be permitted according to the following requirements:
1. Building master identification signs shall not contain the names of
any tenants or occupants of the center.
2. If the multi -tenant commercial building has a floor area of 40,000
square feet or less, the building may have a freestanding sign with
a maximum area of 40 square feet 01'i each Wide

3. If the multiple tenant commercial building has a floor area greater
than 40,000 square feet, but less than the 100,000 square feet, the
enter may have a master identification sign with a maximum of

4. If the multiple tenant commercial building has a floor area of
greater than 100,000 square feet, the center may have a master
identification sign with a maximum area on 120 square feet on
each side and a maximum height of 18 fit.
5. No individual shop or business within a multiple tenant,
commercial building shall have a freestanding sign.
10. DIRECTORY SIGNS
Directory signs are used to guide pedestrians to individual business within a
multiple tenant commercial area and are permitted in Business Park (BP) Districts
subject to design review.
1. Placement -

b. shall be erected only in internal pedestrian access areas and not in
vehicle access areas.

2. Area -
A directory sign may have maximum area on one square foot for each
business listed on the sign and four square feet for the name of the
building or complex.
3. Directory signs may be freestanding but shall not exceed six and one-half
feet in height.
11. AUTOMOBILE SERVICE STATION SIGNS
Automobile service stations are allowed one (1) wall sign and one (1) ground sign
subject to the following conditions:
a. Wall Signs. There shall be no more than one (1) wall sign with a
maximum sign area of one (1) square foot for each IWO lineal feet of
building frontage.
b. Freestanding Signs. There shall be no more than one (1) freestanding sign
for each principal building. A freestanding sign shall be set back fifteen
(15) feet form the front and side property line. A freestanding sign shall
not project higher than qfthl M feet as measured from grade or
contain more than 4M square feet of signage.
Service Bay and Island Identification Signs. Service bay and island
identification signs are permitted providing direction or instruction to
persons using the facility but containing no advertising material of any
kind.
12. SPECIAL SIGN HEIGHT LIMITS
Because of the character of the area, including existing and proposed land use,

13. NONCONFORMING USES
a. Nonconforming signs that are lawful on the date of the adoption of this
ordinance shall have rights outlined in Chapter 31.01, Subd. 9 of the
Zoning Ordinance with respect to their alteration, extension, restoration
and abandonment.
b. Any person violating or failing to comply with any provision of this
ordinance shall upon conviction thereof be guilty of a misdemeanor.
14. VIOLATIONS
In all cases of violations of this ordinance which are unabated thirty (30) days
after written notice to record owner of the property on which the sign is located,
the City may proceed to abate and remove the violation and, if deemed necessary,
to have cost thereof specially assessed against the lot or parcel where the violation
was located.
