This was the day and time set for a public hearing on the request of Dan Stic::e for the vacation of a portion of West Oak Street. Notice of the hearing was published on April 18 and April 2S and May 2 and 9, 1973 and copies were mailed to all property owners shown on said petition. - The Mayor opened the hearing. - Mayor Powell stated that Fr. Florian Muggli had called him about this vacation and requested that the hearing be continued until June 26th. o MARK BRASSINGTON, 316 South Fourth Street, appeared in opposition to the proposed vacation. Mr. Stice I B property enfringes on his property and in 'the past there has been debris strewn over his yard and he had to go to considerable trouble to have same removed. He said the property was con- demned three or four years ago following the fire and feels that the building i8 unfit for inhabitation. He is definitely opposed to the proposed improve- ment of this old church building. GILBERT SW.ANSON, 1424 West Olive Street appeared in behalf of his mother who is 79 years old and finds it exceedingly difficult to maintai!) this property in the mannqr that it should be maintained. It is an attractive lot with trees on it and she has lived in the community since 1965. It is an undue ha..hip to her to have this property both financially and physically. property located in the sam9 block in the area are on lots of the same size or less. Be requested that the Council permit Swager Bros. to construct a house on this property which is 7,500 square feet in area. MAYOR POWELL asked how long his lOOther has owned the property and He said about 1961 or 1962 and she did not rea1iEe that this was only one property. The real estate company represented to her that it was all one package at the time of the purchase, but on the deed this was actually a separate lot. JACK SHBL'l'ON said that it is platted as one lot and that six out of the nine homes in the area are built on 7,500 square foot lots. C01JRCXUIAR I'BTERSON asked when these homes were built and Jack stated back in 1959 or 1960.> which was prior to the current zoning ordinance. MA~~R POWELL stated that the current Ordinance requires 10,000 square feet for this area which previous to that time required 7.700 square feet. JACK S~N utated that this is a single family area - the other houses were built about the time that he came to Stillwater. MAYOR POWELL felt that if other lots are of the same size in the area that this variance request shou.lu. be granted. COUNCILMAN PETERSON asked how big this would make the other lot and JACK SHELTON said there WDuld be more than 10.000 square feet on the portion on which Mr. swanson's mother's home i8 located. MAYOR PONBLL asked if the lot had been sold and MR. SWANSON said it is contracted for. COUNClIIIAN PETERSON asked if when the lot was so 1d the requirement was 10,000 square feet and MR. SWANSON said it was represented to be one lot which was a condition of the sale with a total area of 18,000 square feet. He felt that an empty lot would serve no purpose to the City of Stillwater and that all street 888essments have been paid and couldnlt figure out what it would hurt. COUHCILIIAH PEDRSON said this is 25% short of tho r~uired number of feet for this area. It was his opinion that this should not be granted. MR. SWANSON said the lots across the street are somewhat smaller and asked what one does with these smaller lots. MAYOR POWELL asked about setbacks in the ordinance and MR. KIMMEL stated there is something whereby the council may grant a variance if the lot was in the same ownership at the time of the adoption of the Ordinance. MAYOR POWELL stated that you canlt deny the property owner the right to sell his property. MR. KIMMEL said this lot was not in separate ownership: at the tirr.::: of the adoption of the ordinance - it was one parcel of land with his mother's house. The only way it could be sold without the violation of the Ordinance would be from the present owner. . r' . . . . ,'-' - (~ ... v '-' . (May 22, 1973 - continued) MAYOR POWELL said Mr. swanson's IOOther bought it when the Zoning ordinance was in effect and when he was on the Council they passed this Ordinance. MR. MARSHALL read a letter from Mr. & Mrs. Don Hill and Mr. and Mrs. Thomas Ries who were opposed to this variance since the lot size is too small and there is no public sewer and water. and no provisions for a driveway or garage). MR. SWANSON stated that these two parties negotiated to buy the property and his father would not sell it for the price at that time -- less than $1,000. These two parties have only 7,500 square feet on which they have built. MAYOR POWELL said the Council has granted several variances on undersized lots because the owner had owned it before this Ordinance came into effect. One of these was Charles SalRDre on 'Maple Street and the only objection was that it would obstruct someone's view - the rest of the lot sizes were the same. MR. On D>tion of councilman Wohlers, seconded by Councilman Peterson the date of the first regular Council meeting in June was changed from June 12th to June 5th due to the fact tha t several of the Councilmen would be out-of-town on the 12th.. 2. On I'lDtion of Councilman Wohlers, seconded by councilman Peterson a resolution was introduced "CHANGING THE HEARING DATE FOR LOCAL IMPROVEMENT NO. 117 - Watermains from June 12th to June 5th - Amending Resolution No.. 4908.. No one appeared in favor or opposed to this request.. The Mayor closed the hearing. On motion of Councilman Peterson. seconded by Councilman wohlers a resolution was introduced granting a Special Use Permit to Mrs. Walter Thatcher to operate doll repair at 212 South Greeley Street subject to the conditions as set forth by the Planning and Zoning Commission.. NOtice of the hearing was published on May 11. 1973 and copies were mailed to all residents within 300 feet. (Planning Commission recommended the granting of this variance) The Mayor opened the hearing. DR. NELSON was present but since no one appeared in opposition to the proposed va.riance he did not speak. Mr. & Mrs. Everett Lowry were in attendance but since no one appeared opposed to this variance they did not speak. On motion of Councilman Balfanz. seconded by Councilman Wohlers The council followed the recommendation of the Planning Commission aIw granted the ten foot front yard setback variance at 617 pine Tree Trail. 6. Petition for a Stop Sign to be located at Sixth and Willard Streets was to have been presented prior to this meeting. but was not received. On motion of Councilman Peterson. seconded by Councilman Balfanz the Public Safety Director was instructed to make a check on the matter and come back with a recommendation on June 5th. 7. GERALD -.GAIDWITZ. 710 West Linden Street appeared before the Council and stated that Mr. Blliott recommended that the street be lowered and the drainage was dug out and he has a water problem. Mr. Wohlers and Mr. Hagen have Looked at the ice that builds up and it goes down his yard. "Also hiB sidewalk was not repaired and his driveway wa.n~t replaced and the sod was just thrown in and everything was left in a mess. and nothing seems to get done. He would like to pay the first half of his taxes but want. this mattl!lr taken care of before he makes this payment. He needs special authorization to leave the assessments off of his taxes. MYOR POWELL asked that Mr. Elliott go up and look at the problem and whatever is required will be taken care of. COUNCILMAN PETERSON felt that something should be done about this. MR. ELLIO'rl' stated that Tower Asphalt is the prime contractor and that we are withholding money to take care of the sod and other problems. MAYOR POWELL said that we wluld take care of the problem and that Mr. Galowitz should proceed to pay the taxes and assessments. MR. B~LIOTT AND MR. DICK CLAMMER appeared before the City Council thanking them for the opportunity to use Lily Lake Park for the tournament last weekend which was highly success- ful. He also at this time requested a 3.2 Beer License for the All Star Game to be held on Saturday, July 7th. On motion of Councilman Balfanz, seconded by Councilman Peterson the 3.2 Beer License was granted for the All Star Slow Pitch League and the details of the tournament will be worked out with the Recreation conmission. (Mr. Clammer requested that there be more garbage containers when these specia 1 events are on, keep the warshrooms clean and there is a problem with the fence). 9. This was the day and time set to open bids for Sealcoating of streets in the City of Stillwater. On motion of councilman Peterson, seconded by Councilman Balfanz the Clerk was directed to open the one bid received for Local Improvement No. 116 - Sealcoating. Bid No. 1 Blacktop Construction Route #1, Box 212 Shakopee, Minnesota 55379 Bid Bond Total Bid $38.780.60 URFINJARRn BUSINESS 1. On motion of councilman Thompson, seconded by Councilman wohlers the Clerk made the second reading of an ordinance entilled "AN ORDINANCE AMENDING ORDINANCE NO. 448, RELATING TO CONTRACTOR'S LICENSBS, BY REQUIRING TREE TRIMMERS 'ro BE SUBJECT TO ITS PROVISIONS!.. The Ordinance was read section by section followed by roll call after each section and all members of the council voted in the affirmative. The chair then put the question "Shall this ordinance pass?" and on roll call the Ordinance was unanin'ously adopted. (see ordinances) 2. On motion of Councilman peterson, seconded by Councilman Balfanz the date of June 26, 1973 at 7;30 P. M. was set for a public hearing on the request of Gilbert Benson for a preliminary plat, a~proval. 3. On motion of councilman Thompson, seconded by Councilman Balfanz the Council authorized the issuance of a building permit for a home to be located on Lot 4, BlOCk 2, of the proposed Benson Addition. (William Jenson). 4. The redraft of the Heritage Preservation Ordinance was not ready for action at this time. 5. On motion of Councilman Peterson, seconded by Councilman Wohlers the Council approved the Fire Protection contract with Stillwater TOwnship. 6. On motion of Councilman Thompson, seconded by Councilman peterson, a resolution was introduced "AWARDING THE BID FOR REGULAR GASOLINE AND NO.2 DIESEL FUEL TO CROIX OIL CO." Mr. Abrahamson reported that basically 10% of the dogs in the City that are caught are unlicensed and they are destroyed and there is no attempt made to find the ownerB. Mr. Marshall informed the council that the plat of sunnyslope Addition is off about 10 feet and before the City can improve Lookout Street this matter will have to be resolved. On motion of Councilman Peterson, secondea by Councilman Wohlers the City Coorainator was directed to send a letter to the State Highway Department and to the Contractor for the Interstate Bridge construction congratulating them on accomplishing this project within the specified time. COMM.ITTEE REPORTS PARKS AND RECREAT1:0t1' 1. There was a request to erect a cyclone fence by third base and first base _ six feet high _ at the ball field at Lily Lake park. It was about $1,200.00. It was not originally put in in order to save lOOney but it is needed. MAyOR POWELL instructed Mr. Blekum to work up a feasibility study for this improvement. The estimate of the cost was about $1,200.00. ,- . . . '- . . (May 22, 1973 - continued) PUBLIC WORKS 1. Jack Shelton requested official council action regarding the assessment for Local Improvement No. 105 to the Stillwater Country Club. On motion of Councilman Pe~erson, seconded by Councilman Balfanz the Council wishes to inform the Stillwater Country Club that an assessment has been made against Lot 3, Block 20, Carli & Schulenberg's Addition to the City of Stillwater for sewer ano water services stubbed into this lot, Local Improvement No. lOS, and that if water and sewer mains are ever extended North on Third Street that the aforementioned Lot 2, BlOCk 20 has paid for watermain and sewer assessment and cannot again be assessed for these services. Mr. Les Stepan has requested a boat launching ramp on McKueick Lake on the Bast end and.Mr. Shelton was directed to put up such a ramp. 3. A survey was made of vehicles using the dump boxes behind City Ball and license numbers recorded for all except the 4z numbers. Of the 22 pickups listed 10 were out of the City and two were registered to aontr.ctors that ~rk, in the City. ~. Shelton was directed to send a letter and copy of the ordinance to these violators. PUBLIC SAFETY 1. Mr. Abrahamson announced that on July 11, 1973 the Capitol City Fire Convention will be held in Stillwater and the City Council is invited. CITY ATTORNEY'S REPORT 1.
