Regular Adjourned Meeting.
The meeting was called to order by President Masen.
Present- Councilmen, Bartkey, Bergen, Bourdaghs, Charlsen and President Madsen.
Absent- none
UNFINISHED BUSINESS
Mayor Madsen informed all present that a petition to vacate streets and parts
thereof signed by Arnold J. Deno, Gustav B. Slasrud, W.R. Mahood, Helen K. Wallis,
I*"I'Frederick P. Kalinoff and W.G. Handevidt had been filed with the City Clerk. That
the City Clerk had published notice of hearing on the petition in the official
paper on the following dates, November 4th, loth, l8th.-and 25th, 1955. The notice
set the hearing date on December 6th, 1955 at 7:30 P.M.. That a hearing was held
on December 6th, 1955 at 7:30 P.M. in the Council Chamber and after all persons
interested were heard the hearing was closed, no action was taken on the petition
beoause one of the Councilmen was no$ present due to illness. The meeting was then
adjourned to December 28th, 1955 at 7s30 P.N. and no action was taken at this
meeting'because one of the Councilmen was not present due to illness. The meeting
wasMayor then adjourned to January 5th, 1956 at 7:30 P.M.

Mr. Handevidt and his attorney, Lyle Eckberg were present and again presented a
plat showing the streets and parts thereof proposed to be vacated.

Mr. Lawrence Linner was also present and stated that he would have no objection
to the vacation of North Broadway and the other streets in this area, but he did
object to any assessment in connection with a new street in that area at a later
date, because he felt his property would not be benifitted by a street which
would give access to lots owned by Mr. Handevidt East of his property.

Madsen.

$ .40983 per day,'and the bond covering this application 1n the amount of $1000.00
was also approved. The above action is subject to the approval of the State Liquor
eontrol Commissioner. (Former owner Ben Dobak)
COMMBNICATIONS
From St. Croix Barge Terminal Company informing the Council members that 10,180.45
tone of coal and 1,200 tons of grain moved through the terminal during the calender
year 1955. (A check in the amount of $1000.00 was also enclosed covering rental pay-
ment due January 15, 1956)
From the Stillwater Fire Department Relief Association requesting approval to invest

Clerk reported that he is still holding the lease between the City and the Parents
Group of Stillwater in connection with the old Schulenberg School Building, because
hd has not received the public liability insurance policy from the Parents Group as
stipulated in the lease. On motion of Councilman Bourdaghs seconded by Councilman
Bergen the Clerk was directed to contact the .ecretary of the Parents Group in regard
to this matter.
Clerk reported that at a meeting held on January 4, 1955, Councilman Bartkey brought
up the matter of bringing the hater Department under the jurisdiction of the City
Council and at that meeting it was moved and carried that this matter be brought up
at the regular meeting in January 1956. (No action taken)

COMMITTEE REPORTS
Councilman Bourdaghs;
He stated that he had received a request from the Chief of the Fire Department
^ in regard to changing some of the present rules as adopted some time ago. The
Chief suggested that Rule Number 344 be changed to read as follows; Firemen shall
wear blue chambray shirts; black fore -in -hand tie; black shoes• and regulation
Fire Department cap and badge; fatigue clothes shall consist or blue denim trousers,
blue shirts and black shoes. On motion of Councilman Bourdaghs seconded by Council-
man Bergen it was decided to change Rule Number 3-C as suggested by the Fire Chief.
He reported that some auxillary firemen are now sleeping at the fire station and
that he would like permission to purchase new beds, he stated that some of the beds
aa now In use are in deplorable condition. He estimated the cost at about $350.00, on
motion of Councilman Bergen seconded by Councilman Bartkey the matter was referred
to Councilman Bourdaghs with power to act.
He also explained that the auxillary firemen do not have boots, coats and helmets,
and requested authority to purchase these needed items, he felt that four or five
complete units would cover the heeds at this time and estimated the coat at about
$60.00 per unit. On motion of Councilman Bergen seconded by Councilman Bartkdy this
matter was referred to Councilman Bourdaghs with power to act.
He reported that the skating rinks are in pretty good condition, but that only a
few children are using same.
He stated that there was no activity at the bathing beaches at the present time.????
Councilman Bergen;
He inquired of the Engineer if new street signs have been ordered as proposed at
a meeting some time ago. The City Engineer informed him that some new signs have
been installed.
He inquired if all steps had been taken to insure the installation of traffic
control signals at the intersection of Main and Myrtle streets. The Mayor informed
him that the City had entered into a contract with the State of Minnesota for the
installation of the signals several months ago.
He stated that Mr. Malcomb Brown who resides at Bitterest Drive had talked to him
about improving the drainage in connection with his jroperty, Mr Brown suggested
that a culvert would proahly solve the problem. The City Engineer stated that he
was aware of the condition and that it would be an extensive job, Mayor Madsen
suggested that the Engineer prepare an estimate of cost to correct this condition.

consider changing the direction of traffic on North Third Street, North of Myrtle

stated that he did send a deed to Mr. Casey fee his signature some time ago, but
has heard nothing from Mr. Casey.
He suggested that some arrangements should be made to contact citzens who were
notified last year to repair their sidewalks and failed to conform with the request.
Councilnan Bartkey;
He commended the Street Department and the highway Department for a fine job of
removing ice and snow with a power grader along Hain Street and inquired of the
City Engineer if he intended to do likewise on other down town streets. The Eng-
ineer informed him that he intends to clear all down town streets as soon as
possible.
Mayor Madsen;
,a• He suggested that the Council pass a resolution which would authorize the City
Attorney to call on Mr. Lyle Eckterg whenever he needs assistance. (see resolution)

NEW BUTSINESS
On motion of Councilman Bourdaghs seconded by Councilman Bartkey the contract between
the City and the Stillwater Evening Gazette for official printing and advertising
during the year 1956, as drawn up by the City Attorney was approved and the Mayor
and Clerk were directed to sign same.
The City Clerk presented a report of Municipal and Concilliation Court activities
during the year 1955.
On motion of Councilman Bourdaghs seconded by Councilman Bergen the following contracts
for furnishing fire protection were approved and the Mayor and City Clerk were directed
to sign same;
1. Oak Park Township. 2. Stillwater Township. 3. Grant Township. 4. May Township.
On motion of Councilman Bourdaghs seconded by Councilman Bergen the Mayor and Clerk
were authorized and directed to sign Assent to Registration of land in the matter
of the application of Otto 0. Shelly and Clara L. Shelly, to register title.
The annual report of the Fire Department as prepared by the Fire Chief was presented
and on motion of Councilman Bourdaghs seconded by Councilman partkey the report was
accepted and the Chief was commended for a fine report, (1955) and a job well done.
The annual report of building activities for the year 1955, as prepared by Mr. Simmons
Building Inapdoter was presented, and on motion of Councilman Bourdaghs seconded by
Councilman Bartkey the report was accepted and Fr. Simmons was commended for a fine
report and a job well done.
On motion of Councilman Bergen seconded by Councilman Bourdaghs it was decided to
permit Mr. Ray Steiner to park his trailer house in -back of the store he operates
at 807 North First Street for a period of two years.
On motion of Councilman Bergen seconded by Councilman Bourdaghs the City Clerk was
directed to advertise for bids on a'now truck for the street department, bids re-
turnable February 7, 1956 at 7:30 P.M.

The following resolutions were read and were on roll call unanimously adopted;
1. Directing the payment of bills.
2. Authorizing and directing the City Treasurer to pay Joseph Junker and Son for
collecting, transporting, burying and disposing of garbage and refuse for the
month of December 1955.
3. Authorizing the issue and sale of Certificate of Indebtedness to pay for garbage
and refuse collection and removal for the month of December 1955.
4. Fixing rental charge for rotary snowloader.
5. Authorizing the employment of special counsel if necessary.

The meeting was called to order by President Madsen.

The meeting was called for the purpose of considering an application from Edward
and Dean Buege to operate two taxi cabs in the City.
Mr. Edward and Dean Buege appeared before the Council and explained that they
plan to operate two cabs from their garage at 114 West Churchill Street, and
stated they can obtain proper insurance to Bober the operation as provided in
the ordinance regulating taxi cabs.

On motion of Councilman Bergen seconded by Councilman Charlsen a cigarette license

COMMUNICATIONS
From Dwaine Burke, Route 1 Stillwater, reporting an accident on January 13, 1956
at about 4:30 P.M., he states that he was walking on the sidewalk in front of the
Simonot Furniture and Carpet Company, when he slipped due to ice on the sidewalk and
fell through a plate glass window cutting his hand severly.
From the League of Minnesota Municipalities announcing the dates for the various
municipal short courses at the University of Minnesota at the center for continuation
study. ( the Mayor suggested this matter be brought to the Councils attention at the
meeting on March 6, 1956.)

ference on February 17, 1956 at the State Office Building Auditorium.

On motion of Councilman Bergen seconded by Councilman Bourdaghs it was decided
to.purchase a three quarter ton Dodge truck, six cylinder at E. net cost to the
City of 61257.55. (Bloom Motor Company)
On motion of Councilman Bergen seconded by Councilman Bartkey the Clerk -Treasurer
was directed to refund 6146.31 to Ben Dobak on a 1956 off sale liquor license fee.
Mr. Dobak sold his place of business namely the Stillwater Liquor store to Lawrence
Rolbiecki and Mr. Rolbiecki was granted a liquor license effective January 10, 1956
for the balance of the year 1956 at a fee of $146.31 at the rate of $.40953 per day.
The City Engineer presented plans to correct the drainage problem in the vicinty
of the Carrol J. Brown property on Third Avenue South and he estimated the cost
at about 63636.00. Councilman Bergen suggested that the City Engineer inform Mr.
Brown of the estimated cost to correct the condition as it now exists.
COMMITTEE REPORTS
Councilman Bourdaghs:
1. He presented a report as prepared by the Chief of the Fire Department for the
month of January 1956.
2. He also presented a report prepared by the Chief of the Fire Department in regard
tc auxiliary firemen. (see resolution)
3, He suggested that the Mayor write a letter to the employers of the auxilary firemen
and inquire if they would be willing to allow their employees to leave their work
in case of fire calls and if they would pay their regular compensation for time
lost away from their work while serving as firemen for the City of Stillwater.
4. He reported that the City could acquire insurance coverage for auxilary firemen
at the rate of 62.00 per year for each fireman. On motion of Councilman Bourdaghs
seconded by Councilman Bergen it was decided to cover the auxilary firemen with
insurance as outlined by Councilman Bourdaghs.
5. He reported that skating activities were coming along in good shape.

Councilman Bergen:
1. He reminded the City Engineer about surfacing the balance of the free parking
areas as soon as weather permits.
Councilman Charlsen:
1. He stated that the dormitory at the fire station is in deplorable condition and
suggested that the Council consider calling fcr bids to lower the present ceiling
and install some type of insulation tile and also paint the walls and wood work.
Mayor Madsen suggested that Councilman Charlsen get estimate of costa to do this
work.
2. He inquired if the Council would consider authorizing an expenditure to construct
basketball courts in Washington Park and Staples Field. Mayor Madsen suggested
that he get an estimate of the cost.

regard to this matter.
Councilman Bartkey:
1. He stated that three or four loads of sand would improve the beach at Lily Lake
and inquired if it would be permissible to haul sand from the hillside at the
Legion -Beach. The Council members could see no objection.
Mayor Madsen:
1. He reported that Herb Theisen had talked to him about the accident last year in
which His car was damaged. Mr Theisen informed the Mayor that this accident was
due to a hole or trench near the street in the vicinty of the Walter Nelson Add-
ition at Lily Lake. Mr. Ritzer was hired by Mr. Nelson to lay water mains in this
area and the hole or trench was an excavation in connection with laying of water
mains. The City Attorney stated that there was a question in regard to liability.
Mayor Madsen suggested that the City Attorney contact Mr. Theisen in regard to
this matter.
4. He stated that he is receiving many calls and complaints about dogs running at
large and feels that it may be necessary to pass a lease ordinance.
3. He reported that a campaign has been launched by the owners of the local radio
station about the condition of the old peaslee building on main street, which was
partially destroyed by fire some time ago. He stated that Mr. Peaslee had informed
him that arrangements have been made for razing of the balance of the structure.
NEW BUSINESS
The annual report cuvering activities of the Police Department during the year 1955
as prepared by the Chief of Police was presented. On motion of Councilman Bourdeghs
s•cohded by Councilman Bergen the report was ordered filed and the Chief was commended
for a fine report and a job well done during the year 1955.
Mayor Madsen brought up the matter of garbage assessments, he suggested that the
Council consider amending our present ordinance to permit collection of assessments
in advance which would eliminate much work in the office and would also be a saving
to the taxpayer because it would eliminate interest now paid on certificates of
indebtedness to finance the garbage program. On motion of Councilman Bourdaghs seconded
by Councilman Bergen the City Attorney was directed to amend our present ordinance
to allow for payments of assessments in advance.
On motion of Councilman Charlsen seconded by Councilman Bergen, Raymond F. Law, Chief
of Police was appointed a member of the Board of Health for an indefinite term effective
January 1, 1956.
On motion of Councilman Charlsen seconded by Councilman Bartkey it was decided to hire
Herb Bailin, Deputy County Auditor to print new property roll books for use in the City
Clerk's office. The books now in use are not adequate for present day requirements and
they do not show exempt property which is important when assessment rolls are prepared.
Clerk inquired if the Council members would be interested in a binder for each member
for the purpose of keeping copies of minutes for future use. Mayor Madsen suggested that
the Clerk order binders and necessary paper for this purpose.
On motion of Councilman Bergen seconded by Councilman Bartkey the City Clerk was authorized
to purchase a new Royal typewriter for use in his office.

On motion of Councilman Bartkey seconded by Councilman Charlsen permission was
granted to the Logger Baseball team to sponsor a carnival at the athleticifield
on June 18-19-20, 1956, and the regular license fee was waived.
On motion of Councilman Charlsen seconded by Councilman Bartkey a special permit
was granted to Frank Erlitz to erect a gravel hopper for loading trucks to be
located at the southeast corner of the City limits.
Mr. Radle presented a preliminary plat of a new addition to be known as "Radials
Sunny Slope Addition", no action was taken at this time.
Mr. John Harrigan, Esq. appeared before the Council representing Mr. Walter Wolf.
Mr. Harrigan explained that Mr. Wolf has an option to buy a strip of ground from
James W. O'Brien, this strip of ground is located near the North City limits.
Mr. Harrigan stated that when Mr. Wolf acquires this property he would be willing
to deed same to the City on condition that the City Council make a request to the
Federal Government to have the river dredged along this property so that Mr. Wolf
could operate a small boat harbor. Mr. Harrigan stated that it would also be

On motion of Councilman Bourdaghs seconded by Councilman Charlsen the Clerk made
the second reading of an ordinance " To license and regulate second-hand dealers,
other than second-hand automobile and second-hand automobile parts dealers".
Roll call was taken after the reading of each section, and each section was unani-
mously adopted. The Chair then put the question shall this ordinance pass and -on
roll all the Council members voted unanimously for its adoption.

COMMUNICATIONS
From Mr. Herman Griff, reporting an accident in which he was injured, he states that he
fell on the sidewalk on myrtle street between third and second street near the Lowell Inn.
He claims the fall was due to ice on the sidewalk. Clerk reported that a copy of the
notice was mailed to the Kroll Insurance Agency.
From State of Minnesota, Liquor Control Commissioner, informing the Clerk that all On
Sale liquor licenses must be issued for a period of one year. In cases in which the
liquor dealer paid only one half of the license fee as authorized by the Council some
time ago, the Clerk issued these licenses for a period of six months, because a license
is a receipt and it would be possible for a dealer to operate for one year on payment
of only one half of the yearly fee.
From the State of Minnesota, Railroad and Warehouse Commission in regard to change of
schedule and transfer of the Stillwater Minneapolis Bus Company.
Fran Mrs. Frank Schilling, 1214 Third Avenue South reporting an accident on February
10, 1956 at about 5:10 P.M. in which she was injured, the accident occured in front of
the Ben Franklin Store. She claims the fall on the sidewalk was due to ice which had
accumlated from water dripping off the metal overhanging awning in front of the Ben
Franklin store. Clerk reported that a copy of the notice was mailed to the Krog Insurance
Agency.
From the League of Minnesota Municipalities announcing the dates of various municipal

From J.L. Becker, with sketch attached, requesting permission to lay a sewer on South
Sixth Street. On motion of Councilman Bergen seconded by Councilman Bourdaghs permission
was granted subject to the payment of a connection fee in the amount of $50.00.
From Henry Schmidt, 333 West Laurel Street, reporting damage to his home which he claims
was due to sewage backing up as a result of the cleaning of the main sewer by the street
department. Mayor Madsen suggested that this matter be turned over to the City Attorney.
The City Attorney read a letter from John Harrigan, who is representing Mr. Walter Wolf
and James O'Brien in regard to a proposed small boat harbor on the river near the north
City limits. Mr.jarrigan suggested that the Council take the necessary steps to have
the river dredged -This area by the Federal Government so same would be suitable for a
small boat harbor. On motion of Councilman Bourdaghs seconded by Councilman Be"gen it
was decided to make a carefulinspection of the area involved before ac(epting title to
this property and if in the opinion of the Council members the site is suitable for a
boat harbor then application could be made to the Federal gonernment to have the river
dredged.

Councilman Bourdaghs;
1. He stated that he had met with the town boards now under contract with the City
for fire protection and that the members of the various boards indicated that
they would be willing to go along with the plan suggested by him and Fire Chief
Lawson, and in some cases the board members offered more liberal terms then those
suggested by him and the Chief. He suggested that the Council meet in the near
• future so that he could give a full report on the meeting.
2. He stated that the skating season has closed.
Councilman Bergen;
1. He stated that he had talked with Mr. Brown about the estimated cost of correcting
the drainage problem near his home and that Mr. Brown will contact the City Engineer
in regard to this matter.
2. He stated that Mr. Gilbert had complained about citzens keeping horses within the
City limits, and that he had talked with the owner of the horse and was assured
that the horse will be removed from the City.
3, He stated that he has received a request from Mr. Harvieux who operates a rest home
in the City for installation of quite signs.
4. He suggested that the Council call for bids to apply bituminous surfacing on the
river parking area and for laying of a new sidewalk on South Third Street between
the L•ahman store building and the school property. On motion of Councilman Bergen
seconded by Councilman Bourdaghs the City Engineer was ordered to prepare plans
and specifications as soon as possible to cover the above mentioned projects, so
that the Council would be in a position to advertise for bids.
Councilman Charlsen;
1. He stated that notice for bids to install a new ceiling in the dormitory at the
fire station have not been published due to the fact that specifications were not
available until recently, and the Clerk was instructed to -advertise for bids ret-
urnable on April 3, 1956 at 7:30 P.M.

2. He also stated that notice for bids to construct basketball courts in Staples field
and Washington Park has not been published and sugrested that the Engineer meet with
him to determine cites as socn as possible.

The matter of license fees for a new type of amusement machine known as a minature
pool table was discussed. A Mr. Anderson from Hudson, Wisconsin, appeared before the
Council and explained the new machine in detail and stated that in his opinion the
ordinance covering license fees for pin ball machines was to high for this new type
of machine. He explained that this new machine does not offer free plays or any kind
of prize. On motion of Councilman Bourdaghs seconded by Councilman Bergen the City
Attorney was instructed to amend our present ordinance on amusement machines and fix
the following license fees; $15.00 for operators license and $5.00 for each machine.
A report for the month of February 1956 covering the activities of the Fire Department
as prepared by the Chief of the department was read, and on motion of Councilman

Highway Taxes Distribution Commission.
From John Lawson, Fire Chief, addressed to Councilman Bourdagha in which the Chief
recommedded an increase in salary for Roy Edstrom a fireman who has worked in the
department for the past 90 days. The Chief also suggested that a definite expense
account be set up for two of his men who will attend the fifth annual fire school at
the university of Minnesota farm campus for the period from April 23 through 27, 1956.
On motion of Councilman Charlsen seconded by Councilman Bergen the matter of the expense
account for firemen attending school was referred to Councilman Bourdaghs with power
to act. (See resolution on salary increase for Roy Edstrom)

UNFINISHED BUSINESS
The City Attorney suggested that the Council authorize him to settle the claim filed
by Henry Schmidt, 333 West Laurel Street, for damage to his home due to sewage backing
up from the main sewer. He also stated that this type of a claim is not cobered by our
present insurance and that any settlement would be a general fund expenditure. The
Council members present agreed to abide by the City Attorneys' recommendation.
The City Engineer presented plans and estimate of cost to surface the free parking log
along the river front, he stated that it would require 3600 square yards of bituminous
material at an estimated cost of 04140.00. He also stated that he would have plans
and estimated cost to lay new sidewalks along South Third Street between the Luhman
store and school property, at the next regular meeting of the Council.
The matter of a small boat harbor as presented by John Harrigan representing Walter
Wolff and James O'Brien at a recent meeting was discussed. Councilman Charlsen stated
that he was informed that the Federal Government would not be interested in dredging
for a boat harbor until they are assured that a gasoline pump would be installed on the
dock and a full time employee assigned to take charge of the dock and facilities. It
was decided to lay this matter over to the next regular meeting of the Council.

Mr. Radio appeared before the Council in regard to the new addition known as "Radle's
Sunny Slope a plat of which was approved at a previous meeting. Mr. Radio inquired if
the City would maintain the pee's areas in this addition and also requested a letter
setting forth the contention that the present level of Echo Lane is approximately within
six ,r seven inches of final grade, he stated this information was necessary to get F,H,A.
approval of the new addition. On motion of Councilman Charlsen seconded by Councilman
Bartkey it was decided to accept the park areas from Mr. Radio and maintain them after
the areas have been improved so that same would be suitable for park purposes, On motion
of Councilman Bartkey seconded by Councilman Charlsen the City Clerk was directed to
write a letter to the Federal Housing Administration and inform them that the street
grades will be approximately six or seven inches of the present ground level but cannot
be accruatley determined until a final survey 1a made.
On motion of Councilman Charlsen seconded by Councilman Bartkey the City Clerk was
directed to advertise for bids on 14 or 16 voting machines, bids to be returnable at the
next regular meeting of the Council on May 1, 1956, at 7:30 P.M.
On motion of Councilman Bergen seconded by Councilman Charlsen the "Order for Motor
VehicZ,s" as prepared by Irving Bloom of the Bloom Motor Company, covering the purchase
of a new 1956 Dodge pick up truck for the street department was approved. City Attorney
stated that in his opinion it was not necessary to draw a contract covering this purchase.

install a metal fire escape from the second floor of the City Hall for $371.50. On
motion of Councilman Bergen seconded by Councilman Bartkey the natter was referred
to Councilman Charlsen with power to act.
Councilman Bartkey;
1. He statedthat plans are under way for the installation of a diving tower and new
equipment for Lily lake beach, he estimated the cost the--coat-of a float at about
$1470.00, but felt the new equipment could not be purchased until sometime during
the year 1957.
2. He reported that the dumpmaster was complaining about the dumping of waste material
pumped from cesspools.

NEW BUSINESS
Councilman Bourdaghs suggested that the Council consider the matte* of adopting the.
National Fire Prevention Code. After some discussion, on motion of Councilman Bourdaghs
seconded by Councilman Bergen the following committee was appointed to study the
national code and report their findings to the Council at some later date; Bert
Simmons, Building Inspector- John Lawson, Fire Chief- Henry Klindworth, Fire Marshall,
Dick Ritzer appeared before the Council and requested that the Council deignate a
location for dumping of contents from cesspools, he stated that the City Engineer had
suggested that he. dump same in a man hole on the barge terminal property now under lease,
Mr. Ritzer stated that one of the employee' at the barge terminal informed him that he
could not dump at that location. On motion of Councilman Charlsen seconded by Council-
man Bourdaghs the City Clerk was directed to contact the officers of the Barge Terminal
Company and request permission to dump contents pumped from cesspools in a man hole
located on the terminal property near the river,
Lyle Eckberg, Esq, appeared before the Council and explained that an organisation known
as Alcohol Anopymous are interested in the old MoKuish property located on the corner
of Pine and Second Streets. He stated that the organization would use the premises for
women patients only and requested that the Council grant a special permit to use the
.property for the purpose mentioned above, On motion of Councilman Bourdaghs seconded
by Councilman Bartkey a special permit was granted subject,to the approval of the State
Fire Marshall and Health Officer,
Councilman Charlsen brought up the matter of sick leave for appointed City Officials
and employees, he explained that at the present time the maximum sick leave allowed
is 30 days which is accumulated at the rate of 1 day per month, and felt that in his
opinion this arrangement is unfair to officials and employees who have worked for the
City over a long period of time. Mayor Madsen appointed the following committee to study
this matter and report at a later date, Councilman Charlsen, Bergen and Bourdaghs.
Clerk reported that certain appointed City Officials are not covered by Workmen's Comp-
ensation according to an opinion rendered by the Attorney General. The Clerk was instru-
cted to contact the ihsurance company and inquire if all appointed City 0fficials are
covered under our present policy.
On motion of Councilman Charlsen seconded by Councilman Bartkey the Clerk was authorized

to increase the pay of part time employees in his office from $.85 to $1.00 per hour..
On motion of Councilman Bourdagha seconded by Councilman Bergen insurance policy number
5174 issued by the Minneapolis Fire and Marine Insurance Company covering the public
bath house at the Legion Beach was approved and ordered filed.
On motion of Councilman Bergen seconded by Councilman Charlsen insurance policy number
XP-2766 issued by the Exchange Insurance Association, Chicago, Illinois, covering the
B1g-E-Taxi Company in the following amounts was approved and ordered filed. Bodily injury
liability $25,000.00 each person and $50,000.00 each accident -Property damage liability
$5000.00 each accident.
On motion of Councilman Bourdaghs seconded by Councilman Bartkey the City Clerk was auth-
orized to attend the Institute of Municipal Clerks to be held in New Orleans, Lorisana,

Mr. Sherman Crane appeared before the Council and explained that Maple Island Firma, Inc.
are now manufacturing a new cream mix which will be delivered to their customers by
large tank trailers, and stated that in order to accomdate these largo trailers it will
be necessary to remove certain meters in front of their place of business on -North Main
Street. On motion of Councilman Bourdaghs seconded by Councilman Chaplain it was decided
to remove three meters as requested by Mr. Crane and install no parking signs along this
area.
,.. Mr. Tom Curtis appeared before the Council and stated that he would proably have land
available for garbage and refuse disposal, and that he would enter into a long term
contract with the City to dispose of garbage at the rate of $75.00 per month.
Clerk read a report prepared by the Chief of the Fire Department covering activities
of the department during the month of March 1956. The Chief also suggested that the
Council authorize necessary funds to complete a training program for auxillay firemen.
On motion of Councilman Charlsen seconded by Councilman Bergen it was decided to refer
the matter of additional expense for training auxiliary firemen to Councilman Bourdaghs
with power to act.

length from the inside line of the present sidewalk)
PETITIONS
A petition signed by Forrest A. Nutting and Bonnie Jean Nutting asking for the vacation
of part of Grove Street, with plat attached showing the portion of the street to be vacated,
was presented. On motion of Councilmen Bourdaghs seconded by Councilman Bergen the petition
was ordered filed and the City Clerk was directed to publish notice of hearing as provided
in the Charter. The date for hearing on the petition was set for June 5, 1956 at 7:30 P.M.
A petition with eight signatures requesting that the owner of the vacant property on the
corner of Pine and Harriet Streets, have same cleared off immediately, was read. No
action was taken because the petition was not directed to the City Council.
UNFINISHEL BUSINESS
:he City Attorney reported that he had settled the claim against the City which was filed
by Henry Schmidt who resides at 333 West Laurel Street. He stated that Mr. Schmidt agreed
to accept 0200.00.
On motion of Councilman Bergen seconded by Councilman Charlsen the plans and specifications
for laying new sidewalks on South Third Street between the Luhman Store and Pine Street
as prepared by the City Engineer were approved. (estimated Cost 412.00 per foot, total
cost for job $5044.00)
The matter of constructing a small boat harbor as proposed by John Harrigan representing
Mr. Walter Wolf and James O'Brien was again discussed. On motion of Councilman Bourdaghs
seconded by Councilman Bartkey the proper City official was directed to make a request to
the Federal Government to have the river dredged in front of the suggested site so same
would be usable for a small boat harbor. (Near North City Limits)
On motion of Councilman Charlsen seccnded by Councilman Bourdaghs the contract between the
City and Ed. Zahler and Ovitt Wrangham covering installat;on of a new ceiling in the dormitory

The City Attorney reported that after checking the law in his opinion certain

The Clerk reported that he had contacted Mr. Art Kleinschnitz about dumping of
waste materials pumped from cess pools in a manhole located on the barge terminal
property now under lease. Mr. hleinschnitz is presently employed by the Widholm
^m/ Transfer Company who apparently are sub -leasing this property from the Barge
Terminal Company. The Clerk stated that he had not received a reply from Mr.
,,,• itleinschnitz. Mayor Madsen stated that the Mayor of Bayport had contacted him
and objected to any dumping of cess pool waste into the river.
Clerk reported on permanent registration of voters referred to him at a previous
meeting. He stated that he had made a trip to Red Wing to study the methods now
in operation there and felt that it is the tusiness like way of conducting elec-
tions, but that it would almost be impossible to get properly set up at this
late date for the coming elections during the year 1956. But suggested that the
Council consider the matter of passing a resolution covering permanent voter
registration to become effective in 1958.
Clerk stated that he would like suggestions and advice from the Council in regard
to billing for garbage removal and disposition in advance as authorized by e re-
cent ordinance. On motion of Councilman bourdaghs seconded by Councilman Bartkey
it was decided to include the advance billing along with the statements mailed
out covering the period from February 1, 1956 to August 1, 1956. The advance
billing would cover the period from August 1, 1956 to February 1, 1957.

1. He reported that life guards have been hired for the coming bathing season and that
the beaches will be ready for the opening day.

1. He reported that Mrs. Jesse had called him in regard to the condition at Olive and
Fourth Streets, she complained about bricks and stones on the streets.
2. He stated that Mary JaneLeonard who resides at St. Croix Beach had inquired of him if
the City had any old cement blocks which she could use for a sidewalk.
3. He stated that in his opinion it probably would be a good idea to encourage home owners
to install fire extinguishersin their homes. Having in mind that such an arrangement
might tend to hold the low insurance rates that the residents now enjoy.
4. He reported that a street sweeper has been rented from the Jay W. Craig Company at the
rate of $8.00 per hour including one man.
5. He inquired if the new rest rooms at Lowell Park have been completed.
6. He suggested that the Council consider installing quiet signs in the areas where our
present rest homes are located.
Councilman Charlsen:
1. He reported that an exit door and fire escape have been installed on the second floor
of the City Hall.
2. He reported that the new ceiling and wiring in the dormitory at the fire station is
complete, but that light fixtures have not been installed.
3. He stated that it will be necessary to install an exit light in connection with the
fire escape leading from the second floor of the City Hall and also an outside light.
4. He stated that in order to comply with the law it will be necessary to cover the stoker
pit, install hand rail on front stairway andprovide a three prong plug for electric
drill and toils at the Fire Station.

ment of Claire Dilts, Dale Krongard and John Mudgett as regular auxiliary firemen.
He also inquired if the fire trucks are allowed to travel North on North Third
Street which is designated as a one way street allowing regular travel in a
southerly direction. On motion of Councilman Bourdaghs seconded by Councilman
Bergen Clair Dilts, Dale Krongard and John Mudgett were appointed regular auxi-
liary firemen. The Council members were agreed that fire trucks can not travel
North on North Third Street between Myrtle and Laurel Streets.
City Attorney reported that he has a motion for dismissal of a judgment against
the City pending in District Court. The case was tried in 1951 entitled Beaudette
vs City of Stillwater. A judgment was ordered against the City in the amount
of w 750.00 which covered alleged dan.a€es due to change of certain street graces
and diverting surface water over score of the Ecaudette property along New Orleans
Street and also interferring with a driveway into the same yroperty.

Mr. Harlan Schull and Yr. Arnie Sorenson e_peared before the Council representing the
local Junior Chamber of Commerce requesting permission to use Staples Field for an auto-
mobile rodeo on May 19th, 1956. The Mayor and Council members felt that such an event

Stillwater, and providing punishment for the violation of the provisions of said ordinance",
passed December 21, 1920, published December 22, 1920 and as amended. The ordinance was
read section by section and on roll call vote after each section, all votes being unanim usly
in favor and when the chair put the question shall this ordinance pass it was on roll call
vote unanimously adopted.

enclosed a bid bond and the City Attorney ruled that certified checks are required according

From the City Attorney addressed to the City Clerk in regard to compensation insurance
4 as it effects appointed City officials, also attached were two letters from the Em-
ployers mutual Liability Insurance Company of Wisconsin, the company that covers the
city at the present time. According to one of the letters from the company they indi-
cate that in the case of Stillwater all appointed officials are fully covered with the
exception of the assessor. The City Attorney was instructed to contart the company
arain and inquire why the assessor is not covered.

Councilman Tergen stated thnt he and the City Engineer had visited the area in question

proposed changes as outlined by the city Engineer and Mr. Handevidt. The City Engineer
then stated thnt he tried to get Mr. Linner to state his position on the matter but
that Mr. Linner would not commit himself. The Fngineer also stated that the contractor
did exceed certain reeding beyond his instructions. Councilman Perren inquired of the
City Engineer if a pint had been presented by Mr. Snndevidt for formal approval by the

Thiswas the night set for the public hearing on the petition to vacate a part of Grove
Street. John Thoreen, Veg. representing Mr. and Mrs. Forrest Nutting the petitioners
made the following remarks. That the petition was approved by the Council as to form
and legality; that ell the land on both sides of that part of grove Street sought to be
vacated is owned by the petitioners; that Grove Street as platted has ne:er given access
to Lily Lake because a strip of around 100 feet wide along the < , .., line is privately
owned; that iemloc': and Lake Street provide public •:ccoss to Lily Lake and that the
request for vacat.L.: cart of Grove Street is 'rased on the fact sbst t will provide
additional building sites. Mr. George Rutz state l that :a his :Anion Grove Strnat
has been changed as to location without permission end that ne gas unposed to vacating
same. Mr. Mel Krohn stated that at the present time Grove Street presents a drainage
problem and felt that considerable money would hnve to be spent in order to make Grove
r- Street passible for public use. Mr. Thoreen stated that vacating the Street would be of
no monitary gain for Mr. Nutting because of the expense involved to properly drain this
area and that Mr. Nutting would he happy if Grove Street was opened to the public at
City expense. Mr. Jack Jewell inquired of Mr. Thorsen if Mr. Notting had changed
the Trade of Grove Street any time during the construction of his new home. Mr. Thoreen
stated that the grade was changed by the City. Clarence Gehrke stated that if Grove
Street does not continue through to Lily Lake then he and many other people have
trespassed on private pronerty. He Also stated that he hoped the City Council would
see fit to open Grove Street so that the public would have access to that pert of the
lake because of the snndy shore line which would he ideal to launch small hosts. Mr.
Jewell inquired if Mr. Nutting would be willing to pay all expenses in connection with
fl the drainage problem in that area. Mr. Thereon answered that Mr. Nutting would pay
all such expenses if the street is vacated. The hearing was then closed by Vice Pres-
ident Pourdaghs end he informed all present that no action could to taken this evening
due to the absence of the Mayor. He stated that according to our Charter a street
cannot Fe vacated unless all members of the Council are in favor. On motion of Council-
man Barren seconded by Councilman Partkey action was deferred on the petition until
such time when all Council members are present.
This was the night set to publicly open bids on garbage collection and disposal for
the period from August 1, 1956 to August 1, 1959. The following bids were opened and

sprinkling City streets with tar during the year 1956, between the City end Koppers

Street breaking up tut that the street crew is making repairs.

Clerk reported that Dewey Kelson would like to have the Council consider granting him C,

Clerk reported that Mrs. truenberg who resides at 102 South Rarriet Street paid her
local assessment under pretest. She claims that the street in front of her home is
very rough and the surface should have been repaired before applying seal coating. —.

it was decided to table the matter.
Mr. Dean Ruege appeared before the Council and stated that he would like to have Pine
Street extended 150 feet from Clive Street. le stated that he would pay for the neces-
sary grading if the City would furnish the gravel. 0n motion of Councilmen Partkey
seconded by Councilmen Charisen Mr. Fuego was authorized to grade Pihe Street for a
distance of about 150 feet from Olive Street and the City furnish the necessary gravel.
Clerk stated that Fr. Fred C. Nett had stopped at his office in regard to an assessment
for seal coating. Mr. Nett requested that the Clerk ulna the matter before the Council.
Re felt that due to the fact that part of his property Is not saleable the Council
should consider reducing the assessment which totals 168.28. On motion of Councilman
Partkey seconded by Councilman Charisen the matter was referred to Councilman Bergen
with power to act.
On motion of councilman Fergen seconded by Councilman Bartkey a special building
permit was granted to Earl Ayers to build a garage subject to the approval of the
neighbors within a radius of 300 feet. This motion provides that he must furnish the
council with approval in writing. (Details in Building Inspector's Office)
On motion of comncllmen Bergen seconded by Councilman Charisen a special building
permit was granted to Arnold Deno to enlarge his store at 215 North William Street
providing he has the approval of the property owners in writing as provided in the
zoning ordinance. (Details in the building inspector's office.)
On motion of Councilman Bergen seconded by Councilman Charisen the Clerk was instructed
'to write a letter to Mayor Madsen who is at the Miller 'lospital and inform him that
the Council members miss his good ,judgment and guidance in matters coming before the
council.
On motion of Councilman Fergen seconded by Councilman Bartkey the City Engineer was
instructed to install a culvert and other necessary work to correct the drainage
problem around the Malcom Frown property as requested by Mr. Frown and rfter the job
is completed send Mr. Brown a bill for the entire cost.
On motion of Councilman Fartkey seconded by Councilman Bergen a drain layers license
was granted to Mr. Gibson of Bayport, Minnesota, providing he furnishes the bond as

completely satisfied with the manner in which Mr. Dunker has teen taking care of us
in handling the garbage situation, and would like to have hip continue as garbage
collector" was read and on motion of Councilman Partkey seconded by Councilman Charlsen
the petition was ordered filed.
RNFINISRED BUSINESS
This was the night set to reconsider the bids on garbage removal and disposal, which
bids were opened and read aloud at the regular meeting of the Council on June 5, 1956
at 7:30 P.M. All of the Councilmen stated that they had received calls in the past
few days requesting, that the Council retain Mr. Dunker for the function of collecting
and disposing of garbage. After consideralle discussion on motion of Councilman Bergen
seconded by Councilman Partkey it was decided to reflect all the bids on garbage col-
lection and disposal. Vice President Bourdaghs inquired if there was anyone present
who world care to comment on the action taken by the Council. Philin Eastwood, Esq.
representing one of the bidders, namely Mr. Thompson, stated that the Council should
have awarded the contract to the lowest responsible bidder and should not have read
or considered the bids which were not accompanied by certified checks. Judie McDonough
who was representing a kidder felt that the Council action was sound and legal.
tyle Eckberg, Esq. representing one of the bidders inquired if the City Attorney had
received a recent opinion from the Attorney General as to whether or not the Council
could consider bids which were not accompanied by certified checks. The City Attorney
stated that he, did have an opinion from the Attorney General in retard to this matter
and that according to this opinion bids must be accompanied by certified checks or
cash. Mr. Eckberg stated that for the record he would like to point out the fact that
only two of the five bids submitted were accompanied by certified checks, namely S.
J. Curtis and 'carry Thompson. James Douville, Esq. representing one of the bidders
stated that his client, Mr. 4uston, was disappointed because he was the low bidder.
Councilman Charlsen stated that he had stopped at one of the St. Paul banks and re-
quested a certified check but was informed that a cashiers check was more simple and'
less expensive to issue. Vice President Bourdaghs informed all present that the City
Councilmight abandon the private contractor method of collecting and disposing of gar-
bage. Mr. tyle Eckberg thanked the Council members for a fine job of handling this
matter.
The Clerk informed the Council members that it was the Mayor's wish that a letter
should be written to the trustees of the Methodist Church offering the appraise,.
price of 112,500.00 for their property located on Myrtle end Fourth Streets as re-
quested in a letter from the trustees which was read at the regular meeting of the
Council. on June 5, 1956. On motion of Councilman Bergen seconded by Councilman
Bartkey the Clerk was directed to write a letter to the trustees of the Methodist
Church cfferinr them 112,500.00 for their property located on Myrtle and Fourth Streets.
Councilman Cherlsen who is chairman of the committee appointed to study the sick leave
policy for City officials and employees stated that he probably would have a report
at the adjourned meeting of the Council on June 19, 1956.
Upon instructions by Vice President Bourdaghs the City Clerk presented approximate
costs of garbage and refuse removal as it applies in cities that carry on the function
as a city project. Ave -are cost is about 91 cents per residence per month, with pick
up twice a week in the residentail district and commercial district three times a week.
Betels and restaurants every day except Sunday. The figure of 91 cents permonth covers
labor, gas, oil, repairs and depreciation and also cost to operate tractor to treich
and fill.
Vice President Pcurdaghs reported that Mr. Pete Miller had contacted him in regard to
purchasing a grader from the City. He explained that the grader is not power driven
and anparently not used at the present time. 90 action at this time.

Hr. Patrick F. Curran, who resides in St. Paul, appeared before the Council and stated
that he was engaged in the business of selling and installing metal awnings. He stated
that he had received a permit to make an installation from our building inspector but
did not realize that our present ordinance provides a minimum height from the sidewalk
of eight feet. He stated that in a good many instances eight feet is too high to give
the necessary protection from the sun, and that in most cities the minimum is seven
feet. On motion of Councilman Charlsen seconded by Councilman Bartkey it was decided
to amend our present ordinance and set the minimum height at seven feet providing
it meets with the approval of the building inspector.
The Building Inspector stated that the present building committee has not met in the
pest year and not more than three times since the building code was adopted which is
almost four years ago. That an active building committee would be a great asset to
the building inspector and the City Council, because new ideas in building methods
and materials are being introduced so fast that it is quite a problem for one person
with limited experience to make important decisions. He suggested that the present
building committee be dismissed and a new committee created, consisting of architects
and all contractors in the various building trades that operate within the City. He
also suggested a revolving chairmanship for the committee, having a new chairman each
,year, which would meet at least four Mains annually. On motion of Councilman Charlsen
seconded by Councilman Bergen it was decided to recommend the above suggestions to the
Mayor for his approval

On motion of Councilman Bergen seconded by Councilman Charlsen her resignation was
accepted with regret, and the City Clerk was instructed to write and inform her of the
action taken by the Council.
Mr. Lyle Eckterp, Esq. appeared before the Council representing Mr. Sheldon Smith
and read a letter in which Mr. Smith stated that he made arrangements to purchase
and has obtained options to purchase the following described real estate in the City
of Stillwater:
Lots 8-9-10-11-12-13-14-15-16-17 and 18, in block 21 of the Original. Town, now
City of Stillwater
and that plans ere under way for the erection of a shoppinr center. He requested
that the Council consider re -zoning of this area for commercial nee. On motion of
Councilman Bergen seconded by Councilman Charlsen it was decided to amend the zoning
ordinance to comply with Mr. Smith's request subject to the approval of the majority
of the property owners residing around the above mentioned real estate.

On motion of Councilman Bergen seconded by Councilman Bartkey the contract tetween the
City and Bituminous Surface Treating Company for seal coating City Streets during the
year 1956, as drawn up by the City Attorney was approved and the Mayor and City Clerk
were directed to sign same.
On motion of Councilman Charlsen seconded ty Councilman Bartkey the contract between
the City and the Erlitz Cement .9orks for constructing new curbs and sidewalks along
the East side of South Third Street, being opposite and abetting lots 6-18-19-20-21 and
22, block 35, Original Town as drawn up by the City Attorney was approved and the !Mayor
and City Clerk were directed to sign same.
The Clerk informed the Council members that the voting machines will probably arrive
in Stillwater early in July and inquired if anything, definite has been arranged for in
regard to permanent locations for the machines. Councilman Charlsen stated that he
was quite sure that the machines to be used in the first ward could be stored in the
basement of St. yichaels Church. Vice President Bourdaghs stated that arrangements
have been made to store machines in the Armory which will be used for the second rard.
The Clerk stated that he was reasonably sire that machines to be used in the third
ward could be stored at the Washington School. On motion of Councilman Charlsen seconded
ty Councilman Pertkey the matter of the number of machines to be placed in each location
was referred to the City Clerk.

Clerk reported thnt he had been in contact with Mr. Plordholm who 1s the City Clerk
at Red Ting and that Mr. `Iordholm had informed him that during the month of *"ay the
City served 3300 customers in connection with garbage and refuse collection and that
the labor coats amounted to 12,345.00. The cost to operate three trucks including
r'" gas oil, insurance, un keep end depreciation amounted to 5600.00 for an over all average
of 1.99.2 per customer.
William T. Johnson, County Attorney and temporary special counsel assisting the City
Attorney, inquired of the City Engineer if in his opinion the City could collect and
dispose of garbage for less than the lowest legal bid submitted at a regular meeting
on 7une 5, 1956 at 7:30 P.b". The City Engineer stated that according to figures from
other municipalities over a period of time he was of the opinion that the City would
Fe able to collect and dispose of parbage for less money per customer than the lowest

the Council to this effect prior to the meeting this evening.

permit was granted to Bert Rivard who resides at 1802 West Clive Street to remodel his

On motion of Councilman Pertkey seconded by Councilman Charlsen a 'racial building
permit was granted to Irvin Kiesow who resides at 603 South Proadway to remodel his
home into three apartments. (Details in Puilding Inspector's Office)
Yrs. Atwood and Mrs. Wallace appeared before the 'ouncil and complained stout the
condition of the street leading to their home. The City Engineer informed them that
it would be impossible to make any improvements until Mr. 'iandevidt, who has purchased
land around their property and who is at present engaged in building new homes in that
area, presents a plat for the Councils approval.
On motion of Councilman Charlsen seconded by Councilman Bergen a special building permit
was granted to the trustees of the Methodist Church to build an educational unit 30
feet from Greeley Street. (Details in Puildinr Inspector's Cffiee)
.Tohn McDonough, Eaq. appeared before the Council representung Joseph Junker. Mr.
McDonough explained that Mr. Junker would be willing to collect and dispose of garbage
after his contract expires on .Tuly 31, 1956 on the following basis: Furnish a suitable
truck, take care of all expenses such as gasoline, oil, repairs, insurance also have
the second truck in reserve in case of emergency, furnish a bulldozer to trench for
garbage and cover same, work eight hours per day 6 days a week at the rate of $7.00
per hour. Mr. McDonough also stated that Mr. Junker would provide the same mood service
that the residents are now receiving. Vice President Bourdeghs thanked Mr. McDonough
and Mr. Dunker for making this proposal. lc action at this tl-e.
Vice President Bourdaghs stated that a "r. Pen Teske who resides at New Richmond had
offered to act as dog catcher nt the role of 13.00 for each dog caught on the City
streets and would provide a pound, but the City would he charged with the cost of
feeding the dogs while confined. It was the feeling among the eounrilmen that they
might consider his offer.

the`Thompson Construction Company to proceed with the work as soon as possible.
Councilman Charlsen who is the chairman of the committee appointed by the Mayor to study
the present sick leave policy for City Officials and employees reported that his committee
composed of the following members, Councilman Bergen and Vice President Bourdaghs would
like to make the following, recommendations to the Council for their consideration d New

near the Lutheran Church on South Sixth Street about a strong odor which they believe

Chief was approved and ordered filed. Vice President Bourdaghs suggested that the Council
consider the recommendation of the Fire Chief to install a telephone line from the
Fira Station to the Maple Island Creamery for the purpose of notifying the Engineer
at the creamery to blow the whistle which in turn would summon the auxillary firemen.
On motion of Councilman Charlsen seconded by Councilman Bergen the matter of installing
the above mentioned telephone line was referred to Vice President Bourdaghs with power
to act.
The Clerk informed the Council that Patrick White who resides at 603 West Churchill
Street has paid his street assessment under protest. (Seal coating)
The matter of appointing a new member on the Library Poard to succeed Mrs. John Kilty
who recently resigned, was carried over to the adjourned meeting on July 2q, 1956.
The Clerk reported that a !.Tr. Abresch of the Abresch Barrel Company, Route number 6,
St. Paul, had stopped at his office and informed him that he has a site near Lake Elmo
which could be used for dumping garbage and refuse: Councilman Charlsen stated that he
scold contact vr. Abreach in the near future in regard to this matter.
Vice President Pourdarhs announced the re -appointment of Ernest Peaslee Sr. as a member
of the Poard of Water Commissioners. Cn motion of Councilman Bergen seconded by Council-
man Bartkey the appointment was confirmed.
Clerk reported that 'fir. Ed. Slaughter had called his office and complained about the
trucks and cars parked on the street in front of the property owned by Robert Huston on
South Third Street. Vice President Bourdaghs suggested that the Chief of Police talk
to Mr; Ruston in regard to this matter.
On motion of Councilman Charlsen seconded by Councilman Bergen the City Clerk was author-
ized and directed to advertise for bids on coal for the 1956-57 heating season bids
to be returnable at the next regular meeting of the Council on August 7th, 1956 at

On motion of Councilman Charlsen secoaded by Councilman Bergen the new contract forms
for garbage and refuse collection to be used for the period commencing August 1, 195b,
as prepared by the City Attorney, were approved and the City Clerk was authorized and

On motion of Councilman Charlsen seconded by Councilman Bergen the City Clerk was in-
structed to have a cony of the new customer contract form covering garbage and refuse
collection printed in the daily Gazette so the public will become acquainted with same.

was granted to Pen McPherson, 527 South Broadway to build a new garage near the street,
providing the garage sets back far enough to allow a car to park between the entrance

A petition with 27 signatures of property owners on Pine Street west of Owen Street and
adjoining Streets requesting. an estimate of cost in connection with a new sewer system

Pine Streets to raise sewage in this new section to the proper level to thereafter be
handled by the present sewer system. On motion of Councilman Charlsen seconded by
Councilmen Bertkey the City Engineer was ordered to prepare an estimate of cost. The
City Engineer explained that he would not he able to prepare plans and estimates of
cost because he has not had experience with this type of installation such as lift
stations and suggested that the Council hire an Engineering firm to prepare plans and
estimate of cost. He stated that it would probably cost clout .1500.00 or 5600.00 to -

. The city Attorney reported that he is working with the water board on a R200q,O0.00
bond issue. Proceeds to be used for the purpose of financing major improvements.
On ,lotion cf Councilman Bergen seconded by Councilman Charlsen a permit was granted
to Mrs. Ray Steindorf to connect a sewer line to the service now used by Jesse Roberts
who lives on Orleans Street and is connected to a sewer on South Third Street. This
permit was granted subject to the payment of a connection fee in the amount of 1)50.00.

Mr. Carlson who is a member of the Stillwater Association of Commerce appeared before
the Council and inquired when the roadway leading from the parking lot along the
railroad right of way to the lot in the Lowell Park area would be completed. The
City Engineer informed him that he hoped to have this drive way completed within the
next two weeks.
Yr. Robert Hagen who is the President of the Stillwater Association of Commerce
appeared before the Council in regard to the new traffic signals now being installed
under the supervision of the State Highway Department. The Highway Department informed
the Chief of Police that the signals will not be put into operation until all double
parking is stopped on `lain and intersecting streets. Mr. Hagen felt that some double
flanking is necessary for the purpose of loading and unloading trucks. Vice President
Bourdaghs stnted that he felt the Association shoeld formulate some plan for parking
and present this plan at the next meeting of the Council.
Mr. Edwin Stewart appeared before the Council and stated that he is building a home
in Radles Addition and that same will be completed on the 4th day of August and that
he must vacate the premises he now occupies. He inquired why the City Engineer has
not established levels so a water main can he laid. Mr. Redle stated that he has en-
gaged the Voel.ter Construction Company to lay the water mains but they cannot commence
this work until. the City Engineer furnished levels and grades. The City Engineer
stnted that it probably would require two weeks before he can furnish levels and grades
because he has other projects in progress at this tine.

yellow zone at the rear of his store.
Clerk called the Councils attention to a claim received from Melvin Kreisel for labor
at the City dump for time worked during the illness of the regular dumpmester. On
motion of Councilman Bergen seconded by Councilman Charlsen this matter was referred
to Councilman Bartkey with power to act.

notice of expiration date of agreement for street lighting service at least six months

by Councilman Bourdaghs it was decided to request a proposal from the Northern States
Power Company as to cost for improved street lighting in the residential area, this

From Roderick A. Lawson addressed to Mayor Madsen thanking the Council members for
passage of a resolution in regard to his services in connection with Youth Commission
activities.
Prom Mr. E. D. Hagen inquiring if any progress has been made in regard to a survey in
connection with sewer system and lift stations in the Lily Lake area. Mr. Hagen was
referring to Council action taken at a recent meeting at which time the City Engineer '
was ordered to hire the rannister Engineering Company to make a survey to determine the
cost of such a. protect. The City Engineer stated that he had contacted the Bannister
Engineering Company and that work would begin on the survey within a week.
From Mayor Joiner of Osseo, Minnesota addressed to Mayor Madsen in which she states

COMMITTEE REPORTS
Councilman Bourdaghs
1. He stated that he was happy to report that the City has held its class fire insur-
ance rate due to the good work of the Fire Chief.
2. He reported that the recreation program is running along smoothly and that the
attendance at the beaches has been heavy.
Councilman Charlsen
1. Ye stated that Pioneer and Lowell Parks have been well patronized this summer.
2. He reported that the new rest rooms at Lowell Park ere net standing up too well
and should to cleaned daily. qe felt that the conditions of the rest rooms is
poor advertising for the City. He statedthet the Park Board will net employ a man
to keep the rest rooms clean and inquired of the City Engineer if he could spare
a man for an hour each day to clean the rooms. The City Engineer stated that he
could probably spare the street cleaner each day for an hour or what ever tixe
would be required to keep the rooms clean.
3. He reported that he has been invited to attend a meeting at Des Moines, Iowa in
regard to parks and play grounds.

Yr. Lawrence Linner reported that the sidewalk in frontof his place of business at
207 `forth Main Street has settled and just recently caused and accident. He stated
that the condition of the sidewalk was reported to the City Engineer two years ago.
The City Engineer stated that he had asked yr. Linner to repair this walk some time ago.
On motion of Councilman Charlsen seconded by Councilman Bourdaghs the standard Workmen's
Compensation and Employers Liability Insurance Policy, number 0317-00-03066 issued by
the Employers 'otuals of Wausau, Wisconsin, was approved and ordered filed.
This was the night thnt the Stillwater Association cf Commerce was to present a plan
in connection with the problem of double parking in the down town area. This problem
was brought about when the State of Minnesota notified the Chief of Police that the
new traffic signals located et Myrtle and Main Streets would not be put into operation
until the City prohibits double parking. Councilman Pourdaghs reported that he was
informed by members of the Association that no progress had been made in connection
with this matter.

Charlsen the mayor, Councilman Charlsen and the Chief of Police were named as a committee
tc study this matter and report at a later date so same could be considered when the
budget is adopted for the year 1957.
The City Engineer reported that due to the weather it has been impossible to seal coat
streets as planned early this spring and suggested that the project be deferred to next

From the State of Minnesota, Department of Highways, in regard to law prohibiting use
of trunk highways for local celetretions. On motion of Councilman Pertkey seconded by
Councilman Bergen the Clerk was instructed to turn the letter over to the Chief of
Police for filing.
From Eugene Lammers, 1004 South Second Street complaining about the weeds on the Smith
property on South Third Street. On motion of Councilman Bergen seconded by Councilman
Charlsen the City Clerk was instructed to contact Mr. Smith who resides somewhere in
Minneapolis by telephone and ask him to cut the weeds on his property as soon as
possible.
PETITIONS
A petition with seven signatures requesting that the Council consider the installation
of street lights in the vicinity of South Hemlock Street, because the area concerned
is dark and dangerous especially due to the fart that it is a dead end street. On
motion of Councilman Bartkey seconded by Councilman Charlsen the matter was referred
to Councilman Perren with power to act.
The Council then took up the matter of vacating a portion of South Grove Street. A
hearing on the petition was held on June 5, 1956 at 7:30 P.M. At that time the hearing
was closed. (See resolution vacating a portion of South Grove Street)
UNFINISHED BUSINESS
The City Engineer presented plans and estimate of cost to improve North First and
Fast Balsam Streets. He stated that the total cost including curbs to improve North
First Street would amount to 39,752.19 and If the City would pay 20% of the cost out
of the permanent improvement fund the property owners would be assessed at the rate of
45.391 per foot. The total cost to improve East Balsam would amount to 43,289.10 and
1f the City would pay 201 of the cost out of the permanent improvement fund the property
owners would be assessed at the rate of 54.38} per foot. (See resolution)
The City Engineer presented plans and estimate of cost to lay new sewers and install
a lift station in the Lily Lake area as requested by petition at a recent meeting of
the Council. His estimate was broken down as follows: Sewers, manholes and fittings
t5,314.75, force mains t3,246.50, pumping station $20,000.00. Total cost t28,561.25•
He explained that If 80/ of the cost would be assessed it probably would run around
R10.00 per foot. Mr. R. D. Hagen, one of the petitioners, stated that he felt most
of the property owners would not be willing to pay an assessment of R10.00 per foot.

were appointed judges of election for the Primary on September 11, 1956, and the General

Clerk reported that Vacil. Kalinoff had called him and inquired about the special permit
granted him at a recent meeting in regard to a sewer connection in William Street.
The permit was granted subject tc the approval of the City Engineer. The City Engineer
stated that he did not approve of the connection because Mr. Kalinoff would eventually
connect four or five homes to the sewer and the Water Pollution Control would probably
object and stated that he did not want to take this responsibility. Mayor Madsen Informed
him that the Council would to responsible so far as the Water Pollution Commission is
concerned and inquired of the City Engineer if in his opinion the connection would
meet with engineering principles. The City Engineer stated that it is possible to make
the above mentioned connection. The Council members then decided to grain approve the
connection providing rr. Kalinoff furnishes a complete plan at the next regular meeting
of the Council.

"evnr Madsen inquired of the city Attorney how he was comiep along on the work of re-
viewing our present ordinances ind suggesting a plan to eliminate many old ordinances
and consolidate many into one ordinance. The City Attorney stated that he has worked
on this protect for some time and would like expert help to complete same. He pointed
out that most cities engage experts to codify and index ordinances. On motion of
councilman Pourdaghs seconded by Councilman Bergen the City Attorney was authorized
^ to consult experts in this field and get an estimate of cost to complete the project.
On motion of Councilmen C'arlsen seconded by Councilman nourdaghs the following coal
contracts cover ' the 1956-57 heating season, as drawn up by the City Attorney were

1. The swlmminp season is closed.
2. le reported that there are two vacancies in the fire department and some
applications have been rereived. The Council members were agreed that Councilman
Pourlaghs should make the selections to fill the vacancies.
3. He brought up the matter of advertising for bids on a truck to be used for
garbage collection and also consider the matter of a dump site. On motion
of Councilman rourdaghs seconded by Councilman Bergen the City Clerk was directed
to advertise for bids on a used garbage truck and the City Engineer assist
him in drawing up specifications. Bids returnable on October 2, 1956 at
7:30 P.M.
4. He suggested that the Council consider consulting an Engineer for the purpose
of determining the cost to eliminate surplus water which is entering the sewer
system apparently from springs. He suggested that the Council invite Mr.
Bannister of the Bannister Engineering Company to attend the next regular
meeting of the Council in regard to this matter.
Councilman Pergen:
1. He reported that some sidewalk repairs have not been completed by property
owners. He stated that he had talked to Mr. brown, who inspected all side-
walks last ye'r, and suggested that he make a follow ur inspection tut that
Mr. Brown he: informed him that all of his available time is taken acting as
assistant b..ilding inspector.
2. He reporte at the City Engineer will start work on a drainage project near
the Malcom: rrnwn property, which was ordered done some time ago by the Council.
3. le reported that the City Engineer had informed him that he would not be able
to do any seal coating of streets as planned early last spring, due to wet
weather during the summer months.
4. He stated that quiet signs hove not been installed near the rest homes as
ordered some time ago. The Chief of Police stated that the signs were ordered
from the sign company several weeks ago and have been delivered within the
past few days.
5. He reported that he had received a request from Caroll Frown for a caution
sipn near his property.
Councilman Charlsen:
1. He reported that it was necessary to hire .Al 3itzer to grade and sod certain
areas in Pioneer Park, and that some changes have been made to keep cars from
driving on the grass.
Councilman Bartkey:
1. He reported that he had hired Al Ritzer with his bull -dozer to do necessary
work at the pity dump.
Mayor Madsen:
1. He sta'ed that he has not found time to meet with the Chief of Police and
Councilman rharlsen for the purpose of considering the purchase of a second
police car.
2. He stated that he has received requests for stop signs at the intersection
of Third and Orleans Streets due to a new pedestrian problem in eotnection
with the new school located in that area. The Chief of Police reported that
signs have been installed.

Clerk reported that John Simpson, manager of the Northwestern Bell Telephone Company,
would like to have the Council c'nsider the installation of parking meters in front of
the new telephone building on Second Street. On motion of Councilman Bergen seconded
by Councilman Charlsen the Chief of Police was instructed to carry out the request
and install meters as required.
On motion of Councilman Tourdarhs seconded by Councilman Charlsen it was decided to
enrage the public examiner to audit and examine the books and records of the various
City departments.
On motion of Councilman Charlsen seconded by Councilman Pourdaghs the following
insurance policies were approved and ordered filed.
Policey number 5-R1-97 issued by the Great American Insurance Company of New York,
covering the Schulenburg School against fire end lightning extended coverage.

Stillwater Fire Department for the month of August, 1956, as prepared by the Fire Chief

Councilman Pourdaghs brought up the matter of renting a postage meter for use in the
City Clerk's office. (No action at this time.)

a light at the fire station to Fe used for the purpose of notifying the police dispatcher
that the police chief has left his office and that all calls for the police department
must be answered by the dispatcher at the fire station.

Senator Selmore appeared before the Council, stated that he was chairman of the Dem-
ocratic party in this district and felt it was his duty to encourage people to go to
the polls end vote. ie congratulated the Council for purchasing voting machines. After
these preliminary remarks he stated that he objected to the present polling places within
the City because he felt in many instances the distance to the polling place was too
far for many old people to travel. The Councilmen explained that every effort has been
made to locate the polling places.as centrally as rossible in each district end cer-
tainly would welcome any suggestions from Senator Saimore or any other citizen.

City Attorney McGrath stnted that he had contacted experts in the field on revising and

by Councilmen Chnrlsen the following persons were appointed as auxiliary firemen, Richard
Colemeir - Ernie Dielentheis - Arnold Peltier. ( Recommended by Fire Chief in his

3. Re reported that Tr. E. L. Roney, Editor of the Stillwater Evening Gazette made
a generous contribution to the Firemen's Relief Fund (150.00) end (115.00) to the

This was the night set for the petlic hearing, on the propsed work of grading,
instnllatio❑ of concrete curbs, drainage structures, bituminous surfacing and any
other improvements as and where indicated on the plans therefore, on `forth First
Street between East Juniper and East Palsam Streets and on East Falsam Street
between forth First Street and North Second Streets. John E. Harrigan appeared
before the council representing Mr. Lawrence Linner and inquired about the cost
eft in connection with the proposed project, the City Engineer informed all present that
• it is estimated that it will cost 35.55 Per running foot along North First Street
and T!}.3g'-z per running foot along Balsam Street. Kr. Harrigan then inquired about
the cost of installing proper drainage facilities and the Engineer estimated the cost
at ^822.64. Mr. Harrigan then inquired why the plans call for a concrete drain
near the Herb Balfanz Property and not the same type of drainage near the Linner
orooerty, he also questioned the legality of assessing the cost of flumes which
will cross private property as indicated on the olans. Kr. Harrigan suggested
that the Council postpone the proposed Pork until next spring. Mr. Harrigan stated
now that his client objects to the installation of curbs. Mr. John Thorsen also ap-
peared before the Council and stated that Kr. Oscar Flatten and Arnold Deno would
like to have their names withdrawn from the original petition in connection with
this project because his clients were not aware of the fact that the cost would
he assessed against t'ie property benefited. t'r. Thoreen also stated that his
Monts fonts did not approve of the project as presented and felt that curbs were not
necessary. Kr. Duffy appeared before the Council and states that in his opinion
the Council should consider an inexpensive job, arch es necessary grading end oil

The City Clerk read a cony of a judgement issued by the Clerk of the District t
which was served on him recently. The judgement was in favor of Joseph C. Peaudet and
Albert C. Peaudet, as executors of the estate of Joseph Ernest Peaudet, deceased, in
the amount of 1985.69, broken down as follows: amount of verdict 1700.00, interest on
same 1252.11, statutory costs 110.00, Clerk's fees 115.00, witness fees $8.68. The
above judgement is the result of an action entitled Josenh C. Peaudet and Albert C.
Peaudet, as executors of the estate of Joseph Ernest Peaudet, Deceased, VS. City of
Stillwater, Minnesota, tried without a jury on the loth day of August 1950, and there-
after adjourned nntil the 16th day of August, 1950. The City Attorney advised the
Council to pay the judgement as soon as possible. The Clerk -Treasurer was directed
to pay the ,judgement in the amount of 1995.61.
The City Engineer reported thnt there nre about 29 hydrants throughouttthe City that
are unfit for fire purposes end suggested that the Council consider replacing 10 hydrants
each year at a coat of about 1330.00 per hydrant.
The City Engineer suggested that the Councilconsider purchasing a motor patr 1 grader.
He estimated the rust at about 112,000.00.
Councilman Charlsen stated that there is a conflict between the Building Code and Zoning
Ordinance in some instances, and suggested that the Council consider revision where
necessary.

From Leonard Evans Inquiring if it might become possible to lease the old tourist park
on the East side of the river and North of the inter state bridge. Mr. Evans states
that he would clean up the park and shore line, provide ample parking area, picnic
grounds and cooking facilities and arrange for a ramp into the river for the purpose of
launching boats. Mayor Madsen informed Mr. Evans that the Council has received many
requests for leasing this property but to the best of his knowledge the property in question
was donated to the City for park purposes and can not be leased or sold. The City Attorney

1. He suggested that the Council approve a new set of basic rules for the fire department.
He stated that the new rules are more comprehensive. On motion of Councilman Charlsen

Bourdaghs were approved.
2. He requested approval of the fire chiefs report covering the month of October, 1956.

3. He stated that water is available for skating rinks and same will be flooded when the
good Lord provides freezing temperatures.

reported that some repair work has been dole on the street referred to by Councilman Bergen.
2. He statedthat the street leading to Mrs. Atwood's prooerty is in need of some repair.
3. He reported that the City Engineer has begun work on the drainage problem on the
Malcomb Brown property.
4. He stated that Mr. Me]lin has requested that a street light be installed on Wilkin
Street between William and Owen Streets.

1. He reported that the parks have been closed until next spring.
Councilman Bartkey:
1. He reported that the dumpmasters warmiag house a.me in contact with fire and was partially
destroyed. Me stated that the fire ventilated the building to the extent that a rather
severe draft makes the structure unfit for human use. On motion of Councilman Bourdaghs

Clerk stated that Mr. George Smart, secretary of the Stillwater Chamber of Commerce, had
called his office and 1n,uired if the Council had taken any action in regard to designated
loading zones in the downtown area as proposed by a committee of the association some time
ago. Mayor Madsen stated that in his opinion the matter needs no further action because
all concerned seem to be satisfied at this time. Councilman Charlsen stated that he has
received complaints from Mr. Brekke in connection with loadingspace near his place of
business on South Main Street.
Clerk reported that Norman Johnson, owner of the ambulance, called his office and reported
that the ambulance was damaged to some extent due to a loose pan hole cover at the inter-
section of Myrtle and William Streets. The City Engineer stated that he will investigate
this complaint as soon as possible.
On motion of Councilman Bourdaghs seconded by Councilman Charlsen the following were appointed

RUSINFSS
On motion of Councilman Bourdaghs seconded by Councilman Bergen the following streets were
designated as sliding areas. East side of South Fifth Street from Marsh across Hancock and
Second Street from Locust to Pine Streets.
Councilman Charlsen was authorized to hire the Moelter Construction Company to replace the
slide in the North Fourth Street ravine. (No motion)
Councilman Bourdaghs stated that he will call the Northern States Power Company and have the
service connected in connection with lighting of slides and skating rinks. (No motion)
Mayor Madsen stated that the City will acquire possessdon-of the Methodist Church property
located at Fourth and Myrtle Streets about the first of the year and that a Mr. Dilts now
occupies one of the apartments in the parsonage and does not pay rent because he acted as
janitor for the congregation. The mayor suggested that Councilman Charlsen contact Mr.
Dilts and arrange for some rental charge.
Mayor Madsen reported that the police car 1s in the Ford garage and that the motor is beyond
repair. He stated that Mr. Erickson and Mr. Post of the Erickson -Post Company have offered
the City a new 1957 Ford car to replace the present car at a figure someAwhat less than
$500.00. On motion of Councilman Bourdaghs seconded by Councilman Bartkey the matter was
referred to the Mayor and Chief of Police with power to act.
Councilman Bergen stated that he has received complaints about dogs running at large and
felt that it probably will be necessary to pass a leash ordinance.
The City Engineer was instructed to release a publication for print in the Gazette prohibit-
ing the parking of °arson City streets over night.
The City Engineer stated thmt in his ooinion the resolution adopting and confirming the assess-
ment roll covering water main improvement no. 4 should be amended. He explained when the
assessment roll was prepared the land was not platted, but that he did not present the assess-
ment roll for confirmation at that time. He stated that he could not give any good reason
for the delay. In the meantime the plats covering the areas referred to above were approved
by the Council and about a month later the assessment rolls were confirmed and established.
The plats show land dedicated to the City for park purpose, and can not be assessed. He
suggested that the original assessment against the dedicated property be borne by the permanent
improvement fund. He stated that he would have a resolution prepared amending the original
resolution and present same at the next regular meeting of the council.

Only one bid was received on official printing for the year 1957, that was the bid from
the Stillwater Evening Gazette. On motion of Councilman Bourdaghs seconded by Councilman
Bergen the bid was accepted and the Mayor and City Clerk were authorized and directed to
enter into a contract covering same.
Mayor Madsen announced the re -appointment of Frank Schaffer to the Park Board for a
term of three years, and on motion of Councilman Bergen seconded by Councilman Bartkey
the appointment was confirmed.

COMMITTEE REPORTS
Councilman Bourdaghs;
1. Councilman Bourdaghs explained that Maple Island Inc. usally assist the Fire
department in fighting rural fires not in man,power,but furnish a large tank
of water, and in order to fill the tank they must drive the truck to the inter-
section.of'Main Street and Commerical Avenue. He requested authority to have a
stand pipe installed near the Maple Island plant which would speedup the. filling
of the tank and delivery to the fire. 0n motion of Councilman Bergen seconded by
Councilman Bartkey Councilman Bourdaghs was authorized to order the installation
of a stand pipe near the Maple Island Creamery.
2. He stated that all the fine Christmas decorations in front of the City Halland
fire station were assembled and installed by John Fazendin one ofthe firemen, and
that Mr. Fazendin had also furnished the material and assembled what he called
a mechanical German village. On motion of Councilman Bourdaghs seconded by Coun-
cilman Bartkey a vote of thanks was extended to Mr. Fazendin for his fine work
and the Council members agreed to view the display on the second floor of the fire
station.
3. He brought up the matter of establishing a petty cash fund in the City Clerks
office, no action was taken at this time.
4. He reported that he had received complaints from neighbors residing near the
Robert Huston residence, due to the fact that Mr. Huston was displaying Christmas
trees aadXarrrlitt aaax in kis yard and selling same. Mr. Huston resides at Third
and Hancock Streets

5. He stated that he had occasion recently to view the city dump and that he was not
entirly intisfied;with the work being performed by the dumpmaster, he felt that
the rubbish should be dumped over the edge of the dump and not in piles on the
surface of the fill.
Councilman Bartkey;
1. He reported that it was necessary to spend about three or four dollars at the bath
house at Lily Lake replacing a panel.

Councilman Bergen;
1. He stated that the Northern States Power Company have recently erected additional
poles to carry transmission lines in union Alley and that these poles interfere
with parking because it is almost impossible to open a car door when properly
parked at a parking meter. He also stated that the Northern States Power Company
have made no attempt to 30prove their transmission lines in the City over the
past thirty five years.
NEW BUSINESS
Clerk reported that Le was served with a summons in behalf of the City on December
8, 1956, entitled Flor-:nce M. Wagner vs City of Stillwater and that he had mailed a
copy of said summons to the City Attorney and Krog Agency on December 10, 1956.
Councilman Charlaen presented an estimate of coat fortpainting and necessary patching
in connection with the Methodist Church property (parsonage);
Basement 1120.00, First Floor 000.00, Second Floor 0280.00. On motion of Councilman
Bourdaghs seconded by Councilman Bergen the matter of painting and necessary repair
work in connection with the old parsonage was referred to Councilman Challsen with
power to act.
Mayor Madsen explained Viet a group known as Alcoholic Anonymous are presently meeting
in the basement of the old Methodist Church on the corner of Fourth and Myrtle Stree=s,
and that one of the officers of the organisation had contacted him and inquired if the
group could continue to use the facilities after the City officially acquires the
property. On motion of Councilman Bourdaghs seconded by Councilman Bergen the matter
was referred to Mayor Madsen and Councilman Charlsen with power to act.
