HomeMy WebLinkAbout1982-01-20 JPC MIN• Minutes of the Joint Powers Committee `- January 20, 1982 MEMBERS PRESENT William Lundquist, Ray Senkus, Ann Bodlovick, Harry Peterson STAFF PRESENT Doug Swenson, Dennis O'Donnell, Rhonda Thode OTHERS PRESENT Dick Moore, Nile Kriesel, Bruce Folz, Dave Magnuson, Nelson Jonnes, Mr. & Mrs. Jack Lux, Barb Avise, Brad MacDonald CALL TO ORDER Ann Bodlovick chaired the committee and called the meeting to order at 5:45 p.m. APPROVAL OF MINUTES Ann Bodlovick motioned to approve the November 18, 1981 minutes as presented. William Lundquist seconded. Motion passed unanimously. NEW BUSINESS Ne son Jonnes, owner, stated that American Polywater Corp. was requesting a building permit to put up a 12,000 square foot manufacturing and office facility at the corner of Highway 36 and County Road 5. Since the committee was already familiar with the request, Jonnes was open for questions. �- Bill Lundquist asked to see a copy of the layout. Jonnes presented the Joint Powers Committee with a copy of the site plan showing the proposed location of the building, boundaries of lots, and explaining that he intends on preserving as many trees as possible. Dick Moore showed transparencies to the committee giving them background on drainage in the whole area. Moore stated that all requirements so far as structural and grading have been met by American Polywater. As far as the D.N.R. is concerned, American Polywater may have to provide a desiltation basin. Moore suggested Jonnes talk to the D.N.R., since they have some very definite requirements, and provide them with the information they need. As far as the City of Stillwater is concerned, he would recommend an easement be dedicated to the city for future ponding on the northern portion of this property. Bodlovick asked if he had any questions or concerns with O'Donnell's letter dated January 15, 1982. Jonnes stated he had a question on Item 11 concerning lighted parking lots and requested an explanation. O'Donnell stated the ordinance is very general and if your going to provide lighting, direct it on your own property. O'Donnell didn't see a need for providing lighting. Senkus asked Jonnes if he saw any problem of hooking up to city sewer when it becomes available. Jonnes stated he did not as long as other people (neighbors) shared in the cost. Jonnes brought up another concern he had regarding the requirement of blacktopped areas being surrounded by a curb. Jonnes stated that when you push the snow off `. the curb it gets in the way. He was in favor of curbs where people would be parking. O'Donnell stated in his narrative there could be a waiver on this. Joint Powers - Minutes January 20, 1982 Page 2 O'Donnell brought to Jonnes' attention Item 16 which states: Construction shall begin one (1) year after the issue date of this permit or the permit becomes void, and Item 17 which states: A financial guarantee attached as Exhibit shall be retained by the Zoning Administrator to insure compliance with the conditions of this permit. This financial guarantee shall be 125% of the cost of paving the parking area and instillation of concrete curbing. Jonnes stated he was in full agreement. Peterson brought up Al Goodman's memo in which Goodman aludes to the fact that American Polywater doesn't have much waste water. Jonnes informed the committee that he was in the business to sell, and doesn't waste much. The kinds of mater- ials that go down the septic system are insignificant. Bodlovick stated that she supports the proposed plan, but it has been the policy of the City of Stillwater to attain a ponding easement at the time of development, and that the Joint Powers Committee will be requiring American Polywater Corp. to put in a ponding area, and would like to agree to designate or to donoate land for the easement right now. Senkus stated he understood that Jonnes was currently using a process so that materials going down the drainfield were not hazardous, and was wondering if Jonnes could guarantee that he would not allow hazardous material in the drainfield in the future.. Jonnes stated there were state laws that prohibit him from doing so. Senkus asked Jonnes if he would like to in any way limit. the scope of the manufacturing that American Polywater does. Jonnes stated he hopes to be doing new and better things in the future, and he would not be putting any highly dangerous material into the septic system. Jonnes felt it would be in his best interest not to dirty up or destroy his own property. Bodlovick asked if under a Conditional Use Permit, for some unknown reason, would Jonnes have to come back if he changed the manufacturing of anything. Swenson stated if Jonnes continues to do what is allowed under the permit granted, he would not unless he wants an amendment for some other use. Jonnes stated he only wants to do what anybody else is allowed to do on an industrial zoned piece of property. Bodlovick asked O'Donnell what would be encompassed in the Conditional Use Permit. O'Donnell stated all the conditions in his letter dated January 15, 1982, plus conditions requiring a ponding easement and a D.N.R. permit. Harry Peterson moved that a Conditional Use Permit be granted to American Poly - water Corp. subject to the conditions that have been pretty well covered here and spelled out in the letter from Dennis O'Donnell dated January 15, 1982 with specific agreement by American Polywater to dedicate a ponding easement to the City of Stillwater, hook-up to city water and sewer if and when it becomes available, and obtain a D.N.R. permit. In addition, a wavier of -the require- ment that there be curbing of all of the blacktopped area and that curbing be required only for areas for which there will be parking. Seconded by Ray Senkus, motion passed unanimously. Joint Powers - Minutes January 20, 1982 Page 3 GENERAL DISCUSSION O'Donnell felt the cost of surveying that may need to be done for the ponding easement should be borne by the developer and not the county or the city. Bruce Folz stated he may be able to help in that area since he has contours of that whole area. ADJOURNMENT Ann Bodlovick motioned to adjourn the meeting at 6:45 p.m. Seconded by Harry Peterson. Motion passed unanimously. `1
