HomeMy WebLinkAbout2018-189 (preliminary plat for Neal Meadows 7th Addition, Case No. 2018-38) RESOLUTION 2018-189 CITY OF STILLWATER WASHINGTON COUNTY, MINNESOTA A RESOLUTION APPROVING THE PRELIMINARY PLAT FOR NEAL MEADOWS 7TH ADDITION CASE NO. 2018-38 WHEREAS,Bruce and Linda Livermore,property owners,have submitted an application for approval of: 1. Rezoning of the property at Lot 7, Block 2, Neal Meadows; and 2. Vacation of a Drainage and Utility Easement; and 3. Preliminary Plat for Neal Meadows 7th Addition as shown on Exhibit A WHEREAS, on August 8, 2018 the Planning Commission held a public hearing on the associated requests and upon hearing testimony from the public unanimously approved with conditions; and WHEREAS, on September 4, 2018 the City Council held a public hearing on the requests and found them to be compatible with the neighborhood and consistent with the City's Zoning Code, Subdivision Code, and Comprehensive Plan. NOW,THEREFORE, BE IT RESOLVED, that the City Council of the City of Stillwater hereby approves the Preliminary Plat for Neal Meadows 7th Addition with the following conditions: 1. The site shall be developed in substantial conformance with the plans on file with the Community Development Department,including those below, except as may be modified by the conditions herein: a. Preliminary Plat 7/10/18 b. Grading, Drainage,Paving, Erosion Control 7/10/18 2. All future electrical and communications utility lines shall be buried. 3. This development is responsible for paying$5,000 to the City for park and trail dedication fees. These fees will be due prior to release of the final plat from the City for recording with Washington County. 4. This development is responsible for paying the applicable 2018 development impact fees including the AUAR (Storm Sewer) of$3,599.00, and Trunk Sewer and Water fee of$6,458.14 prior to release of the final Page 1 of 3 September 4,2018 J plat for recording with Washington County. These fees are subject to annual increases, if not paid by December 31, 2018. 5. All three lots must receive their sanitary sewer and municipal water from the existing stubs located on the east side of Creekside Crossing. 6. The documents necessary to vacate the existing drainage and utility easements must be signed by the land owner prior to release of the final plat from City offices, and then filed together with the new plat. 7. Tree removal in excess of five trees per lot will require a 1:1 replacement for each tree removed in excess of five. A tree preservation and removal plan must be submitted if more than five trees are to be removed on any lot. And, replacement trees shall be installed according to the standards found in City Code Section 31-522. Any replacement trees that are necessary must be installed prior to release of the grading escrow for the specific lot.
