Chairman Fontaine called the meeting to order,
APPROVAL OF MINUTES
Motion by Duane Elliott, seconded by Warren Pakulski, to approve
the minutes of September 17, 1990 as submitted. All in favor.
RCM ZONING AMENDMENTS
1. RCM, Medium Density Multiple Family Residential District -
Study results and zoning amendment recommendations.
Assistant City Planner, Ann Pung-Terwedo, gave a presentation on
the recent land use study in the RCM district and the Zoning
amendments recommended as a result of that study. The study found
that the majority of the homes in the district are currently
single family homes built before 1900. Many of the structures
require rehabilitation. Staff recommends that the district be
rezoned to RB, Duplex Residential, and a new zoning designation,
PA, Public Administrative Office. The rezoning would be more
restrictive, and would set the density at lower levels to
maintain the character of those districts.
Chairman Fontaine asked for comments from the audience. Richard
Kilty questioned why lot 37 (St. Mary's Church block) would be
rezoned PA instead of RB. The Commission determined that this lot
should be rezoned RB.
There were also questions from owners of multiple family
residences regarding how the rezoning would affect their
property. The property owners were informed that their residences
would be "grandfathered in" and that the rezoning would not
affect their property unless it was sold.
The Commission also discussed whether to include retail u-se in
the new PA district and determined that retail should not be
included.

adding a new Public Administrative Office District, PA, to
the Zoning ordinance Land Use Designations. City of
Stillwater, Applicant.
Motion by Warren Pakulski, seconded by Angela Anderson to
approve the Zoning Ordinance Text Amendment with the
elimination of retail use. Motion carried 5-0.

designating certain zoned lands from a RCM Multi -Family
Residential designation to PA, Public Administrative Office.

Motion by Judy Curtis, seconded by Warren Pakulski to approve
the Zoning Ordinance Map Amendment. Motion carried 5-0.
PUBLIC HEARINGS
Case No. v 90-60 - Variance to the sideyard setback requirements
(twelve feet requested, twenty feet required) for the
construction of an attached garage at 322 West Churchill Street
in the RB, Two Family Residential District.
Duane Arndt, property owner, presented the request to remove the
existing garage and attach a two -car garage to the rear of the
house. The home is approximately 135 years old, and the proposed
garage will be architecturally correct. Because of two large
spruce trees on the property, this is the only location for the
new garage.
The Commission felt that putting the garage at this location
would cause a problem because any cars parked in the driveway
would extend out into the sidewalk. It was felt that, from a
safety standpoint, it would be preferable to remove the spruce
trees and build the garage farther back.
Motion by Judy Curtis, seconded by Angela Anderson to deny the
Variance request as proposed. Motion carried 5-0.
C,3se N(�.y/90-61 - Variance to the Parking Ordinance for a
residential/commercial building at 220-224 East Chestnut Street
in the CBD, Central Business District, Historic Commercial
District.
Shawn Otto presented the application. He is proposing to restore

the building at 220-224 East Chestnut Street for first floor
commercial/office space and second floor residential or office.
The parking requirement is 13 for the commercial and residential
use, and would be 16 if the second floor is used as office
space. There is no on -site parking, and Mr. Otto feels it will be
difficult to rent the space as a residence without on -site
parking.
There are four recommended conditions of approval which the
applicant agrees to.
Motion by Duane Elliott, seconded by Warren Pakulski to approve
the variance request with four conditions. Motion carried 5-0.
Case No. LiPIVfDI 90---62 - Special Use Permit, parking, sign
variance, and design review for the construction of a train depot
and parking lot at 601 North Main Street in the RB, Two Family
Residential District, Flood Plain, FP, Downtown Plan District.
David Paradeau, owner of the Minnesota Zephyr, presented the
application along with his general manager and general contractor
for the proposed site. The project is also awaiting approval from
MNDot and Burlington Northern.
There was discussion of the eight recommended conditions of
approval. Condition No. 4 was amended to require a revised
landscape plan if the current plan is not approved by MNDot. The
Commission also suggested that more natural landscaping be used.
Motion by Warren Pakulski, seconded by Angela Anderson to approve
the Special Use Permit with eight conditions as modified. Motion
carried 4-1 (Judy Curtis opposed).
Case No. ZA.M/90-5 - Zoning Ordinance Map Amendment changing the
zoning of three fourths acre of land from residential duplex, RB,
to CBD, Central Business District located between the railroad
and Main Street, north of Laurel Street. City of Stillwater,
Applicant.
Motion by Warren Pakulski, seconded by Duane Elliott to appprove
the zoning amendment. Motin carried 5-0.
OTHER
Case No. D /90-7 - Design review for the placement of a temporary
fence at 102 North Second Street in the CBD, Central Business
District, Historic Commercial District. No action was taken.
Chairman Fontaine asked that Planning Commission members call him
or Steve Russell any time they are unable to attend a meeting.

SUBJECT: NORTH WILLIAM STREET LAND USE/PUBLIC FACILITY STUDY
BACKGROUND:
At the COlancil meeting of September 18, 1990, the City Council received a
request to use North William Street for access to vacant Lots 6 and 7. The
vacant lots combined contain 12,000 square feet. In the RB Duplex Residential
District this size lot could accommodate a single family dwelling or duplex.
Besides the property owner, several residents who live in the area appeared
at the Council meeting and expressed concerns for the sewer services along
Linden, the impact of a new dwelling unit on the site, the maintenance of the
vacant lots, the potential for additional development using North William
Street for access. The property owner indicated he had purchased the property
many years ago for development.
Based on the comments, the Council felt additional information and study was
necessary to make a decision on the request and referred the request to the
Planning Commission to address the concerns.
STUDY
A Land Use Study was conducted to examine existing land uses in the area and
determine the potential for additional vacant lot development along North
William Street. The vacant lots are relatively flat and overgrown with
vegetation. A ravine runs along the north portion of the study area. Portions
of the most northerly vacant lots have been filled.
A land use map is attached showing existing land use and vacant sites. Beside
the vacant parcel requesting access, two or three additional lots, depending
on ownership, have potential for development based on existing RB zoning
requirements. (See land use map.)
North William Street, south of West Linden Street, has a sixty foot
right-of-way. North of Linden the east half of the right-of-way has been
vacated for 125 feet. Then the right-of-way increases to the original sixty
feet. The thirty foot right-of-way cannot accommodate a new local street that
constructed to City standards.
Water and sewer services are located in West Linden Street. According to the
Water Department and Public Works Department, there is adequate capacity to
accommodate the requested one lot development or a potential additional three
lots. The area would slope to the northeast into a lower ravine running
east/west just south of Laurel Street.

ANALYSIS_
In the study area, three or four vacant lots could develop in time. Access to
the lots would be off North William Street. To service the four lots, access
would be provided over the North William Street right-of-way and utilities
would be extended from Linden Street.
The City utility departments recommend a twenty four foot street minimum, six
inch water line and eight inch sewer line. A fire hydrant and man►iole would be
located at the ends of the lines.
RECOMMENDATION:
A] ow use of North William Street for access to lots 6 and 7 subject to the
following terms:
1. The twenty four foot street shall be constructed according to City
standards extending from Linden Street to the north boundary of lot 6.
2. An eight inch sewer main and manhole shall be constructed extending
from 'Jest Linden Street to the north boundary of lot 6.
3. A six inch water main shall be extended froi7 West Linden to the north
boundary of lot 6. A fire hydrant shall be located at the end of the
line according to the Water Department standards.
4. Any development on the vacant lots shall meet all zoning requirements.

I am the owner of Lots 6 and 7, Block 11, Sabins Addition to
Stillwater.
Williams Street, which runs North and South, and which is30 feet
in width, North of West Linden Street, is the access street to my Lots
6 and 7, and which is unimproved.
Each lot is 50 feet in width and 120 feet in depth for a total
property size of 100 x 120 feet, on which I wish to build.
Water and Sewer are available in West Linden Street.
I request that the Stillwater City Council grant me permission to
use the Westerly 30 feet of North Williams Street as a driveway access
to Lots 6 and 7, Block 11, Sabins Addition.
I enclose a plat of Sabins Addition, in which includes the lots
that I own.

SUBJECT: REQUEST TO USE A PORTION OF NORTH WILLIAMS
UNIMPROVED RIGHT-OF-WAY FOR DRIVEWAY ACCESS TO
VACANT LOTS 6 AND 7.
The request is to use the thirty foot west portion of North
William Street, north of Linden Street, to provide access
to a vacant 12,000 square foot lot (Lots 6 and 7). The lots
meet the size requirements for the R-B District and are
flat with overgrown vegetation. Development regulations
require that lots must have access to an improved public
road.
Adjacent property owners have been notified of the request.
If the request is approved, a license could be issued to
property owners to use the right-of-way for a driveway,
subject to possible future use for a public street.
RECOMMENDATION: Approval.

DISCUSSION:
The request is to resubdivide the original Cottages of Stillwater Subdivision
into three lots. One lot, Lot 1, would house a 49 unit senior apartment
project, a senior center would occupy one lot, Lot 2 and Outlot "A". Outlot
"A" does not have access according to the development plan which is a'concern
unless Outlot "A" is combined with Lot 1 or the Erickson Post commercial lot
on the corner of Orleans Drive and County Road 5 or combined with Lot 1 until
development plans for the area are proposed. Access to the Outlot must be from
Orleans and not County Road 5.
A previous subdivision request for a portion of the original Cottages of
Stillwater subdivided area has been approved but not recorded so the remainder
of the site must be either finally subdivided or designated as an Outlot for
purposes of this subdivision.
As shown on the preliminary plat, a utility easement bisects the property.
This is necessary to provide sewer services to the area. A utility drainage
easement is shown in the northwest portion of the site. This is for the
existing pond detention area..
Other six foot drainage easements should be provided along all property
boundaries.
A utilities easement also may be necessary to provide sewer service to the
Outlot "A" once development is proposed.
The utility plan and grading plans are being reviewed by the City departments
and City Engineer for comment.
CASE NO. SUB/90-53 - Continued.
RECOMMENDATION:
Approval with conditions.
The final plat shall incorporate the following comments.
1. The remainder of the subdivision area (Heritage Development project
area) shall be finally platted or designated an Outlot.
2. The area designated as Outlot "A" shall be combined with the Erickson
Post lot or Lot 1, to make sure access off of West Orleans Street can
be provided to the site when it develops without access to County Road
5.
3. Additional six foot drainage easements shall be shown on both sides of
all property boundaries.
4. Any comments from Washington County Development, City Departments and
the City Engineer shall be incorporated in the final plat.
5. A grading permit shall be required before construction begins. The pond
easement area shall be improved according to overall plans for the
pond.

PROJECT DESCRIPTION:
Request For PUD Amendment for a 49 unit senior housing project and 7,000
square foot senior center.
DISCUSSION:
The request is to amend the previously approved Planned Unit Development
concept for the site by changing the use from a commercial center to senior
housing and senior center.
The project is divided into two parts, a 49 unit three story apartment
building and a 7,000 square foot senior center. The 49 units are situated on a
3.9 acre site resulting in a density of 12.6 DU/acre. 107 parking spaces, 57
garages are provided for the 49 one and two bedroom housing units are
provided. 98 are required. Beside the senior center next door, open space
areas are provided to the north, south and east of the apartment structure.
Decks are provided to with most of the units.
A landscape plan shows the landscaped area in grass with some trees and
bushes. It is recommended that additional evergreen trees be planted along the
west boundary of the site and the coomunity center parking lot be screened by
land form, berming, or planting a hedge and trees to screen the lot and
headlights from the residential project.
The apartment building material includes lap -siding, asphalt shingles, wood
balconies. A special entry design connects the apartment structure to the
parking lot.
It is recommended that an arbor with vines be added to more visually connect
the apartment project to the community center and add an attractive
design/landscape element to the project. A similar design shade structure
could be added behind the senior project.
The senior center is comprised of offices and a multipurpose room. The design
of the senior center building is consistent with the apartment project. 61
parking spaces are provided, including three handicapped spaces. More
handicapped spaces may be needed but that adjectment to the parking can be
provided as needed.
Sign locations are snown on the site plans but no sign detail. The signs
should below profile wonument type signs using similar colors and materials as
the project with landscaping at the base of the signs.
Trash areas and utility areas are not shown on the site plan. Trash areas
must be located from public view and enclosed or completely screened.
RECOMMENDATION:
Approval wif_conditions.

1. The landscape plan shall be modified by adding evergreens along the west

1) Access roads to this project do meet minimum width requirements
(20 ft.), but do not meet distance requirements of the Uniform
Fire Code. Both access roads exceed 150 feet and are dead ended.
Turn around areas or looping of these roads should be provided to
satisfy these requirements.
2) There should be street or yard hydrants provided for boosting of
sprinkler system and hardline use. One (1) per location.
O> The building housing the mixed occupancy has only one area that
is large enough to classify as an assembly area (marked

Dear Mr. Russell,
Enclosed you will please find our application for a special use
permit to convert existing office space into three one bedroom
residential units.
The first unit we would like to convert as soon as possible, is
located at 115 South Union Street. This unit, originally a
residential, unit was converted to an office several years ago.
This space is currently occupied by the Community Volunteer
Service until October 31, 1990. I believe the highest and best
use for this property would be as a residential unit. There is
virtually no demand for this type of property for use as an
office. Normally there are approximately four people working in
this office during the day. This means that they require four
parking spaces. If we convert this unit to a one bedroom apart-
ment, the demand for parking would most likey be reduced to one
parking space. It has been my experience that most of the
apartment renters downtown work 'days, therefore requiring a
parking space from approximately 5:00 pm to 7:00 am when there
is less pressure on the available parking.
The other two units would be at 118 South Main Street on the
second floor. This space is currently being used as office
space, but will be vacated in the next few months. There is no
demand for second floor office space of this type in downtown
Stillwater. Here again, I am sure that the best use for this
property would be as residential rental units. As you probably
know many sources, including the Washington County HRA, have
stated many times that there is a need for lower priced rental
units in this area. The type of units we are asking permission
to create would fall into this category. Rents would be less
than $400.00 per month including heat. If this space is
occuppied as office space there is the potential demand for four
to eight parking spaces. If used as two one bedroom rental
units the demand for parking most likely would be two spaces.

In closing I would recap by saying that by converting this
existing office space to three one bedroom residential rental
units we would accomplish three positive things.
1. Sinificantly reduce the demand on public

time when there is less demand.
2. Provide low cost housing.
3. Use the property for its highest and best use.

PROJECT DESCRIPTION:
The request is to resubdivide -two lots of 29,624 square feet and 21,537 square
feet into lots containing 26,946 and 24,215 square feet.
DISCUSSION:
The City of Stillwater previously granted the owners of three vacant sites
(Gould, Troyer and Hubbard) south of the Hazel Street Park Road permission to
use the road for access to the vacant lots. The property owners will be
responsible for improving the park road when it is needed.
The request before the Council is for a resubdivision of the Troyer parcel and
Hubbard parcel. The resubdivision provides a thirty foot shared roadway
easement connecting both lots to the park road.
The new lots (26,946 square feet and 24,215 square feet) meet the lot size
requirements for lots not on the City sewer system. Soil surveys showing that
both sites have soils suitable for on -site septic systems have been submitted.
The proposed lot shapes are irregular but result in a buildable lot and
recognize the topographic constraints of the site.
RECOMMENDATION:
Approve
CONDITIONS OF APPROVAL:
i. Driveway improvements, plans including drainage improvements, and
specific septic system plans shall be approved by the City before
construction of the driveway access or building permits are issued for
the residences.

When referring to the attached surveys please note that the
Preliminary Survey is how the ownership lies presently. And the
final survey shows the ownership after transfer of certain
parcels. The area outlined in pink is owed by the Troyers and
the area outlined in yellow belongs to the Hubbards.
Re: Lot 6, Block 44
In order to make Lot 6 a buildable lot with access to a public
street, and land on which to put a septic system we are
requesting approval to add part of vacated Willow St. and part of
vacated 3rd St. adjacent to this lot as shown on the attached
surveys. The attached perc tests were done on that part of
vacated Willow which we are acquiring since it is the only level
land available to locate a septic system.
This will also give us frontage on Block 47, which is a park
owned by the City of Stillwater and access to the park road. We
have entered into an agreement with the city regarding use and
maintenance of this roadway.
The added land also helps this lot meet the 20,000 square feet
requirement for a buildable lot.
Re: Lot 3, Block 46
We are requesting approval of the addition of portions of vacated
3rd and Willow Streets to Lot 3, Block 46 of Carli &
Schulenburg's addition. The addition of this land will provide
access to this lot from the park road mentioned above, and will
provide the needed land to build a driveway.
It is proposed that a common driveway be built to both lots along
the diagonal line dividing vacated Willow St labeled "roadway" on
the survey.

The reasons for adding on to our garage are twofold: We
would like to add a recreation room without changing the
structure of our home. Our house was built in the 1000s
and we would like to preserve the original structure.
Since the house does not include a full basement or attic,
we do not have a family room for ourselves and our
children. By adding on to the garage instead, we could
leave the original house unchanged.
The second reason is cosmetic. Our three car garage is
modern looking with a low ceiling and does not match the
Victorian look of our house. By raising the roof and adding
dormers, we could better match up the garage to look like
the original house. We think this v7ould certainly add to
the beauty of our home and the neighborhood in general.

A Special Use Permit for a three room Bed and Breakfast.
DISCUSSION:
The request is to establish a three guest room Bed and Breakfast. Tne
applicants have stated their intentions are to run the three guest room inn
under a new name, "The Summit Place". The owner/manager will reside in the
home. Only breakfast will be served as the basic compensation. The home is
located on an 85,000 square foot lot overlooking Pioneer Park.
The site plan shows that all guest parking will be on -site leaving Laurel
Street open for public parking. Access to the site will be from Second Street,
as shown. A new sidewalk is also shown. A section of the s sidewalk is on
private property.
No sign plan has been submitted for the use but the sign location is shown on
the site plan. The applicants are allowed an identification sign not exceeding
four square feet.
The home is located within three blocks of another approved Bed and Breakfast
site. They have a Special Use Permit to conduct a two room Bed and Breakfast
at 102 East Cherry Street. The Bed and Breakfast Ordinance prohibits Bed and
Breakfasts within three blocks. This was integrated into the Ordinance for two
reasons. One, the preservation of residential neighborhoods was the greatest
concern. Commercial uses have an impact on those residents due to an increase
in traffic and pedestrians. Two, a majority of the lots in the RB and RCM
zoning districts do not have excess space for additional parking. It is not
City policy to allow on -street parking for commercial use. This site is an
exception due to its large lot and its location next to Pioneer Park away from
neighboring residential structures. Based on these characteristics, the home
at 210 East Laurel Street is an excellent site for a Bed and Breakfast. It is
set apart from the neighborhood and is large enough to accommodate parking,
its location next to Pioneer Park and the historical architectural integrity
of the structure creates a wonderful setting for a Bed and Breakfast.

7. The Special Use Permit shall be reviewed by the Planning Commission upon
complaint.
8. The structure shall be inspected by the Fire Marshal, Building Official
and Health Officer as required by such a use before the Bed and Breakfast
begins operation.
9. A sign permit application shall be submitted for the business and
approved by the Community Development Director.
10. No additional signage shall be located on the site.
11. The Bed and Breakfast shall connect to City sewer service by May 1, 1991.

have always said that 1 was a Minnesotan
by birth, education, and choice. Among my
many youthful memories are the three years
at Carleton College where I majored in
mathematics and secured my B.S. degree in
1908. Today 1 would be at a loss to solve
even the simplest problem in calculus, yet 1
vividly remember the rhetoric that Seeley
K. Tompkins taught.
1 have never had delusions about the ease
of writing. It is plain, hard work. Just a few
days ago a friend picked up a copy of my
latest publication Herbert Hoover, Buy AN.

1 did not dash it oar. I had written it ma-

hundred lines, I thought the job simply could

Because I had been trained at Carleton to
become it teacher, I became one. As it high
schoul instructor, I spent two years teaching
ten subjects in Caledonia, Minn., and three

Stillwater. 1 then taught for a year in Rap-
id City, S. D.
During these gay, carefree years 1 saved
enough money to spend three months in
Europe. The trip was arranged by a Carleton
professor. Illy college background gave en-
joyment to all the sights — the ships at Glas.

DREAM COMES TRUE
1 saw Stillwater, Minnesota, for the first
time on a glorious fall day when the river
was bluer than the sky and the Wisconsin
hills were a bright tapestry. I said, "I'm go.
ng to live here all my life." Illy dream came
true, in a wily, for almost thirty years. I
married Hollis Murdock Comfort of an old
Stillwater family of lawyers. In the big
