CITY OF STILLWATER
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION VACATING THE DRAINAGE AND UTILITY EASEMENTS
IN LOTS 2 &3, BLOCK 1, RIVARD ADDITION
CASE NO. 2019-08
WHEREAS, Mark J. Guenther, President, Fenway Land Company, Inc., owns Lot 2
and 3, Block 1, Rivard Addition,Washington County, Minnesota ("Property");
WHEREAS, drainage and utility easements presently encumber the Property;
WHEREAS, Mark J. Guenther submitted an application to have the Property
replatted as part of a new plat known as MARYLANE MEADOWS ("Final Plat");
WHEREAS, in connection with the Final Plat,the existing drainage and utility
easements encumbering the Property were requested to be vacated as depicted on Exhibit
A attached hereto;
WHEREAS, it is in the public's interest to vacate the drainage and utility easements.
NOW,THEREFORE, BE IT RESOLVED,that the City of Stillwater hereby vacates the
drainage and utility easements encumbering Lot 2 and 3, Block 1, Rivard Addition, as
depicted on Exhibit A effective as of the date of this Resolution; and be it further
RESOLVED,this Resolution shall constitute a notice of completion and the City Clerk
is hereby authorized and directed to file this Resolution with the office of the County
Auditor to be entered into the transfer record and then record it with the office of the
County Recorder.
Adopted effective as of 2nd April 2019.
