December 5, 1977 Jeffrey Zoller Ann Bodlovick Russell Meister Charles Swanson Mary Lou True CALL TO ORDER Chairman Jeffrey Zoller called the meeting to order. SPECIAL USE PERMITS AND VARIANCES Case No. 302. Applicant: Jerry Mechelke. Address: 809 W. St. Croix Ave. Permit to sell woodburning stoves out of his home. Mr. Mechelke gave the Commissioners brochures showing the type of woodburning stove he wants to sell from his home. He stated that he has one in his home now, and an additional two stoves are stored in his garage. Mr. Mechelke takes orders for the stoves, picks them up in Fridley, and delivers them to his customers. He noted that in the last two months he has sold 16 stoves, 12 of which were sold by phone calls. Mr. Mechelke stated that when he was told.he would have to get a Special Use Permit to sell the stoves, he wasn't told that he would have to stop selling them until the Permit was issued. He noted that he had curtailed his selling as of Friday night. Ann Bodlovick noted that two months ago Mr. Mechelke was told by the City Attorney that he had to get a Permit. She noted that he has been selling the stoves illegally. Mr. Mechelke noted that he had removed the advertising sign from his mother's yard. He was not aware of the sign ordinance. The signs on the telephone poles have also been removed. Mr. Mechelke pointed out that the neighbors have not said anything against his selling the stoves from his home. Ann Bodlovick noted that there have been several complaints from citizens because Mr. Mechelke was selling the stoves without a Permit. She pointed out that Mr. Mechelke had been told to get a Permit two weeks prior to the time Mr. Mechelke applied for his Special Use Permit. Mr. Mechelke replied that he had applied two days after the Police Chief told him to remove his'signs from the telephone poles. There was some discussion as to whether or not a Permit should be issued, since.Mr. Mechelke had been selling the stoves illegally. Mr. Mechelke stated that he planned to display an advertising sign approximately 2' x 18" on Weekends only.- His hours of operation are Saturdays from 10:00 A.M. to 5100 P.M. and Sundays from 1100 P.M. to 5e00 P.M. Stillwater Planning Commission Minutes December 5, 1977 Page Two Russell Meister moved that the Stillwater Planning Commission recommend that a Special Use Permit be granted to Jerry Mechelke to sell woodburning stoves from his home at 809 W. St. Croix Avenue, with the following restrictions: (1) The advertising sign will be non -illuminated and no larger than four square feet; (2) hours of operation will be restricted to weekends, Saturdays from 10:00 A.M. to 5:00 P.M. and Sundays from 1:00 P.M. to 5:00 P.M.; (3) there will be no outside. storage of the stoves; (4) this Permit will expire in one year, at which time it will be reviewed. The motion was seconded and passed, with one opposition by Ann Bodlovick. Case No. 304. Applicant: Dan Dana. Address: 821 N. Fourth Street. Permit to convert dwelling into three-plex in two-family district. Mr. Dana did not appear at the meeting, so'the Planning Commission tabled its decision on this case. Case No. 305. Applicant: Delbert Wheeler. Address: 615 South Holcombe. Permit to operate chain saw sales and sharpening service and small engine repair. Mr..Wheeler stated that he is trying to work up a business so that he eventually will operate from another building, preferably in a commercial area.. He wants to start his business from his home. His hours of operation will be from 8:00 A.M. to 5:00 P.M. every day except Sunday. He noted that his neighbors are all in favor of his plans. Mr. Wheeler stated that he will display a sign about.30" in size at the back of his lot. Mary Lou True stated her concern in regard to the noise generated by the chain saws when customers would want to try them out. Mr. Wheeler stated that the brand of saw he would be selling is relatively quiet compared to the older models. Mary Lou True moved that the Stillwater Planning Commission recommend that a Special Use Permit be granted to Delbert Wheeler to operate chain saw sales, service, and small engine repair at 615 South Holcombe, with the following restrictions: (1) Hours of operation will be Monday through Saturday, from 8:00 A.M. to 5:00 P.M.1 (2) the advertising sign will be non -illuminated and no larger than four square feet; and (3) this Permit will expire in one year, at which time it will be reviewed. The motion was seconded and passed unanimously. Case No. 306. Applicants Bill' Hann. Address of Property: 209 South Main Street. Permit for a residence in commercial district. Mr. Hann noted that he owned the Coast -to -Coast stone.. It is a two-story building, and five older gentlemen live upstairs. Mr. Hann stated that conditions are such that even if he does not get approval for the Permit, he will do something with the upstairs Stillwater Planning Commission Minutes December 5, 1977 Page Three because it is not suitable for anyone to continue'living in it at'this point. Mr. Hann's plans are to convert the upstairs into a two -bedroom apartment for his family. He showed the Commissioners sketches of his plans for the apartment. He plans to gut the upstairs and hopes to get down to the original walls. Mary Lou True asked about living facilities for the five gentlemen currently living upstairs, and Mr. Hann replied that two had already found another residence, and he would help the others find suitable accommodations. Charles Swanson moved that the Stillwater Planning Commission recommend that a Special Use Permit be granted to Bill Hann'to convert the second floor of the Coast -to -Coast store at 209 South Main Street into an apartment. The motion was seconded and'passed unanimously. GRAND GARAGE RESTAURANTS Mr. Paul Pink, architect representing Mr. Perkl, showed the Commissioners drawings of the Grand Garage shops and restaurants. It was noted that a Special Use Permit would not be necessary at this time,,but the City had requested that plans be shown to the Planning Commission and Council, so that suggestions might be made. Mr. Pink noted that there will be a dining -bar -lounge area on the first floor, and another restaurant -lounge upstairs, as well as party rooms and a piano bar and lounge which will overlook Main Street. The seating capacity upstairs in the restaurant will be 113, in the bar -lounge area 85, and in the lower dining area 105. There was some discussion as to the parking problems which would occur on the weekends. Mr. Pink stated that they really had not gone into the parking aspect. Mr. Zoller asked when they anticipated opening, and Mr. Pink replied that they would be opening in stages. They hope to start serving in the upper dining area by late winter or early spring. Mr. Pink stated that they do not anticipate 300 people at any one time. He'noted that on the weekends they expect the upstairs dining room to be busy,.while downstairs would probably not draw so many people. Mr. Pink pointed out that if there should be a parking problem, their business would be affected, and they would have to do something about it at that time. Mary Lou True suggested to Mr. Pink that perhaps an area south of the Telephone Company at the end of Nelson Street, which is partially used for lumber storage, could be used for parking. She stated that it might be worthwhile to talk to the owner of the property about using the area for parking on the weekends. Mr. Pink stated that he would talk to Mr. Perkl about the possibility. The Commissioners praised the proposed plans for the Grand Garage. Stillwater Planning Commission Minutes December 5, 1977 Page Four PLANNING COMMISSION APPOINTMENTS Chairman Jeffrey Zoller noted that all but two of the candidates considered for the Planning Commission last July have expressed an interest to -be considered again. Mr. Zoller stated that in an effort to consider each candidate in an unbiased manner, the Candidate Information Sheets for each person had been typed up omitting the name of the candidate. He noted that each sheet was numbered, and the Secretary had a list of the names for each numbered sheet. .Mr. Zoller stated that three of the candidates were currently serving on the Commission, and their terms will expire at the end of the year. All of them have indicated that they would like to remain on the Planning Commission. They are: David Knefelkamp,.Mary Lou True, and Jeffrey Zoller. Russell Meister moved that the Stillwater Planning Commission recommend to the Council that the following candidates remain on the Planning Commission for another term: David Knefelkamp, Mary Lou True, and Jeffrey Zoller. The motion was seconded and passed unanimously. Chairman Zoller noted that Dale Kress had decided to resign from the Planning Commission, so his vacancy must be filled. Ann Bodlovick moved that Candidate No. 10 be recommended to fill the vacancy which exists on the Stillwater Planning Commission. The motion was seconded and passed unanimously. (Candidate No. 10 is Mr. Russell Weitz, 813 Everett Drive.) In the event a second choice candidate is deemed necessary by the City Council, Charles Swanson moved that the Stillwater Planning Commission recommend Candidate No. 5 as its next choice: The motion was seconded and passed unanimously. (Candidate No. 5 is Mr. Tom Palmer, 190 Northland Avenue) RTR HISTORIC SURVEY Mr. Neil Krueger, representing RTR, presented a report on the progress which has been made by RTR in preparing the historic survey of homes in Stillwater. He noted that the Council had granted RTR $1200 for the survey, because -they felt the information would be helpful in the preparation of the Master Plan. Mr. Krueger noted that a Survey Committee had been formed a year ago, and they now have a CETA employee who gathers and coordinates all of the information for the historic survey. They have offices in the old courthouse, donated by the Historic Courthouse Foundation. Mr. Krueger then outlined a letter RTR had prepared to send to the City Council in regard to the survey of Stillwater homes. He noted that 80% of the homes have been photographed, and this will be completed this spring. Stillwater Planning Commission Minutes December 5, 1977 Page Five COOPER'S ADDITION Mr. Gary Swager, representing Swager Brothers, Inc., presented the Commission , with a drawing of the proposed new lotting of Cooper's Addition. He stated that their attorney, Howard Turrentine, had been working with City Attorney Harold Kimmel and Mr. Kimmel had stated that a replatting was not necessary, since this was a viable plat. This drawing now shows a cul-de-sac, and because of this, Lots F & G on the west side of Forward Street were made larger. Mr. Swager stated that the gentleman living on Lots 7 and 8 asked if he could buy 6' of Lot B. Mr. Swager told him he would check with the Planning Commission and that Swager Bros. would have no objections to selling him the 6'. When asked how many duplexes were planned, Mr. Swager replied that he will still hold it to a maximum of six duplexes. Mr. Zoller asked what street improvements they would make, Mr. Swager stated that they.would be directed by the City's wishes. He indicated that they had, contacted the City Engineer for some estimated costs. They will put in the sewer and water, street and curbing. Mr. Swager stated that Mr. Turrentine and Mr. Kimmel had worked together on the new lotting, and the major items agreed upon were that there would be no more than six duplexes. They also agreed that Lots A and B would be strictly single family, and they would not run sewer and water down West Stillwater Avenue --it will run to the West boundaries of Forward Street. Russell Meister moved that the Stillwater -Planning Commission recommend that the City Council review Swager Brothers' proposed new lotting of Cooper's Addition as reviewed by the City Attorney and Mr. Howard Turrentine, representing Swager Brothers. It is recommended that the amity Council direct the City Attorney to draw up an agreement with Swager Brothers regarding the development of this land and -covering the following concerns: That there be a maximum of six duplexes; that Lots A and B be developed in single family homes only, that the developer will not have to provide sewer, water and street improvements on West Stillwater Avenue west of Forward Street; that Lot B be decreased by 6' as requested by the property owner on Lot 7 and 8; that the developer be .required to provide all sewer, water, curb, gutter and streets as required by the ordinance for the development, including the cul-de-sac as shown on the Certificate of Survey dated 11-8-77. In addition, this agreement should indicate that at no time in the future after the land is developed are the single family lots allowed to be increased to two-family lots. The motion was seconded and passed unanimously. Stillwater Planning commission Minutes December.5, 1977 Page S ix NEW ZONING MAP The new zoning map was not available for this meeting, but Chairman Zoller noted that they had seen it at the November 7 meeting. He pointed out that the Council will be considering approval of rezoning the riverfront property to single family, and with that change the new zoning map should be complete. Russell Meister moved that the Stillwater Planning Commission recommend that the City Council have a first reading of an ordinance adopting a new zoning map for the City of Stillwater, pending its decision December 6, 1977 on the rezoning of the riverfront land. The motion was seconded and passed unanimously. NEXT MEETING DATE Due to the fact that the next regularly scheduled meeting would fall on a holiday, the meeting will be held Tuesday, January 3, 1978. ADJOURNMENT The meeting was adjourned at 8:45 P.M.
