BE IT RESOLVED. by the City Council of the City of Stillwater, Minnesota,
that romancing with the month of January, 1967, Regular meetings of the
City Council shall be held at the Municipal Building at 7:30 o'clock P. M.,
unless otherwise stated, on the first and second Tuesdays of each month:
providing, however, that if the first Tuesday Mall fall on or before the
5th day of any month, then the Regular Meetings for such month shall be
held at the same time and place on the second and third Tuesdays.

and hospital coverage on the City group insurance plan to retired employees,

RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT LOCAL IMPROVEMENT NO.
48-1964
WHEREAS, a contract was let for the improvement consisting of Street
Surfacing - South Hancock Street from South Seventh Street to South
Holcombe Street: and the contract price for such improvement is $1.859.60.
end thr expenses incurred or to be incurred in the making of said improve-
ment aiuount to $148.69, so that the total cost of said improvement will
be $2,008.29, and of this cost the City will pay $502.07 as its share of
the costs
AND WHEREAS, the City Engineer has prepared a proposed „sessment of the
cost of said improvement and has notified the City Council that such pro-
posed assessment has been completed and filed in the City Clerk's office
for public inspections
NOW. THEREFOR!, BE IT RESOLVED, by the City Council of the City of Stillwater.
Minnesota.
1. That the cost of such improvement to be assessed is hereby
declared to be $1,506.22:
2. That a hearing shall be held on the 14th day of March, 1967, at
7:30 o'clock P. M. in the Municipal Building to pass upon such proposed
assessment and at such lime and place all persons owning property affected
by such improvement will be given an opportunity to be heard with reference
to such assessment.
3. That the City Clerk be, and he is hereby, directed to cause a
notice of said hearing to be published once in the Stillwater Evening
Gazette, official newspaper of the City, at least two weeks prior to the
date of said hearing and to be mailed to each property owner known to be
affected by said improvement at least two weeksprior thereto, said notice to
specify the total cost of said.isprovement.

that said Council hereby urges the 1967 session of the Minnesota Legislature
to enact the necessary legislation to enable Minnesota municipalities to
receive the maximum amount of Federal Grants in Aid, provided for in the
"Clean Waters Restoration Act of 1966", passed by the recent United States
Congress:

RESOLUTION NO. 3003
RESOLUTION AUTHORIZING AND REQUESTING THE DRAFTING AND INTRODUCTION IN THE
STATE LEGISIATURE OF LEGISLATION RELATING TO TAXATION FOR GENERAL FUND
PURPOSES
HE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the City Attorney be authorized and instructed to draft legislation
for enactment at the 1967 session of the State Legislature which would have
the effect of increasing the legal limit of forty-five (45) mills for all
general fund purposes as provided by the present statute, to a maximum of
fifty-five (55) mills. The legislation, when finally drafted and introduced,
shall apply to either all cities of the Fourth Class, or to the City of
Stillwater only, which decision cannot be made at the time of the passage of
this Resolution, but which decision shall subsequently be made. and the City
Council hereby authorizes and approves of either of said alternatives.

RESOLUTION EMPLOYING ENGINEERING SERVICES
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the Mayor and City Clerk be, and they are hereby, authorized to enter
into an agreement with the Banister Engineering Company of St. Paul,
Minnesota. in accordance with the proposal of said company received December
14, 1966, and accepted by the Mayor and City Council on January 17, 1967, for
the purpose of making a study and report, plans and specifications, engineering
during construction if ordered by said City, for secondary treatment of sewage
facilities at the city disposal plant, and the necessary interceptor sewers
to areas outside the City Limits of said City which will need a sanitary sewer
system in the future.

RESOLUTION REQUESTING SIDEWALK AMENDMENT TO MUNICIPAL STATE AID LAWS
WHEREAS, Section 162.14 of the Minnesota Statutes defines the purpose for
which Municipal State Aid monies shall be used; and
WHEREAS, said Section 162.14 provides for the expenditure of Municipal
State Aid funds for safety devices on the State Aid Street system; and
WHEREAS, the Commissioner of Highways has not construed initial sidewalk
installation along the Municipal State Aid Street system as a safety device
eligible for the expenditure of Municipal State Aid monies; and
WHEREAS, it is the experience of the City of Stillwater that the vehicular
thoroughfares represented by the Municipal State Aid Street system also
tend to serve as pedestrian thoroughfares as well, thereby creating a safety
conflict; and
WHEEAS, it ie the position of numerous engineers representing Minnesota
municipalities that they favor Municipal State Aid participation in initial
sidewalk construction along Municipal State Aid Streets;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota. to request its legislators to introduce legislation to amend
Section 162.14 of the Minnesota Statutes to provide that Municipal State Aid
monies may be expended for the installation of initial sidewalks on the
Municipal State Aid Street system.

1. That such proposed assessment is hereby accepted and shall constitute
the special assessment against the lands named therein, and each tract of land
therein included is hereby found to be benefited by the proposed improvements
in the amount of the assessment levied against it.
2. That such assessment shall be payable in equal annual installments
extending over a period of three (3) years, the first of the installments to
be payable on the first Monday in January, 1968, and shall bear interest at the
rate of six (6) percent per annum from the date of the adoption of this
assessment resolution. To the first annual installment shall be added interest
on the entire assessment from the date of this resolution until December 31,
1968. To each subsequent installment when due shall be added interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to the
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property, with interest accrued to the date of payment, to
the City Treasurer, except that no interest shall be charged if the entire
assessment is paid within 30 days from the adoption of this resolution; he may
thereafter pay to the County Treasurer the installment and interest in process
of collection on the current tax list and he may pay the remaining principal
balance of the assessment to the City Treasurer.
4. The Clerk shall file the assessment roll pertaining to this assessment
in his office and shall certify annually to the County Auditor on or before
October loth of each year the total amount of installments and interest which
are to be due in the following year on the assessment on each parcel of land
included in the assessment roll.

RESOLUTION ADOPTING ASSESSMENT LOCAL IMPROVEMENT NO. 57A
WHEREAS. pursuant to proper notice duly given as required by law, the
Council has met and heard and passed upon all objections to the proposed
assessment for the improvement consisting of the following;
RESURFACING
West Willard Street from South Everett Street to South Martha Street;

as compensation for services rendered for sjch employment the said Jeanette

RESOLUTION DESIGNATING DEPOSITORIES OF PUBLIC FUNDS
BE IT HEREBY RESOLVED, that the following named banks authorized to do
a banking business in Minnesota be, and hereby are, designated depositories
of the publ:- funds of the City of Stillwater, County of Washington, Minn-
esota, for the term commencing with the 1st day of May, 1967, and ending
with the 30th day of April, 1970, to -wit:
The First National Bank of Stillwater, Minnesota, in sums not to
exceed in the aggregate Six Hundred Thousand($600,000.00) Dollars
at any one time;
The Farmers & Merchants State Bank of Stillwater, Minnesota in sums
not to exceed in the aggregate Six Hundred Thousand ($600,000.00)
Dollars at any one time;
The Cosmopolitan State Bank of Stillwater, Minnesota, in sums not
to exceed in the aggregate Six Hundred Thousand ($600,000.00) Dollars
at any one time;
upon the terms and conditions following, to -wit:
To secure such funds, the said depositories shall deposit with the City
Treasurer such bond or other collateral as is required or permitted by
law. The total in amount of such collateral computed at its market value
Shall be at least ten percent (10%) more than the limit of deposit which
would be permitted if a corporate or personal surety bond was furnished.
The depositories may in their discretion furnish both a bond and collateral
aggregating the required amount. Any collateral so deposited shall be
accompanied by an assignment thereof to the City, which assignment shall
recite that such depository shall pay over to the Treasurer or his order
on demand all moneys deposited therein at any time during the period such
collateral shall be so deposited; and, that in case of any default on the
part of any depository, the City shall have full power and authority to
sell such collateral, or as much thereof as may be necessary, to realize
the full amount due the City and to pay over any surplus to such deposi-
tory or its assigns. The depositories may in their discretion deposit
collateral of a value less than the total designation and may from time to
time, during the period of their designation, deposit additional collateral
and make withdrawals of excess collateral, or substitute other collateral
for that on deposit or any part thereof. Before any collateral is deposited
with the Treasurer, it shall first be approved by the City Council, but
no such authority shall be necessary for the withdrawal of collateral. If
both bond and collateral are furnished by the depositories, all or any
part of the collateral may be withdrawn without in any way impairing the
full force and effect of the bond unless it shall contain a provision that
the collateral shall not be withdrawn without the consent of the surety
thereon. I£ a corporate surety bond is furnished by either of the deposi-
tories, it shall be in a penal sum not to exceed the amount designated as
the limit of the deposit herein, nothwithstanding any other provisions of
law to the contrary.
At no time shall the Treasurer maintain a deposit in the depositories
against collateral in excess of ninety (90%) percent of the market value
thereof. Any bond furnished shall be approved by the City and filed in the
office of the County Auditor as provided by law, and all collateral deposited
shall likewise be approved by the City and after such approval, deposited
with the Treasurer, unless the City Council shall by resolution fix and de-
termine some other place for the safekeeping of such collateral. Such col-
lateral shall not be re -deposited in the designated depositories. The
depo "----- -t any time they deem it advisable or desirable may substitute
obligations of the United States of America for all or any part of the se-
curities pledged. The collateral so substituted shall be approved by the
City at its next official meeting. Such securities so substituted shall, at
the time of substitution, have a market value sufficient, together with the
market value of the original securities for which no substitution is made,
to equal or exceed $110.00 for every $100.00 of public deposits.

Each of said depositories shall pay on demand all deposits therein subject
to payment on demand and shall pay on demand all time deposits therein, with
accrued interest, at or after the end of the periods for which the same shall
have been deposited. All of said disbursements shall be made by order or war-
rant signed in an appropriate place by the city Treasurer and by the President
of the City Council, or, in the absence of the President, by the Vice President
of the City Council, which warrants when so signed and issued shall become a
check upon the said City depositories.

Legislature which would have the effect of increasing the legal
limit of forty-five (45) mills for all general fund purposes in
the City of Stillwater. Minnesota. as provided by the present
Statute. to a maximum of sixty (60) mills.

and specifications submitted by the Washington County Highway Department.

RESOLUTION FAWRING LEGISLATION
WHEREAS, the present salary of the Municipal Court Judge is $7,500.00 per
year;
AND WHEREAS, the salary as presently fixed will expire on July 1, 1967, and
the case load has increased considerably because of County population in-
crease and statutory provisions;
NOW, THEREFORE; BE IT RESOLVED, that the City Council of the City of Still-
water hereby favors legislation which would fix the salary of the Municipal
Judge in the City of Stillwater, until July 1, 1969, at $10,000 per year
($9,500.00 as Municipal Court Judge and $500.00 per year as Conciliation
Court Judge); and of this amount the County of Washington shall pay $6,500.00
per year.

RESOLUTION VACATING A PART OF STILLIC SR AVENUE
WHEREAS, at a meeting of this Council held on the 7th day of March, 1967,
a petition was presented praying for the vacation of a part of Stillwater
Avenue in the City of Stillwater hereinafter described; and
WHEREAS, at said meeting the Council did, after due consideration, deem
it expedient to proceed with said matter and did order the said petition
to be filed in the office of the City Clerk; and
WHEREAS, the City Clerk did thereupon and thereafter give notice by
publication in the Stillwater Evening Gazette, official newspaper of the
City, for four successive weeks beginning on Friday, March 17, 1967, and
thereafter on Friday of each week to and including April 7, 1967, to the
effect that said petition had been filed as aforesaid and stating concisely
its objects and that said petition would be heard and considered by the
Council at the Municipal Building in the City of Stillwater, Minnesota, on
the 18th day of April, 1967, at 7:30 o'clock P. M.; and
WHEREAS, at the time and place appointed in said notice, the Council at a
duly called and held meeting thereof, did investigate and consider said
matter and did hear the testimony and evidence on the part of all parties
interested, at which meeting and hearing there was no opposition to said
vacation; and
WHEREAS. said matter was laid over and continued and pursuant to adjourn-
ment came before the Council for further consideration at a meeting duly
called and held at the Municipal Building in said City on the 25th day of
,April, 1967, whereat the Council determined that the vacation of said part
of Stillwater Avenue is in the public interest;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Stillwater. Minnesota, that the said petition be and the same is hereby
granted and that the following part of said street as presently laid out
and dedicated in said City be, and the same is hereby vacated, absolutely
and forever, viz:
All that part of Stillwater Avenue lying between Ovens Street
and Carnelian Street;
BE IT FURTHER RESOLVED, that the Council deems substantial benefits will
accrue to the City from the vacation of that part of said street as herein
provided, and the public benefits will be such that said vacation is here-
by ordered without payment of compensation;
BE IT ALSO FURTHER RESOLVED, that upon publication of this resolution
according to law, a transcript thereof, together with a duplicate of the

RESOLUTION ORDERING HEARING ON IMPROVEMENT, APPROVING PLANS AND SPECIFICATIONS
AND DIRECTING CLERK TO ADVERTISE FOR BIDS.
WHEREAS, this Council did, on the 9th day of May, 1967, receive the prelimin-
ary report of the City Engineer that the following described improvement is
feasible, and may be made as proposed, in connection with Local Improvement
No. 65 6 66, viz:
Construction of 6" cast iron watermain in St.Croix Avenue from
Carnelian Street to Owens Street and North Owens Street from West
Wilkin Street to West Sycamore Street;
and has prepared plans and specifications for said improvement and has pre-
sented same to the Council for approval; and
WHEREAS, the City Engineer has further reported to the Council that the esti-
mated cost of said improvement is $13,500.00; and
WHEREAS, the area proposed to be assessed for said improvement includes all
property abutting upon the portions of said streets above described.
MOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
1. That the Council shall meet at the City Hall in said City on Tues-
day, the 6th day of June, 1967, at 7:30 o'clock P.M. for the purpose of holding
a public hearing on the making of said improvement; and that the City Clerk be,
and he is hereby. authorized and directed to cause proper notice of the time,
place and purpose of said hearing to be published in the Stillwater Evening
Gazette, official newspaper of the City, and mailed as required by law.
2. That said plans and specifications be, and the same are hereby,
approved and ordered filed in the office of the city Clerk.
3. That the City Clerk is hereby authorized and directed to prepare and
cause to be inserted in said official newspaper, an advertisement for bids;
said advertisement to specify the work to be done, that bids will be opened and
considered by the council at 4:30 o'clock P.M. on Tuesday, the 6th day of June.
1967, in the Council Chambers at the Municipal Building; that no bide will be
considered unless sealed and filed with the City Clerk and accompanied by a
cash deposit, cashier's check, bid bond or certified check, payable to the City

A RESOLUTION PROVIDING FOR A HEARING TO DETERMINE THE NEED FOR A HOUSING
AND REDEVELOPMENT AUTHORITY TO FUNCTION IN STILLWATER, MINNESOTA
Whereas, the Minnesota Housing and Redevelopment Act, Chapter 487, Minne-
sota Session Laws of 1947, creates a "Housing and Redevelopment Authority" i
in each city, villaae and borough, and provides that such an Authority shall
not transact any business or exercise its powers until the governing body of
the city, village or borough by resolution shall determine that there is need
for an Authortiy to function in such city, village or borough.
THEREFORE, DE IT RESOLVED by the City Council of the City of Stillwater, Minn-
esota:
That on the 13th day of June, 1967, at 7:30 oscoock P.M. at the Munici-
pal Building, being the time and place of a regular meeting of the City Coun-
cil of the City of Stillwater, Minnesota, this body shall determine:
(a) Whether substandard areas exist in the City of Stillwater, Minnesota,
which cannot be redeveloped without government assistance:
(b) Whether adequate housing accommodations are not available to veterans
and servicemen and their families; or
(c) Whether there is a shortage of decent, safe, and sanitary dwelling
accommodations in the City of Stillwater, Minnesota, available to persons of
low income at rentals they can afford.
That at such meeting a public hearing will be held on these matters.
That all interested persons be and hereby are invited to attend said
hearing and present evidence to this body.
That the Berk be and he hereby is directed to cause this resolution to
be published after the adjournment of this meeting in the Stillwater Evening
Gazette, a newspaper qualified to publish Resolutions and Ordinances.
The motion to adopt the resolution was seconded by Councilman Molds and

NV AND MAINTENANCE OF INCOME DURING DISABILITY DUE TO ILLNESS OR INJURY.
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that Resolution No. 2429 be amended as follows, that for the purpose of
providing a vacation plan for all officers and employees who are not members
of a union, organization, federation, other than elected officers and temporary,
emergency, seasonal or part time employees, annual paid vacations will become
available to each such officer and employee as follows, to wit:

RESOLUTION AUTHORIZING PURCHASE OF EASEMENT
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota that
the purchase by the City of an easement for the purpose of ingress and egress for
maintaining storm sewer outlets to Lily Lake upon and across the following land
lying and being situated in Washington County, Minnesota, to -wit:
A fifty -foot (50') Strip of land, described as follows:
Commencing at the Northeast (NE) corner of Lot Two (2).
Block Two (2) of HAM!s.. Lily Lake Addition to the City of
Stillwater, County of Washington, Minnesota; Thence Southerly
along the East (E) line of said lot and the same extended
to the South line of Lot Three (3), Block Two (2) of said
Addition: Thence Westerly along the South line of Lot Three (3)
for a distance of Fifty (50) feet to a point; Thence Northerly
parallel to and Fifty (50) feet Westerly of the East line of
Lot Two (2) as platted and extended, to the North Line of
Lot Two (2), Block Two (2) of said Addition; Thence Easterly
along said North line of Lot Two (2) to the Northeast (NE)
Corner of said lot; being the point of beginning for this
easement.
BE IT FURTHER RESOLVED, that the sum of Two Thousand and no/100th Dollars
($2,000.00) be, and the same is hereby appropriated for the said easement and
that upon delivery to the City of properly executed instrument of conveyance
of said easement, a warrant payable to the order, of Donald G. Hill and Veronica
H. Hill and Gilbert E. Swanson and Helen C. Swanson, shall be drawn upon the City
Treasurer for the sum aforesaid and issued accordingly.

RESOLUTION AUTHORIZING OVERTIME PAY FOR POLICEMEN AND FIREMEN
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that from and after January 1, 1967 regular policemen and firemen including
the Chiefs of both departments shall be entitled to additional compensation
for overtime worked to cover a shift for a regular policeman or fireman, in such
cases the rate of pay per hour shall be the same rate the employee receives for
regular working hours.

WHEREAS. by resolutions adopted May 16, 1967, this Council did fix a date for
public hearings on proposed improvements consisting of the following, to -wit:

RESOLUTION NO. 3062
RESOLUTION AUTHORIZING AGREEMENT WITH THE COUNTY OF WASHINGTON,
CITY OF STILLWATER AND THE VILLAGE OF OAK PARK HEIGHTS TO
CONSTRUCT STORM SEWER FACILITIES.
WHEREAS, there is existing a surface water drainage problem in
the area located in Webster's Third Addition. MCKenty's Addition,
McMillan and Cooley's Addition, and that said area lying within the
City of Stillwater and the Village of Oak Park Heights, and
WHEREAS, the County of Washington is in the process of con-
struoing a County Office building in said area, and
WHEREAS, a considerable problem has been experienced with
reference to surface waters that have accumulated in the area, and
WHEREAS, it is feasible and necessary that this problem
be solved by the construction of the necessary storm surface water
drainage, and
WHEREAS, the engineering staff of the County of Washington
has heretofore submitted a general plan in which said facilities
can be installed to alleviate said problem, and
WHEREAS. the City of Stillwater is willing to participate
in said plan as proposed by the engineering staff of the County of
Washington, and
WHEREAS, it appears that the most feasible plan is designated
as Alternate III wherein the City of Stillwater would pay 78.23% of
the total cost of construction of said project, and that the estimated
cost thereof to the City of Stillwater is $25,407.93.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Stillwater as follows:
1. That they hereby generally approve of said plan as
proposed by the engineering staff of the County of Washington. to -wit,
Alternate III.
2. That the City of Stillwater is willing to pay their share
of 78.23% of the total cost of said project being estimated at
$25.407.93.
3. That the mayor and clerk are authorized and directed to
enter into an agreement under the so-called joint powers act,
Minnesota Statutes Annotated 471.59, with said County of Washington
and Village of Oak Park Heights, providing that said project be let
out on bids in accordance with the laws of the State of Minnesota,
by the County of Washington and that said work shall be supervised
by said engineering staff of the County of Washington.

that the bid of American National Bank and Trust Company (And Associates)
of St. Paul, Minnesota, to purchase $350,000 Street Construction and
Equipment Bonds of 1967, of the City to be issued in accordance with
Ordinance No. 413, adopted on June 13, 1967, and the published notice
of sale, at a price of par and accrued interest plus a premium of $0,
bonds of said issue maturing in the years set forth below to bear interest
from date of issue until paid or duly called for redemption at the annual
rate set forth opposite such years, respectively:

RESOLUTION NO. 3066
RESOLUTION PRESCRIBING THE FORM AND DETAILS AND DIRECTING THE
EXECUTION AND DELIVERY OF $350,000 STREET CONSTRUCTION AND
EQUIPMENT BONDS OF 1967, CREATING A SINKING FUND, AND LEVYING
TAXES FOR THEIR PAYMENT
BE IT RESOLVED by the City Council of the City of Stillwater, Minnesota
as follows:
1. The City having heretofore duly authorized, advertised for sale,
and contracted to sell the bonds described herein, there shall be forth-
with prepared for issuance the negotiable coupon general obligation
Street Construction and Equipment Bonds of 1967 of the City in the aggregate
principal amount of $350,000, said bonds to be dated as of July 1, 1967,
to be 70 in number and numbered from 1 to 70, inclusive, each in the
denomination of $5,000 and to mature serially, in order to serial numbers,
lowest numbers first, on January 1, in the amount of $30,000 in each of
the years 1970 through 1972, $35,000 in each of the years 1973 through
1979, and $15,000 in 1980, all without option of prior payment. The
bonds maturing in the years set forth below shall bear interest at the
respective rates per annum appearing opposite such years of maturity,
as follows:

Interest shall be payable on July 1, 1968, and semi-annually thereafter
on each January 1 and July 1. Both principal and interest on said bonds

Minnesota, and the City agrees to pay the reasonable and customary charges
of said paying agent for the receipt and disbursement of the principal
and interest moneys.
2. Said bonds and the interest coupons to be attached thereto shall
be in substantially the same form as the form presented to the Council.
on the date hereof.
3. Said bonds shall be forthwith prepared for execution under the
direction of the City Clerk and attorneys, and shall be executed in behalf
of the City by the signature of the Mayor, attested by the City Clerk, and
by a printed facsimile of the official seal of the City; and the interest
coupons and certificate as to legal opinion shall be executed and authen-
ticated by the printed, engraved or lithographed facsimile signatures of
said officers. When the bonds have been so executed, they shall be
delivered by the City Treasurer to the purchaser thereof upon receipt of
the purchase price heretofore agreed upon, and the purchaser shall not
be obligated to see to the application of such purchase price.
4. There is hereby created a separate Sinking Fund for said $350,000
Street Construction and Equipment Bonds of 1967, which fund shall be kept
by the City Treasurer apart from all other funds of the City and used for
no purpose other than payment of the principal of and interest on said
bonds; provided that, if any payment of principal or interest shall become
due when there is not sufficient money in said fund to pay the same, the
Treasurer shall nevertheless pay such principal and interest from the
general fund or other moneys of the City, and such general fund or other
funds may be reimbursed for such advances out of the proceeds of the
taxes hereinafter levied. Into said fund shall be paid the proceeds of
all taxes levied pursuant to this resolution and all other moneys received
for or appropriated to the payment of said bonds and interest, including
the accrued interest and any premium received by the City upon the sale
and delivery of said bonds.

5. The full faith, credit and unlimited taxing powers of the City
are hereby irrevocably pledged for the prompt and full payment of the
principal of and interest of said bonds as such principal and interest
respectively become due. To provide moneys for such payment, there is
hereby levied upon all of the taxable property in said City a direct,
annual, ad valorem tax, which shall be spread upon the tax rolls and
collected with and as a part of other general property taxes in said
City, in the years and amounts as follows:

provided, that the City hereby reserves the right and power to reduce the
levies in the manner and to the extent permitted by Minnesota Statutes,
Section 475.61, as ammended.
6. The City Clerk is hereby authorized and directed to file a
certified copy of this resolution with the County Auditor of Washington
County, together with such other information as the Auditor may require, and
to bbtain from said Auditor a certificate that said bond issue has been
entered on his register and that such tax has been levied as required by law.
7. The County Auditor of Washington County and the officers of the
City are hereby authorized and directed to prepare and furnish to the
purchasers of said bonds, and to the attorneys approving the legality
thereof, certified copies of all proceedings and records of the City
relating to said bonds and to the financial condition and affairs of the
City, and such other certificates, affidavits, and transcripts as may be
required to show the facts within their knowledge or as appear from the
books and records in their custody and control pertaining to the validity
and marketability of said bonds; and such instruments, including any
heretofore furnished, shall constitute representations of the City as to
the truth of the facts purported to be stated therein.

that Russell J. Wolff, Clerk of the Municipal Court of the City of

of January, February, March. April, May, and June, 1967 of Twenty -
Five Dollars ($25.00) a month for a total of One Hundred Fifty Dollars

RESOLUTION CONFIRMING APPOINTMENT OF POLICE OFFICER.
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the appointment of Donald Staberg as a police officer of the City for
a probationary period of not to exceed six months. commencing July 16, 1967,
be, and the same is hereby, confirmed; that as such police the said Donald
Staberg shall have the powers to police officers at common law or under
the laws of the State of Minnesota, and it shall be his duty to serve warrants,
summons, writs, subpoenas or other process issued by the Washington County
Municipal Court; to command the peace, suppress rioting or disorderly conduct
within the City and to arrest, with or without a warrant, as authorized by
the laws of this State, persons charged with the commission of any public
offense under the laws of the State of Minnesota or the ordinances of the
City, and to perform any and all other duties incidental to the office of
a policeman as directed by the City Administrator or the Chief of Police;
and that the said Donald Staberg shall receive as compensation for services
rendered as such police officer the sum of $495.00 per month.

BE IT RESOLVED, by the City Council of the City of Stillwater. Minnesota,
as follows:
WHEREAS, The Council on June 28, 1967 adopted Resolution No. 3066, and
WHEREAS, the tax levies set forth in paragraph five of said Resolution
were incorrect, said paragraph five is hereby amended to read as follows:
"The full faith, credit and unlimited taxing powers of the City are
hereby irrevocably pledged for the prompt and full payment of the principal
of and interest on said bonds as such principal and interest respectively
become due. To provide moneys for such payment, there is hereby levied
upon all of the taxable property in said City a direct, annual, ad valorem

RESOLUTION DECLARING AN EMERGENCY IN THE AVAILABILITY OF DUMP SITES AND

WHEREAS, the dump site used by the citizens of the City of Stillwater has
been closed by the Township of Stillwater:
AND WHEREAS, the City of Stillwmter presently owns a tract of Land previously
used as a City Dump:
AND WHEREAS, it is necessary for public health and sanitation that the City
Dump be re -opened as an emergency measure:
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota:
That the City Dump site owned by the City of Stillwater be re -opened by
reason of an emergency and remain open until further order of the City
Council.

RESOLUTION ACCEPTING PETITION AND ORDERING PREPARATION OF PRELIMINARY
REPORT.
WHEREAS, petitions were presented by several property owners; and said
petitions were found to be adequate and were accepted by the Council,
and it has been proposed to construct the following described improve-
ments and to assess the benefited property for all or a portion of the
cost thereof, viz:
Surfacing,curb and gutter on North Brick Street (Birchwood
Drive North) from Myrtle Street to Linden Street.

RESOLUTION ORDERING HEARING ON IMPROVEMENTS, ORDERING PREPARATION OF
PLANS AND SPECIFICATIONS AND DIRECTING CLERK TO ADVERTISE FOR BIDS.
WHEREAS, this Council did, on the 15th day of August 1967, receive the
preliminary report of the City Engineer that the fallowing described
improvements are feasible, and may be made as proposed in connection
with Local Improvements No. 63, 64, 67, 68, 1967. viz:
Surfacing, curb, gutter and other appurtenances on South
Sixth Street from West Hancock Street to West Orleans Street.
Surfacing, curb, gutter and other appurtenances on North Brick
Street (Birchwood Drive No.) from West Myrtle Street to West
Linden Street.
Surfacing, curb. gutter and other appurtenances on Echo Lane
from West Myrtle Street to West Linden Street.
Surfacing, curb, gutter and other appurtenances on West Linden
Street from North Owens Street to Westerly dead end.
and the engineer is hereby ordered to prepare plans and specifications
for said improvements; and
WHEREAS, the City Engineer has further reported to the Council that the
estimated cost of said improvement is $158,350.00; and
WHEREAS, the area proposed to be assessed for said improvements includes
all property abutting and non -abutting upon the portions of said streets
above described.
NOW, TBEREFORE, BE IT RESOLVED, by the City Council of the City of
Stillwater, Minnesota:
1. That the Council shall meet at the City Hall in said City
on Tuesday, the 19th day of September, 1967, at 7:30 o'clock P. N. for
the purpose of holding a public hearing on the making of said improvements
and that the City Clerk be, and he is hereby, authorized and directed to
cause proper notice of the time, place and purpose of said hearing to be
published in the Stillwater Evening Gazette, official newspaper of the
City, and mailed as required by law.
2. That the City Clerk is hereby authorized and directed to prepare
and cause to be inserted in said official newspaper, an advertisement for
bids; said advertisement to specify the work to be done, and that bids will
be opened and considered by the Council at 11:00 o'clock A. M. on Tuesday,
the 19th day of September, 1967, in the Council Chamber at the Municipal
Building; that no bide will be considered unless sealed and filed with the
City Clerk and accompanied by a cash deposit, cashier's check, bid bond or
certified check, payable to the City of Stillwater for ten (10) percent
of the amount or arch bid; and tnat the Council shall have thirty (30)
days within which to act upon said bids.

RESOLUTION ACCEPTING ENGINEERING PROPOSAL.
WHEREAS, the Banister Engineering Company of St. Paul, Minnesota, has
submitted to the City a written proposal, dated September 12. 1967, for
the performance or engineering services in connection with construction
of proposed improvements and expansion to the existing City of Stillwater
Sewage Treatment Plant; and
WHEREAS, after due consideration said proposal is found to be fair and
reasonable and in the best interests of the City;
BE IT RESOLVED, by the Council of the City of Stillwater, Minnesota,
that subject to the grant of Federal assistance in the construction of
said improvements and expansion of the existing City of Stillwater
Sewage Treatment Plant and subject to the City s acceptance or such grant
if offered, the proposal of the said Banister Engineering Co. to be in
all things accepted and the Mayor and the City Clerk are hereby authorized
to execute proper written acceptance thereof.

City of Stillwater and the formerly recognized representative Local #49
International of Operating Engineers AFL-CIO dated June 1, 1967 is hereby

RESOLUTION ORDERING IMPROVEMENTS AND ACCEPTING BID FOR CONSTRUCTION OF
LOCAL IMPROVEMENTS NO. 63. 64, 67 and 68.
WHEREAS, by resolutions adopted August 15, 1967, this Council did fix a date
for public hearings on proposed improvements consisting of the following, to -wit:
Surfacing, curb, gutter and other appurtenances on South Sixth
Street from West Hancock Streetto West Orleans Street.
Surfacing, curb, gutter and other appurtenances on North Brick Street
(Birchwood Drive No.) from West Myrtle Street to West Linden Street.
Surfacing, curb, gutter and other appurtenances on Echo Lane from West
Myrtle Street to West Linden Street.
Surfacing, curb, gutter and other appurtenances on West Linden Street
from North Owens Street to Westerly dead end.
AND WHEREAS, pursuant to notices duly published in the Stillwater Evening
Gazette, official newspaper of the City, On September 5, 1967 and September 12,
1967, and mailed as required by law, said hearings were held at the City Hall
at 7.30 o'clock P. M. on Tuesday, the 19th day of September, 1967, at which
time and place all persons desiring to be heard on said improvements were given
an opportunity to be heard;
AND WHEREAS, by resolutions adopted August 15, 1967, this Council did authorize
and direct the City Clerk to advertise for bids, returnable at 11:00 o'clock
A. M. on Tuesday, the 19th day of September, 1967, for the construction of the
aforesaid improvement:
AND WHEREAS, it appears from the affidavits of publication presented by the

RESOLUTION ESTABLISHING OCTOBER 24, 1967 SPECIAL SUNDAY LIQUOR OPTION
ELECTION.
BE IT RESOLVED, by the City of Stillwater City Council:
1. That a special election shall be held on Tuesday,. October 24. 1967
to consider the sale of intoxicating liquor on Sundays in the City of Stillwater
and the question shall be submitted to the voters of the City in substantially
the following form:
Shall special licenses be granted for the sale of intoxicating
liquor on Sundays in the City of Stillwater, Minnesota?
2. The Clerk is hereby directed to give notice of said special election
as required by the Charter of the City of Stillwater.
3. The Clerk is directed to prepare paper ballots and all voting on the
proposed question shall be by paper ballot.
4. The voting time on the proposed question shall be between the hours
of 7:00 A. M. and 8:00 P. M. on October 24, 1967.
5. The voting places shall be as follows:
A11 of the First Ward, both First and Second Precincts, St.
Michael's Church, Basement, located at South Third and East
Walnut Streets.
All of the Second ward, both First and Second Precincts,
Methodist Church, Basement, located at Myrtle and Greeley Streets.

RESOLUTION VACATING A PART OF OAK STREET
WHEREAS, at a meeting of this Council held on the 12th day of September,
1967, a petition was presented praying for the vacation of a part of oak
Street in the City of Stillwater hereinafter described; and
WHEREAS, at said meeting the Council did, after due consideration, deem
it expedient to proceed with said matter and did order the said petition
to be filed in the office of the City Clerk; and
WHEREAS, the City Clerk did thereupon and thereafter give notice by
publication in the Stillwater Evening Gazette, official newspaper of the
City, for four successive weeks beginning on Friday, September 15, 1967,
and thereafter on Friday of each week to and including October 6, 1967, to
the effect that said pation had been filed as aforesaid and stating concisely
its objects and that said petition would be heard and considered by the Council
at the Municipal Building in the City of Stillwater, Minnesota, on the 17th
day of October, 1967, at 7:30 o'clock P. M.; and
WHEREAS, at the time and place appointed in said notice, the Council at a
duly called and held meeting thereof, did investigate and consider said
matter and did hear the testimony and evidence on the part of all parties
interested, at which meeting and hearing there was no opposition to said
vacation;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Stillwater,
Minnesota, that the said petition be and the same is hereby granted and that
the following part of said street as presently laid out and dedicated in said
City be, and the same is hereby vacated, absolutely and forever; viz:
All of that part of Oak Street, formerly Division Street, which
lies South of Lot 9, Block 17, and North of Lot 12, Block 18,
and between the East and West lines of Lot 9, Block 17 extending
South, and between the East and West Lines of Lot 12, Block 18
extended North, all in MCKinstry and Seeley's Second Addition to
Stillwater.
BE IT FURTHER RESOLVED. that the Council deems substantial benefits will
accrue to the City from the vacation of that part of said street as herein
provided, and the public benefits will be such that said vacation is hereby
ordered without payment of compensation;
BE IT ALSO FURTHER RESOLVED, that upon publication of this resolution
according to law, a transacript thereof, together with a duplicate of the
plat showing the part of said public street vacated hereby, certified by
the. City Clerk, shall be filed for record and recorded in the office of the
Register of Deeds of Washington County, Minnesota.

RESOLUTION TO ACCEPT MUNICIPAL BUILDING. AND FIRE STATION.
BE IT RESOLVED THAT THE COUNCIL OF THE CITY OF STILLWATER, MINNESOTA
that the City fix a completion date and acceptance of the work on the
new municipal building and fire station. and that the acceptance of
these facilities is based on the following facts:
Peter L. Racchini the City's Architect has informed
the City Council that the general contractor, namely
Dean Lundholm Construction Co., Inc., the mechanical
contractor the Axel Newman Co. and the electrical
contractor Linner Electric Company have satisfactorily
completed all work as required in accordance with
contracts.
NOW THEREFORE BE IT RESOLVED, that the City Council hereby accepts
the Municipal Building and Fire Station in accordance with the
city architect's recommendation.

RESOLUTION NO. 4024
RESOLUTION AUTHORIZING PURCHASE OF REAL ESTATE.
WHEREAS the City Council of the City of Stillwater deems it necessary for
the good of the City and the welfare of its inhabitants that the City
purchase the following described real estate, to wit:
Lots Fourteen (14) and Fifteen (15) in Block Twenty (20) of Holcombe's
Second Addition to Stillwater, according to the plat thereof on file and
of record in the office of the Register of Deeds of Washington County,
Minnesota.
All that part of the Southwest Quarter of the Northwest Quarter
(SW1 of NW ) of Section Thirty-three (33) in Township Thirty (30).
Range Twenty (20) West of the Fourth Meridian, described as follows,
to wit;
Beginning at a point in the north line of said subdivision of said
Section thirty-three (33), Three hundred and eighty-six and one -
tenth (386.1) feet west of the northeast corner of same, and running
thence West along the North line of said subdivision Two hundred and
seventy-seven (277) feet; thence South at right angles with said
North line One Hundred (100) feet: thence East parallel with said
north line of said subdivision Two hundred and thirty-six and six -
tenths (236.6) feet to a point in the West line of South Greeley
Street in the City of Stillwater; thence North 2201' East along
said West line of South Greeley Street one hundred seven and nine -
tenths (107.9) feet to the place of beginning, containing 0.59 acres
of land.
Excepting therefrom that part thereof conveyed to the City of
Stillwater by deed dated October 24, 1932 and recorded December 11,
1933 in Book 123 of Deeds, page 246 in the office of the Register
of Deeds of Washington County, Minnesota.
That part of the North Half of the Southwest Quarter of the North-
west Quarter (N1 of Sw4 of WW1) of Section Thirty-three (33).
Township Thirty (30) North of Range Twenty (20) West, described
as follows, to -wit:
Commencing at a point in the North line of said tract Three
hundred eighty-six and one -tenth (386.1) feet West of the Northeast
corner thereof; thence Southwesterly along the West line of South
Greeley Street a distance of one hundred seven and nine -tenths
(107.9) feet to a point of beginning of this description; thence
West parallel with the North line of said tract a distance of Two
hundred thirty-six and six -tenths (236.6) feet to a point; thence
straight South a distance of Eighty-one (81) feet to a point; thence
East parallel with said North line a distance of Two hundred three
and eight -tenths (203.8) feet more or less to the Westerly line of
said Greeley Street; thence Northeasterly along the West line of said
Greeley Street a distance of Eighty-seven and three -tenths (87.3)
feet more or less to the point of beginning.
According to thr United States Government Survey thereof.
said purchase to be for the sum of Fifteen Thousand Dollars ($15,000.00)
payable Three Thousand Dollars ($3,000.00) on November 1, 1967 and Three
Thousand Dollars ($3,000.00) each year thereafter without interest on the
unpaid balance, NOW, THEREFORE,
BE IT RESOLVED that the Mayor and City clerk are hereby authorized and

WHEREAS, Mr. Isaac Gordon attained the age of 105 years and spent 62 years
of his life in the City of Stillwater, Minnesota and
WHEREAS, Mr. Gordon was keenly interested in the affairs of the iityCofy

Stillwater and this was demonstrated by his many appearances
Hall during his residency in the City, and
WHEREAS, the Mayor and Council deem his passing on Sunday, November 12, 1967
of sufficient importance and public interest to warrant the adoption of a
resolution in his memory.

RESOLUTION PROHIBITING PARKING IN CERTAIN AREAS.
WHEREAS, it has come to the attention of the City Council that due to the
location of the County Office Building on West Anderson Street in the City
of Stillwater and the parking which has resulted therefrom, parking on both
sides of the street in this area has obstructed the normal flow of traffic,
NOW, THEREFORE, BE IT RESOLVED that the City Engineer is hereby directed
and instructed to erect "No Parking" signs on the west side of Greeley
Street from its intersection with the south line of Churchill Street south
to the city limits of the City of Stillwater, and that from and after the
passage and publication of this resolution and the erection of said signs,
it shall be unlawful to park in the area described.

RESOLUTION ACCEPTING PETITION AND ORDERING PREPARATION OF PRELIMINARY REPORT
WHEREAS, a petition was presented by several property owners; and said peti-
tion was found to be adequate and was accepted by the Council, and it has
been proposed to construct the following described improvements and to assess
the benefited property for all or a portion of the cost thereof, viz:

South William Street between West Oak Street and

RESOLUTION ACCEPTING BID AND AUTHORIZING EXECUTION OF CONTRACT
BE IT RESOLVED, by the City Council of the City of Stillwater, Minnesota,
that the bid of Kilty-Ogren Petroleum Company. Stillwater, Minnesota, in the
amount of 11.69 cents per gallon on 18,000 gallons, more or less of No. 2
Fuel Oil delivered into the tanks of the Municipal Building of the City of
Stillwater for the period January 1, 1968 to January 1, 1969, which bid is
hereby found to be the lowest responsible bid meeting specifications be, and
the same is hereby accepted; and the Mayor and the City Clerk are hereby au-
thorized and directed to enter into a contract on behalf of the City with the
said Kilty-Ogren Petroleum Company for the purchase of No. 2 Fuel Oil. said
contract to be in accordance with the specifications and the proposal of the
bidder which are on file in the office of the City Clerk.

RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT, LOCAL IMPROVEMENT No. 65 & 66-
1967,
WHEREAS, a contract has been let for the improvement consisting of water -
main in North Owens Street, West Wilken Street to West Sycamore Street
and St. Croix Avenue from North Carnelian Street to North Owens Street, of
which the Council deleted the following portion:
Portion of No. 65 being on West St.Croix Avenue
from North Carnelian Street to North Owens Street,
and the contract price for such improvement is $11,993.98, and the expenses
incurred or to be incurred in the making of said improvement amount to
$9,566.76; and of this cost the City will pay $None as itsshare of the
cost;
AND, WHEREAS, the City Clerk, assisted by the City Engineer, has prepared
a proposed assessment of the cost of said improvement and has notified the
Council that such proposed assessment has been completed and filed in his
office for public inspection;
ROW, THEREFORE, BE IT RESOLVED, by th" City Council of the City of Still-
water, Minnesota:
1. That the coat of such improvement to be assessed is hereby declared
to be $9,566.76.
2. That a hearing shall be held on the 13th day of February, 1968 at
7:30 o'clock P.M., in the City Hall, to pass upon such proposed
assessment and at such time and place all persons awning property af-
fected by such improvement will be given an opportunity to be heard
with reference to such assessment.
3. That the City Cledcbe, and he is hereby, directed to cause a notice
of said hearing to be published once in the Stillwater Evening
Gazette, official newspaper of the City, at least two weeks prior
to the date of said hearing and to be mailed to each property owner
known to be affected by said improvement at least ten days prior
thereto, said notice to specify the total cost of said improvement.

RESOLUTION AUTHORIZING ISSUE AND SALE OF CERTIFICATES OF INDEBTEDNESS
RESOLVED BY THE COUNCIL OF THE CITY OF STILLWATER, MINNESOTA, that there
shall be issued and sold Certificates of Indebtedness of the City of Still-
water in the total sum of $107,251.11, in anticipation of collection of
special assessments levied,, or to be levied, on properties specially bene-
fited by the following projects, to -wit:
No. 42-Sealcoating, $8,170.94; No. 47-Sewer --$8,888.18; No. 48-
Surfacing-$210.32; No. 49-Sewer, Lily Lake School-$5,254.50;
No. 50-Water -Sewer -$56.70; No. 52 Water-$1,342.14; No. 53-Sewer -
$4,522.01; No. 54-Sewer -$4,057.07; No. 55-56-Storm Sewer and
Street Construction-$28,250.30; No. 57-57A-Resurfacing, $4,185.06;
No. 59-Surfacing -$8,336.13; No. GO -Greeley Street-$18,591.77;
No. 61-Union Street- $2,635.47; No. 62 South Fourth Street-$3,183.76;
No. 65- Owen Street Sewer & Water - $9,566.76.
Certificates issued for the foregoing projects are to be numbered and in
the amounts as follows:
21 certificates number 1 through 21, inclusive, in the denomination
of $5,000.00 each and 3 certificates numbered 22 through 24, inclu-
sive, in the denomination of $750.37 each.
All of said Certificates are to be dated December 28, 1967, and shall be
due on or before December 31, 1968, with interest at the rate of 4h percent.
They shall be signed in the name of the City by its Mayor and the City Clerk
and shall bear the official seal of the City. They shall be paid primarily
from said special assessments, but the full faith and credit of the City are
hereby pledged for the full payment of said principal.
The principal of said Certificates shall be a first -charge on all the monies
received from the collection of said assessments. The City Treasurer shall
endorse upon each Certificate when presented to him the name and post office
address of such holders. In order to avail itself of the privilege of pay-
ing any or all of said Certificates prior to the date of maturity recited
above, the City by its Treasurer, must give the record holdl€hereof, 30 days
written notice of its intention to pay said Certificate, addressed to the
last known holder thereof.
