August 29, 1977 Jeffrey Zoller Ann Bodlovick Dale Kress Russell Meister Jack Shelton Jerry Smith Charles Swanson Mary Lou True APPROVAL OF MINUTES Chairman Jeffrey Zoller called the meeting to order. Russell Meister moved that the minutes of the August 1, 1977 meeting be approved as submitted. The motion was seconded and passed unanimously. SPECIAL USE PERMITS AND VARIANCES Case No. 286. Applicants Brian McKean. Address: 911 W. Hickory. Variance for a 24' x 24, garage. The proposed structure. would be 1' from the lot line .in the front yard. Charles Swanson noted that if the street were ever improved in the future, it would be wider than it is now, and there would not be enough room because the structure would be one foot from the street as it is now. Other alternatives were discussed, but because of the terrain Mr. McKean felt this was the only feasible plan. It was pointed out that there were three lots beyond Mr. McKean's property. A storm sewer for the school runs through one of the lots, so that one is not a buildable lot. The other two lots are small (40' to 459, but one house could be built on the combined lots. Charles Swanson moved that the Stillwater Planning Commission deny Mr. Brian McKean's request for a variance to construct a garage at 911 W. Hickory Street, based on the fact that the structure would be one foot from the front property line. It is recommended that Mr. McKean consider an alternate plan. The motion was seconded and passed with three abstentions by Dale Kress, Mary Lou True, and -Jack Shelton. Case No. 287. Applicant: Gold Medallion Corporation. Address of Property: 1119 N. Owens Street (Maple Manor Nursing Home). Permit to build an addition on nursing home. Ms. Pearl Behm, Administrator for Maple Manor. Nursing Home, and Gary Bresler, presented the proposed plans for the addition. Mr. Bresler noted that the addition will be a physical therapy area, about 2700 square feet. Additional parking is also provided. The addition will be one story, with the same.brick and window treatment that is on the present structure. Mr. Robert Armbruster, architect, pointed out that Carnelian Street has been vacated,and the property is owned by the nursing home. 0 Stillwater Planning Commission Minutes August 29, 1977 Page Two Mr. James Alexander, 1208 North William Street, and Mr. Clarence Loran, 1114 N. William Street, looked at the plans for the addition. Mr. Loran asked if the existing field will be left as -it is, and also if the parking lot area would drain into the existing pond. Mr. Armbruster replied that the field would be left as ,is at present, and he noted that the runoff from the parking lot will go to the pond. He said the vacant property would eventually be developed into a park area to be used by the families visiting relatives at the home. Mr. Alexander asked if there would be fencing provided when the park has been completed. Mr. Armbruster stated that they have not planned that far ahead, but there probably would be some type of fencing provided. 'Ann Bodlovick moved that the Stillwater Planning Commission recommend that a Special Use Permit be'granted to the Gold Medallion Corporation to build an addition on Maple Manor Nursing Home at 1119 N. Owens Street. The motion was seconded.and passed unanimously. Case No. 288. Applicant: Charlotte Lander. Address of Property; 111 E. Orleans St. (St. Peter's United Church of Christ). Permit to operate day care center. It was noted that this case had already been approved by the City Council, but the Commission may make any additional comments. Mary Lou True asked if the children would be playing outside at times, and also how close the nearest residence is to the Church. Mrs. Lander replied that the children would be using the playground equipment at times. The nearest residence Is some distance away, and the Church owns the property surrounding it. Ann Bodlovick moved that the Stillwater Planning Commission grant a Special Use Permit to Charlotte Lander to operate a day care center at St. Peter's United Church of Christ, 111 E. Orleans Street. The motion was seconded and passed unanimously. Case No. 289. Applicant: Dennis Galowitz. Address: 1020 South 5th Street. Variance for garage. Mr. Galowitz is requesting two side yard variances, one foot on the west side, and two feet on the north side. There will be a 17' driveway to the lot line. Mary Lou True moved that Stillwater Planning Commission recommend that variances be granted to Dennis Galowitz to build a garage at 1020 South 5th Street. The motion was seconded and passed unanimously. Case No. 290. Applicants James Gannon. Address: 406 West Laurel. Permit to build a paint spray booth and storage addition on existing building. Variance also requested= 8.71' on North side if the three lots are lumped together, or 17' for rear yard if the lots are not lumped together. It was noted that the property is zoned Stillwater Planning Commission Minutes August 29. 1977 Page Three commercial, but it abuts residential property. The paint booth and storage area were deemed allowable uses. Mr. Gannon stated that his neighbors were aware of his plans and had expressed no objections to him. He pointed out that he would prefer that the lots be left as they are and not lumped together, so he is requesting a 17' rear yard variance. Mr. Gannon stated that he was aware of the fact that he would have to meet the fire code standards for the paint booth. Charles Swanson moved that the Stillwater Planning Commission recommend that a Special Use Permit and a 17' rear yard variance be granted to Mr. James Gannon to build a paint spray booth and storage addition on an existing building at 804 West Laurel Street. The motion was seconded and passed unanimously. AMENDMENT TO ZONING ORDINANCE RELATING TO LOT SIZES Chairman Jeffrey Zoller stated that he had received a study on lot sizes from the Metropolitan Council on selected communites throughout the Twin Cities area. He cited some statistics for cities comparable in site to'Stillwater. In Shakopee the requirement for two-family is 9,000 square feet, and single family is covereed by five zones ranging from 12,000 square feet to 29,000 square feet. In Cottage Grove the ordinance for single family requires three acres down to 10,000 square -feet. South St. Paul's ordinance requires 7,200 square feet for two family, and 9,000 square feet for single family. ,Anoka requires 10,000 square feet for two family, and 7,500 square feet for single family, with different requirements for certain districts. Mary Lou True suggested that the ordinance might stipulate -a two-story duplex would require a smaller lot size than if the structure were one story. Mr. Zoller stated that -it might be possible to require the duplex to cover a certain percentage. of the lot, but there may be a problem if someone wanted to build a two-story duplex in an area of one-story homes. Mrs. True asked how many vacant lots there are in Stillwater which are small but zoned two family. Mr. Zoller replied that there are probably not very many, but there are many residents who live on a double lot and use one lot for their yards. They could decide to sell their second lots. It was felt that if sewer and water had been stubbed in the lots, they could be sold for a homesite. Mr. Shelton pointed out that in the older part of town water and sewer probably are not stubbed in such lots, unless there has been a reconstruction of the street. Mr. Zoller stated that the ordinance could provide that in a two-family area 10,000 sq.ft.would be required, with a lot coverage restriction. In the older part of town 10,000 sq. ft. would not be required for a single family dwelling. Mr. Zoller pointed out the expense of rezoning the whole Town. He suggested also changing Stillwater Planning Commission Minutes August 29, 1977 Page Four the ordinance with regard to side lot lines, to prevent homes from being built so close together. A resident in the audience stated that he has traveled to many cities, and he feels that the 10,000 square foot lot is most acceptable for new homes, because it provides more space for outdoor living. He noted that there are some communities which did not have the foresight to do this, and now they are having problems because so many variances are needed for garages and additions. Mr. Zoller pointed out that some areas require off-street parking or garages. It was felt that the possibility of side yard restrictions and the requirement of off-street parking should be investigated. Mr. Zoller stated that he would meet with Harold Kimmel, City Attorney, in regard to including in the ordinance two different lot sizes and restrictions on side lot and off-street parking. The major concern is the size of the unit on the lot and how it blends with the character of the rest of the neighborhood. LOW DENSITY MULTIPLE DWELLING ORDINANCE Chairman Jeffrey Zoller noted that the City Council had the first reading of the low density multiple dwelling ordinance. He stated that the Commission can recommend that the second reading of the ordinance be held after a review by the City Attorney. Ann Bodlovick stated that it was her understanding that the property on South Greeley Street could be down -zoned because of the fact that the original intent was to allow a certain number of units on the property. A down -zoning would put a restriction of 24 units on the property. Jack Shelton moved that the Stillwater Planning Commission recommend that the City Council take the necessary steps for the second reading of the Amendment to Ordinance 383 adopting low density multi -family dwelling zoning ordinance after the City Attorney has made any comments on it. The motion was seconded and passed unanimously. Ann Bodlovick moved that the Stillwater Planning Commission recommend that the property on South Greeley Street be rezoned from medium density to low density. The motion was seconded and.passed with one opposition by Jack Shelton, FIRST NATIONAL BANK PROPOSED ADDITION Chairman Jeffrey Zoller convened a meeting of the Heritage Preservation Commission in conjunction with the discussion of the First National Bank's plans . for an audition to their present building. Mr. Harry Swanson and Mr. Gerald Beall represented the Washington County Historical Society. Stillwater Planning Commission Minutes August 29, 1977 Page Five Mr. Quentin Heimerman, President of the First National Bank, presented a drawing of the completed structure. He stated that the same lines of the present building would be followed. The plans include a concrete ramp over the whole area where the auditorium theatre was situated, and the top of the ramp will have seven drive-ins off of Second Street and a ramp off to Olive Street. On the Olive Street side there will be an entrance to a parking area below the ramp for covered parking, which will accommodate 30 to 35 cars, plus seven or eight open spots for employees during bank- ing hours. The parking will be open to the public after banking hours, and the under- ground parking area will be lighted. Mr. Heimerman then showed the Commission the site plan. He noted that they will not be utilizing the alley at all. He then explained the layout of the office space. He stated that the balconies and false ceiling would be torn out to reveal the original skylight, beam ceilings, and top of the balconies. The Commission praised the proposed addition. Mr. Beall stated that the Historical Society was favorably impressed with the plans. Ann Bodlovick moved that the Heritage Preservation Commission inform the City Council of its acceptance of the First National Bank's proposed addition. The motion was seconded and passed unanimously. Chairman Jeffrey Zoller asked Mr. Peter.Erickson, of River Town Restoration, for his opinion as a representative of RTR. Mr. Erickson noted that the plans have some very good points and some very poor points. He felt they had made an effort, but he did not personally feel comfortable with everything they had done. As a group, he felt the RTR would generally accept the plans, and they would be particularly pleased that the old part of the building would not be torn down. A.motion was made to adjourn the Heritage Preservation Commission meeting. It was seconded and passed unanimously. MC KUSICK LAKE STUDY COMMITTEE Chairman Jeffrey Zoller noted that within the next few weeks he would be organizing a volunteer McKusick Lake Study Committee, which will be meeting with the Public Works Department and the DNR. He asked those Commissioners who were interested in serving on the Committee to contact him. Mr. James Gannon volunteered to serve on the Committee.
