Mayor Kozlowski called the meeting to order at 7:02 p.m. Present: Mayor Kozlowski, Councilmembers Collins,Junker and Weidner Absent: Councilmember Polehna Staff present: City Administrator McCarty City Attorney Land Community Development Director Turnblad Fire Chief Glaser Public Works Director Sanders Finance Director Provos City Clerk Wolf PLEDGE OF ALLEGIANCE Mayor Kozlowski led the Council and audience in the Pledge of Allegiance. PETITIONS, INDIVIDUALS, DELEGATIONS&COMMENDATIONS There were no petitions, individuals, delegations or commendations. OPEN FORUM There were no public comments. STAFF REPORTS Public Works Director Sanders reported that the National Weather Service indicates there is a 99%chance of the St.Croix River going to minor flood stage or 687 elevation,and a 90% chance of reaching major flood state or 689 elevation. He showed a map where a dike will be built along Lowell Park. He reported that the Minnesota Department of Transportation is removing their equipment and scaffolding from the lift bridge. The lift is not working so they are making modifications to raise the bridge to allow any ice or dead logs to go through. He provided a map showing parking lots that will be closed off during flooding.Volunteers will start sandbagging Thursday. If all goes well it will take three days to build the wall. Community Development Director Turnblad stated those who have a $20 monthly parking permit for one of the closed lots may come to City hall and get a temporary pass to park in the parking ramp. River Market customers may park in the upper level (Second Street entrance) at the Crosby Hotel. City Clerk Wolf stated that the volunteer slots for sandbagging filled within a few hours and businesses are contributing food for the volunteers. City Council Meeting March 19, 2019 Mayor Kozlowski thanked the Washington County Board for setting up the recent emergency management training. City Administrator McCarty reminded the Council of the League of Minnesota Cities Annual Conference in Duluth June 26-28. He reported that the Highway 36/Manning Avenue Interchange funding request is making its way through the State Legislature. CONSENT AGENDA March 5, 2019 regular, recessed and closed session meeting minutes Payment of Bills New Wine and Strong Beer Liquor License for La Carreta Resolution 2019-031, resolution amending Resolution 2018-173 adopting 2019 Fee Schedule Resolution 2019-032, resolution approving Lease of dock space from St. Croix Boat& Packet Resolution 2019-033, a resolution denying a Zoning Text Amendment to the RB Two- Family Zoning to allow a minimum width for Two-Family Properties, CPC Case No. 2019-03 Purchase of Loader for Public Works Department Resolution 2019-034,approving 2019-2020 Labor Agreement between City of Stillwater and International Association of Firefighters Motion by Councilmember Weidner,seconded by Councilmember Collins,to adopt the Consent Agenda.All in favor. PUBLIC HEARINGS There were no public hearings. UNFINISHED BUSINESS Resolution denying CVII Holdings Inc Conditional Use Permit for the Historic Armory Community Development Director Turnblad stated that at the last Council meeting the Council reviewed the application and voted 3-2 to deny the Conditional Use Permit based on inadequate space for on-site parking as configured. He presented a resolution memorializing the denial. Motion by Councilmember Weidner, seconded by Councilmember Junker,to adopt Resolution 2019-035, a resolution denying a Site Review Conditional Use Permit for the Historic Armory at 107 Chestnut Street East, CPC Case No. 2019-06.All in favor. NEW BUSINESS Resolution Calling for Public Hearing on Revenue Bonds by the City of Bethel Sofia Lykke, of Kennedy and Graven, Chartered, bond counsel to City of Bethel, stated that Birchwood Landing LLC has proposed the issuance of revenue obligations in the aggregate principal amount not to exceed$15,000,000,the proceeds of which will be applied to make a loan to the Company to finance the costs of the acquisition, construction and equipping of a multifamily senior housing development in the City of Stillwater located on Bridgewater Way, north of 72nd Street North. A public hearing must be held on the housing program. Page 2 of 4 City Council Meeting March 19, 2019 Following the hearing, the Council would need to approve the issuance of the bonds by the City of Bethel. Motion by Councilmember Weidner,seconded by Councilmember Junker,to adopt Resolution 2019-036, a resolution calling for a Public Hearing and approving Publication of a Notice of Public Hearing with respect to Host City Approval of the issuance of Revenue Bonds by the City of Bethel, under Minnesota Statutes, Chapter 462C, as amended.All in favor. COUNCIL REQUEST ITEMS There were no Council request items. RECESS TO CLOSED SESSION Motion by Councilmember Collins,seconded by Councilmember Junker to close the meeting pursuant to Minn. Stat. 13D.05 subd. 3(b) to discuss attorney-client privileged communication regarding the 2017 assessment appeals. The Council moved to the Riverview Room. Present: Mayor Kozlowski, Councilmembers Collins, Junker, and Weidner. Also present: City Administrator McCarty and City Attorney Land. Motion by Councilmember Collins seconded by Councilmember Junker to re-open the meeting. Motion by Councilmember Collins, seconded by Councilmember Weidner to close the meeting pursuant to Minn.Stat.§13D.05 subd. 3(c)to consider the purchase of real property located at 121 Chestnut Street East.All in favor. Present: Mayor Kozlowski, Councilmembers Collins, Junker, and Weidner. Also present: City Administrator McCarty, City Attorney Land and Community Development Director Turnblad. Motion by Councilmember Collins seconded by Councilmember Junker to re-open the meeting. All in favor. OTHER BUSINESS Resolution approving the use of eminent domain Motion by Councilmember Weidner seconded by Councilmember Junker to adopt Resolution 2019-037,a resolution approving the use of Eminent Domain to acquire Fee Title from private property owners as required for public parking purposes.All in favor. ADJOURNMENT Motion by Councilmember Junker seconded by Councilmember Weinder to adjourn. All in favor.
