The meeting was called to order by President Powell.
The Invocation was given by city Coordinator. Marshall.

Mr. Gene Bremer, 2214 Fairmeadows Road appeared before the Council in reference
to his street assessments on Local Improvement No. 91 and Mayor powell referred
this matter to the City Attorney and Duane Elliott to check out and Mr. Kimmel
reported later in the meeting that there was nothing that could be done with this
assessment as we had a number of other complains that were denied that involved
two different improvements for corner lots. (See page ~ for action on this
matter) .
AD informal hearing on ~he possible changing of the name of Brick Street to
B;;'rchwood Drive was held at this time.
JOHN WIRSIG, 524 South Erick Street stated that he objects to the
proposed change - this is the original name of the street and is
the location of a Brick Yard and could see no reason for making the
char.ge wit~out Q logical reason.
Mr. Marshall stated that the reason for the possible change was that
?Sople were getting lost in this area.
MR. WIRSIG stated that there are other streets in the area that do not
follow through with the same name and he requested thdt the name of
Brick Street be retained.
COUNCILMAN LAMMERS stated that the Council doesn't feel strongly one
way or the other on the matter.
MR. MARSHALL stated th~~ he was aware of four people opposed to this
name change an~ two F~ople in favor.

BUD JAGUSCH. 525 South Brick Street was opposed to the proposed change -
he likes the name of Brick street, and wanted it to remain that way. It
is too much effort and expense involved to make the change.
MR. A. 8. JACKSON appeared before the council regarding the approval of a
preliminary plat which was approved by the planning commission on October 4.
1971 and also approved by the Township planning Commission and the Township
counciL He presented a legal description of the property to the City
Coordinator as directed. This plat involves a' performance Bond for the black-
topping after three homes are built in the plat. He has been working on this
matter since 1962.
On motion of Councilman Lammers, seconded by councilman
Balfanz a resolution was introduced accepting Mr. Jackson's petition
for the annexation of certain land to the City of Stillwater.
(see resolutions).
On motion of councilman wohlers, seconded by Councilman Peterson
a resolution was introduced for the detachment of certain land from
Stillwater. (see resolutions).
REVISIONS IN THE PRELIMINARY PLAT OF WILD PINES --
MR. ORRIN THOMPSON explained that .they are willing to do whatever the council
directs as far as oak Ridge Road is concerned - to offset it. dead end. or
barricade it.
MAYOR POWELL suggested that this possibly should be left up to the Public
Safety Director and the PUblic Safety committee.
MR. HARRY KLAASSEN. 2127 oak Ridge Road spoke in behalf of the citizens now
residing on Oak Ridge Road and they feel that there should be a buffer zone
of one family homes next to oak Ridge Road and that this street should be
cul-de-saced - they do not want Oak Ridge Road to become an "1-94". They
feel that the work in the Wild pines area should not be underway until the
final plan is approved by the planning Commission and the city Counci. He
further cLjected to the grading which was being carried on by the developer
without a permit from the City.

MR. MAP'SHALL stated that there was a delay in the final plat due to the
annexation proceedings. The area that ~as proposed to be the first developed
is still in the Township, so the developer has switched to an area within
the City. He stated that the city Building code and in fact no Building Code
requires the granting of permits for grading as long as there are no dangers
to the adjoining property or affects the other property. He also stated that
it was the intention of the council that the road was to be barricaded -
a cul-de-sac was ruled O'lt at the last meeting_
ORRIN THOMPSON stated they needed information from the city officials as
to the type of barricade and he was willing to meet with the city's Engineer
and they will take care of it.
MAYNARD NELSON, 2316 Oak Ridge Road stated that he wanted a place where he can
raise his family. He questioned why this will be a better place for him to
raise his family with this development. It is the time to take time to check
back on the steps taken on this development. He stated that the council was
elected to speak for the community and they are the citizens of this community
and not the 700 people Mr. Thompsou will bring to Stillwater. He invited the
Council to speak to the rest of the citizenry and seb what they think of such
a development. and if they are like him. they won't want it.

ORRIN THOMPSON stated that maybe we have to share part of this area with the
rest of the world and not have the attitude that I am here - everybody else out.
MR. NELSON stated that there is no housing shortage in this area - there are
homes that have bAen empty in this area for sometime.
In response to a question from MR. DON MARTIN, 718 west Myrtle Street, MR..
THOMPSON stated that his homes cost between $26,500 and $40,000, and that they
all have garages. The interest rate is 7% at this point. They are built right
on the site and the average resale is seven to nine thousand above wta t they
paid for them.
MRS. DEAN SHA2ER, 210 Maryknoll Drive asked for assurance as a c~nservationi8t
that they would not have any trouble with erosion in the area.
MR. LEE ,mOMS. 420 Laurie Lane questioned if they put on a five ton axel load
limit if this would not solve the problem.
MR. KLAASEN stated that a cul-de-sac would enhance the Whole area and further
stated the first proposal by Mr. Steindorff for this area was for development at
a much slower rate, and much better a8 far as he was concerned.
ROBERT STEINDORPF stated that two years ago he had no intention of selling his
property and he wanted to develop the land. but he coulc:in1t make enough money
last year to pay the taxes. He stated it has to be developed the way Mr. Thompson
i. going to develop it.

pollowing the recess Mayor powell read a letter from orrin Thompson, and also an
opinion from Mr. Harold Kil'lllD8l, city Attorney. regarding the approval of the
preliminary plat of wild pines.
MR. ROBERT Ie GARRY asked whether or not the Council is going to have oak Ridge
Road made into a cul-de-sac or not before the granting of any building permits
for the l\lOdel homes. He stated that if we do have some adverse weather early this
fall it is very possible that. collector street will not be finished this year.
MAYC\R PONBLL stated that if Mr. Thompson canlt build a collector street then he
will have to drive on a airt road for this construction work. We can put up a
barricade.
MR. II: GARRY felt that the City has given the citizens on oak Riage Road nothing
and aidnlt feel that he was being unrealistic in his request since this street is
a 31 foot street. which is the narrowest in the sub-aivision. They feel it i.
important becaU8fl somebody is going to get hurt. especially in the winter time. and
they are concerned with the safety of their children walking to school.
MR. THOMPSON stated that they could put a three ton axel limit on this road, but
Mayor powell stated that the simpliest thing is to put up a barricade.
RAY OSTERBERG, 2007 West pine Street questioned why Oak Ridge Roaa couldn't be
cul-de~saced and Mayor powell replied because of emergency YBhicles. Mr. osterberg
felt that the residents on Oak Riage Road deserved the consideration of a cul-de-sac
since there is another road to the South of this that could be used.
MR. ROBERT Km'Z. 2309 oak Ridge Road stated that Mr. Nelson brought up a question
about development - he did ask the council why they wanted a rapid development and
requested an answer to this question.
COUNCILMAN LAMMERS stated Bob McGarry's point is well taken. and felt that a decision
would have to be made about Oak Ridge Road before the Council could give the building
permits for the model homes. He was very much opposed to a permanent barricade. and
felt the Council should look at an alternative means of keeping Oak Ridge Road a
residential street.
Regarding Mr. Nelson's question it was his opinion that in the last year he
couldn1t recall anyone saying that they didn't want the development as such. The
people were concerned with the traffic and the Town Houses in th~ir back yards. and

they repeated that they were not against the development. He felt that to the
best of the council's ability they would assure these people that there is
good planning. and that the development is properly done. They have confidence
in Mr. Thompson and the CO'.1ncil's challenge is to insure proper development by
proper planning. He felt that the problem of oak Ridge Road should be resolved
first.
MR. ORRIN THOMPSON suggested also that they could put in stop signs or make it
a one-way street, if that is what the council ordered.
CHIEF ABRAHAMSON stated that right now we are . talking about the unknown as far
as traffic in this area and he felt that a one-way street is better than a
barricade.
COUNCIlMAN LAMMERS felt that there should be a five ton axel limit and then also
put up a barricade.
MR. J<<: GARRY stated that safety is one factor and they wanted some assurance
there will be some type of controls. His primary concern was that the bilrcade
be put up before the building permits are granted so that the construction
equipMnt and building material trucks would not come in over oak Ridge Road.

granting to Mr. Thompson a variance to the sub-division
ordinance for tha purpose of building of model homes before
the acceptance of the final plat.

PHASE II - SEllER AlID WATER FOR TIlE WIUl FINES FIAT
on motion of councilman Lammers, seconded by councilman wohlers a resolution
was introduced that upon the receipt of a petition for proposed utilities for the
wild pines Develo~ntand a waiver of the publiC hearing, the City's Bngineer
is to prepare final plans and specifications for these utilities and the Clerk
is direct::ed to advertise for bids returnable at 4:30 P. M. CST on November 16,
1971. Also that an agreement be reached between the city of Stillwater,
and Mr. Thompson for a three year assessment on this project. (8ee resolutions).
MR. FRED DUROCHBR appeared before the council regarding his assessments for
sewer and water on olive and Ramsey Streets and Mayor powell directed that he
meet with Mr. Shelton and Mr. J(immel and Mr. Elliott on this matter, anCl find
out if the city i. in error ard what the procedure would be to adjust the
matter.

Mr. Marshall informed the council that the Planning cOlBil5sion
will be reviewing the Flood plain ordinance.
C:I'l'Y COORDINATQR.5 REPORT
1.
The matter of purchasing a Check Signer was deferred until a later date.
2. Discussion was held on the possibility of establishing a penalty for
delinquent utility bills which up to this time were certified interest
free. (no action) .
3.
The matter of an ordinance authorizing the pro-rating 0_ License pees
was discussed and the council felt that baeical1y it was a good idea.

4. On motion of Councilman ~rs, seconded by Councilman Balfanz the
superintendent of Public Works was authorized to re-stripe the interior
portion of the Water Street parking Lot to permit angle parking with
entrance on Chestnut Street and exit on water Street and orderin~ the
removal of four meters in this lot.
5. The matter of hookup charges for sewer for apartments was discu~sed
along with a Comprehensive Sewer Plan for the City and Mr. Marshall
i8 going to check into the League of Municipalities a8 to what other
areas are doing, and arrange a meeting on the issue.

6a Mra James Junker asked for the Council's reaction to a rubbish transfer
station on the old Rivard Farm, and it was the Council's feeling and
some of the citizens that this should not be allowed due to all the
problems that the city had with the old City Dump formerly located in
this area.

the individual general admission charge for children 12 years or under

Mr. Marshall informed the Council that there would be a meeting of the

at 7:30 P. M. in the Municipal Building.
9. councilman Lammers and Mr. Marshall reported on their meeting with the
Library Board on Friday. october 22 - they requested that the Cltypick.

take care of this matter.
CONSULTING ENGINEER' S REPORT
1. Mr. Elliott reported that he had received the Waste Rules and Regul,ations
from the Metro Sewer Board and' he will arrange to discUSS these with Mr.
Marshall.
2.
Be stated that he had received the contr.ctorls final estimate for the
construction of the willard and Main Street Stairs and would have the
Estimate ready for payment for the next meeting - amount was $1.750.00.

1.
The stop signs have been placed on the cross streets for Pine and Churchill
as directed.
2. Chief Abrahamson stated that two officers are attending school and will be
finished in November. The Meter Maid is doing very well in her schooling
and is averaging over 90 in her grades.

Mr. FRBD DUROCHBR appeared before the council again in reference to his sewer
and water assessments on Olive and Ramsey Streets. and Mr~ Blliott stated that
he recOJ!IIIended that he be allowed one-half of the service assessment on Ramsey
Street but no change in the Olive Street project assessment~ (ThiS action was
taken by the council at. a previous meet.ing).
Mr. Durocher still felt. that the council should pay him t.he cost of
t.unnelling to find t.he sewer on olive st.reet which was sixteen feet
from the property line. which was refused at a previous meet.ing~
on motion of Councilman Lammers. seconded by Councilman
peterson the matter of reimbursement to Mr ~ Durocher was
tabled. (amount was $183.00 and he was willing to settle
for $180.00)
UNFINISHED BUSINESS
l~ The matter of accepting the work and authorizing final payment for
surfacing and miscellaneous construction items at Lily Lake Park - T~ A.
Schifsky & Sons was postponed to a future meeting as Mr. Elliott indicated
that some of the work had not been completed to date.
2. On motion of councilman peterson, seconded by councilman Balfanz the
council authorized a rebate to Mrs. R. E. Erickson, 208 West Chestnut
Street for a sewer connection fee of $100.00 plus $51.55 interest and
sewer revenue payments from 1959 to 1971 in the amount of $253.80 or
a total of $405.35.

3. On motion of councilman Lammers, seconded by councilman wohlers a
resolution was introduced Accepting Work for Interior Building Construc-
tion at Lily Lake Park - George W. Olsen construction Co.. and make the
Final payment in the amount of $13,860.54. (see resolutions).
4. On motion of Councilman Peterson, seconded by councilman Balfanz a
resolution was introduced Accepting the Work for the Construction of
the sewage Treatment plant Expansion and Making Final payment to BareD
Construction Co. in the amount of $10,921.68. (see resolutions).

resolution was introduced authorizing Banister, Short, Elliott.
Hendrickson and Associates to finish the field surveys for project
No. 97, Stor~sanitary sewer separation. (see resolutions)
6. On motion of councilman Peterson, seconded by councilman wohlera that
the matter of the preparation of the operations and Maint,na)~.:e Manual
by Banister_Short_Blliott-Hendrickson and As.ociates be. referr.ed to the
City coordinator and he be instructed to contact the netro Sewer Board
and indicate the council's feelings on this matter as discussed this
evening .
7. on motion of Councilman peterson, seconded by councilman Wohlers pursuant
to Resolution NO. 4411, the City coordinator vas authorized totrans~er
city deposits from the First National Bank of Stillwater to the Farmers
& Merchants State .ank for the )~ars 1972-73-74.
8. Mrs. Michael Raleigh asked the Mayor about the bids for the Truck Rental
for Snaw Remeval and the council deferred action on this matter until

CITY COOP~INATOR'S REPORT
1. On motion of councilman Peterson, seconded by councilman wohlers the
City Coordinator was instructed to prepare the necessary speciiications
for the possible bidding of health insurance for the year 1972.
2. On motion of councilman Peterson. seconded by councilman wohlers the
City Coordinator was authorized to sign an agreement with the New
Careers Training Program indicating the City's willingness to participate
with them in the employment of an additional member on the city's forces.
3. Mr. Marshall requested a meeting with th9 council to finish up the budget,
capital improvements for 1972 and 1972 salaries - d~te set was TUesday,
November 16, 1971 in the afternoon.

1. Mr~ Blliott presented Estimate No. 5 for the Tower Asphalt Co. for
Local Improvement No. 98 and Mcelter construction , Estimate No. 5
for Local Improvement No. 98. (These estimates were included in the
resolution for the payment of the bills).

Mr. Blliott informed the council that work is proceet,!~ng on

3. Mr. Blliott recommended that on the matter of the sewer and water services
for Cliffo~d Akey, 1302 North Second Street that he was billed in error for
one water and one sewer service.
Mr~ Elliott stated that this cost of $433.12 would be
paid by Banister's and the City will bill them for this amount.

recommendation on the assessment for Mr. Akey was accepted.

Council accepted the Comprehensive Sewer Plan as prepared by Mr. Elliott
and authorized transmittal to the Metro Sewer Board for their s~udy and
recommendation and also that this plan be referred to the Planning
Commies ion.

8th in the pistol range - score was 96 in grading in her class.
