REGtJLA,R MEETING The meeting was called to order by President powell. The Invocation was given by city coordinator, Marshall. Herman senft INDIVIDUALS - DELEGATI.ONS - PETITIONS This was the day and time for a public hearing on a request of William H. powell, 219 Birchwood Drive North for a special Use Permit, Case No. 112. (To do sign work in the basement of his home). No one appeared in favor or opposed to this request. on motion of Councilman Wohlers, seconded by Councilman Peterson a special Use Permit was granted to William H. powell to do sign work in the basement of his home at 219 Birchwood Drive North. PETI.TION TO VACATE A PORTION OF MARYKNOLL ORI.VE. on motion of councilman Lammers, seconded by councilman Balfanz the petition to vacate a portion of Maryknoll Drive was referred to the Planning commission for their study and to bring back a recommendation to the city council. UNFINISHED BUSINESS Discussion was held regarding the proposed changes in an ordinance "Amending Ordinance No. 481, Regulating Traffic and parking During Snow Emergencies and providing for a System of Calendar parking". The matter of permitting parking on both sides of a given street after both the driving and parking lanes were cleared of snow were considered and the city coordinator was requested to make further changes in this ordinance and there would be a second reading of this amending ordinance on January 11, 1972. 197'. a . . . . 198 ( December 21, 1971 - continued ) On motion of Councilman Peterson, seconded by Councilman Wohlers the Clerk made the second reading of an ordinance entitled "AN ORDINANCE PROHIBITING THE DEPOSIT OF CERTAIN MATERIALS ON CITY STREETS." The ordinance was read section by section followed by roll call after '~ach section and all members of the Council voted in the affirmative. The chair then put the question, "Shall this ordinance pass?" and on roll call the ordinance was unanimously adopted. (see ordinances). DEi:.EGATION (out of order) Rev. Herman Senft, pastor of St. Paul's Lutheran Church, Stillwater presented a cback in the amount of $200~OO to the Mayor for the City of Stillwater as a donation in lieu of taxes for services they receive. He requested that $100.00 be used for the Police Auxiliary and $100.00 for the Volunteer Pire Department. On motion of Councilman Peterson, seconded by Councilman Lammers the City Coordinator was instructed to write a thank you letter to Rev. Senft and St. Paul Lutheran Church for this donation and also acknowledge to them that we will abide with his wishes as far as distribution of the money is concerned. UNFINISHED BUSINESS (continued) This was the day and time set to open bids for Puel oil for 1972. The advertisement for bids was published in the Stillwater Evening Gazette, official newspaper of the City, on December 10, 1971. The following bids were opened and read aloud: Bid No.1. Kilty-ogren Petroleum Co. Stillwater, Minnesota Certified Check Bid Price l2.9C per gallon Bid No. 2 Standard Oil Division American Oil Co. Kansas City, Missouri aid Bond Bid Price l2.9C per gallon On motion of councilman peterson, seconded by Councilman Lammers the bids were referred to the City Attorney for investigation and the Council would have a special meeting to award the contract after they receive a recommendation from the City Attorney. NEW BUSINESS 1. On motion of Councilman Lammers, seconded by Councilman Peterson a resolution was introduced "Re-Certifying the 1972 Tax Levy" as proposed by the City Coordinator. (see resolutions). 2. On motion of Councilman Peterson, seconded by Coucilman Balfanz a resolution was introduced "Adopting the 1972 Budget". (see resolutions). 3. On motion of Councilman Peterson, seconded by Councilman Lammers the following salary schedule for the non-organized employees of the City were approved as presented by the City Coordinator and approved by the Administrative Committee within the limits of the pay Board for the year 1972: r " r r , ~ '-' r . . . t . . ii' , ~. On motion of councilman Balfanz, seconded by Councilman Peterson the matter of authorizing 88EH to complete all plans for the Storm Sewer Separation, L. I. No. 97 was deferred to the meeting of January 11, 1972 and Bee what the results of the meeting of January 10, 1972 are regarding these grants. Mr. Elliott stated that under a crash program this would take a minimum of four months, and the receipt of bids in early spring or in the fall are more favorable. He further stated that there have been few separation grants from BUD or EPA. Councilman Lammers felt that we should not proceed with construction of this until we know we have the grant. Mr. Elliott stated that the plans would not change substantially but the city would have the investment for the engineering costs. THE MAYOR DBCrARED A RECESS FROM 8:45 to 8:55 P. M. 5. On motion of Councilman Peterson, seconded by Councilman Wohlers a resolution was introduced "Establishing the wild pines First Addition Escrow Fund and Cancelling certain Inter Fund Transfers". (See Resolutions). 6. At this time Mayor Powell introduced Ali Reza Farahmand, a guest Journalist from Iran. 7. On motion of Councilman Lammers, seconded by councilman Peterson the appointment of Jeffery zoller to the Planning Commossion was approveo effect.i.ve January 1, 1972. 8. On motion of councilman Peterson, seconded by Councilman wohlers the appoint- ment of Mrs. John True to the Housing Authority was approved subject to her acceptance of the position. 199 .~ . . . . 200 . (December 21, 1971 - continued) r"' COMMUNICATIONS YEO~ Vern Stenseng of the Metropolitan Sewer Board requesting that we send a representative (an elected official) to a meeting of the Metro Sewer Board on January 11. 1972 for an organizational meeting for Area 6. On motion of Councilman Peterson, seconded by Councilman Wohlers that the city send Jack Shelton to this organizational meeting for Area 6 of the Metro Sewer Board and report back to the council. CITY COORDINATOR I S REPORT 1. Mr. Marshall reported that the annexation hearings have been expanded to include all of Long Lake and that the hearings have been deferred to February 24, 1972. This addition would be 48 acres immediately East of the property that the City has petitioned for annexation. /""' 2. Mr. Marshall reported that he met with Mr. Bruce Rasmussen regarding the boundary lines for the Hooley-peely property which were in question. 3. On motion of councilman Peterson, seconded by Councilman Balfanz the City coordinator was instructed to study otherCa~l. TV Franchises and to contact Mr. MCCarten and iron out any problems. 4. The matter of funer-al leave was discussed and this matter was referred to the Administrative Committee for study and recommendation. CONSULTING ENGINEER'S REPORT 1. Mr. Elliott informed the Council that in reference to the proposed vacation of a portion of Maryknoll Drive that there is a sewer line in this location and that the pond is the drainage for the area. and this should be considered when they have the hearing. 2. Mr. Elliott informed the council that it was his understanding that in ordar to get the grant for the sewage plant that they must p~epare the operating Manual. and they would receive credits from the Sewer Board over a period of years on their billings for same. On motion of Councilman Lammers, seconded by CounciLman Peterson. the City Attorney and the c~ty Coordinator were instructed to proceed further on this matter.
