November 7, 1977 Jeffrey Zoller David Knefelkamp Jack Shelton Charles Swanson APPROVAL OP MINUTES Chairman Jeffrey Zoller called the meeting to order. He noted that there. was not a quorum for the meeting, but those members of the Commission present would make their recommendations to the City Council. Charles Swanson moved that the minutes of the October 3, 1977 meeting be approved as submitted. The motion was seconded and passed. SPECIAL USE PERMITS AND VARIANCES Case No. 297. Applicant: Gerald Polzin. Address: 1334 South 3rd Street. ".pecial Use Permit to operate a small engine repair shop and do saw filing at residence. Mr. Polzin has been sharpening saws in the past, but he now will be doing some lawn mower repair work and small engine repairs. He stated that this is a part time job, and he doesn't start working before 9.00 A.M. and usually stops before 8:00 P.M. in the wintertime and before 9:00 P.M. during the summer. He does the'work in his garage. He stated that the sign will remain as it is. David Knefelkamp moved that the Stillwater Planning Commission recommend that a Special Use Permit be granted to Gerald Polzin to operate a small engine repair shop at 1334 South 3rd.Street, with the following restrictions: (1) The use bf noisy equipment be stopped by 9:00 P.M.; and (2) any outside advertising be non -illuminated and limited to four feet square in size. The motion was seconded and passed. Case No. 298. Applicant: Karen Jenson, Croixside Press. Address: 310 S. Main. Permit to construct an addition to the rear of present building. Chairman Zoller noted that this is a permited use, but due to a new ordinance the Planning Commission and City Council must review any new industry and this requires a Special Use Permit. Karen Jenson showed the Commissioners a drawing of .the proposed addition, which, will be used for paper storafe and bindery work. She has met with the Building; Inspector, and the addition will meet the building code. It will be a one-story addition. Jack Shelton moved that the Stillwater Planning Commission recommend that a Special Use Permit be granted to Croixside Press, 310 South Main Street, to construct an addition to the rear of the present building. The motion was seconded andpassed. Stillwater Planning Commission Minutes November 79 1977 Page Two , Case No. 299. Applicant: Gene and Roberta Erickson. Address of Property: 1415 Riverview Drive. Variance of setback requirement for construction of new home. Mr. Alexander Decker, designer of the proposed home, presented architectural drawings of the structure. He stated that they were requesting a variance of the prevailing 17' setback to 10' b '. A resident asked Mr. Decker what the roof elevation of the new home from the . street would be. Mr. Decker said that he did not know what the elevation would be. Mr. Zoller read the restrictions placed on two other applicants who were granted variances (Dr. Kalinoff and Mr. Simpson). He noted that because Mr. Erickson is requesting a variance, the Planning Commission and City Council may put certain stipulations on the structure if they want to grant the variance. Mr. Decker and Mr. Erickson pointed out that they were unaware of the past variance requests and stated that there weren't any restrictions on the property when they purchased it. It was pointed out that a restriction had been placed on other homes to be a maximum of 15' above the street. Mr. Decker estimated that the building would be. 22' higher than the street. Mr. Swanson asked Mr. Decker if there would be a problem in maintaining approximately the same height as those homes adjacent to it. Mr. Decker replied that there would be a problem because of the lay of the land. He pointed out that they were trying to keep the site as natural as possible. Mr. Erickson stated that for this reason they decided to put the garage beneath the house to eliminate more building space. They had tried every other conceivable plan, but none would work out for them. Mr. Wendell Beardsley, 1412 Riverview Drive, told the Commissioners that he was the first one to build in that area, and since then everything has been done to maintain the view in spacing the houses to keep them low. He noted that they had even paid for underground electricity service themselves. Mr. Beardsley stated that he had designed Mr. Simpson's home to fit in with the rest of the houses. He felt that a house could fit in the lot which would maintain the minimums that were allowed for Dr. Kalinoff and Mr. Simpson. Mr. Alex Kraemer, 1410 Riverview Drive, stated that he would like to see the same restrictions placed on the Simpson and Kalinoff residences also placed on any new residence in this particular area. Mr. Beardsley was concerned that whatever action is taken here would set a precedence for another vacant lot in front of his residence. 3 Stillwater Planning Commission Minutes November 7, lW7 Page Three Mr. Swanson felt it would be helpful to know the respective elevations so that some type of correlation can be made between what exists on the same side of the street. There was some discussion as to whether the ordinance requires a 30' setback or a 17' setback, which is the setback used by the Simpson and Kalinoff homes. Mr. Decker felt that a precedent had been set for the 17' setback. Mr. Knefelkamp asked Mr. Decker how far the elevation could be dropped, and Mr. Decker replied that they could drop it another three feet. The possibility of detaching the garages was discussed, but it was felt by the builder that this would be more unattractive than a higher building. Chairman Jeffrey Zoller stated that he would contact City Attorney Harold Kimmel to determine if the required setback is 30' or 17'. Mr. Decker proposed that the application for variance be tabled until the setback is determined. He noted that if a 17' setback is required, they may alter the plans to meet that requirement, thereby negating the necessity of coming before the City Council for a variance. Mr. Charles Berg, 1408 Riverview Drive, stated that he would like Attorney Harold Kimmel to send his opinion regarding the setback requirement to all adjacent property owners. Mr. Decker also stated that he would like a letter from Mr. Kimmel. Charles Swanson recommended that if the City Attorney rules that Mr. Erickson does need'a variance, prior to the next Planning Commission meeting the Commission should be furnished with first floor elevations of the structure in relation to adjacent properties on both sides of the street. Mr. Beardsley stated that Mr. Kimmel should be made aware ofthe fact that Dr. Kalinoff and Mr. Simpson were required to request variances for their 17' setbacks. Case No. 300. Applicant: Mrs. Jon Stratte. Address: 114 Lakeside Drive. Side yard variance for entry addition and roof overhang on north side of dwelling. Mrs. Stratte showed the Commissioners a drawing of the proposed addition and roof overhang. It was noted that a 21' variance was necessary. Charles Swanson moved that the Stillwater Planning Commission recommend that a variance of 2Z' be granted to Dr. and Mrs. Jon Stratte to construct an entry addition and roof overhang on the north side of their home at 114 Lakeside Drive. It is further recommended that due to the fact that Dr. and Mrs.. Stratte were previously granted a larger variance for an addition, the Public Hearing on this case be waived. The motion was seconded and passed. Stillwater Planning Commission Minutes November 7, 1977 Page Four Case No. 301. Applicant: Wayne Herr. Address of Propertys Corner of County Road #5 and W. Oakes Street. Approval of preliminary plat. Mr. Herr stated that he would like to subdivide the property into three lots rather than eight as he had originally planned. He showed the Commissioners drawings of the property. Mr. Herr stated that he had to make a decision as to whether or not to purchase the property by tomorrow, and he wanted the Commission's feelings on the matter. Jack Shelton moved that the Stillwater Planning Commission recommend that approval be given to Mr. Wayne Herr's preliminary plat of the property located at the corner of County Road # 5 and West Oakes Street. Mr. Swanson amended the motion to include the provision that there be no ingress and egress to Olive Street, and that the additional requirements of the subdivision ordinance (Section 905.01) be waived for this subdivision. The motion was seconded and passed. NEW FLOOD PLAIN AND ZONING, MAPS Mr. Shelton showed the Commissioners the new flood plain and zoning maps. Mr. Shelton noted that he wanted to discuss a few items with Bill Schwab in regard to the zoning map. Mr. Zoller asked the secretary to compile a list of the rezonings, giving the ordinance number involved in each rezoning, so that this can be referred to in the future. He would also like a copy of Ordinance 479. Mr. Zoller stated that the Commission would wait for the final copy of the zoning map before recommending approval by the City Council. COUNCIL ACTION ON ELDERLY HOUSING AND FIRST NATIONAL BANK VARIANCES Mr. Zoller reported to the Commissioners the action the Council had taken with regard to a variance needed by the Dominium Corporation for the elderly housing. The variance concerned the parking= ordinance stipulates that parking be behind the building, but a variance was granted so that parking may be in front of the proposed building. The variance granted the First National Bank was in regard to the parking ramp. VICTORIA VILLA Mr. Schwab had submitted a memorandum to the City Council and Commission in regard to the Victoria Villa. Mr. Zoller outlined what has taken place in this regard recently. It was determined that no action would be taken by the Planning Commission until Doerfler Construction could appear at a future meeting. e n_miTPVMmrrr The meeting was adjourned at 9s10 P.M.
