Location of Property: Caves on South Main Street. Special Use Permit to operate retail gallery and gift shop in the old caves. 4. Discussion of Mr. Charles Hooley's plans for property on Highway #212. 5. Case No. 222. Applicant: James Wilkin. Location of Property: Nine lots on North Center Street. Informal hearing on Mr. Wilkin's proposed use of the above property. At the July 11, 1977 Planning Commission meeting, Mr. Wilkin was denied his request to rezone the property to multi -family so that he could con- struct three four-plexes on the property. All property owners within 300' of this property have been informed of this informal hearing. 6. August 1, 1977 Jeffrey Zoller Ann Bodlovick Dale Kress Russell Meister Jack Shelton APPROVAL OF MINUTES Chairman Jeffrey Zoller called the meeting to order. Ann Bodlovick moved that the minutes of the July 11, 1977 meeting be approved as submitted. The motion was seconded and passed unanimously. SPECIAL USE PERMIT Case No. 283. Applicant: Peter Kohl. Location of Property: Caves on South Main Street. Permit to operate retail gallery and gift shop in the old caves. Mr. Kohl stated that he is renovating the Curtis Caves, noting that he had put a new roof on them and had cleaned up the surrounding area. Mr. Kohl is a potter and would like to sell his pottery in the caves, as well as the work of local artists on a consign- ment basis. He will also sell miscellaneous household gifts. Mr. Kohl pointed out that his.hours of business will probably be from 12:00 P.M. to 6:00 P.M. every day of the week. He will be using the front part of the caves, with an approximate area of 350 square feet. Mr. Kohl had met with John Lawson regarding the required build- ing code. He plans to open the business by August 15. Mr. Kohl stated that he would do some outside landscaping also. Russell Meister moved that the Stillwater Planning Commission recommend to the City Council that Mr. Peter Kohl be granted a Special Use Permit to operate a retail gallery and gift shop in the old caves on South Main Street, provided that Mr. Kohl meets all the requirements of the Building Inspector. The motion was seconded and passed unanimously. Case No. 222. Applicant: James Wilkin. Location of Property: Nine lots on North Center Street. Informal hearing on Mr. Wilkin's proposed use of the above nine lots. Chairman Jeffrey Zoller recapped for the concerned residents what has happened thus far in regard to Mr. Wilkin's request for rezoning to multi -family. Mr. Zoller pointed out that the Planning Commission had denied Mr. Wilkin's request for rezoning at its meeting held July 11, 1977. Mr. Zoller noted that this informal hearing would allow the neighborhood residents to express their feelings and help Mr. Wilkin decide how he will develop his land. Stillwater Planning Commission August 1, 1977 Page Two Mr. Wilkin showed the Commissioners and neighbors a drawing of his plans for three four-plexes on the property. The North Center Street access route was dis- cussed. One resident pointed out that at one time it had been surveyed to put through Center Street, and it was recommended by the surveyor that it not be done. Another resident stated that the access would be right through her driveway. Mr. Wilkin pointed out that if he put nine single family homes on the property, which he can legally do, the property would be divided into nine lots rather than three. Jack Shelton pointed out that only half of North Center Street is dedicated, and if it were to go through, the property owners abutting it would be assessed for improvements. Another resident stated that the new street would be right out his front door. He pointed out that the terrain was such that because of the hilly area, the proposed structures would have water problems. He said there was at least a 60' drop in the land. Mr. Zoller stated that the three four-plexes would generate more people in the area than the nine single family homes, but the single family homes will have a greater physical impact on the site. A resident pointed out that the nine houses would blend in with what is already there and would be at the same height. The ingress and egress problem was discussed, and Mr. Shelton suggested that perhaps access could be gained by coming in on Mulberry or Rice Streets. Mr. Wilkin stated that the structures would be two-story buildings, 40' x 40', with cedar siding, and the cost of each unit would be approximately $75,000. He presented a drawing showing what screening he would provide on the west side of the property --a fence and trees. Chairman Jeffrey Zoller stated that judging by the neighbor's comments, it seems that they are not pleased with the idea of four-plexes. With that in mind, he informed Mr. Wilkin that he could still attempt to have the property rezoned by the City Council, or he could come back with a preliminary plat for nine single family lots showing ingress and egress. PROPOSED PLANS FOR HOOLEY PROPERTY ON HIGHWAY #212 (STILLWATER INDUSTRIAL PARK Mr. Charles Hooley showed the Commissioners drawings of his plans for the property on Highway #212. He pointed out that the fast food establishments would all be located in the same area. Mr. Hooley stated that it is almost certain that the Bank and Cub Store will go in. Ann Bodlovick pointed out that this drawing was not presented to the Joint Powers Committee. Mr. Hooley stated that he would like the Planning Commission's approval of the preliminary plat, and then he will go on to the Joint Powers Committee and the City Council. It was pointed out that the Bank has been approved- Stillwater Planning Commission Minutes August 1, 1977 Page Three and the conditional use permit has been completed. Mr. Schwab noted that the only requirement the Bank must meet is that prior to opening for business, the road must be constructed and sewer and water must be installed. Approval of the preliminary plat is needed so that the right of way can be dedicated. Mr. Schwab reviewed his memorandum regarding the preliminary plat dated August 1, 1977, addressed to the Stillwater City Council and Planning Commission. He pointed out that since the main intersection is the hospital road, the frontage road will be a primary source of traffic. He stated that the integrity of that frontage road will have to be protected, because it is not the type of road to allow for a lot of in and out turning. He felt that the frontage road should be upgraded. Mr. Schwab pointed out the need for a Public Hearing with regard to the pre- liminary plat, so that the surrounding property owners know exactly where the sur- veyed points are, because once the plat is approved, it is final. Mr. Schwab recommended that the strip of land running between Lots 2 and 3 which is 30' feet wide, should be taken out and tied into Lots 1 and 2, to alleviate traffic problems. He also pointed out that there were a number of items missing on the preliminary plat which are required by the City's Subdivision Ordinance, and Mr. Schwab suggested that Mr. Hooley supply all of the needed information. A discussion followed regarding the frontage road, and Mr. Schwab pointed out that the State is currently maintaining the frontage road, but if it is decided that the road be upgraded, the State will no longer take care of it. He felt that two accesses to the plat could be made if driveways from the frontage road were eliminated. This could be accomplished, he stated, by area; for instance, just one road to get into the total fast eating area. He noted that this could be done by having one access for lots 1 through 9, one access for lots 1 and 2, and one access for lots 14 and 15. Russell Meister moved that the Stillwater Planning Commission recommend to the City Council that it accept the road layout plan for Stillwater Industrial Park, dissecting Blocks 3-and 4 to provide a roadway. It is further recommended that the City Council petition the State Highway Department for an interchange at the first crossover east of the County Road #5 bridge over Highway #212. The Commission now refers the plat to the Joint Powers Committee. The motion was seconded and passed unanimously. I,01-1 DENSITY MULTIPLE DWELLING ORDINANCE Chairman Jeffrey Zoller stated that the City Council had requested that the Planning Commission discuss the property on South Greeley Street, on which Doerfler Construction Company had proposed to build an apartment unit-. Mr. Zoller pointed --- Stillwater Planning Commission Minutes August 1, 1977 Page Four out that he had talked to City Attorney Harold Kimmel, and Mr. Kimmel stated that the property could be rezoned to low density if the City had a low density multiple dwelling zoning ordinance. The Commissioners were furnished with copies of such an ordinance. The other option would be to down -zone the property or put restrictions on it, but Mr. Kimmel felt this option was not as strong. Mr. Zoller pointed out the differences in the low density ordinance as opposed to the medium density ordinance, noting that they were basically the same with the exception of the minimum lot area per unit and area required for open space. It was pointed out that the City Council would need to have two readings of the ordinance. Mr. Zoller suggested that the Commission might ask for the first reading of the ordinance and review it further before the Council's second reading. Mayor Junker asked if the downzoning would be limited to just this particular area. Mr. Zoller stated that it was his understanding this would apply to this piece -of land only. Ann Bodlovick stated that she would like to discuss the matter with Mr. Kimmel. She felt the ordinance was good, but wanted to discuss the rezoning question with Mr. Kimmel. Mayor Junker asked how many units the developer would be able to build under the low density ordinance, and Ann Bodlovick replied that up to 24 units would be allowed. Ann Bodlovick moved that the Stillwater Planning Commission recommend that the City Council take the necessary steps for the first reading of the Amendment to Ordinance 383 adopting low density multi -family dwelling zoning ordinance. The motion was seconded and passed unanimously. Russell Meister moved that the Stillwater Planning Commission recommend that the City Council re -zone the property on South Greeley Street from medium to low density. The motion died for lack of a second. OTHER RUSINF)S Ann Bodlovick stated that Councilman William Powell had suggested considera- tion be given to making Water Street a one-way street going north to Chestnut. He felt this would alleviate some of the traffic problems. Chairman Jeffrey Zoller stated that he would contact Mr. Brine, Chairman of b the Downtown Retail Parking Committee, and also the Highway Department to set up a meeting to discuss this and other possibilities. Stillwater Planning Commission Minutes August 1, 1977 Page Five PLANNING COMMISSION APPOINTMENT Mayor Junker noted that Mr. Al Ranum had expressed an interest in serving on the Planning Commission. Russell Meister moved that the Stillwater Planning Commission recommend to the City Council that Mr. Al Ranum be added to the list of potential candidates to fill the vacancy on the Planning Commission. The motion was seconded and passed unanimously. ADJOURNMENT The meeting was adjourned at 9:10 P.M.
