ESTABLISHING A MONTHLY RATE SCHEDULE FOR THE COLLECTION OF SOLID
WASTE AND RECYCLING EFFECTIVE JULY 1,2018—JUNE 30,2019
WHEREAS,the City is currently in a 5-year Agreement(7/1/2016—6/30/2021)with Waste Management
for the collection of solid waste and recycling; and
WHEREAS,Item# 9 of the current Agreement states that the Contractor and the City agree that disposal
rates are a combination of tipping fees and hauler rebates. In the event that the net of tipping fees and
hauler rebates increase or decrease in any given 12-month period, either party may request a rate
adjustment by contacting the other party. Any rate adjustments shall be negotiated between the parties
and approval will not be unreasonably withheld. A maximum of one(1)adjustment per 12-month period
is allowed; and
WHEREAS, In accordance with Washington County requirements, all municipal solid waste (MSW)
generated from the City of Stillwater must be processed at the resource recovery facility in Newport,being
operated by the R&E Facility; and.
WHEREAS, the tipping fee at the R&E Board Facility in 2016 and 2017 was $70.00 per ton and the
Hauler Rebate is$12.00 per ton. The tipping fee was increased to$77.00,but the net disposal costs is less
than $77.00, therefore the collection/disposal rates require adjustment of 2.5%.
NOW THEREFORE, BE IT RESOLVED that the Stillwater City Council hereby approves the
following rates for July 1, 2018—June 30, 2019.

BE IT FURTHER RESOLVED, that all other terms and conditions of the Solid Waste and Recycling
Service Agreement between the City of Stillwater and Waste Management of MN, Inc. July 1, 2016 —
June 30, 2021 shall remain the same and in full effect.
Adopted by the Stillwater City Council this 17th day of July, 2018.
