James M.-Waters, Applicant. 2. Case No. SUB/91-46 - A 1,400 square foot minor subdivision of Lot 19 to Lot 18 of Fairmeadows First Addition. Director Members Absent: Angela Anderson and Don Valsvik Chairman Fontaine called the meeting to order. APPROVAL OF MINUTES Motion by Gary Funke to approve the minutes of the meeting of June 10, 1991 as submitted. Seconded by Glenna Bealka. Motion carried. PUBLIC HEARINGS Case_ N.o. V/.9139 - A Variance to the frontyard setback requirements (twenty feet requested, thirty feet required) for the construction of eight single family homes on the north side of Van Tassel Drive and the east side of Neal Avenue. Lots 1 through 8, Oak Glen 13th Addition, in the RA, Single Family Residential District. The applicant, David Johnson, explained that the request is because of high perched water in the area. The digging will start at the 30-foot setback, but may have to be moved up to 20 feet if the high water makes it necessary. Recent soil borings have shown the water to be three feet higher than in 1984. He also stated that one excavation may drain the other sites, making the variance unnecessary. The variance will only be used if it is shown to be necessary. There are two recommended conditions of approval. The Commission determined that a third condition should be added, allowing a maximum of five feet in the difference between setbacks of adjacent lots. Motion by Gary Funke to aprove the variance request with three conditions. Seconded by Glenna Bealka. All in favor. Case No. V/91-40 - The applicant has requested a continuance to the September meeting. Case No. VJ91-41 - A Variance to the frontyard setback requirements (sixteen feet, three inches requested, thirty feet required) for the constrution of a single family home on the east side of Riverview Drive (next to 1419 Riverview Drive). 1 Stillwater Planning Commission Minutes August 12, 1991 Doug McNamara of Robert H. Mason Homes presented the application, along with Clifford and Donna Fearing, property owners. There are five recommended conditions of approval. Mr. McNamara stated that condition No. 1 as written may be impossible as the foundation has not yet been engineered and he does not know how much working area will be needed. He agreed that the area will be as undisturbed as possible, and that the trees will be fenced and erosion control fences erected during construction to preserve the site. The Commission agreed to add "to the maximum extent possible" to the first condition. Condition No. 2 was amended also, with "erosion control plan" added. Condition No. 6 was added: "The City Engineer shall review the site plan and storm sewer drainage initiated by the site plan". Motion by Rob Hamlin to approve the Variance request with six conditions as discussed. Seconded by Duane Elliott. All in favor. Case No. SUP/91-42 - A Special Use Permit to conduct a commercial entertainment concert studio at 116 East Chestnut Street in the CBD, Central Business District. David G. Peterson, property owner, presented the application. He explained that the downstairs area of Water Music has been used for lessons and recitals and he wishes to use the area for small concerts in the evening. Building and fire inspections have been made and the recommended changes have been completed. He also stated that he has no intentions for a future restaurant use, but plans to serve only items such as coffee and cookies with a .L L M .L 6 c.A J. V 0 U There was discussion of the parking situation, and it was determined that if the concerts are held on the weekends or after 6 p.m. on weekdays, there would not be a parking problem. There are four recommended conditions of approval. Motion by Gary Funke to approve the special use permit with four conditions. Seconded by Duane Elliott. All in favor. Case_ No. V/91-43 - A Variance to the Sign ordinance for the construction of a sign twenty eight inches in height (twenty four inches allowed based on River Heights Plaza Sign Program) located at River Heights Plaza. Shannon Grady, of Sign Services, presented the application. He is concerned that, because of the number of letters in the sign, a 24 inch sign would not be legible from Highway 36. He also stated that the JC Penney Catalog Store was granted a variance. K Stillwater Planning Commission Minutes August 12, 1991 Mr. Russell explained that the Penney store had to be differentiated from a JC Penney retail store because of customer confusion and was allowed to add the Catalog Store sign. The Commission was concerned that approving this variance would set a precedent for other new stores in the center. Motion by Councilmember Funke to deny the variance request. Seconded by Duane Elliott. All in favor. Case Na. V/91-_44 - A Variance to the Sign Ordinance for the placement of a forty five square foot monument sign approximately twelve feet from the street at 1826 Tower Drive, Janet Jezior presented the application. An existing shrub will be removed for placement of the sign. The sign will be 8 or 8- 1/2 feet wide. She feels the 12 foot location will give better visability to the sign from Tower Drive. Members of the Commission felt that placement of the sign at the 15-feet allowed by the ordinance would be adequate and that there would be sufficient room for the sign at 15 feet. Motion by Duane Elliott to deny the variance request. Seconded by Rob Hamlin. Motion to deny carried 3-2 (G. Bealka and G. Funke opposed). OTHER Vacancies on the Planning Comission - There are currently two vacancies on the Commission. The Commission reviewed eight applications which have been received. One applicant was immediately excluded because of membership on another commission. Each Commission member chose four applicants whom they would like to interview. There were five applicants receiving an equal number of votes. Those applicants will be interviewed by the Commission before next month's meeting at 6:30 p.m. on September 9. The Commission will then recommend two of the applicants to the City Council for membership. Motion by Rob Hamlin to recommend adoption of the Flood Plain Ordinance by the City Council. Seconded by Duane Elliott. All in favor. Review of Sign Ordinance.- The Commission reviewed a report on sign variance requests. There was discussion of allowing more square footage on freestanding signs, possibly based on the amount of square footage of the building. 3 Stillwater Planning Commission Minutes August 12, 1991 The Commission noted that the City requires all businesses to post their street address. It was suggested that this requirement be more strictly enforced. Motion by Rob Hamlin to recommend that the City Council enforce the street address ordinance for all businesses and residences. V/91-47 Planning Commission Meeting: September 9, 1991 Project Location: Just west of Highway 95/96 intersection. Flood Plain: No Bluffland/Shoreland District: Yes Applicant's Name: Kenneth Seefert Type of Application: Variance PROJECT DESCRIPTION A-Variance_to evelopment Bluffland/Shoreland Ordinance requirements for installation of a sanitary sewer system on slopes of over 12%. DISCUSSION The site is located in the Riverway District north of Highway 96 and can not be seen from the St. Croix River. (See attached location map.) The application is to construct a single fa;nily,house requiring an on -site septic system. No City sewer service is availaUle to the area. The on -site septic system would be located on land that has slopes of greater than 12%. The Bluffland/Sinoreland Ordinance does not allow structures on slopes of greater than 12`). (See attached letter from the DNR. ) The proposed site for the on --site sewer system, as shown on the attached map contains slopes of greater than 12%. There are other locations on the lot of slopes of less than 13% that could accommodate the on -site system. In a related application, the owner has requested a lot split separating the 11.29 acre lot into two lots of 4.96 and 6.33 acres but has not met the conditions of the lot split approval. For purposes of this review, the entire 11.29 acres is considered as one lot. (A copy of the Conditions of Approval for the lot split, SUB/91-17 is attached.) The installation of the sanitary sewer system on the sloped area can meet all PCA requirements for on -site sewer systems and conditions of approval are proposed to minimize the impact of the installation on the site. According to the Bluffland/Shoreland Ordinance in considering a variance, the following factors shall be considered. 1. Preserving the scenic and recreational resources of the St. Croix Riverway, especially in regard to the view from and use of the river. 2. The maintenance of safe and healthful conditions. 3. The prevention and control of water pollution, including sedimentation. 4. Tile location of the site with respect to floodways, slopes and blufflines. 1 5. The erosion potential of the site based on degree and direction of slope, soil type and vegetative cover. 6. Potential impact on game and fish habitat. 7. Location of the site with respect to existing or future access roads. 8. The amount of wastes to be generated and the adequacy of the proposed disposal system. 9. The anticipated demand for police, fire, medical and school services and facilities. 10. The compatibility of the proposed development with uses on adjacent land. A review of the request, area, and site conditions indicate the following findings can be made: 1. The scenic and recreational resources of St. Croix would be preserved because the site is riot visible from tine river and no recreation resources are located in the area. 2. Minnesota PCA requirements for septic system will be met and access to the site is already provided. 3. As conditioned, based on project approval, water quality will be preserved and erosion minimized. 4. The site is not in a floodway or a bluffline - a portion of the site is in slopes of greater than 12%. 5. As conditioned, site erosion will be minimized. 6_ The site is within an urban area_ City of Stillwatpr_ nnp hnusP nn 11.29 acres will minimally impact the habitat. 7. Currently access is adequately provided to the site. 8. An on -site septic system would meet PCA requirements. 9. Garbage services are provided to City residences. 10. The single family use is consistent with existing area land use and zoning. VARIANCE FINDING: The property owner did not cause the hardship which is unique to the site because of topographic conditions. The request is for a reasonable use of tree property. The proposed will not alter the essential character of the locality. RECOMMENDATION: Approval with conditions. 2 fr CONDITIONS OF APPROVAL: 1. A drainage and erosion control plan to minimize on -site erosion shall be submitted and approved by the Community Development Director before plumbing permits for the septic system is issued. 2. All tree removal for the residence and on -site septic system shall be shown on the site plan and reviewed and approved by the Community Development Director before building permits arka issued. The DNR does not have to formally certify this subdivision, because under the current rules, a subdivision is division of property into three or more lots. We do, however, have some concerns about this property due to slope conditions. I have visited parcel B, and have seen parcel A from parcel B. Neither parcel contains very much land which is less than 12% slope. The slopes would not be considered blufflines, since the property is screened by topography from the river. Variances would undoubtedly be needed for structures, and possibly septic systems, given the slope conditions. Hardship would be extremely difficult to demonstrate, since the problem is create3 by the landowner. Section 701.01 of the bluffland model code prohibits subdivision of land which has, among other things, "unfavorable topography". If the property is allowed to be subdivided, and subsequent property owners apply for a variance to build on a 12 % or greater slope, it is questionable whether the variance could be granted due to the self-created hardship issue. DISCUSSION: The request is to upgrade most of the signage at the Lakeview Memorial Hospital/St. Croix Valley Clinic site. This sign plan includes a free standing and wall identification signs, directional signs and regulatory signs. It also includes new emergency signage along Greeley Street. Tne new sign plan includes the use of the Lakeview Memorial Hospital logo for a unified affect throughout the site. As stated in the proposal packet and site plan, the signs in general meet the goals to enhance movement through the property. The following are comments which could reduce some of the signage. - The "Emergency/Patient Parking Only" signs could be combined for two parking spots with arrows identifying the parking spots. - The "Reserved for Doctors" signs could be reduced with arrows identifying to parking spots. - The "Cancer Care" and "I Can Cope" signs could also be reduced as stated in the above comments.' A detailed landscape plan was not included in the packet. Before permits are issued, this plan should be submitted to the Planning Department. CONDITIONS OFAPPROVAL: 1. A detai-led landscape plan for the signs along William Street and Greeley Street shall be submitted to the Planning Department for review and approval before a sign permit is issued. Attached is the Sign Ordinance that was in effect when CUB was approved (pre i988 Sign Ordinance Amendment). I have also drafted some additions to the Sign Ordinance regarding multi -tenant commercial developmentsand directory signs. The existing Sign Ordinance does not treat these subjects and we have had requests for such signs requiring a variance. The Commission can consider the amendment and decide if you would want to add it or other changes to the Sign Ordinance. (20) Advertising signs shall not be located closer than three thousand (3,000) feet to any other sign on the same side of a street or highway. Advertising signs are only permitted after the issuance of a conditional use permit. (21) Multi -faced signs shall not exceed two (2) times the allowed square footage of single -faced signs. (22) No sign that exceeds one hundred (100) square feet in area shall be erected or maintained: (a) Which would prevent any traveler on any street from obtaining a clear view of approaching vehicles on the same street for a distance of five hundred (500) feet. (b) Which would be closer than'one thousand three hundred fifty (1,350) feet to a national, state or local park, historic site, picnic or rest area, church or school. L• POSSIBLE SIGNORDINANCE CHANGES Multi -Tenant Master Sign Program for multi -tenant commercial buildings: A building master Sign Program shall be required, besides the individual tenant and occupant signs, a building master identification sign may be permitted according to the following requirements: 1. Building master identification signs shall not contain the names of any tenants or occupants of the center. 2. If the multi-cenanz, commercial building has a floor area of forty thousand (40,000 square feet or less, the building may have a freestanding sign with a mar.imum of one ( i ) square feet of sign for each five (5) feet of building frontage. 3. If the multiple tenant commercial building has a floor area greater than forty thousand (40,000) square feet, but less than the one hundred thousand (100,000) square feet, then the center may have a master identification sign with a maximum of seventy five (75) square feet on each side and with a height of twenty (20) feet. 4. If the multiple tenant commercial building has a floor area of greater than one hundred thousand (100,000) square feet, the center may have a master identification sign with a maximum area of one hundred and twenty square feet (120) on each side and a maximum height of twenty five (25) feet. 5. No individual shop or business within a multiple tenant and commercial building shall have a freestanding sign. DIRECTORY SIGNS Directory signs are used to guide pedestrians to individual business within a multiple tenant commercial building. 1. Placement - a. must be placed on the site of the development b. shall be erected only in internal pedestrian access areas and not in vehicle access areas c. directory signs area to be used for the purposes of direction and identification only. 2. Area - A directory sign may have a maximum area of one (1) square foot for each business listed on the sign and four (4) square feet for the name of the building or complex. 3. Directory signs may be freestanding but shall not exceed five and one half (51) feet in height. 4. Directory signs shall be non -illuminated, illuminated only by indirect light.
