DOMINIUM CORPORATION VARIANCES
Chairman Jeffrey Zoller called the meeting to order. He stated that the
Dominium Corporation Public Hearing before the Council is scheduled for Tuesday
evening, April 26 (Case No. 274). Due to the fact that the Council has passed the
new high density multiple dwelling ordinance amendments, Dominium will now be re-
quired to adhere to the new amendments. Chairman Jeffrey Zoller pointed out that
in addition to the variances requested by Dominium, the Commission should vote as
to whether this particular site should be declared a redevelopment area (Section
13a01 of Ordinance No. Y+7).
Mr.'Avchen and Mr. Safar, representing Dominium Corporation, showed the
Commissioners a model of the proposed housing for the elderly to be located on
North Second and Mulberry Streets. They also showed architectural drawings of
the building elevation, and.the floor plan of the units. It was pointed out that
the building will be lower than the church which is located on Third Street to the
rear of the proposed building. There will be 86 one -bedroom units and 10 two -
bedroom units. Five percent of the units will be constructed to accommodate the
handicapped, providing for residents in wheelchairs. The one -bedroom units will
be approximately 563 square feet, and the two -bedroom units will be approximately
780 square feet.
Mr. Safar distributed copies of letters from the Housing and Redevelopment
Authority of.St. -Paul, Minneapolis, and Duluth, relative to the parking ratios
for public housing in each of those areas. The Duluth and Minneapolis Authorities.
stated that a parking ratio of one space for every four units proved successful,
while the St. Paul Authority requires one space for every three units, and none
for downtown housing.
Mr. Jim Hunt asked what type of exterior was planned. Mr. Avchen replied
that the front elevation will be stucco of an earthen color, and the other three
elevations will be brick.
Mr. Hunt asked if there would be any mechanical equipment on the roof of the
building. Mr. Avchen replied that there would be some equipment adjacent to the
penthouse area, but they would attempt to screen this from view.

Mr. Hunt felt that a cornice at the roofline of the building might relate more
to the town. He also felt that the east and curved walls would look better in red
brick, in keeping with the rest of the downtown buildings.
Mr. Avchen stated that they could consider going to brick. Going back to the
subject of the mechanical equipment on the roof, Mr. Avchen noted that there would be
a condenser on the roof. He pointed out that the'only area in the building which will
be air conditioned will be the recreational area, so the air conditioning unit will be
a small one.
After further discussion, Russell Meister moved that the Stillwater Planning
Commission recommend that the following property on North Second and Mulberry Streets
be designated a Redevelopment Area of the City as set forth in Section 13a01 of
Ordinance No. 547= All of Blocks 1, 2, 3 and 4; Lot 5 with.the exception of the
South 25' of the West 50'. The North 25' of Lot 6, all in Block 19, the Original
Town. The motion was seconded and passed unanimously.
Chairman Jeffrey Zoller then listed the variances requested by Dominium
Corporation and asked for discussion on any of the items.
Mary Lou True asked where the exits were located. Mr. Avchen stated that an
exit was located on the third floor. There was some discussion as to whether this
was adequate, but it was pointed out that this would have to be taken up with the
Building Inspector.
There was some discussion as to the outdoor recreational space. Mr. Avchen
stated that the terrace area was designed for this space. He pointed out that the
elderly enjoy sitting by the front entrance where they can see the activity.
Russell Meister suggested that an area be set aside for benches and picnic tables
for use by family groups. Mr. Safar stated that this could possibly be done, and
they could also provide facilities such as shuffleboard for recreational use.
Russell Meister questioned as to why only ten car outlets for heaters would
be provided. He felt more should be provided. Mr. Safar stated that many of the
elderly would not use their cars in the cold weather. He pointed out that HUD
requires an extra charge for such service, and this also discourages the use of
the outlets.

Russell Meister moved that the Stillwater Planning Commission recommend that
the following variances be granted to Dominium Corporation for the construction of
housing for the elderly at North Second and Mulberry Streets:
.Floor area ratio will be 2 to 1. (Maximum allowed is 1 to 2)
Maximum building height on the south elevation will be 75'. (Maximum allowed
on any -elevation shall not exceed 40')
The area per dwelling unit will be 425 square feet. (Minimum lot area per
dwelling unit allowed is 500 square feet)
The area designated for recreation is 1,050 square feet. (10% of gross project
area--8, 500 square feet --required)
Sideyard setback is zero. (Setback of 20' required)
Corner setback is zero. (Side yard setbacks are required to conform to existing
setbacks on the block or if no setback exists it shall be 10')
There is a partial backyard setback of 0. (20, required)
There will be 23 parking spaces provided, none of which will be enclosed. Ten
car heater outlets will be provided. (1.5 parking spaces per unit required,.
with .75 of the 1.5 to be enclosed)
The motion was seconded and passed with one abstention by Mary Lou True.
Chairman Jeffrey Zoller asked Mr. Safar how they advertised for renters, and
wondered if Stillwater residents would have first priority.
Mr. Safar stated that the rules do not permit that type of arrangement, but
he had talked with the Community Volunteer Service personnel, who are in the process
of compiling a list of people -in the Stillwater area who might be interested in
the proposed building. It will be on a first -come -first -serve basis.
When asked what the rental would be for the apartments, Mr. Safar replied
that the tenant pays 25% of his or her income. The average rent would probably be
$ 60, but the average in this building could be higher--$80 to $100. The total rent
would be approximately $280. He noted that they hope to start construction this
year.

SUBJECT: Variances needed from new Stillwater Zoning Ordinance for Multi -Family
Housing
Section 13aO3.3 States that the "Maximum floor area ratio shall be I to 211.
The floor area ratio for this'project is 2 to I.
Section 13a03.4 "Maximum building height on any elevation shall not exceed
401." The maximum building height on the south elevation is 751.
Section 13aO4.3 "For senior citizen housing the minimum lot area per dwelling
unit shall be 500 square feet". The area per dwelling unit is
425 square feet.
Section 13aO5.1 "Ten (10) per cent of the gross project area shall be specifically
design, developed and maintained for recreational purposes" _
8,500 square feet. The area designated for recreation is
1,050 square feet.
Section 13606.2 Side yard setback requirements. "A setback of at least
twenty (20) feet shall be maintained." Side yard setback is
zero (0). "Side yard setbacks on corner lot shall conform to
existing setbacks on the block or if no setback exists it shall
be ten (10) feet." Corner setback is zero (0).
Section 13a06.3 Backyard. "A setback of at least twenty (20) feet shall be
maintained." There is a partial backyard setback of zero (0).
Section 13aO7 Parking. "Parking shall be provided on a site owned by the
developer and shall be provided in the ratio of 1.5 parking
spaces per unit, at least .75 of the 1.5 to be enclosed."
There are 23 spaces or .24 per unit. None of the spaces is
enclosed. Car heater outlets are provided for ten cars.

was provided for the two elderly projects built.
RESIDENTIAL AREAS
A parking ratio of one (1) space for every three (3) units is required.
Our observation indicates that this is more than adequate for the tenants.

Dear Jack:
We currently operate about 6,500 units -of housing for the elderly in T1inneapolis
in about 40 high rise structures. Our most recent survey indicates that 10% of
our tenants have cars. The highest usage we ever experienced in our surveys
(expressed as a percent of cars to units, including visitors and employees) was.
28%, which occurred on a Sunday: We feel that the provision of one space per
four dwelling units for low-income senior citizens is completely adequate.

The Housing and Redevelopment Authority currently operates approximately.
500 units of hi -rise type elderly housing in the City of Duluth. Our
project No. MINN. 3-4 has 109 units and has 26 parking spaces; and our
project No. MINN. 3-5 has 102 units and has 21 parking spaces for elderly
residents. Based on past experience, we have found that the parking ratio
of one parking space for every four units has proved to be very successful
in developing elderly housing in the City of Duluth.
