October 3, 1977 Jeffrey Zoller Jack Shelton Ann Bodlovick Jerry Smith Russell Meister Charles Swanson APPROVAL OF MINUTES Chairman Jeffrey Zoller called the meeting to order. Russell Meister moved that the minutes of the August 29, 1977 meeting be approved as submitted. The motion was seconded and passed unanimously. SPECIAL USE PERMITS AND VARIANCES Case No. 293. Applicant: Frederick Crissey. Address: 1632 Meadowlark Drive. Variance to build garage in front yard. Mr. Crissey stated that the proposed garage will be attached to the house where part of the driveway is presently located. After some discussion, Ann Bodlovick moved that the Stillwater Planning Commission recommend that a variance be granted to Mr. Frederick Crissey to build a garage attached to the front of his home at 1632 Meadowlark Drive. The motion was seconded and passed unanimously. Case No. 294. Applicants James Harvieux. Location of Property: 2102 South Main. Special Use Permit to operate woodworking operation in rear part of The Greenery. Mr. Harvieux stated that he would be building furniture, and he will be using some saws, but he planned to add insulation to the east wall in order to cut down the noise level. He will not be using the existing brick boiler, but will put in a new furnace. Mr. Harvieux has discussed this plan with some of the neighbors, and they are all pleased with his shop. This will be a one-man operation. Charles Swanson moved that the Stillwater Planning Commission recommend that James Harvieux be granted a Special Use Permit to operate a woodworking business in the rear part of The Greenery at 2102 South Main Street. The motion was seconded and passed unanimously. Case No. 295. Applicant: John A. True. Address: 322 S. Broadway. Variance to build a garage. Mr. True stated that he is requesting a side yard variance. He noted that his back yard is about four feet lower than the lot to the south and there is a stone wall to the rear of the lot. The proposed garage will be adjacent to the stone wall. There will be three feet between the garage and his neighbor's garage. For that reason, Russell Meister pointed out that a fire wall may be necessary. Russell Meister moved that the Stillwater Planning Commission recommend that a side yard variance be granted to John A. True to construct a garage at 322 South Broadway. The motion was seconded and passed unanimously. Stillwater Planning Commission Minutes October 3, 1977 Page Two Case No. 296. Applicants Dale Kruse. 'Address:419 South Greeley. Variance for an attached garage. Mr. Kruse stated -that there is at least 10 feet between the proposed garage and his lot line. The garage will be attached. Russell Meister moved that the Stillwater Planning Commission recommend that a variance be granted to Mr. Dale Kruse to construct a garage 1t 419 South Greeley. The motion was seconded and passed unanimously. EXPIRED SPECIAL USE PERMIT Case No. 246, allowing a beauty shop to be operated by Mrs. Keith Curtis at 1415 Lookout Street, expired September 21, 1977. No complaints had been received regarding the operation of the shop. Ann Bodlovick moved that the Stillwater. Planning Commission recommend that a permanent Special Use Permit be granted to Mrs. Keith Curtis to opera.te.a beauty shop at 1415 Lookout Street. The motion was seconded and passed unanimously. CITY PROPERTY ON WEST OLIVE STREET AND WEST OAK STREET Chairman Jeffrey Zoller stated that the City has received a bid on the property located at West Olive Street and West Oak Street. The Council delayed a decision to sell the property pending action from the Planning Commission and the Parks and Recreation Commission. It was noted that the developer can be -restricted to five lots with access off of Oak Street. Three concerned residents were present. The County Road 5 access was discussed, and it was felt that this is a dangerous corner. One of the residents felt .the property should be kept by the City and used as a park. Ann Bodlovick pointed out that in the future the neighborhood might want the land developed into a park, and this would be an expense for the City. Another resident expressed concern that this was choice property being sold by the City for only $4,000 per lot.., Mr. Swanson pointed out that in order for the lots'to be developed, approximately $6,000 to $8,000 may have to be invested for each lot. One of the residents suggested that if, the City is intent on selling the property, he would recommend that they plot out three lots and sell them at a good price. Mr. Zoller read the minutes of the Parks and Recreation Commission. It was ti their recommendation that the property not be developed as a park but let the Council decide if it should be sold or left as open area. . If the property was to be sold, the money should be given to the Park Fund. Stillwater Planning Commission Minutes October 3, 1977 Page Three Mr. Zoller stated that he had talked to the prospective buyer, who said he would be willing to put in five lots with access to Oak Street. A discussion followed as to the quality of homes to be built on the property. The residents were concerned that low-cost housing might be constructed. There was also some concern that there would not be adequate space for five homes. Mr. Zoller stated that he tended to agree with the neighbors in that he wondered if the City is going to get that much out of the property by selling it. After further discussion, Charles Swanson moved that the Stillwater Planning Commission recommend that the City sell the property at West Olive Street and West Oak Street, that the developer be required to replat the property to show not in excess of five lots, preferably four, and all accesses, ingress and egress, be obtained off of Oak Street, with no individual driveways on to County Road #5. The motion was seconded and passed, with one opposition by Jeffrey Zoller. MC KUSICK LAKE STUDY COMMITTEE Chairman Jeffrey Zoller noted that the McKusick Lake Study Committee held a meeting September 22. ,The Committee is comprised of 14 citizens. Their first step will be to review all State, City and Federal studies that have been done on the Lake. The Committee hopes to restore the lake to a wildlife natural area. Jack Shelton pointed out that the DNR must be contacted for their recommenda- tions as to what can be done, especially with respect to the dredging of the Lake. ..Mr. Zoller told the Commissioners to contact him if they had any ideas or suggestions for the Committee. ORDINANCE DEFINING A LOT Mr. Zoller showed the Commissioners a copy of an ordinance which states what constitutes a buildable lot. He stated that the City Attorney had asked for a recommendation on the ordinance from the Planning Commission. Jack Shelton moved that the Stillwater Planning Commission recommend to the City Council that there be a second reading of the Ordinance defining a lot. The. motion was seconded and passed unanimously. OFFICIAL ZONING MAP Jack Shelton showed the Commissioners the zoning map which is being updated. He stated that they had gone over every ordinance that had been passed since 1963. Mr. Zoller suggested that the Planning Commission recommend any zoning changes necessary before the map is completed. The riverfront property was discussed, the point being made that most of it is now zoned two-family. Stillwater Planning Commission Minutes October 3, 1977 Page Four Russell Meister moved that the Stillwater Planning Commission recommend that the first reading of the ordinance amending the zoning ordinance be held, and that all riverfront property East of the railroad tracks and North of Muller Boat Works, Inc. in the. City of Stillwater be rezoned single family. After more discussion, Mr. Meister amended his motion by moving that the Stillwater Planning Commission recommend that the first reading of the ordinance amending the zoning ordinance be held, and that all property in the riverway area in the City of Stillwater, with the exception of Aiple Towing's industrial area, should be rezoned single family.
