REGULAR MBETING The meeting was called to order by President Powell. The Invocation was given by Mr. Marshall. Present: Councilmen Balfanz, peterson, Thompson, wohlers and President Powe 11. Absent: None Also Present: City coordinator, Marshall; City Attorney, KiDDel; Superintendent of Public works, Shelton; Public safety Director, Abrahamson: Director of parks and Recreation, Blekum: consulting Engineer, Elliott preas: Stillwater Bvening Gazette - Roger Gratiot Citizens: Howard symmes, Representative from winden Associates for Orrin Thompson, Jerry Mahoney, John DeCurtins, Jr., Francis Rice, Jerry wallace, Ted Gillen, Ed Simonet, Jr. INDIVIDUAIB - DELEGATIONS - PETITIONS 1. This was the day and time set for a public hearing on the request of orrin Thompson Homes for a setback variance on Lot 2, Block 1, Croixwood, Second Addition. The notice of hearing was published on April 13, 1973 and copies were mailed to all property owners within 300 feet. The Mayor opened the hear ing.. A r.~es.ntative of Winden & Associates represented Orrin Thompson Homes and briefed the City Council on the details of this variance. No one else appeared in favor or opposed to this variance. This variance was approved by the Planning CORllllssion on April 2, 1973. On Etion of Councilman Wohlers, seconded by Councilman Thompson the nine foot variance for a garage was granted to Orrin Thompson Homes as recommended by the planning Commission. 2. This was the day and time set for a public hearing on a Special Use Permit from soward symmes to operate a wholesale ice cube production facility at 622 West Churchill Street. Notice of the hearing was published on April 13, 1973 and copies were mailed to all property owners within 300 feet. The Mayor opened the hearing. MR. SYMMES was in attendance and Dick Blekum stated that he is within the area involved and it was okay with him. . . . . 474 (April 24. 1973 - continued) MR. MARSHJl.LL cited the Findings of Fact from the Planning Commission's meeting of April 23. 1913 when this Special Use Permit was approved. On motion of Councilman Peterson, seconded by Councilman Balfanz a resolution was introduced approving the special Use Permit for HOWard symmes to operate an ice cube production facility at 622 West Churchill Street, subject to the recommen- dations of the planning Commission. (see resolutions). 3. MR. TOM Ie INTYRE appeared again before the Council in reference to the parking of a mobile home on his property at 712 South Fifth Street. MR. XIMMBL stated that the Ordinance does provide for the parking of mobile homes as long as it is not used 8S a residence and as long as it conforms with the required setbacks and other requirements for an accessory building. He was instructed to check this matter out with the building inspector as to where it should be located on the property and get a permit. If it cannot be put on his property and comply with the ordinance, then he will have to apply for a variance permit. UNFINISJlBD BUSINESS On motion of councilman Thompson, seconded by Councilman Wohlers an Excavating Bond for Peter J. Miller, Stillwater, Minnesota was approved. (Continuation from April, 1969). HEW BUS:INBSS 1. On motion of Councilman peterson, seconded by Councilman Thompson a resolution was introduced "CONFIRMING 'l'HE APPOINTMENT OF BEACH PERSONNEL AND FIXXNG COMPENSATION". (see resolutions). 2. On motion of councilman Balfanz, seconded by Councilman Thompson a resolution was introduced "CALLING FOR THE SALE OF $120,000 IMPROVEMBN'r BONDS". (Sewer and water for Cro:txwood, Second Addition, Local Improve- ment No. 115) (see resolutions) 3. On motion of Councilman Peterson, seconded by Councilman Balfanz a resolution was introduced "AUTHORIZING ,.118 EXECtrrION OF A WAGE AGREDIBNT WITH THE FIRE DEPARTMENT". (see resolutions). (Comp Time will be $4.00 per hour and the Top Fireman will be $906.00 - $57.00 increase) 4. On IDOtion of Councilman wohlers, seconded by councilman Balfanz a resolution was introduced "CONFIRMING THE APPOINTMENT OF MAINTENANCE BNGIHBER AND CHANGING COMPENSATION". (Albert Schmeckel change from a monthly salary to $4.50 per hour as a light equipment operator). (Councilmen Peterson and Thompson opposed) (see resolutions). s. Discussion was held on the recommendations by the St. Croix River Intergovernmental Planning Conference of Thursday, March 29, 1973: in the files). (See memo Discussion centered around Items 3, 5, 8, and 9 on said memo. Action on these recommendations was delayed until the May 8th meeting. ,- r , , '-.- . . . ~ . . On DDtion of Councilman Balfanz, seconded by Councilman wohlers the installation of a dynamite storage area by Orfei Construction Co. at the old dumpsite was approv,:,d ~ (Mr. Abrahamson stated that it had the approval of the State Fire Marshal and that it will be patrolled every two hours Whereas the requirements call for every four hours - there is no fire danger and the contractor is responsible for any liability) a 7. On motion of Councilman peeerson, seconded by councilman Balfanz the city's Engineer and the Superintendent of Public works were authorized to draw up specifications and the Clerk was directed to advertise for bids returnable on May 22, 1973 at 4:00 P. The matter of an agreement with Stillwater Township on the extension of the SOuth Greeley Sewer will be checked out by the City Attorney and the City Coordinator ano report back to the Council on May 8th. roo ko 9. Hamm for the thawing of frozen water services. (Discussion but no action taken at this time). CITY CooRDINATOR'8 REPORT 1. On motion of Councilman Thompson. seconded by Councilman Wohlers that $500.00 be allocated to the Jaycees for fixtures for the beach facilities across the river. 2. Mr. Marshall informed the City Council that all of the regulatory signs in the City are being updated. 4. On motion of Councilman Peterson. seconded by Councilman Balfanz the Clerk was directed to re-advertise for gasoline bids returnable on May 8. 1973 at 4:00 P. M. 5. Discussion was held on t~ rate authority for gas and electric franchises. 6. On motion of Councilman Balfanz. seconded by Councilman Thompson the Clerk was directed to advertipe for clerical help for the Building Inspector and Director of Public Works. said person to be available to answer the phone calls. paper work. and possibly have a knowledge of the type of work she will be doing_ , ,~" CONSULTING ENGINEER IS REPORT 1. On motion of councilman peterson. seconded by Councilman Balfanz a resolution was introduced "ORDERING A FEASIBILITY REPORT FOR THE REPLACEMENT OF WATERMAINS ON SOUTH SIXTH STREET FROM WEST M!RTLE TO WEST RAMSEY Arm NORTH WILLIAMS STREET FROM WEST ELM TO WEST HICKORY". On motion of councilman peterson, seconded by councilman Balfanz a resolution was introduced "APPROVING THE PETITION FOR ANNEXATION OF CERTAIN LANDS TO THE CITY OF STlLUlATER, MINNESOTA". (Freedom Acres and Bethany Covenant Church - Bob Steindorff and Peter Alexander). (see resolutions). Mr. Blekum brought up the matter of some type of fencing on the East and SOuth sides of pioneer Park and this matter will be checked out and a complete report given later.
