The Invocation was given by Mr. Marshall. F. Niederer, Lillian Niederer, Glenn Thompson, Jack Rice. Gary Laidig, Jerry Mahoney, Melvin Priedrich, Rev. Herman Senft INDIVIDUALS - DELBGATIONS ~ PETITIONS 1. Mrs. W. F. Niederer and daughter. Lillian had requested an appearance before the City Council regarding a light in Washington Park. Mayor pOwell announced that the Administrative Committee had discussed this matter this evening at their meeting and also that the matter has been discussed at a previous council meeting and asked the Council for their recommendation at this time. on motion of Councilman peterson. seconded by Councilman Wohlers the City council authroized the installation of an additional light in Washington Park and authorized the Director of public Works to review the situation and install said light at a position that will best serve the problem. (Councilman Balfanz. opposed). 2. A PETITION from Ralph Otte for an "on-Sale Liquor License" at The Harbor. 517 NOrth Owens Street. On motion of Councilman Lammers. seconded by Councilman Balfanz a publiC hearing was set for December 12. 1972 at 7:30 P. M. on the request for an "on-Sale Liquor License' for The Ba.rbor and .that the planning commission be instructed to consider this matter at their next meeting ano report back by December 12th. On motion of councilman Peterson, seconded by Councilman wohlers the Clerk made the second reading of an ordinance entitled "AN ORDINANCE REGULATING THE DISPOSAL OF LIQUID WASTE MATERIALS IN THE SANITARY SEWER SYSTEM". (ordinance No. 501 - See Ordinances) The ordinance was read section by section followed by roll call after each section and all members of the Council voted in the affirmative. The chair then put the question. "Shall this ordinance pass?" and on roll call the Ordinance was unanimously adopted. (see ordinances) 2. On motion of councilman Balfanz, seconded by councilman Wohlers the Clerk made the second reading of an Ordinance entitled "AN ORDINANCE REPEALINI'; CITY CONSTRUCTION CODES AND PROVIDING FOR THE IMPLEMENTATION OF THE MINNESOTA BUILDING CODE BY DEFINING FIRE ZONES AND PERMIT FEES". f) The Ordinance was read section by section followed by roll call after each section and all members of the Council voted in the affirmative. The chair then put the question, "Shall this Ordinance pass?" and on roll call the Ordinance was unanimously adopted. (sae ordinances) - 3. on motion of councilman Lammers, seconded by councilman Peterson the recorrmendation of the Director of public Works was accepted for the installation of a street light on MOore Street between North William and North Martha Streets. 4. On notion of Councilman Peterson, seconded by Councilman Lammers the Council authorized a rebate to Mrs. Thomas Murphy in the anount of $90.00 for the removal of a boulevard tree. HEW BUSINESS 1. The matter of scheduling a public hearing on the rezoning of certain lands within the City as Wetlands was postpon.;,d to another meeting. 2. on ootion of Councilman Lammers, seconded by Councilman Peterson a resolution was introduced "Authorizing the Mayor and the City Coordinator to Execute An Agreement for the City as a Member of the Minnesota Gas Rate Authority". (see resolutions). 3. on motion of Councilaan Balfanz, seconded by Councilman Peterson a resolution was introduced "Appointing Mr.. Raymond Marshall, City Coordinator, as a delegate for this Rate Authority and appointing councilman George Wohlers as the alternate. (Councilman Wohlers abstained from voting). 4. On motion of councilman Peterson, seconded by Councilman Wohlers the Clerk was directed to advertise for bids for fuel oil for 1913 and also to advertise for bids for the official advertising for the city for the year 1913. 5. On motion of Councilman Lammers, seconded by Councilman Peterson the City Attorney and the City Coordinator and Jack Shelton were authorized to meet with the owners of the lot on Rainbow Court that is causing a drainage problem and request that he do something soon to correct the situation and report back with a recommendation at the next meeting. . . . \ ,. . . 390 . . (November 28. 1972 - continued) 6. On motion of councilman Wohlers, seconded by councilman Balfanz a public hearing was set for Tuesday, December 12 at 7:30 P. M. for the special Use Permit for Eugene White, 216 South Owens for a lipidary shop in his home and accessory buildings. APPLICATIONS On motion of councilman peterson, seconded by Councilman Wohlers the following "on-sale" Club LiquorL!censes were approved for 1973: (renewals) American Legion Club 103 south Third street. Stillwater Eagles Lodge 101 South Main Street, stillwater Elks Lodge 110 South Main Street. Stillwater Stillwater County club North Fourth street, stillwater VFW, Post 323 124 North Main street, stillwater Also bonds in the amount of $3,000 foor each were approved. On motion of councilman wohlers, seconded by councilman Balfanz the following "Off Sale" Liquor Licenses were approved, subject to approval of the Liquor control commissioner: (renewals) John L. Meister 112 North Main Street, Stillwater Also bonds in the anDunt of $1,000.00 each were also approved. COMMUNICATJ:ONS From Phil Easton regarding conditions at the Minnesota State Prison. Mayor powell, RayBDnd Marshall, Wallace Abrahamson and councilman Balfanz attended a recent meeting of the Task Force on the problems at the prison. CITY COORDINATOR'S REPORT 1. Mr. Marshall announced that there are a number of appointments to be made to the Planning commission, Library Board, Park Board and Housing Authority and Civil Defense Director and asked the press to publicize this fact in order to get some new members for these various boards. r ~I - '--' "-, . . . . , , . r-, . " j . (N0vember 28, 1972 - continued) 2. M~. Marshall requested that the Council plan to meet with the Legislative delegation prior to the 1973 session. He will talk to these representatives and see what their schedules call for and let the Council know. 3. There will be a meeting with the Chamber Re-development Committee on Tuesday, December 5th at 3:00 P M. 4. On rrotion of councilman Wohlers, seconded by councilman Peterson the City Coordinator was authorized to issue overtime checks for three members of the clerical staff for work on elections, each to receive 30 hours overtime pay which will come out of the Election Fund Account. 5. Mr. Marshall informed the Council that the group of women who will be helping the Retarded Children on a shopping trip have requested free parking in the downtown parking lots during this time. CONSULTING ENGINEER'S REPORT 1. Mr. Elliott informed the council that the drainage for the Croixwood Second Addition should be considered as some work is being done here and there has not been approval of the final plat, and that Orrin Thompson should not proceed until the PCA has approved this and also for the Council's approval of the final plat which should be done at the December 12th meeting. DELEGATIONS lout of order) Rev. Herman senft, Pastor of St. Paul1s Lutheran Church and Melvin Friedrich presented a check in the amount of $200.00 to the Mayor and City council in lieu of taxes to the city of stillwater for the benefits they receive from the police and Frie Departments. On motion of Councilman Peterson. seconded by Councilman Balfanz the city Coordinator was directed to send a letter of thanks to the St. Paul Lutheran congregation and that the press make a notation of this donation. Mr. Kinunel reported that Stillwater Township and oak Park Heights have signed a joint resolution asking for the merger of those two communities. He requested that the Council take some formal action as soon as we receive a formal order and he felt in the interim we should write a letter to Stillwater TOwnship again suggesting that we are still willing to pursue whatever services are available to this area. On rootion of Councilman Lanwers. seconded by Councilman Peterson the city Attorney in conjunction with the City Coordinator to write the proper letter. APPROVAL OF MINUTES on motion of councilman Peterson. seconded by councilman Lammers the minutes of the following meeting were approved: November 9, 1972 November 14, 1972 special Meeting Regular Meeting 10.30 A. RESOLUTIONS The following resolutions were read and on roll call were unanimJusly adopted: 1. Authorizing Execution of Agreement - Minnesota Gas Rate Authority. 2.
