HomeMy WebLinkAbout2019-042 (preliminary plat for Valley High Estates 2nd addition (Case No. 2019-07)) RESOLUTION NO. 042 CITY OF STILLWATER WASHINGTON COUNTY, MINNESOTA A RESOLUTION APPROVING THE PRELIMINARY PLAT FOR VALLEY HIGH ESTATES 2ND ADDITION CASE NO. 2019-07 WHEREAS, Scott and Michelle Lindquist have submitted an application for approval of a three-lot single family residential preliminary plat known as VALLEY HIGH ESTATES 2ND ADDITION; and WHEREAS, the subject property is legally described as: Lot 8 Block 1,Valley High Estates,Washington County, Minnesota; and WHEREAS,on March 27, 2019 the Planning Commission held a public hearing on the preliminary plat and on a unanimous vote recommended that the City Council conditionally approve the preliminary plat; and WHEREAS, on April 2, 2019 the City Council held a public hearing on the preliminary plat and found it to be compatible with the neighborhood and consistent with the City's Zoning Ordinances, Subdivision Ordinances, Comprehensive Plan,and infrastructure. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby approves the preliminary plat of VALLEY HIGH ESTATES 2ND ADDITION with the following conditions: 1. The site shall be developed in substantial conformance with the following plans on file with the Community Development Department,except as may be modified by the conditions herein: • Preliminary Plat dated 2/11/19 • Preliminary Plat Conceptual Grading Plan dated 2/11/2019 2. All future electrical and communications utility lines shall be buried. 3. The existing accessory structure shall be removed or relocated to Lot 1 prior to the release of the Final Plat. 4. The developer install a construction barrier along Boutwell Road North, limiting construction traffic to the 16' driveway access. 5. The trail shall be restored to pre-construction conditions. 6. Conservation easements for all Lots will be required to be filed with the final plat for all wetlands and wetland buffer areas. These must be submitted to Page 2 of 2 the City for approval of form and content together with final plat application materials. 7. The boundaries of the wetland/pond buffers must be signed according to Brown's Creek Watershed District rules 8. The documents necessary to vacate the existing drainage and utility easements must be signed by the land owner prior to release of the Final Plat from city offices, and then filed together with the new plat. 9. If determined acceptable by the Park and Recreation Commission,this development will be responsible for paying dedication fees to the City for park and trail dedication fees. These fees will be due prior to release of the final plat from the City for recording with Washington County. 10.This development shall be responsible for paying 2019 development impact fees including the trunk sewer and water and connection fees for the new and existing residences. Rates may be adjusted,annually. These fees shall be due prior to release of the final plat for recording with Washington County. 11.The rezoning will not become effective until after the Final Plat is approved by the City and filed with Washington County for recording.
